The Supreme Court scrapped the Truth and Reconciliation Commission (TRC) guidelines for putting insurgency-era rights violation cases on hold, reports The Himalayan Times. A division bench of justices Jagadish Sharma Poudel and Dipak Kumar Karki scrapped the TRC guidelines, stating they were against the provision of the TRC Act and Regulations. Nepali Congress leader and General Secretary of Conflict Victims National Society Binaya Dwaj Chand, along with other 15 conflict-victims organisations, had filed a petition against the guidelines on September 26, 2016. The apex court had earlier issued an interim order against the guidelines. The TRC had prepared the guidelines for putting on hold insurgency-era human rights violation cases on several grounds, including lack of evidence and inadequate details. Thousands of conflict-era cases were likely to be shelved without conducting any inquiry if the guidelines were followed.

A day after the Government formed a task force to seek suggestions on the report of the Local Bodies Restructuring Commission (LBRC); its office bearers say revision of the report is not possible, reports The Himalayan Times on February 4. LBRC member Neeraj Sah said LBRC received over 50 phone calls and multiple delegations everyday from across the country seeking changes in the report.”The government cannot make selective revisions. If the report is revised it will set a bad precedent and will become a never ending process,” said another LBRC member Sunil Ranjan Singh. He said the report was prepared keeping in mind both the geography and the population. He added that neither the government nor any task force had the authority to revise the document and the report could be revised only after its implementation. “It will be unconstitutional to revise the report,” said Singh. Meanwhile, Minister for Federal Affairs and Local Development Hitraj Panday, who is also the head of the government’s task force to study the LBRC report, said the task force would study the report thoroughly and recommend its revision, if needed. Expressing dissatisfaction with its contents, the government has refused to endorse the report saying further consultations were needed on the report among the political parties. The constitutional body had submitted its report on number and boundaries of local bodies to the government on January 6. Apart from determining the number and boundaries of local bodies, the LBRC is mandated to prepare a report on the special, protected and autonomous regions, their economic feasibility and structure of the public administration in the federal model by March 13.

Madhesi Janaadhikar Forum-Democratic (MJF-D) Chairman Bijaya Kumar Gachhadar, on February 3, said his party would not participate in civic polls without passage of a revised the Constitution amendment bill from the Parliament, reports The Himalayan Times. Addressing party cadres in Rajbiraj, Gachhadar accused the Government of trying to announce the election dates without amending the statute amendment bill. Accusing the leaders of major parties of not being serious towards problems facing the country, Gachhadar said, “Leaders of the Nepali Congress (NC), CPN-UML (Communist Party of Nepal-Unified Marxist Leninist) and CPN-Maoist Centre (Communist Party of Nepal-Maoist Centre) are power hungry and are not concerned about the country’s problems,” he said. Stating that the people’s long-cherished dream of writing the constitution through the Constituent Assembly was yet to be realised, he said, “The constitution was written, but the big leaders of the big parties are not serious about its implementation.”

Prime Minister (PM) Pushpa Kamal Dahal invited the Madhesi parties at the PM’s official residence in Baluwatar, Kathmandu, for a joint meeting on February 3 and told them that he wanted to move forward the preparations for local elections and the Constitution amendment that they sought simultaneously, reports The Himalayan Times. PM Dahal assured the Madhesi parties of “making efforts” to address their concerns over the report prepared by Local Body Reconstructing Commission. An understanding has been made between the Madhesi leaders and the PM to take an initiative to correct and endorse the Constitution Amendment Bill from the Parliament, according to a statement issued by the PM’s secretariat. A few hours after the Government officially asked the Election Commission of Nepal to make necessary preparations for local elections; PM Dahal also held a meeting with the leaders of United Democratic Madhesi Front (UDMF) in his bid to assure them that he did not ignore them. The PM’s secretariat said the meeting ended on a positive note.

Truth and Reconciliation Commission (TRC) on February 5 recommended Government to extend its tenure by one year, reports The Himalayan Times. “We have forwarded a written request to the Ministry of Peace and Reconstruction seeking TRC’s term extension,” TRC member Madhabi Bhatta told. She said a meeting of the TRC secretariat held in Kathmandu had decided to write to the ministry, which would forward the proposal to the Council of Ministers. She said without TRC recommendation the Government could not take a decision on its term.

According to sources, the Prime Minister's Office has requested the speaker to delay forwarding the bill to the President. Once the bill is authenticated by the President, the Government is forced to announce the date for local election. It is learned that the Government has not sent the bill to the President as it is not too keen to announce the election date. The bill has been languishing for a week in Parliament Secretariat under the pretext of editing its language and grammar.

However, many victims couldn’t register their complaints due to various reasons, officials said. CIEDP Spokesperson Bishnu Pathak said the commission would issue a notice by mid-March, urging all remaining conflict victims to file their complaints. The victims will be given a month to file their complaints, according to him. A cabinet meeting agreed to extend the deadline of the taskforce formed under the leadership of Minister for Local Development Hitaraj Pandey. The taskforce was formed on February 2 with a 15-day deadline for making revisions in the report prepared by LLRC about the numbers and boundaries of local units to be delineated under the federal setup. The taskforce had submitted a review report about a week ago to the cabinet and recommended increasing the number of local bodies on the basis of population. Though the commission has fixed the numbers and boundaries of the local units across the country, its report has been strongly opposed by Madhes-based political parties mainly in the eight Districts of Province-2. Also, some proposed units are under dispute in a few hill districts including Nuwakot, Khotang and Bajhang.

The opposition, which was against allowing deliberations on the amendment bill in parliament, said that the agitating Madhesi parties must commit to accepting the result of the parliamentary vote on the bill and participate in local elections. “We have become flexible in our previous stance following the government's request for creating an environment for local polls. But the UDMF (United Democratic Madhesi Front) must express its commitment to accepting the result of the voting on the bill in parliament and it must be ready to participate in local elections,” Bhanu Bhakta Dhakal, chief of the Communist Party of Nepal-Unified Marxist Leninist (CPN-UML), said. A meeting of the CPN-UML parliamentary party and a separate meeting of the nine-party alliance decided to demand that the Government and the UDMF express commitment to accepting the voting result in parliament and that the UDMF commit to participating in the local elections. “The government and UDMF must make it clear that they will accept the result of the vote in parliament.
