India, on October 1, welcomed UN Security Council resolution No. 1373, passed on September 28, on combating international terrorism as a positive step and hoped that the resolve of the international community will now be translated into concrete action through its effective implementation and regular monitoring by the Council. An Indian External Affairs Ministry spokesperson, while speaking to the media in New Delhi, said the resolution indicated the global nature of international terrorism and the need for comprehensive international cooperation in combating it. The spokesperson added that India would continue to press for the early finalisation of the Comprehensive Convention on International terrorism mooted by it.

The Cabinet Committee on Security (CCS), with Prime Minister Atal Behari Vajpayee in the chair, met on October 1 to evaluate the prevailing security situation in Jammu and Kashmir in the wake of the storming of the State Legislative Assembly complex. The meeting issued a virtual ultimatum to Pakistan to stop aiding and abetting terrorism in the State. After the meeting, a statement issued by the Ministry of External Affairs said, "India cannot accept such manifestation of hate and terror form across its borders. There is a limit to India's patience''. The statement described Pakistan President Gen. Pervez Musharraf's declarations, that the offices of the Harkat-ul- Mujahideen (HuM) had been closed, as a ‘cosmetic step’ taken under international pressure. Pakistan, it said, "Continues to be a country that aids, abets and sponsors terrorism and terrorist networks.''

Official sources said five activists have been arrested from Jabalpur, three from Rajgarh and one from Indore. So far, a total of 49 SIMI activists have been arrested in the State since the Union government imposed a ban on this extremist Islamic students organisation.

According to media reports, Canada announced new regulations on October 3 prohibiting Canadian citizens from raising funds for 22 terrorist organisations, including the Harkat-ul-Mujahideen (HuM) and the Jaish-e-Mohammad (JeM), and individuals, and if they defied they could face upto five years’ imprisonment. Announcing the regulation, Canadian Finance Minister Paul Martin said, "We will destroy (the terrorists') capacity to wield military might against innocent people. We are going to rip from their grasp the capacity to finance that violence". Until now, Canada had no prohibition on raising money for terrorist groups. The new sanctions, called as an interim measure, form part of the regulations under Canada's United Nations Act. The government is also reportedly drafting a comprehensive anti-terrorism bill that will be tabled in the House of Commons shortly. The Act would empower the government to seize funds of these terrorist organisations and groups.

British Prime Minister Tony Blair, on October 3, called up Indian Prime Minister Atal Behari Vajpayee and conveyed his sympathies and condolences to the victims of the suicide attack on the Jammu and Kashmir State Legislative Assembly Complex by Jaish-e-Mohammad (JeM) fidyaeen (suicide) terrorists, on October 1. Official sources said Blair told Vajpayee, "This is the kind of terrorism the governments should cooperate in rooting out". The British Prime Minister also backed India’s position that terrorism has to be tackled globally and should be fought strongly at different levels. The two leaders also agreed that their governments would exchange views on the evolving situation following in the September 11-terrorist attacks in the United States. The JeM, which has claimed responsibility for the suicide attack, is proscribed in the UK under the Terrorism Act, 2000. France has also strongly condemned the attack in Srinagar, saying the ‘‘terrorists have clearly shown that their target is Indian democracy’’. In a statement issued in Paris, and circulated by the French Embassy in New Delhi, French foreign ministry spokesman Francois Rivasseau recalled that France and India have already begun to cooperate in fighting terrorism. The first meeting of the Indo-French working group on terrorism was held in Paris in September 2001 and both sides agreed on the need to embark on joint efforts to combat the scourge.

According to media reports, on October 4, the Ministry of Home Affairs convened a joint meeting of the officials of Assam and West Bengal Governments. The meeting was called to review the threat from the increasing nexus between the United Liberation Front of Asom (ULFA) of Assam and the Kamtapuri Liberation Organization (KLO) of West Bengal. The meeting was attended by Chief Secretaries and Directors General of Police of both the States. Officials discussed the measures to be adopted to check the rising activities of KLO in North Bengal. Sources in the West Bengal Government claimed that the ULFA was not only training KLO cadres but was involved in supervising the latter’s operations. Assam Government sources said the State government has been keeping a tight vigil along the inter-State border to prevent ULFA terrorists from entering West Bengal.

