On June 1, the Constituent Assembly (CA) begun deliberations on state restructuring, as it discussed the process and nature of federalizing the country as per the Interim Constitution of Nepal, reports Nepal News. Taking part in the discussion, CA member Bidya Devi Bhandari suggested forming few provinces as identity continues to change with time while viability is always applicable. It is however meaningless to still harbor suspicions over federalism, she added. "We should consider our multi-ethnic, multi-lingual and multi-cultural social fabric while discussing about state restructuring and distribution of state power, Bhandari said.

On June 3, a writ petition has been filed by 234 victims from both rebel and state sides at the Supreme Court, demanding the review of the Truth and Reconciliation (TRC) Act 2071, reasoning that some sections of the Act are against the Interim Constitution, the international human rights and humanitarian laws, the principles of transitional justice, and the Supreme Court orders, reports Nepal News. Section 13, 22, 24, 25, 26 and 29 of the Act are incompatible with Articles 12, 13, 24 (9), 25 and 26 of the Interim Constitution, the petitioners said, stressing the need to address the conflict victims through the constitution.

According to Police, the suspected pressure cooker bomb was planted warped with polythene. Leaflets printed in the name of Dalit Mukti Force have been recovered near by the incident site. However, the bomb disposal team found out that the pressure cooker was just a hoax and was planted there to spread fear, said New Baneshwor Police Circle Deputy Superintendent of Police (DSP) Ramesh Kumar Tamang, adds Ekantipur.com. "There was no explosive material inside the cooker," said Tamang.

The Unified Communist Party of Nepal-Maoist (UCPN-M) continued their obstruction of the Parliament on June 4, demanding investigation into what they call “election fraud,” among other things, reports The Hindu. Negotiations between the ruling parties and the main opposition failed to end the obstruction. Speaking in Parliament, UCPN-M lawmaker Agni Sapkota accused Prime Minister (PM) Sushil Koirala of not being serious in addressing the party’s concerns. The UCPN-M has been demanding implementation of the four-point agreement signed between victorious parties and the Maoists after the second Constituent Assembly (CA) elections in November 2013.

At the meeting of the Constituent Assembly (CA) in Kathmandu on June 5, majority of the CA members emphasized on the need of developing a federal system unique to Nepal and not based on ethnic and regional ground, reports Nepal News. Expressing their views on the report of the CA Committee on Constitutional Archives Study and Determination on the agreed and disputed issues in then CA Committee on Restructuring of the State and Distribution of State Power, they said that federalism should not be a basis for disintegration but promoting unity and consensus in the country. The CA members also pointed out to the fact that federalism was in fact one of the reasons behind the failure of the first CA to draft the new constitution, and stressed on federating states based on multi-identity.

On June 6, deliberation on whether conscription should be included in the new constitution has resumed at the Constitutional-Political Dialogue and Consensus Committee, reports Ekantipur.com. The issue that was earlier dealt and almost resolved unanimously by the National Interest Protection Committee of the first Constituent Assembly (CA) has become a matter of debate in the new CA. The issue has now come before the Constitutional Political Dialogue and Consensus Committee from the CA Constitutional Archives Study and Determination Committee. Expressing their views over the proposed mandatory military training and service for citizens of 18 years and above, majority of the CA members in the committee said that such training was not necessary and also not economically viable for the country. However, some of the CA members were of the view that conscription was essential in order to dedicate the youth force in the interest of the nation.

One June 9, lawmakers of different political parties stressed on the need to adopt a federal system based on the country's specialty, reports The Himalayan Times. The lawmakers stressed that country's unique feature and necessity should be considered while federating the country. It would be unfortunate for the country if it was federated haphazardly, they said, arguing that maximum seven provinces based on country's economic capacity and potentiality would be appropriate. However, some of the lawmakers demanded that Comprehensive Peace Accord, the Interim Constitution of Nepal and other political pacts be enforced while mapping the federal states and issues of identity of the people should not be interpreted from the point of view of ethnicity alone. Issues regarding how to lead the country towards prosperity should be the agenda of federalism, they said.

In a meeting with the Nepali Congress (NC), Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) and Unified Communist Party of Nepal-Maoist (UCPN-M) leaders on June 9, CPN-Maoist Vice-chairman CP Gajurel presented an eight-point outline aimed at bringing all the political forces together. The debate began on May 29, with about 400 CA members expressing their views on issues related to federalism and distribution of state power. It is now a mandate of the Committee led by Unified Communist Party of Nepal-Maoist (UCPN-M) leader Baburam Bhattarai to settle the issues by holding talks with political parties in and outside the Assembly. Speaking in the Parliament, the Chairman of the Unified Communist Party of Nepal-Maoist (UCPN-M) Pushpa Kamal Dahal aka Prachanda said he was hopeful of constitution-writing gaining momentum after the agreement. He said the need of the hour was to conclude the incomplete tasks of the peace process. Dahal added that the parties were still discussing on the nature and composition of the High Level Political Committee (HLPC). Dahal said, “Should it comprise of the parties represented in the Constituent Assembly or also those outside it — the Communist Party Nepal-Maoist (CPN-Maoist) and other parties? We will decide the matter soon.” However, he asked the House members not to think too much about the work and formation of the HLPC. A three-member bench led by Chief Justice Damodar Sharma issued the order to this effect on June 12. The bench was deliberating whether a stay order is required as sought by the plaints. On June 5, the court had called both petitioners and defendants to discuss whether an interim order was required as demanded. On June 13, a full meeting of the Constitutional Dialogue and Consensus Committee reached an understanding on the controversial issue of giving compulsory military training to Nepali citizens above 18 years of age, reports The Himalayan Times. After discussion on the last Constituent Assembly (CA)’s thematic committee report on National Interests Protection Committee, the dialogue committee unanimously agreed that it would be the duty of the citizens to “provide compulsory service as and when required by the nation”. This provision will be inserted in the section ‘Citizens’ Duty’ in the new constitution. But the agreement does not clearly state that the term “compulsory service to the nation” means the compulsory military training as demanded by the Unified Communist Party of Nepal-Maoist (UCPN-M). Committee chairman and UCPN-M leader Baburam Bhattarai said it was the middle path acceptable to all parties represented in the second CA. The dialogue committee has representatives from all the parties represented in the Constituent Assembly.

