Prime Minister KP Sharma Oli draws flak for dissolving the House of Representatives (HoR) during the first meeting of the seventh session of National Assembly on January 1, reports The Himalayan Times. Nepali Congress (NC) lawmaker Jitendra Narayan Dev termed the dissolution of the HoR as an unconstitutional and undemocratic act, while Janata Samajwadi Party-Nepal (JSP-N) lawmaker Pramila Kumari termed it as a repeat of royal coup d’état staged by the then king Mahendra against the constitution. Ruling Nepal Communist Party (NCP) lawmaker Dinanath Sharma said it was unfortunate that the HoR was dissolved due to the intra-party wrangling.

The faction of Nepal Communist Party (NCP) led by Pushpa Kamal Dahal and Madhav Kumar Nepal on January 2 announced its second phase of nationwide protests against the dissolution of the House of Representatives (HoR), reports The Himalayan Times. The faction will submit a memorandum to Prime Minister KP Sharma Oli on January 8 through all 77 District Administration offices demanding apology from him for dissolving the HoR, and restoration of the HoR. It would read out the constitutional provisions on the streets and interpret those provisions on January 10. On January 12, the rival faction will distribute pamphlets to households and erect red flags against the dissolution of the Lower House and on January 18, it will organise protest programmes in all local levels. On January 29, the Dahal-Nepal faction will organise protest programmes in five provinces — Province-1, Gandaki, Lumbini, Karnali and Sudurpaschim Provinces. The faction said it would organise protests in Province 2 on January 30. On February 4, the faction will bring out torch rallies in all wards of the local levels. It will organise a protest rally and a mass gathering on February 5 in Kathmandu valley.

The Election Commission (EC) has amended its rules to formalize the split in the ruling Nepal Communist Party (NCP), reports The Himalayan Times on January 5. Earlier rules didn’t allow the poll panel to recognize a split in a party after announcement of General Elections. After amending its rules, the EC can now decide which faction of the NCP is authentic and which should register with the poll panel under a new name. Spokesperson for the EC Raj Kumar Shrestha said the amendment meant that the EC could hear claims and counter claims of parties’ factions about who should use the original party’s name, flag, and election symbol during the election. According to Shrestha, previous rules prohibited the EC from recognizing a splinter group as a new party even after it submitted signatures of 40 per cent of Central Committee members and the Parliamentary Party.

The Supreme Court on January 4 issued a show cause notice to the Office of the Prime Minister and the Council of Ministers seeking an explanation on the recent expansion of the cabinet, reports The Himalayan Times. The apex court asked the Government to furnish its reasons for inducting new Ministers to the cabinet even after the dissolution of House of Representatives. A single bench of Justice Anil Kumar Sinha issued the order and scheduled the next hearing on January 12. On December 25, 2020, five days after recommending dissolution of House of Representatives, Prime Minister KP Sharma Oli had inducted new members into his cabinet.

The All-Nepal National Free Students’ Union (ANNFSU), the student wing close to Pushpa Kamal Dahal and Madhav Kumar Nepal faction of Nepal Communist Party (NCP), took to the streets with lanterns in their hands demanding reinstatement of the lower house of Parliament on January 6, reports Republica. The agitating students carried lanterns, giving a symbolic message that they could not find any Articles in the Constitution of Nepal that allows Prime Minister Oli to dissolve HoR. The rally was organized as the Supreme Court was conducting hearings on 13 different writ petitions filed against the move of Prime Minister Oli to dissolve the parliament.

The lawyers, who filed separate writ petitions at Supreme Court challenging the decision of Prime Minister K P Oli to dissolve the lower house of Parliament, have demanded a full bench of the apex court in the course of the preliminary hearing on the case on January 6, reports Republica. Chief Justice Cholendra SJB Rana had earlier formed a five-member constitutional bench under him. The bench includes Justices Bishwambhar Prasad Shrestha, Tej Bahadur KC, Anil Kumar Sinha and Hari Krishna Karki. Arguing that the case deserves to be heard in the full bench as this is a politically highly significant issue for the country, the petitioners have demanded Chief Justice Rana to make an arrangement to forward the case to a full bench. As many as 13 writ petitions have been filed at the apex court challenging the decision of Oli to dissolve the parliament on December 20.

