A Mumbai court on January 1 extended till January 15 the judicial remand of Mohammed Afroz Razak, a suspected member of the Al Qaeda, who had planned to blow up targets in Britain and Australia. The accused did not plead for bail and also preferred not to engage any lawyer. Hence, no bail petition was moved on his behalf. Earlier, on December 18, 2001, Afroz had made a statement purported to be a confession about his links with the Al Qaeda and its plans to hit targets in foreign countries. However, the contents of his statement are not known, as it was recorded in-camera.

In the past, Pakistan has waived normal extradition procedures to deliver two men Ramzi Yousef and Mir Amal Kansi wanted by the US for terrorist crimes there. But, Pakistan Foreign Minister Abdus Sattar said, on January 1, that the 20 suspects would be handed over to India under the South Asian Association for Regional Co-operation’s (SAARC) Regional Convention on Suppression of Terrorism, that too, only if India met the necessary "legal obligations''. Sattar also said that India should initiate a case against each person in its own courts, indict them and then ask for their extradition. At that point, he clarified, "Pakistan will consider the request and if the person is genuinely required for the prosecution, (he) will be handed over''.

India had, on December 15, 2001, presented four demands to Pakistan, following the December 13, 2001 terrorist attack on Parliament. The demands were (a) arrest of terrorist leaders present in Pakistan, (b) a ban on their finances (c) a ban on their activities, and (d) the closure of their offices.

The MEA officials have also said that the first four demands made to Pakistan were "consistent with Pakistan's obligations under international law'' and also with UN Security Council Resolution 1373. However, the extradition request takes India into uncharted legal territory.

Speaking at a public meeting in Lucknow, on January 2, Prime Minister Atal Behari Vajpayee criticised Pakistan’s demand for proof that its nationals were involved in the December 13, 2001, attack on Parliament in New Delhi. The Prime Minister said the bodies of the terrorists slain during the attack and documents recovered from their possession were enough proof to establish their identity as Pakistani nationals. The Prime Minister also said that religious fundamentalism was the driving force behind terrorism, which he described as the biggest threat to the world after the cold war. Terming the attack on Parliament as an attack on the heart of Indian democracy, Vajpayee said it was important to see whether it was one organisation or an entire government that had masterminded the incident.

The news analysis adds, under international law, extradition presupposes the consent of the `host' government's judicial institutions. The only exceptions in recent years have involved two separate US demands––that Libya hand over two men wanted for the Lockerbie disaster and that the erstwhile Taliban regime in Afghanistan deliver Osama bin Laden. The US was able to get the UN to impose sanctions on both countries. Though Libya was eventually compelled to extradite the men, the US had to compromise by agreeing to have them tried in Netherlands under Scottish rather than US law. According to the news analysis, India could also approach the Security Council but the outcome is uncertain.

According to the expert, Article VIII of the SAARC Convention obliges countries to provide "…all evidence at their disposal necessary for the (legal) proceedings…'' and though the evidentiary standard need not be high, "…extradition requests have to be accompanied by specific judicial documents…"

Four postal employees were injured when a parcel bomb exploded at the Surya Nagar sub post office in the premises of Veterinary College of Orissa University of Agriculture and Technology (OUAT) near Siripur under Khandagiri police station limits, on January 3. Official sources said the registered parcel was being stamped when it exploded. The Chief Post Master General, who visited the scene of the blast, said the name of the consignee could not be ascertained as the postal department had dispensed with the practice of keeping duplicate copies of the receipt given to the sender of the parcel. The district police chief said that residue materials collected have indicated that the parcel had Electronic Explosive Device (EED). The explosive devices is suspected to have been triggered with a remote and contained a timer.

Media reports from Surat, in the western Indian State of Gujarat, said, on January 3, police ad officials of the Intelligence Bureau (IB) belonging to various states have almost finished the preliminary investigation into the backgrounds of 123 Students Islamic Movement of India (Simi) activists arrested in Surat. Thee information gathered is being passed on to the various States to which the cadres belong. Reports also claimed that, Intelligence officials from all States, except Bihar, had cooperated in the investigations. The SIMI cadres were earlier arrested in Surat where they had converged to hold a meeting, on December 29 and 30, 2001. A majority of the arrested persons belonged to Maharashtra.

Police, on January 3, arrested a terrorist of the Al Badr in Varanasi. Identified as Azizul, a native of Miyan Wali in the Punjab province of Pakistan, he reportedly confessed during interrogation that he was an active member of Al Badar since the last three years. He reportedly admitted that he attended three training camps in Pakistan and was operating in Jammu region comprising Rajauri, Punj and Doda areas. He has also admitted his involvement in a series of terrorist acts in Jammu and Kashmir. Police sources have not ruled out the possibility of his arrival being linked to a recruitment drive.