In the discussions the major parties, Nepali Congress (NC), Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) and Unified Communist Party of Nepal-Maoist (UCPN-M), put forth views according to their party lines, leaving little room for compromise. NC CA member Ramchandra Paudel said, the executive head (Prime Minister) must be accountable to the people’s elected representatives (Parliament) as this will not give any room for the executive head to become a dictator after election. “If we elect the executive head (directly-elected prime minister or directly-elected president) for five years, there is chance that he will become a dictator,” Paudel said, adding that such a person could not be made accountable to Parliament and the concept of inclusiveness would also weaken. He said a ceremonial head of state (President) would ensure checks and balances in governance. He said the Pradesh chief should also be elected by elected representatives. He, however, said some provisions could be added to the constitution to ensure that the parliamentary system gives stability.

The commissions will settle cases of human rights violation meted out during the decade long Maoist insurgency. The Cabinet formed a committee headed by former chief justice Ombhakta Shrestha to recommend names for the two commissions. The two commissions will have five members each including a woman, as per the Act. “First, the committee will determine its process and make it public and then it will finalise the names. So, it is likely take 15 to 20 days to recommend names for the commissions,” Minister for Peace and Reconstruction Narahari Acharya said. In another move, the government formed a five-member commission headed by former chief judge of Appellate Court Keshav Mainali to help the government implement all agreements reached with different agitating groups. Other members of the commission include human rights activist Dipendra Jha, educationist Raj Kumar Rai and advocate Rita Mainali. One member will be deputed from the Ministry of Peace and Reconstruction. “The government has reached 71 agreements with different groups after the Peace and Reconstruction Ministry was set up. The commission will look into all the agreements and recommend ways to implement them,” said Acharya.

However, the later has dubbed the move as mere propaganda. After facing humiliating defeat in the second Constituent Assembly (CA) election in November 2013, scoring just 80-seat out of 575 CA seats and downsizing to third party from the first, UCPN-M chairman Pushpa Kamal Dahal aka Prachanda has been approaching the Mohan Baidya-led CPN-Maoist with a view for party unification. Though the breakaway faction had sought a six-point condition as the basic ground for party unification in response to the informal party unification proposal, UCPN-M leaders themselves admit that they have not discussed these conditions in any organs of the party. Hence, the CPN-Maoist doubts whether the UCPN-M is serious about party unification. “Though they are talking about party unification, it just looks like propaganda, as they have not done any homework with regards to our six-point condition,” said CPN-Maoist secretary Dev Gurung. In the six-point condition put forth by the CPN-Maoist, the UCPN-M has been asked to decline parliamentary system and to assume the political line, policy and programs of new people centric democracy. Meanwhile, UCPN-M leaders argue that though they are yet to discuss these conditions, they are committed to seek unification in near future. “It is true that we have not formally discussed the six-point condition put forth by the CPN-Maoist, and that we are about to form a forum for discussing all these ideological and political issues,” UCPN-M vice-chairman Narayan Kaji Shrestha said.

Most CA members stressed that the federal parliament should be bicameral (Lower House or House of Representatives and Upper House or National Assembly), the Pradesh Assembly should be unicameral and local bodies should have their councils to govern it. A cross-party taskforce formed by the Unified Communist Party of Nepal-Maoist (UCPN-M), Mohan Baidya-led Communist Party Nepal-Maoist (CPN-Maoist), Mani Thapa-led Revolutionary Communist Party (RCP), Matrika Yadav-led CPN (Maoist) and Pari Thapa-led CPN (Unified) finalised code of conduct and procedures of the alliance on June 25, but failed to agree on the leadership of the alliance. The UCPN-M has claimed for the leadership, while other fringe Maoist parties are pushing for the rotational leadership. Top leaders of the five parties are likely to forge a consensus on the leadership on June 26 (today). “We are planning to make a formal announcement of the alliance by Thursday (June 26) evening. Nations Office of the High Commissioner for Human Rights (UNOHCHR) urged the government to amend the act related to the formation of Truth and Reconciliation Commission (TRC) and the Commission on Enforced Disappearance (CED) to make it fully consistent with Nepal´s obligations under international laws, reports Republica on July 1. UNOHCHR has said the act on transitional justice contains several provisions that do not fully conform to Nepal´s obligations under international laws. The first round of deliberations in the full House of Constituent Assembly (CA) in Kathmandu completed on June 30, reports Ekantipur.com. The top leaders having the responsibility of settling the issues proposed in a new Constitution that are still in contention, said the Constitution drafting process has entered a difficult phase, and only a proactive role from the top leaders of major political parties can take the process ahead. During one and a half months of deliberations on disputed issues, the CA approached each subject on the basis of the progress made by the previous CA. The issue of federalism, judiciary, and forms of governance were the main focus of discussion in the period. The agreed issues have been forwarded to the CA Constitution Drafting Committee, while the disagreed issues have been entrusted to the CA Political Dialogue and Consensus Committee (PDCC) which has been mandated to settle the outstanding issues of the new constitution.