Union Home Minister LK Advani warned that the possibility of terrorists having access to weapons of mass destruction could no longer be ignored. Addressing a conference of State chief secretaries and police chiefs in New Delhi on October 5, he said, this possibility, therefore, called for very high degree of preparedness in managing internal security of the country, including expertise in disaster management. The Minister laid stress on greater cooperation and coordination between law enforcing agencies of the Union government and the States, and said a law to deal effectively with terrorism was required. Cabinet Secretary T R Prasad reportedly told the meeting that there was a proposal to form a National Disaster Management Agency (NDMA). It could be modeled after the Federal Emergency Management Agency (FEMA) in the US to handle the rescue operations like the aftermath of the September 11 terrorist attacks in the United States. Briefing the media on the conference, Union Home Secretary Kamal Pande said, " Almost all States were in agreement over a need for a law against terrorism and for creating the Central Law Enforcement Agency. Some states like West Bengal, however, wanted their turf (of law and order) not to be meddled with." He said several such crucial issues would again be discussed at the conference of Chief Minister to be held in November 2001. The conference recommended a minimum action plan to all States and Union Territories. These included: setting up a State disaster management agency with sub-units in all district headquarters and with Civil Defence and Home Guards in its ambit; drawing up lists of vulnerable targets including buildings, installations, monuments and important persons; training and equipping at least a company of State Armed Police for search and rescue work in all disasters; procuring search and rescue equipment like earth movers and cutters, as also sniffer dogs; strengthening fire and mobile medical facilities; revamping communication network.

Feroze Ahmad Mir, Mohammad Sayed Tantrik alias Yusuf, Mohammad Manzoor Mir, Mohammad Lateef Hajaam, Abdul Rashid Gojri and Inderjit Singh Bali have been charged under section 121 (Waging or attempting to wage war or abetting waging of war against government of India), section 121-A (conspiracy to commit offences punishable by section 121) and section 120-B (criminal conspiracy) while the rest four accused have been charged only under section 120-B of the Indian Penal Code (IPC). Police had arrested Feroze Ahmad Mir and Tantrik on June 20, 2001 from a guesthouse in the walled city area of the capital and seized Rs 15 lakh from them. Later, the other accused had been arrested.

US President George W Bush spoke to Indian Prime Minister Atal Behari Vajpayee over the phone on October 7 around 5.30 p.m. and informed him that the American strikes in Afghanistan would take place later in the evening. He also assured the Prime Minister that the US would soon issue an executive order banning the Pakistan-based Jaish-e-Mohammad (JeM) terrorist outfit. Pervez Musharraf called up Indian Prime Minister Atal Behari Vajpayee late on October 8 and condemned the October 1-terrorist attack on the Jammu and Kashmir State Legislative Assembly complex. According to media reports, Musharraf is believed to have assured Vajpayee that he would hold an inquiry into Pakistani involvement, if any, in the October 1 attack. Vajpayee demanded the arrest of those involved in the attack in which more than 30 persons, mostly civilians, were killed. General Musharraf reportedly told the Indian Prime Minister that the stalled dialogue process between the two countries should be restarted. The Prime Minister is understood to have agreed in principle. But he pointed that if the unifocal of Pakistan insistence remained on Kashmir, and only Kashmir, then the dialogue would remain stalled. The tribunal will decide if there were sufficient reasons for declaring SIMI as an ‘unlawful association’. SIMI was banned on September 27 and declared ‘unlawful association’ under the provisions of Unlawful Activities (Prevention) Act, 1957 for indulging in anti-national activities. According to procedure, the next step is referring the decision to a tribunal within one month of such declaration. The Act also provides that the declaration is to be adjudicated by the tribunal within six months.

External Affairs Minister Jaswant Singh, addressing a press conference in New Delhi on October 11, ruled out India playing a larger or more direct role in the current US-led campaign in Afghanistan or providing forces for it, saying it was neither necessary nor on the cards. He also ruled out India contemplating granting the US the right to establish permanent bases as were being reported. However, the Minister said neutralisation of terrorist bases in Afghanistan was of direct interest and benefit to India as terrorists of the Al Qaeda’s network were operating in Jammu and Kashmir. He also indicated India’s desire to play a role in the future dispensation of Afghanistan. Saying that India would like to have a process-based rather than personality-based structure, he added it was necessary to ensure that Afghanistan did not once again become a centre that radiated terrorism. While extending support for a broad-based multi-ethnic government, Singh rejected the suggestion that a moderate Taliban leadership could be part of it, saying the term was an oxymoron. The Minister said India will continue to exercise restraint on the issue of hot pursuit but feels this is not the right time for either a visit to Pakistan or resumption of dialogue. He said, for a dialogue to resume, it was necessary that the weapon of terrorism be discarded. Welcoming the recent OIC communique condemning terrorism, he expressed optimism that the current campaign against terrorism would be taken to its logical conclusion.

Media reports said, the Union Cabinet, on October 16, approved the decision to promulgate the Prevention of Terrorism Ordinance, 2001, (POTO). Ever since the Terrorist and Disruptive Activities (Prevention) Act (TADA) scrapped there has been no specific law to deal with terrorist offences. Attempts to put in place anti-terrorism law were made by preparing a draft Criminal Law (Amendment) Bill (CLAB), but these have not gone beyond considering the draft several times over. An official statement said the new Ordinance will be an improvement over the CLAB, because an inter-ministerial group which examined the CLAB had found it to be "too weak to provide a legal framework for combating terrorism". The new ordinance defines terrorist acts thus: "Acts done by using weapons and explosive substances or other methods in a manner as to cause or likely to cause death or injuries to any person or persons or loss or damage to property or disruption of essential supplies and services with intent to threaten the unity or integrity of India or to strike terror in any section of the people."