West Bengal Home Secretary AK Deb, while talking to the media in Kolkata said that the arrested suspect, Mohammad Dilshad who is a Pakistan Army personnel, confessed that he had been asked by the ISI to collect information on 33 Corps army headquarters in Siliguri and other vital army installations. Based on his statement during interrogation, police raided his rented house in Adarshnagar, Siliguri and arrested four accomplices. One of the four was employed with in the 33 Corps army headquarters. The raid led to the recovery of half a kilo of RDX, a grenade, arms, a floppy disc with information on Army installations, restricted Army maps, Army special train movement maps and pocket diaries listing a large number of telephone numbers in Pakistan and the United Arab Emirates (UAE). The police recovered a .30 calibre Chinese pistol, several live and spent cartridges and some drawings from the spot. His accomplice, however, managed to escape. The deceased had been arrested by the Delhi Police in 1993 and convicted by a Delhi court under the Terrorist and Disruptive Activities Act, Arms Act and other counts. He however, ‘jumped’ bail on a personal bond in 1995 and allegedly lived in Delhi's Sundar Nagar locality for the next five years.

The Government of India's (GoI) list includes Pakistan-based Lashkar-e-Toiba (LeT), Jaish-e-Mohammed (JeM) and Harkat-ul-Mujahideen (HuM), terrorist organisations of the north-eastern region like the United Liberation Front of Asom (ULFA) and National Democratic Front of Bodoland (NDFB), the proscribed Students Islamic Movement of India (SIMI) and Liberation Tigers of Tamil Eelam (LTTE). Sources added that the RBI’s measure is consequent to the President of India's promulgation of Prevention of Terrorism Ordinance (POTO) in October 2001. "It has been decided in consultation with GoI that banks should keep a watchful eye on the transactions of these organisations and if something is found violative of the extant acts or normal banking operations, the matter must be reported by the concerned bank to the appropriate authorities under the ordinance and to RBI," the apex bank said in a circular issued to all commercial banks.

As reported earlier, Afroz, on December 18, 2001, had reportedly made a confessional statement about his links with the Al Qaeda and its plans to air-dash targets in foreign countries. A media report on January 18, said that the Federal Bureau of Investigation of USA has given India a list of 30 Indian nationals who are suspected to have been part of the Al Qaeda terrorist network of Osama bin Laden. The FBI move is reported to be part of the co-operation between India and the US over sharing of intelligence. The report added that the Karzai government and US authorities have arrested some of them in Afghanistan. At least three of those named in the list are under arrest in Hyderabad. This is in addition to the two Hyderabad men who were held in the US after the September 11, 2001 terrorist attacks. The list reportedly also includes the name of Mohammad Afroz, who had been arrested by the Mumbai police in October 2001. As reported earlier, Afroz had confessed that he had been given pilot training in Australia, the UK and the US before September 11. Sources added that the FBI list is being processed by Indian security agencies within and outside the country. The Al Qaeda’s Indian connection is also expected to be discussed by US and Indian intelligence officials at a meeting of the two countries’ joint working group on terrorism which is scheduled to meet on January 21 and 22.

Media reports have indicated that officials in Kolkata received a telephone call from Farhan Malik, who is based in Dubai and is linked, to the Harkat-ul-Jehad-e-Islami (HuJI), a Pakistan-based terrorist outfit. Reports quoting official sources said that Malik in March 2000 was issued a Pakistani passport and was reportedly directed to establish a covert network in India to carry out terrorist operations. Malik is allegedly involved in underworld crime and also organized the abduction earlier this year of a Calcutta businessman for a 37.5 million-rupee ransom. Sources added that in August 2001, Malik was in contact with Omar Sheikh, an Al Qaeda terrorist, who was released in exchange for passengers of an Indian Airlines plane hijacked in December 1999 to Kandahar, Afghanistan.

The State and Central intelligence agencies, including the military intelligence, have reportedly compiled the list of madrassas in the Cooch Behar, Jalpaiguri, Malda and Murshidabad districts. The agencies are reported to have gathered evidence that these madrassas have been harbouring terrorists belonging to various Islamist terrorist outfits and have also been preaching terror. Quoting intelligence sources, the report added that a crackdown on these madrassas is expected to commence soon. While pointing out that all these madrassas have reportedly been funded by trusts based in the Gulf countries, the report added one of the trusts in Saudi Arabia is known to have strong linkages with the Al Qaeda terror network of Osama bin Laden. A media report quoting intelligence sources has indicated that the Asif Reza Commando Force (ARCF), one of the two outfits that has claimed responsibility for January 22 terrorist attack on the American Centre in Kolkata was raised sometime in the third week of December 2001. According to intelligence sources, the ARCF was probably raised at a village populated by illegal migrants from Bangladesh along the Indo-Bangladesh border in the Malda district of West Bengal. The sources said that the ARCF is an adjunct of the Harkat-ul-Jehadi-e-Islami (HuJI), a Pakistan-based terrorist outfit that has links with Pakistan's external intelligence agency, Inter-Services Intelligence (ISI). As reported earlier, the HuJI has also claimed responsibility for the attack. Sources added that certain HuJI leaders upon entry into Malda through Bangladesh are reported to have met some fundamentalist activists of the proscribed Students' Islamic Movement of India (SIMI) there and floated the idea of forming a front outfit of the HuJI. According to media sources, a report, prepared by the Border Security Force (BSF), in December 2001 and submitted recently to the West Bengal Chief Minister, has indicated a sharp rise in the number of unaffiliated madrassas (religious seminaries) in North Bengal, particularly along the border with Bangladesh. However, it is not known how many madrassas in the border areas are affiliated with the Board of Madarasa Education. Sources indicated that while minority institutions have gone up by approximately 50 per cent, the report points at a change in the demography of North Bengal in the last two decades. A survey was conducted along a 20-km stretch of the border in six districts. According to the report, the number of madrassas and mosques in 1990 were 487 and 823. In 2001, the numbers rose to 734 and 1227 respectively. The report also reportedly indicates that most of the institutions have emerged within a radius of five km from the border. The number of mosques close to the border has gone up from 475 in 1990 to 639. In case of madrassas, it has risen to 317 from 255.

