Unified Communist Party of Nepal-Maoist (UCPN-M) Chairman Pushpa Kamal Dahal floated a proposal to form a broad alliance comprising representations from the like-minded parties to ensure a democratic and timely constitution in the country, reports Republica. He further added that there is no alternative to working together until the new constitution is delivered. According to him the party is heading toward socialism making use of capitalism. While, senor leader Baburam Bhattarai said the past leadership and the modus operandi of the party do not work in the present context, calling for change. The ongoing conference will also amend the paper on construction, production and management endorsed by the party’s Hetauda Convention. The political dossier will be presented in the first phase of the session while the second phase will elect a central working body of the party, a party source said.

There were disputes over the selection of representatives of more than a dozen Districts due to the formation of parallel committees by rival factions. Parallel committees, which were formed due to altercation between Party Chairman Pushpa Kamal Dahal, and senior leaders Baburam Bhattarai and Narayan Kaji Shrestha, claimed legitimacy during the convention.

UCPN-M chairperson Pushpa Kamal Dahal agreed for an election, but he said it has to take place by raising hands, instead of casting secret ballots. However, senior leader Baburam Bhattarai was not happy with the view of Dahal and was preparing to come back to Kathmandu without completing his participation in the convention. Amid uncertainty, the postponed closed session of the convention is likely to take place in the morning of May 6.

The Mohan Baidya-led Communist Party Nepal-Maoist (CPN-Maoist) politburo meeting on May 6 decided to boycott the by-election of the Constituent Assembly scheduled for June 22, reports The Himalayan Times. Revealing the decisions of the politburo meeting, party Chairman Mohan Baidhya said the party had decided to hold its national conference from June 24 to 29 in Kathmandu. The party is also organising programmes raising issues of national interest and people’s livelihood. The party will celebrate students’ day on May 15, hand over a joint memorandum to the government demanding all-sector political conference and a demonstration will be held on May 28 protesting the dissolution of the CA. Baidya said his party was ready to unify with Unified Communist Party of Nepal (UCPN-M) if they were ready to correct the party line adopted by Hetauda convention.

The Unified Communist Party of Nepal-Maoist (UCPN-M)’s national convention that was aimed at strengthening the party concluded in Biratnagar in Morang District on May 6, reports Ekantipur.com. The UCPN-M re-elected party chairperson Pushpa Kamal Dahal to the same post again. Leaders from both Chairman Dahal and senior leader Baburam Bhattarai factions rule out an immediate split in the party. They say the party will possibly remain one until the promulgation of a new constitution but are not sure of its fate thereafter. Leaders say the dispute is ideological as well as organisational and is difficult to settle. “We haven’t yet taken extreme measures such as splitting the party. We are ready to join the CC if Dahal meets our demands,” said Devendra Poudel, a leader close to Bhattarai. With Bhattarai’s revolt, the convention failed to elect the office bearers—vice-chairman, general secretary, secretary, treasurer—except the party chairman, Dahal.

On May 7 Minister for Forests and Soil-Conservation Mahesh Acharya said the Constituent Assembly (CA) would get a full shape within a week, reports Ekantipur.com. Acharya said the nomination process of the remaining 26 CA members has reached the final phase and the nomination would be announced soon. "The Constitution-drafting is the priority of the incumbent government," Acharya said adding that political appointments have been delayed due to the same reason, but they will be made soon following consultations with other political parties. The Nepali people will get the new constitution on time, Acharya added.

Minister Gautam said that the number of armed outfit’s active in the two regions has come down "significantly" and that security agencies are arresting the heads of such armed groups. After the signing of the Comprehensive Peace Agreement in 2006, the number of armed outfit’s operating in Tarai and Hilly Districts grew considerably, prompting the Home Ministry to publicise a list of 120 armed outfit’s operating across the country. "But the number has come down significantly now," Gautam said without specifying it.

The Comprehensive Peace Agreement had envisaged the commissions within six months of its signing in 2006. After two earlier attempts by the Unified Communist Party of Nepal-Maoist (UCPN-M)-led government, the present coalition of the Nepali Congress (NC) and the Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) finally drafted the bill that was passed by a majority in Parliament. The bill has now become an Act, but the provisions of amnesty and reconciliation remain controversial. While the government is adamant on reconciliation, victims’ groups object to amnesty for perpetrators of grave human rights violation. “If we look at the bill from the rights perspective, there might be room for reform, but it’s up to the government,” said President’s legal advisor Surya Dhungel.

The Act states that the government shall appoint a former chief justice as the chairman of a to-be-formed committee which will recommend the names for TRC and CED. This provision contradicts Article 106 (2) of the Interim Constitution, which prohibits appointment of former chief justice or Supreme Court justices in any government position. “We failed to pay proper attention to the provision, as there was already a precedent of government forming a commission led by former Supreme Court judge Prem Sharma to investigate into the murder of justice Rana Bahadur Bam. We are now studying whether to amend the Act to make it compatible with the constitutional provision,” Minister for Law, Justice, Constituent Assembly and Parliamentary Affairs Narahari Acharya said.

