Chairman KP Oli of the ruling Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) formally proposed the Madhesh-based parties affiliated to the ‘Samyukta Loktantrik Madhesi Morcha’ to join the government during a meeting at the CPN-UML Parliamentary Party Office in Kathmandu on December 1, reports Ekantipur.com. The alliance of Madhesh-based reiterated its previous stance of not joining the government unless a new constitution was formed. Chairman of Sadvawana Party, Rajendra Mahato, turned down Chairman KP Oli’s proposal saying the parties aligned to the Madhesi front will not join the government. “We instantly rejected the UML’s proposal of national unity government,” he said, adding, “We will not even utter the letter ‘G’ of government until a constitution is drafted.”

On December 1, organising a press conference in Kathmandu, Netra Bikram Chand formally announced formation of the Communist Party of Nepal-Maoist (CPN-M), reports The Himalayan Times. Chand also announced to organise first national convention of the new party from January 7-10, 2015. The new party includes former leaders of Communist Party of Nepal-Maoist (CPN-Maoist), including Khadga Bahadur Bishwokarma, Ishwari Dahal, Dharmendra Banstola, Tilak Pariyar and Santosh Budha. Further, Chand said the party has no plans to launch an armed revolt, adds Myrepublica. Chand, however, clarified that his party is ready to retaliate if the government tries to suppress their struggle. “We are ready to wage war, sit for talks or even shake hands to institutionalize the achievements of the decade long people´s war,” Chand said. The new party has also asked the government to recognize it as a parallel force. “The major theme of the peace process was coexistence and cooperation. Thus the state should be ready to revamp the army, judiciary and administration,” reads the statement. Chand threatened to revive insurgency-era parallel government if their demands are not met.

On December 1, various conflict victim organisations accused the government of ignoring those who were rendered disabled by the decade-long conflict, and also warned of launching stern protest if their demands were not addressed immediately, reports The Himalayan Times. The conflict victims also submitted a memorandum to Ministry of Peace and Reconstruction, Kathmandu, calling for preparing data of people who were rendered disabled during the conflict. Their demands include ensuring participation of the victims in all justice process and long-term plans and policies for those living with disability among others. Free treatment, education and other services are some of their other demands. They have also demanded rehabilitation for the conflict victims and disabled-friendly environment among others.

On December 2, Constitutional Political Dialogue and Consensus Committee (CPDCC) Chairman Baburam Bhattarai said the constitution making process fell into a quandary owing to failure on part of the major political parties to reach an agreement on contentious issues, reports The Himalayan Times. After receiving a memorandum for a timely delivery of the new constitution from the Federation of Nepali Journalists (FNJ) Lalitpur Chapter in Kathmandu at his residence, Bhattarai underlined the problem created by the widening polarization among the parties. He underscored the constitution making as a subject which could not entertain majority and minority voting process while stressing on agreement as the only resolution for the rising dispute. CPDCC Chair Bhattarai said the constitution must create a sense of ownership among all when it is promulgated on 22 January.

A meeting of the Constitutional Political Dialogue and Consensus Committee (CPDCC) held on December 3, after a long period of suspension, has handed committee Chairman Dr Baburam Bhattarai the responsibility to present the committee report, on contentious issues of the constitution, to the Constituent Assembly (CA), reports Nepal News. CPDCC was unable to present its due-report to the CA in time due to a drawn-out dispute among the parties on four major contents of the constitution. The committee's deadline to submit the report was extended four times, to facilitate the CPDCC to gather consensus on the disputed issues. Discussion at the CPDCC was suspended since November 2, 2014, due to conflicting issues among parties to meet consensus. Bhattarai was entrusted this responsibility with full faith that he'd deliver his task, addressing the sentiments of all.

Majority of Central Committee (CC) members of the Mohan Baidya-led CPN-Maoist in the far-western districts have joined the party´s splinter Communist Party of Nepal-Maoist (CPN-M) formed on December 1, under the leadership of Netra Bikram Chand, reports Myrepublica on December 5. CC member Om Prakash Pun, who is also the in-charge of Seti and Mahakali zones, and joint-in-charge of the same zone, Sharad Singh Bhandari, joined the Chand-led Maoist party recently. Pun claimed that most of the CC members and District leaders from Seti and Mahakali zones have joined the new party. "Eight of the total 10 central committee members from Seti and Mahakali have joined our party. Discussions with the other two leaders are underway," he said. CC members Hemraj Bhattarai Shrawan, Bhagat Baduwal and Rupa Chaudhary of Kailali and assistant secretary Mahesh Baduwal of the same District have quit the Baidya-led party. Similarly, other CC members from this region including Devidutta Pandey from Kanchanpur, R P Lamichhane of Achham and Shankar Bahadur Khadka of Bajhang District have joined the new organization.

