The court´s decision has come at a time when both the Maoist parties - Unified Communist Party of Nepal-Maoist (UCPN-M) and Communist Party Nepal-Maoist (CPN-Maoist) - have been continuously exerting pressure on the political leadership not to take up insurgency-era cases until the Truth and Reconciliation Commission (TRC) and the Commission on Disappearance are formed. The former rebels are for settling all the war-time cases solely through the two commissions and not under existing justice system.

The 13-member Task Force formed by the Government to prepare new draft bills for a Truth and Reconciliation Commission (TRC) and a Commission on Enforced Disappearance submitted three draft bills for both the transitional mechanisms on April 3, reports Republica. The Task Force, in the draft bills, proposes denying amnesty to those involved in serious cases of human rights violation such as murder, enforced disappearance of people, torture and rape; making consultations with and the consent of the victim parties mandatory while granting amnesty to those involved in other forms of crime; and denying reconciliation without the consent of victim parties. Likewise, the Task Force has made an arrangement for adequate reparation to the victim parties.

Mukunda Sharma, the secretariat spokesperson said "Once a consensus is reached among all political parties, the Constitution promulgating timetable will be endorsed by the CA. The Work Management Committee of the CA had prepared the timetable amid consensus among all political parties. According to the amended calendar, the certified copy of the approved constitution would be signed by each CA member while CA Chairperson would certify the constitution and President puts signature on the copy and announces the promulgation of new constitution by January 22 next year.

Unified Communist Party of Nepal-Maoist (UCPN-M) leaders on April 6 met Prime Minister Sushil Koirala in Kathmandu and expressed concern about the ‘unilateral decision’ to reform the Bills on Truth and Reconciliation Commission (TRC) and Commission on Disappearances and called for downsizing negative list for granting amnesty, reports The Himalayan Times. Former UCPN-M general secretary Bahadur Bogati said that the Government had taken a negative approach and claimed that establishing truth should be the main objective of the commissions. The guilty should seek apology and the victims should forgive them so as to develop harmony in the society. “If we try to punish each other and go for vengeance, society will again plunge into serious conflict,” he warned.

The bill has proposed a commission, which will have a status of a judicial commission with rights akin to a court. The commission will have tenure of two years. The bill, which provisions two separate commissions of inquiry, has incorporated some provisions of the previous ordinance regarding transitional justices, which were struck down by the Supreme Court. The bill gives authority to the commission for reconciliation if either a perpetrator or a victim files for reconciliation. The accused will be recommended for prosecution if a victim's family opts not to reconcile and pardon.

Former Chief Justice Anup Raj Sharma on April 24 said that there is no guarantee of a new constitution in a year as five months have already passed since the election of the CA. Sharma said “There is more possibility of coming up with a constitution in time, but leaders of major parties need to give up their personal and party interests first.” Stating that Nepal is a multi-cultural, multi-lingual and multi-ethnic country, Sharma said the new constitution must address the aspirations of this social structure. Unified Communist Party of Nepal-Maoist (UCPN-M) CA member Baburam Bhattarai was elected the Chairman of the Constitutional-Political Dialogue and Consensus Committee. The Parliament on April 25 has passed the bills on the formation of the Truth and Reconciliation Commission (TRC) and the Commission on Enforced Disappearances (CED) with amendment, reports Nepal News. The term 'disappearance' has been replaced with the term 'enforced disappearance' following the amendment. A number of lawmakers of different political parties took part in clause-wise deliberations on the bills. 18 amendment proposals on 119 points of the bill were presented. The lawmakers taking part in the deliberations said the bill is welcoming as it helps to conclude the peace process and none involved in the heinous crimes be freed from the punishment. They stressed the need of settling the wartime cases of crime through the means of mediation rather than reviving the wounds of conflict.

Issuing a joint press statement, 12 organizations demanded that the Bill on Truth and Reconciliation Commission (TRC) and Commission for Enforced Disappearance (CED) be amended and made "victims-friendly". "Bill on transitional justice mechanisms passed by a majority votes in the Parliament is laudable," read the statement. "However, the provisions for amnesty to the perpetrators of heinous crimes committed during war era have to be amended. Perpetrators have to be booked by the law."

The Constituent Assembly’s (CA) Political Dialogue Committee has decided to review the contentious issues of new constitution by the end of May, reports Nepal News on April 28. A nine-member sub-committee headed by Nepali Congress’s Purna Bahadur Khadka is formed to study the agreements signed by the government with the agitating parties or groups after signing of the peace agreement in 2006 and prepare its report. The Committee has been vested with the crucial task of forging consensus with all political forces inside and outside the House so as to promulgate a new constitution in time.

The bone of contention among the Maoists was about selecting and forming a new District Committee in Kathmandu. Supporters of CPN-Maoist General Secretary Ram Bahadur Thapa and Secretary Netra Bikram Chand clashed with each other, despite efforts by another leader Pampha Bhusal to find a solution. While those loyal to Baburam Bhattarai are holding their function at Dharahari Village Development Committees (VDC), and the supporters of Dahal are organising a parallel conclave at Gedahiguthi VDC of the District. The organizers of both the conclaves have claimed their event to be the official one. "We should rise above individual interest in the party," said lawmaker Ashok Jaiswal, loyal to Prachanda, accusing the Bhattarai faction of derailing the party's main agenda.

He said his party will build an alliance with different ethnicities, aborigins, women, Muslims and other downtrodden communities, which believe in Maoism.
