She said “Extradition treaty is a long pending issue important for both the neighbouring countries as many top-listed Bangladeshi criminals were said to have crossed the border while some Indian separatists like the United Liberation Front of Assam (ULFA) leader Anup Chetia intruded into Bangladesh”. Home Minister Muhiuddin Khan Alamgir on January 22 said the Government has information on the whereabouts of former Jamaat-e-Islami (JeI) leader Abul Kalam Azad, also known as Bachchu Razakar, the first war crimes accused convicted by the International Crimes Tribunal-2 (ICT-2), reports The Independent. Alamgir said, “Fugitive Bachchu Razakar is staying in a certain country. He will be brought back through diplomatic communications with that country.” The Home Minister, however, did not specifically name any country where according to him Azad is hiding. On January 21, the ICT-2 in its maiden verdict handed down death penalty to Azad who was tried in absentia for his involvement in crimes against humanity committed during the War of Liberation in 1971.

At the joint press conference in Dhaka on January 28, the Bangladesh Home Minister Muhiuddin Khan Alamgir said Bangladesh would not be able to send back United Liberation Front of Assam (ULFA) general secretary Anup Chetia under the treaty as he had prayed for political asylum in the Supreme Court, reports The Assam Tribune. He further said Chetia, who was booked under criminal charges, has completed his prison term and has since applied for political asylum in the country. “This extradition treaty specifically provides for handing over of criminals, but political asylum seekers are a different category,” he said. The Supreme Court will first have to dispose of his prayer for political asylum, he said. “After that, we will decide whether to treat this person or any other persons under this extradition treaty or in some other way,” he said.

The agreement was signed at the 4th meeting of the Home Ministers of Bangladesh and India. In the joint statement the two Home Ministers expressed the ‘belief that the Extradition Treaty would help increase cooperation among law enforcing agencies of the two countries and curb criminal activities’. The new treaty would allow transfer of convicted or under-trial criminals but it would not be applicable for those accused in ‘political crimes’ or other criminal offences punishable with imprisonment for less than one year.

Briefing the media, DG, BSF, Subhash Joshi and DG of BGB, Major General Aziz Ahmed said that forces were on alert, denying reports of rise in infiltration along the highly porous international border. DG BSF Subhash Joshi said about 27 percent of India's border with Bangladesh could not be fenced due to riverine terrain and other difficult geographical features. He said fencing work was sanctioned for 3,436 km of the 4,096-km border with Bangladesh and 2,525 km had been fenced. He was placing arguments before the High Court (HC) during a hearing on a writ petition filed by Rezaul Haque Chandpuri, secretary general of Bangladesh Tariqat Federation and 24 others challenging the legality of JeI’s registration as a political party. Hasina said, “We’ve already gone through HeI demands. Many of these have already been implemented while some are in the process. The HeI’s first demand is a reinstatement of the phrase “Absolute trust and faith in the Almighty Allah” in the constitution as one of the fundamental principles of state policy. Responding to this, Hasina noted the constitution begins with Bismillahir Rahmanir Rahim [In the Name of Allah, the Compassionate, and the Merciful]. “This is a verse of the Holy Quran. No other sentence could be more appropriate,” she said, adding it demonstrates faith in Allah. The PM also mentioned that Islam is now the state religion. Meanwhile, HeI Nayeb-e-Amir (Vice-President) Nur Hossain Kasemi at a briefing at HeI’s office at Dhaka city on May 3, said their cadres (Tauhidi Janata) will be deployed at six entry points of the city on May 5 to lay siege to Dhaka peacefully, reports New Age. Prosecutor Tureen Afroz on July 19 said: “We are working on the issue after the verdict in the Quader Molla case. We all know about the role of this political party during the Liberation War. So they have no right to work as political party in Bangladesh.” Hannan Khan, chief coordinator of the tribunal’s investigation agency, said: “Our officers are working with the prosecution team. We have got many documents as proof of anti-liberation activities of Jamaat. They have no right to conduct political activity in an independent Bangladesh.” On February 17, the Government amended the ICT Act 1973, incorporating the provision to try political parties and organisations, alongside individuals, for the war crimes committed in 1971. A foreign ministry spokesman told, "We know one of them (Mueenuddin) is living in Britain and the other is in the United States. We will do all we can to return them home to be exposed to justice." The International Crimes Tribunal (ICT-2) on June 24 indicted Mueenuddin and Khan on 11 counts of 'crimes against humanity' committed during the war. According to the prosecution evidence, Mueenuddin was the Al-Badr operation in-charge while Ashrafuzzaman Khan was the chief executor of the militia force which is accused of killing top intellectuals, doctors, scholars and journalists during the war.

