Meanwhile, the Constituency Delimitation Commission (CDC) on August 2 said that it could not fulfill demands, which were beyond its jurisdiction, reports The Himalayan Times. “We cannot fulfill majority of demands as they are beyond our jurisdiction,” CDC Chairperson Kamal Narayan Das told. According to Das, people from the Tarai-Madhes region complained about state restructuring. Political leaders from the Tarai-Madhes region demanded that constituencies be determined on the basis of population. “Some people demanded that the constitution be amended first, while others sought change in provincial boundaries,” Das said.

Rastriya Prajatantra Party (RPP) Chairman Kamal Thapa addressing a cadres training progamme organized in Hetaunda city of Makwanpur District on August 3 announced that it won’t join the incumbent coalition Government led by Nepali Congress (NC) President Sher Bahadur Deuba, reports The Himalayan Times. Thapa accused the current Government’s bad intention and its lackey nature. Thapa urged the incumbent Government to create a conducive environment for all the political parties to participate in the third phase of local level elections in Province number 2 on September 18. “Rastriya Janata Party Nepal is also willing to take part in the local polls, so, the government should bring RJP-N on board the local polls to thwart secessionist and extremist forces getting strong hold in the Terai region,” Thapa added.

Elsewhere, Ganesh Raj Karki, spokesperson for Constituency Delineation Commission (CDC) on August 4 said CDC is all set to start data analysis and report writing from tomorrow as it has completed the task of collecting suggestions from the public, reports The Himalayan Times. He said “CDC officials could not collect suggestions from all parts of the country due to time constraints. The officials reached out to the people in densely populated cities as Biratnagar, Janakpur, Birgunj, Pokhara, Nepalgunj, Surkhet and Dhangadi and collected suggestions.” CDC was formed on July 20, 2017 under former justice Kamal Narayan Das to determine 165 constituencies for the election to House of Representatives and 330 constituencies for provincial election, both of which are to be held by January, 2018. It had started its field work on 26 July. The report for delineation of constituencies based on population and geography and will submit it to the Government by August15.

RJPN leader Brikhesh Chandra Lal said “There is a strong voice in the RJP-N that the party, which is carrying the agenda of Madhesis and other marginalized communities, should not take part in the election in the current situation without ensuring passage of the constitution amendment bill. If the RJP-N abandoned its agenda of empowering Madhesis and other marginalized communities, then some other forces would champion the same cause.”

Dahal, the common candidate of the ruling Nepali Congress (NC) and CPN-Maoist Center garnered 43,127 votes while Gyawali got 42,924 votes in the re-election held in Ward number 19 of the metropolis.

Separately, a source at the Constituency Delineation Commission (CDC) said office bearers were mulling over the possibility of giving 90 per cent weightage to population and 10 per cent weightage to geography while delineating electoral Districts, reports The Himalayan Times on August 5. The CDC is currently studying inter-District migration as well as intra-District migration trends, the source said. The CDC is also looking at the models on the basis of which 205 constituencies were delineated in 1991.

ICJ’s discussion paper ‘Nepal’s Transitional Justice Process: Challenges and Future Strategy’ summarizes the key challenges faced by Nepal’s transitional justice process as identified by conflict victims, representatives of human rights organisations, lawyers and other stakeholders during consultations held in Pokhara, Biratnagar and Nepalgunj and a round-table meeting in Kathmandu in May and June. As of July 2017, the Truth and Reconciliation Commission (TRC) has received 58,052 complaints of human rights violations, and the Commission of Investigation on Enforced Disappeared Persons (CIEDP) has received 2,874 complaints of alleged enforced disappearances. Since the ICJ held its consultations on the operation of the transitional justice mechanisms, the commissions have started preliminary investigations in some of the cases. However, according to information received by the ICJ, these investigations also suffer from flaws as the investigation teams do not have human and financial resources to handle the large number of cases and there are concerns about the opacity of the appointment process of investigators.

The Commission of Investigation on Enforced Disappeared Persons (CIEDP) has started conducting detailed study into complaints of conflict victims after completing preliminary study, reports The Himalayan Times on August 27. CIEDP is studying 100 such complaints, to begin with, said CIEDP Spokesperson Bishnu Pathak. Of the total 3,093 complaints, CIEDP has approved 1,300 for detailed study, while it is yet to decide on 1,400 to 1,500 plaints. Once everything is finalized, CIEDP estimates that 2,200 to 2,300 complaints will be taken up for scrutiny. “This is because we have also received complaints of cases of disappearance that fall beyond our jurisdiction, such as incidents that took place during the Popular Movement of 2006,” said Pathak. “We are forwarding some complaints to the Truth and Reconciliation Commission (TRC) as they come under its jurisdiction. While some of the complaints will be scrapped, the others will be kept as ‘pending’.”

A cabinet meeting held decided to hold the polls in two different dates as per the suggestions of the Election Commission (EC), which said it is logistically challenging to hold the polls across the country in one go. A Communist Party of Nepal-Maoist Centre (CPN-Maoist Centre) cadre who was pronounced guilty of murder by the District Court of Bara, lured by financial inducement and under pressure from Home Minister Janardan Sharma has been let free instead of being jailed, reports Republica on August 31. The District Court had slapped 20 years jail term on Ashok Kumar Sah Kalwar of Barainiya village, Bishrampur Rural Municipality-2. However, lured by financial inducement and under pressure from Home Minister Janardan Sharma, Bara Police let him walk free after detaining him for a night, various sources have claimed. Kalwar was arrested on August 21. However, the Police released him the next day, an officer of the Police post confirmed. Kalwar is close to Maoist leader Prabhu Sah, who is also currently the Minister for Urban Development.
