Conflict-era victims have complained that the two transitional justice mechanisms — Truth and Reconciliation Commission (TRC) and Commission of Investigation on Enforced Disappeared Persons (CIEDP) — have largely been apathetic to their plight, reports The Himalayan Times on December 3. Instead, they said, the bodies were prolonging their physical and mental agony by adopting lengthy, complicated and non-transparent truth finding procedures. With just three months remaining for their terms to expire, the conflict victims said they had lost their hope for justice from TRC and CIEDP.

Earlier, a bomb went off targeting the mass meeting addressed by Communist Party of Nepal-Maoist Centre (CPN-Maoist Center) Chairman Pushpa Kamal Dahal at Pakadi of Mayadevi Rural Municipality in Kapilvastu District on December 2, reports The Himalayan Times. The blast occurred immediately after the Dahal completed his address to the mass meeting. Police said that no human casualty has been reported in the incident.

Meanwhile, Police claimed that anti-poll activists were luring daily wagers to carry out terrorist activities, reports The Himalayan Times on December 4. Sanjay Gurung, a daily wager who was arrested on November 28 told Police that he was offered Rs 1,000 for exploding a cylinder and he accepted the offer, since as a daily wager he used to earn only Rs 200 to 300 per day. Another daily wager had also exploded a cylinder at Lanku Bridge in Narayanghat on the morning of November 28. Police arrested him immediately. He too told the Police that he exploded the cylinder, as he was promised Rs 1,000 by someone. In another such incident, Ganju Singh Gurung was arrested on November 29 from Ratnanagar Urban Municipality when he hurled a Molotov cocktail on a vehicle being used for campaigning. Ganju Singh told police that Netra Bikram Chand-led Communist Party of Nepal (CPN), which had suspended him for joining Communist Party of Nepal-Maoist Centre (CPN-Maoist Center), had told him to carry out an explosion to show his commitment to Chand-led CPN.

Sah was heading towards Karmaiya from Hajariya on a jeep (Na 2 Cha 2019) when the IED went off near a stream, three kilometres from the East-West Highway. There were no casualties.

According to SP, Thapa, Sanjay Gurung, who was arrested, on November 28, for carrying a gas cylinder in Ratnanagar Urban Municipality of Chitwan to trigger an explosion, told Police that he was merely carrying out anti-poll elements’ order for a sum. Gurung told Police that he was offered INR 1,000 for exploding a cylinder and he accepted the offer, since as a daily wager he used to earn only INR 200 to 300 per day. However, according to Police, it is not clear who told Gurung to explode a cylinder and who paid him INR 1,000 for carrying out the blast. Also, another daily wager had also exploded a cylinder at Lanku Bridge in Narayanghat in Chitwan District early morning of November 28. The daily wager after his arrest told the Police that he exploded the cylinder, as he was promised INR 1,000 by some unidentified person. In another such incident, Ganju Singh Gurung was arrested on November 29 from Ratnanagar Urban Municipality when he hurled a Molotov cocktail on a vehicle being used for campaigning. Ganju Singh also told Police that Netra Bikram Chand-led Communist Party of Nepal-Maoist (CPN-Maoist), which had suspended him for joining CPN-Maoist, had told him to carry out an explosion to show his commitment to Chand-led CPN-Maoist.Following these incidents, Police have beefed up security by carrying out cordon search and sweep operation across the District. They have increased vigilance in Mugling, Lother Bridge, Narayani Bridge and in areas where landless people are settled. Police have so far arrested 25 anti-poll activists and 19 gangsters with explosives, weapons and ammunition. Twenty-five anti-poll activists who have been arrested are suspected to be associated with Chand-led CPN-Maoist but the Government bodies have not confirmed their political association. “We’ll not let people stand in a group of five or more on the road,” said SP Thapa. “Joint security forces will also carry out cordon search and sweep operation across the district,” he added.

Presenting the mission’s preliminary statement in Kathmandu, Željana Zovko, EU chief observer said, “The 2017 elections to the House of Representatives and the provincial assemblies represent a key milestone in the implementation of the 2015 constitution. EC Information Officer Surya Prasad Aryal said the poll panel had to complete all electoral procedures for the NA election as in other elections. He said the EC would appoint chief returning officers for seven provinces, establish their offices, ask the parties to file nominations, publish names of candidates and give them time to launch poll campaign, which would take at least three weeks. He said NA polls would be held in seven provinces and polling centres could be established in several districts to facilitate voting. Each province will elect eight upper house members and the president will nominate three members on the recommendation of the government. The Government had formed the commission on September 18, 2016, to investigate into the killings and violent incidents that took place during protests in the Tarai. The commission had begun its investigation on October 17. Chief of the probe commission Lal told that they had submitted the report to the group and it was up to the Government to publish the report. Lal said 66 people, including 10 security personnel and one 18-month-old child, were killed during 2015-16 protests. Out of 66 victims, 56 were civilians. According to Lal, 52 people have already been given the status of martyr, but four victims have not been given the status of martyr. The commission investigated 3,264 complaints lodged by victims, ordinary citizens and political parties.

Out of 49 parties that contested the parliamentary PR elections, only five — the CPN-UML, the Nepali Congress (NC), Communist Party of Nepal-Maoist Centre (CPN-Maoist Center), the Federal Socialist Forum-Nepal (FSF-N) and the Rastriya Janata Party-Nepal (RJP-N) — were able to secure three per cent votes, the required threshold to be recognized as national parties. Among the five parties, the CPN-UML got 3,173,494 votes, followed by NC’s 3,128,389, CPN-Maoist Center’s 1,303,721, RJP-N’s 472,254 and FSF-N’s 270,201 votes. Of the total 275 members in the Parliament, 110 will be elected under the PR category while 165 members have already been elected through the FPTP electoral system. Experts estimate that the CPN-UML will get 41 seats, NC 40 seats, CPN-Maoist Center 17 seats and RJP-N and FSF-N will bag six seats each. The MoPR had on December 12 forwarded a letter to the two transitional justice bodies seeking their inputs on the draft amendment to the act. Both the transitional bodies have already sent a reply to the letter. While the CIEDP has sought a three-year extension of its tenure, the TRC had replied to the ministry stating that its official position had not changed on its eight-point amendment proposal that it had forwarded to the government in December 2015. Ministry’s Spokesperson Ram Prasad Bhattarai said ‘high-level consultations’ were under way on inputs forwarded by the TRC and CIEDP on the draft amendment and by how many years their tenure should be extended. “Two things are almost certain: The tenure will be extended and the amendment will incorporate the Supreme Court directives,” he said, adding that they would soon reach a conclusion on the issue after deliberations.

President Bidya Devi Bhandari on December 29 authenticated the ordinance on election to the National Assembly (NA), reports Republica. The President's Chief Personal Secretary, Bhesh Raj Adhikari, said that the President authenticated the ordinance which had been pending at the Office of the President for long due to the dispute among the political parties over it. Although the President had wanted all the political parties to agree on the ordinance, she authenticated the ordinance with a view to ending the latest political deadlock, the President's Chief Personal Secretary said. The Government had presented the ordinance to the President in the third week of October for authentication.