The three Districts are Chapainwababganj, Satkhira and Jessore. Among the three Districts, most firearms are being smuggled into the country through different border points of Jessore. According to DMP, a total of 59 foreign-made pistols and 19 revolvers were recovered by Police from different parts of Dhaka city between January and July this year. The investigators suspect that some aides to the BNP leader masterminded the leak to undermine the tribunal as well as its verdict and bribed the employees — office assistant Fakhrul Hossain and cleaner Nayon Ali — to smuggle out the document. They said that Mehedi Hasan, assistant to SQ Chowdhury’s counsel Fakhrul Islam, might have emailed the draft to the UK from where it was posted on websites. Joint Commissioner Monirul Islam of Dhaka Metropolitan Police said that the cleaner had confessed to the crime. Fakhrul Hossain had asked Nayon to give Mehedi “some documents” related to SQ Chowdhury’s trial from the tribunal’s computers. Nayon handed over Mehedi the soft copies of 165-page document in phases using pen drives. He at one stage had refused to do the task. The UN human rights chief had written to Prime Minister Sheikh Hasina to halt the execution. She said, Molla was convicted of war crimes ‘in a trial that did not meet international standards for imposition of the death penalty’. Molla was set to be executed at 12:01 am on December 11 (today), but the last-minute halt order came when his lawyers moved the Supreme Court Chamber Judge, Justice Syed Mahmud Hossain. United States (US) Secretary of State John Kerry on December 11 said the execution of JeI leader Abdul Quader Mollah might lead to events, which could derail the next parliamentary election in Bangladesh, reports The Daily Star. Talking to Prime Minister Sheikh Hasina over the phone, he expressed concern over the violence during recent hartals and blockades. The US Secretary of State wanted to know about the trial process of the war criminals. The PM told Kerry that some trials have been completed following due legal procedures and the Government would follow the same in implementing the verdicts of the International Crimes Tribunal (ICT), including the one against Quader Mollah. The US official welcomed the Government’s position.

Bangladesh Bar Council, a statutory body regulating the lawyers, on December 30 claimed that democracy will get buried if the national election is held on January 5, reports UNBconnect. Council vice-chairman Khandkar Mahbub Hossain, flanked by its member and Supreme Court Bar Association (SCBA) president AJ Mohammad Ali, came up with the view at a press conference at its office in Dhaka city. Khandkar Mahbub, also an adviser to the BNP chairperson, said the Bar Council does not support any political party, but it asks both the parties to restore democracy through a consensus. He said even the civil society members and others have been pressing for scrapping the Jan 5 polls. Backing the programme announced by the BNP chairperson, he said Begum Zia had called upon people from all walks of life to join the ‘March for Democracy’, but the Government in order to resist it made the whole country paralyzed, showing disregard to democratic norms.

Foreign Minister AH Mahmood Ali in a briefing attended by the ambassadors, high commissioners and Controller of Defence Accounts (CDAs) of the United Kingdom (UK), Sweden, Netherlands, Germany, France, Italy, Spain and Denmark on December 30 told that a responsible Government cannot relinquish its responsibilities and allow the fundamental values of the statehood to be undermined by the indiscriminate terrorist acts perpetrated by the BNP and JeI-ICS, reports New Age. Mahmood told the European Union (EU) diplomats that though the opposition was agitating in the name of democracy, they had never engaged in any serious preparation for elections at the ground level, and thus was not ready to participate in the upcoming elections. He said it proved that the BNP and its 18-Party alliance never negotiated in good faith for participating in the elections as they were always insisting on certain pre-conditions.