The disputed issues of the constitution writing process are once again likely to be sent back to the Constitutional-Political Dialogue and Consensus Committee (CPDCC) after theoretical deliberations in the full House CA, reports Ekantipur.com on December 5. Sources said that there has been an agreement among the top leaders from the major political parties to send the disputed issues back to the CPDCC, despite opposition from some second-rung leaders from the ruling parties. "When it comes to constitution writing, we are not in a void. We have a functioning interim constitution. Though the Constitutional Political Dialogue and Consensus Committee (CPDCC) of the CA forwarded the report containing the list of disputes to the CA plenary on December 5, major political parties are still sharply divided over what to do next after the deliberations. CA Chairman Subas Nembang held separate meetings with Prime Minister (PM) Sushil Koirala, CPN-UML Chairman KP Sharma Oli and Unified Communist Party of Nepal-Maoist (UCPN-M) Chairman Pushpa Kamal Dahal aka Prachanda on December 7, so that parties agree on a way out before the CA concludes deliberations on disputed issues in the CA full House. Leaders from Nepali Congress (NC) and Communist Party of Nepal-Unified Marxist Leninist (CPN-UML), among some other political parties, have fervently opposed the proposal to send the disputes back to the CPDCC. They have proposed to seek any solution from within the CA´s full House or decide the disputes through majority votes if consensus eludes. But Unified Communist Party of Nepal-Maoist (UCPN-M) and Madhes-based parties have been insisting that the CPDCC is the only body that is entrusted with the task of settling the disputes and that the disputes should be sent back to the committee for one more time. Union Ministry of Home Affairs (UMHA) is working on a proposal to double the strength of the intelligence wing of Sashastra Seema Bal (SSB) and give it state-of-the-art technical intelligence tools, to effectively counter terror activities mounted by Pakistan from Nepal, The Times of India reports on December 18. SSB, which guards the porous Nepal and Bhutan borders with India, is the only paramilitary unit to have a full fledged intelligence wing. Sources said the idea is to shore up SSB's capabilities to effectively guard entry of Inter-Services Intelligence (ISI) backed terrorists and monitor the activity of ISI in fast mushrooming madrasas (Islamic Seminary) on the border. It would also help the force counter activities of north-east insurgents on the Bhutan border. SSB Director General B D Sharma said, "Intelligence is our biggest weapon when it comes to securing the open and porous borders with Nepal and Bhutan. These are sensitive borders. We have sent to the government a proposal in this regard as we seek to revamp our snooping infrastructure." He added, "We want to excel in intelligence-related works because at these two unfenced frontiers it is only 'good information' that can help secure the area from illegal elements".

Nepal Bar Association (NBA), the umbrella organization of lawyers across the country, has concluded that the recently promulgated Truth and Reconciliation Commission (TRC), Commission for Investigation of Disappeared Persons Formation Act 2014 needs amendment, reports Myrepublica. An expert committee formed by NBA under the leadership of former Justice Pawan Kumar Ojha had conducted a study on whether the act was in line with international standards and the Supreme Court verdicts in cases related to transitional justice. NBA launched the report amidst a program in the capital, Kathmandu, on December 19. “Truth, justice, reparation and assurance of no recurrence of human rights violations are the four pillars of transitional justice. They should not be accepted as alternatives to each other but complementary to each other,” reads the synopsis of the report. “The Comprehensive Peace Accord has also accepted it but the act has not maintained the balance between the four pillars,” it reads further. The expert panel has concluded that the act overlooks the verdicts of Supreme Court and commitments made at the international level.

A meeting of the UCPN-M led Federal Republican Front (FRF) held at Singha Durbar on December 19, issued a warning that the front would try to hold discussion with other parties for a few days, failing which they would start the protest, reports Nepal News. The Friday meeting called for a meeting of 19-parties affiliated to the front on December 20, and a meeting of 22-parties on December 21. According to Sadbhawana party co-chair Laxmanlal Karna, it was also decided that parties representing indigenous people and Madheshi people would hold separate protests and UCPN-M would eventually lead the 'movement' incorporating both the sides. Speaking at a debate organized by the Federation of the Nepalese Chamber of Commerce and Industry (FNCCI) in Kathmandu on December 22, the opposition parties even warned that failure to promulgate new statute through consensus will invite fresh conflict in Nepal. “We are ready to move ahead with consensus to bring new statute. But how long should we wait as our efforts in the Constitutional Political Dialogue and Consensus Committee (CPDCC) have so far failed to yield any result?” asked Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) Vice Chairman Bhim Rawal. Rawal argued it would be tantamount to undermining the mandate given to the CA by the Nepali people if this CA also failed to produce a new constitution under the pretext of consensus. Nepali Congress (NC) Vice President Ram Chandra Paudel alleged that opposition parties were interpreting consensus to suit their own interests. “Opposition parties have to either be flexible to reach consensus or they should agree on a process [to promulgate new statute]. It is not good to block both consensus and voting processes in the CA,” he said. Paudel said although the Unified Communist Party of Nepal-Maoist (UCPN-M) leaders walked out of the meeting on December 20, the ruling parties will continue negotiations with the opposition parties as last-ditch efforts to bring the new statute in consensus. “We are committed to addressing concerns of all groups. The new proposal floated by UCPN-M, which also leads the alliance of opposition parties, is expected to help end the ongoing deadlock over major contentions issues in constitution writing. The Maoist proposal seeks mixed ethnic identity as the major basis for delineation of provinces. In the past, the party had been pressing for single ethnic identity as a basis for delineation of provinces. The party has come up with the idea of merging two adjacent areas with separate identities. The party has also reiterated that if parties agree on a six-province model, the nomenclature of the provinces be finalized by the Constituent Assembly (CA).