Addressing a mass at Budhanilkanta, Kathmandu, NC President Sher Bahadur Deuba urged all to join hands with the NC as the communist parties had not been able to meet people’s expectations. He, however, also said it was not a democratic practice to exert pressure on the Supreme Court from the streets to give verdict in one’s favour. Deuba said, “Nepali Congress is a party that follows moral values. We believe in rule of law and the court. We shall wait for the SC’s verdict. On behalf of the writ petitioners, senior advocates Krishna Prasad Bhandari, Harihar Dahal, Raman Kumar Shrestha, Hari Upreti, Dinesh Tripathi, Dr Chandra Kant Gyawali and Shambhu Thapa pleaded for the hearing of writ petition on extended full bench. Advocate Bhimarjun Acharya said that the Prime Minister has no power to dissolve the HoR and as per the constitutional provision the House could be dissolved only after exhausting all options listed in Article 76 regarding formation of the Government. Acharya said there were only two conditions under which the HoR could be dissolved — on the expiry of the five-year term of the HoR or when a coalition of parties fails to appoint a PM or the PM appointed by them fails to obtain a vote of confidence. “This does not mean that the PM can recommend dissolution of HoR at his will,” he argued. Advocate Sunil Pokharel wondered how the PM, against whom the HoR could not move a no-trust motion for the first two years, dissolved the HoR in 17 minutes. Pokharel said as per the constitution only the PM formed under Article 76 (5) of the constitution could recommend House dissolution under Article 76 (7).

The Citizens’ group formed to protest Prime Minister KP Sharma Oli’s move to dissolve the Parliament on January 25 announced the beginning of the ‘third people’s movement’ following Police crackdown on protesters, reports The Himalayan Times. Accusing the administration of turning the peaceful citizen’s protest violent by using force on unarmed, civil demonstrators, the group said it is launching the movement against every form of regression. The first people’s movement of 1990 brought end to absolute monarchy, the Panchayat form of governance, instated constitutional monarchy and multi-party democracy system. Likewise, the second people’s movement overthrew monarchy, ushered republicanism, secularism and federal system. It also paved way for the Maoist rebels’ entry into mainstream politics.

A day after Police applied force to disperse a protest organized by civil society activists at Baluwatar in Kathmandu, where the official residence of the Prime Minister is located, the National Human Rights Commission (NHRC) on January 26 urged the Government to respect the citizens’ rights to freedom of expression and peaceful assemblies, reports Republica. The NHRC reiterated that Article 20 of the Universal Declaration of Human Rights-1948, Article 21 of the International Covenant on Civil and Political Rights 1966 and Article 17 of the Constitution of Nepal have ensured the right to freedom of opinion and expression and to assemble peaceably and without arms. “The use of excessive force goes against the national and international laws,” reads the statement. “The commission urges the government to be sensitive in this regard.” The rights body also drew the attention of the Government not to violate, under any pretext, the citizens’ fundamental right to freedom of expression.

Two cases of contempt of court have been registered at the Supreme Court on January 26 against Prime Minister KP Sharma Oli, reports Kathmandu Post. Senior advocate Kumar Sharma Acharya and advocate Kanchan Krishna Neupane have filed the contempt of court cases against Oli for using disparaging remarks against legal practitioners and trying to influence the court. On January 22, Oli, while addressing his cadres, had taken a jibe at senior Advocate and former chair of Nepal Bar Association, Krishna Prasad Bhandari, saying that the petitioners were giving trouble to a “grandfather” lawyer as well. Bhandari (94), on January 17 had argued on behalf of the petitioners who have challenged Oli’s House dissolution move.

With just two weeks left in its tenure, the Commission of Investigation on Enforced Disappeared Persons (CIEDP) on January 28 started distributing identity cards to the kin of people who disappeared during the Maoist insurgency, reports Kathmandu Post. Families of 21 people who disappeared during the Maoist insurgency, received their identity cards in the presence of Minister for Foreign Affairs Pradeep Gyawali in Bardiya. Representatives of the victims, however, aren’t happy with the identity cards as they are not associated with any Government facility or concession. They allege that the commission is distributing cards just to show the Government that they have been working hard. Suman Adhikari, founding chairperson of Conflict Victims’ Common Platform (CVCP) told “What is the meaning of holding the cards when it is of no use to the victims? This is nothing but a sham to show that the commission is working hard. The government should announce some facilities for cardholders.”

Senior Advocates Raman Kumar Shrestha and Ram Narayan Bidari on January 29 said that Prime Minister (PM) KP Sharma Oli’s House of Representatives (HoR) dissolution move against statute, reports The Himalayan Times. Arguing on behalf of the petitioners who have challenged the PM's move to dissolve the House, Shrestha said Article 76 (7) gave the PM the power to dissolve the House when the new government could not be formed but in this case the power was exercised by the PM and hence the dissolution of the HoR was unconstitutional. Similarly, Bidari said that Articles 76 and 100 were incorporated with the main aim of maintaining checks and balance between the legislature and the executive and the PM's move to dissolve the HoR had rendered these articles inactive. If the SC validates the PM's move these two Articles of the constitution will be rendered defunct and the current constitution would be crippled.