CA members from all the parties underlined the need to make judiciary more accountable and transparent but they were divided over whether to have a mechanism to ensure it. Unified Communist Party of Nepal-Maoist (UCPN-M) lawmakers lobbied for adopting a system in which a special parliamentary committee controls overall judiciary, adds Republica. While lawmakers from the former rebel party advocated for bringing the judiciary under the purview of the special parliamentary committee, members from Nepali Congress (NC) strongly opposed it. Party chairman Pushpa Kamal Dahal aka Prachanda informed the party Central Committee (CC) meeting that party leaders decided to hold election after efforts to settle the leadership row at the CC meeting failed to make any headway. “We have decided to hold vote for the vital posts as several leaders are contending for the same posts. Party chairman informed the CC meeting that the election to these vital posts would be held on Saturday (May 24),” party leader Lokendra Bista said. The party has not yet finalized the number of office bearers. Party statute will be endorsed by the CC meeting prior to holding the election. Leaders are divided over the size of the office bearers´ body. Election will be held for a 17-member standing committee and 51-member politburo.

The Nepal government has projected the recently enacted Truth and Reconciliation Commission (TRC) and Commission on Enforced Disappearances (CED) as one of its major achievements during its first 100 days in office, reports Republica on May 26. Minister for Information and Communications Minendra Rijal, government spokesperson, made public a 55-page document that incorporates major achievements of the government since it came to the helm of the power on February 10. “Act on the TRC and CED has been introduced through parliament on the basis of political consensus among major parties. The government has fulfilled its commitments to conclude the peace process. This has created conducive environment for drafting the new constitution,” the minister said at a press conference held at Singha Durbar-based Harkha Gurung hall.

Meanwhile, on May 25, the 151-strong nominated central committee (CC) of the Unified Communist Party of Nepal-Maoist (UCPN-M) elected 50 politburo members, reported The Himalayan Times. According to election committee member Ram Narayan Bidari, among the 116 total votes, 16 were declared invalid and only 100 votes were counted. He said all 151 central committee members were voters as well as candidates for the 50-member politburo. Party senior leader Post Bahadur Bogati got the highest number of votes (100) and Narayankaji Shrestha got the second highest with 99 votes. As per the election process, election for 16 standing committee members, two vice-chairmen, one general secretary, three secretaries and one treasurer will be held tomorrow morning. All the 151 central committee members are eligible to vote, but only the elected 50 politburo members will automatically be the candidates for the 16-member standing committee. Only the elected 16 standing committee members will automatically contest for the seven positions of central office bearers.

"Unity is possible only with sacrifice from all the sides concerned," Dahal said urging all to move ahead by learning from the past mistakes and shortcomings. Speaking at the same program, Communist Party Nepal-Maoist (CPN-Maoist) Chief Mohan Baidya said unity process should move ahead not based on emotions but on need. "Unity is possible only on the basis of ideology and principle," he said. According to the election committee, leader Posta Bahadur Bogati has been elected in the Standing Committee with the maximum votes (103 out of 116) while Baburam Bhattarai with 99 votes, Barshaman Pun with 94 votes and Janardan Sharma with 92 votes. However, Spokesman Dina Nath Sharma and leader Lila Mani Pokhrel, who had been on the committee since 2009, lost the election. Eleven are from the Chairman Pushpa Kamal Dahal aka Prachanda faction, three from Bhattarai faction and two from the Narayan Kaji Shrestha faction.

On May 29, the Constituent Assembly (CA) began deliberations on the modality of state restructuring and the distribution of state powers--two of the most contentious issues--to be defined in the new constitution, reports Ekantipur.com. Two reports on state restructuring prepared by the Committee to Study and Determine Constitutional Records and the High-level State Restructuring Commission provide agenda for discussion among the CA members. The committee is entrusted to prepare reports on the basis of the progress made by the previous CA while the commission was an experts' panel formed in 2011 to suggest ways to federate the country. Submitting both the documents to the CA, Committee Chairperson Bishnu Poudel requested Assembly members to provide their suggestions and comments on federalism. There are several disputed issues related to federalism such as the number, name and demarcation of provinces which led to the dissolution of the first CA without delivering a constitution. Federalism continues to be a challenge in the parties' plan to draft a constitution within a year. Commenting on the reports, Prime Minister (PM) Sushil Koirala said that parties would give priority to resolving issues related to federalism in consensus. Unified Communist Party of Nepal-Maoist (UCPN-M) Chairman Pushpa Kamal Dahal aka Prachanda claimed that it would be very unfortunate for the country if the Nepali Congress (NC) and other ruling parties insisted on deciding the contentious issues in the new constitution through voting in the Constituent Assembly (CA), reports Republica. Prachanda said that these contentious issues in constitution-making should be settled through consensus among the political forces and the new statute should be produced mainly on the basis of the historic 12-point agreement signed between the then Seven-Party Alliance and the erstwhile Communist Party Nepal-Maoist (CPN-Maoist), the Comprehensive Peace Agreement-2006 and the Interim Constitution-2007. "If the spirit of these historic political accords, including the 12-point agreement, the CPA and the Interim Constitution, is trampled upon and the contentious issues decided through voting on the ground that this is mandated by CA procedures, it will be a biggest blunder for the country," Prachanda said while addressing the CA meeting on May 29. Prachanda said that the NC and Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) leaders started insisting on deciding the major disputes through voting only after they emerged as the two largest parties through the second CA election. "I had proposed in the previous CA to decide such disputes through voting. But at the time it was rejected, arguing that there would be blood on the floor if this was done," said Prachanda. "But now the leaders of the same parties have been pushing for voting. Such an approach will push the country into crisis."