He said, "We deplore terrorism wherever it exists, whether on September 11 or on October 1 in Srinagar." He reiterated the US position that both the countries stood shoulder to shoulder fighting terrorism and ‘that includes the terrorism that has been inflicted on India’. The Secretary of State, however, skirted the issue of Pakistan’s role in terrorism in Jammu and Kashmir. Asked whether Pakistan should be included in the global coalition against terrorism, he said Pakistan had recognised the nature the Taliban government and was working with the US to fight the Al Qaeda. He also clarified that he had not said in Islamabad, on October 16, that Kahsmir was ‘the’ central issue between India and Pakistan, but ‘a’ central issue. He said the Kashmir issue must be resolved between India and Pakistan, but the US would be willing to help facilitate the talks. He also announced that Prime Minister Atal Behari Vajpayee had accepted an invitation from President George Bush to visit Washington on November 9. At the press conference, Jaswant Singh said India has assured the US of full cooperation in its action against Afghanistan. He said, India has also demanded that the US’ war against terrorism go beyond Afghanistan and address Pakistan-sponsored terrorism in Kashmir. The Minister admitted that there were differences on the Kashmir issue between India and the US and added, "We can disagree without being disagreeable." Separately, the Secretary of State and India’s Union Home Minister L K Advani signed a treaty on legal assistance in criminal matters. Official sources said the pact would enhance the ability of the two countries to pursue the common objective of law enforcement by putting in place a regularised channel for obtaining law enforcement from each other. Issues pertaining to cross-border crime such as illegal immigration, smuggling and trafficking in women and children were also discussed in the meeting. Bangladesh is understood to have agreed to take back infiltrators if returned by India within 24 hours of their entering India. However, there was no agreement on the manner of deportation of convicted Bangladeshis on the Indian side. While BSF proposed a quick hand over, BDR wanted deportation through consular access. The meeting followed killing of four Bangladeshi nationals along the border with India in northeastern Sylhet district close to Assam and Meghalaya over the last four days. The Indo-Bangladesh borders have occasionally seen flare-ups with either side opening fire to crack down on terrorists and criminals.

Announcing the promulgation of the ordinance, Union Home Secretary Kamal Pande said, "The recent attack on the USA emphasises the urgency to undertake immediate special measures". He added that though POTO had built in safeguards to make it more humane for the innocent, it was a legal salvo against terrorism and terrorist outfits. He said, " The existing criminal justice system was not designed to deal with the types of heinous crimes that have appeared in the country in the last 50 years. Separate definition of terrorist acts, special provisions relating to financing of terrorism, use of explosives and weapons of mass destruction, substances of chemical and biological warfare and operations of terrorists organisations were not there or were ineffective.'' While the maximum punishment under POTO would be death, it has the provision of five-year imprisonment as the minimum punishment. Besides, he added, any person having connection with the proscribed organisations could face an imprisonment of 10 year with fine. The CBI chief, while speaking to the media in New Delhi, said, "We have got full information about these arms dealers and their addresses. We are hopeful of nabbing them soon.'' He added that several CBI officials were tracking down these arms smugglers and more information was being collected about their syndicate. The seizure suggests that all materials were being collected to make bombs. After the September 11 terrorist attacks in the US, and the US led military operations against Afghanistan, the CBI has formed a ‘core group’ to collect intelligence in a big way on the terrorist groups. The seizure of the arms consignment was a fall out of this exercise.

US Ambassador in India Robert Blackwill, in an interview to a private news channel on October 27, admitted that the US made mistakes in its policies on terrorism. He said the war against terrorism has to address the menace in India and the issue would be discussed during the Vajpayee-Bush meeting in Washington in early November. Asked why it took the September 11 attacks for the US to understand India’s concerns about terrorism, Blackwill said, "Every country feels its own terrorist attacks most acutely" and added "the US made some mistakes in its terrorist policies." On being asked if the US believes that Pakistan harbours and trains terrorists, Blackwill said the global war against terrorism "will reach every country that harbours terrorists, it will reach every terrorist organisation, it will reach every country that promotes terrorism and there will be no exceptions."

Union Civil Aviation Minister Syed Shahnawaz Hussain, while speaking in Delhi on October 29, said the government was planning to bring in a new legislation to arm the Bureau of Civil Aviation Security (BCAS) with more powers. He said, " A new enactment is under consideration for giving more powers to the BCAS and a decision on this will be taken soon. A draft of the legislation will be placed before the Cabinet as early as possible". The Minister added that the government had decided to deploy the Central Industrial Security Force (CISF) all the airports in the country within the next six months.