Sources said that Omar Sheikh, one of the terrorists released at Kandahar, Afghanistan, in the IC-814 hijack incident of December 1999, was involved in planning the attack. Sources indicated that it was Sheikh, an Al Qaeda cadre, who gave Farhan Malik alias Aftab Ansari, Dubai-based Mafia Don, the idea of attacking the American Centre. Malik was reportedly taken to Islamabad in August 2001 and asked by Omar Sheikh to provide cover and logistical help for terrorist operations from Bangladesh.

Addressing a press conference in New Delhi on January 28, Union Home Secretary Kamal Pande said the Jharkhand police raided a hideout and in the encounter that ensued, two Pakistani terrorists were seriously injured. Pande said that one of them Mohammad Zahid, in a statement admitted that he was a resident of Khanewala district in Multan and had opened fire at the police personnel guarding the American Centre. Both of them died at hospital. "Further investigations are being carried out but there is hardly any doubt now about the role of Pakistani nationals and Pak-based terrorist ‘tanzeems’ in this case", the Union Home Secretary added. He said a new trend was emerging in terms of the direct involvement of Pakistani nationals in terrorist, espionage and subversive activities in India. Apart from the December 13 terrorist attacks at the Parliament House, there have been at least five cases of subversion and espionage in recent months in which Pakistani nationals were arrested in the country, Pande said. Those arrested admitted during interrogation that they had been sent to India for sabotage and terrorism at the behest of Pakistan’s Inter Services Intelligence (ISI), he added. Putting together the sequence of events after the January 22 incident, Mr. Pande said the Dubai-based criminal, Farhan Malik alias Aftab Ahmed Ansari, had called up the police and two newspaper offices in Kolkata within a few hours of the shooting and claimed responsibility. It also became known that Farhan Malik operated the terrorist module in conjunction with the Harkat-ul-Jihad Islami (HUJI) and the Lashkar-e-Toiba (LeT).

Soumen Mitra, Deputy Commissioner of Police, Kolkata, while speaking to a news agency in Hazaribagh on January 29, said this was proved by the dying declaration of one of the slain terrorists, Zaheed. He said the declaration of Zaheed also tallied with the statement recorded by Kolkata police from eyewitness accounts. He added that although the identity of Zaheed's companion Salim was not established, it was confirmed that he was part of the terrorist outfit. Mitra said linkages of the slain terrorists with Nalanda-based criminals have also been established.

According to media reports on January 31, intelligence agencies are tracing the fund routes of private madrassas in North 24-Parganas and Murshidabad districts of West Bengal. Reports said that unrecognised madrassas in the region have been receiving funds through various international routes which depend heavily on illegal finance network, hawala channels. A senior intelligence officer was quoted as saying, "We are now tracking a person in Kazipara area of Barasat who receives the money siphoned to private-run madrassas through separate hawala channels. We have information that this individual recently received more than Rs. 600,000 from one such channel for a 'private-run academy', which doesn't have permission under the Foreign Currency Regulation Act, 1961. We also have reports of the presence of a Pakistan and Bangladesh-based organisation, 'Khilafat Majlish', that is regularly funding private madrassas." The police are also keeping a watch on pre-madrassa institutions in rural areas, 'Makhtabs', which do not need any government registration. There are allegations that Makhtabs are involved in the "elementary brainwashing" of children to create the foundation of the so-called jehadis, says an intelligence report.

At the Home Secretary-level talks in New Delhi on January 30, the two sides decided to hold the Secretary-level talks annually alternately at New Delhi and Tehran. Both sides resolved to enter into close co-operation in eradicating the scourge of global terrorism. To establish structural instruments of co-operation, it was agreed to consider conclusion of an agreement on mutual legal assistance in criminal matters and an extradition treaty. The two sides also recognised the need to firmly deal with drug trafficking and agreed to have close co-operation in combating the menace of drug trafficking and narco-terrorism.
