The delay in clearing legal hurdles and the refusal of the opposition parties to be part of the fresh Constituent Assembly elections have minimised chances of the polls being held on November 22, Election Commission (EC) officials said on July 10. EC officials came to this conclusion after separate meetings with Prime Minister Baburam Bhattarai and his ministers and leaders of 28 opposition parties in the past two days. However, the EC is yet to announce this fact in public as it is waiting for the July 22 deadline it has given to the Government to amend electoral laws and the Interim Constitution to hold free and fair polls.

the Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) instructed its leaders from the centre to the local level to focus on preparations for upcoming fresh polls. Issuing an intra-party circular to cadres across the country and aboard, CPN-UML has asked all eligible voters to be registered with the new digital voter registration campaign launched by the Election Commission. CPN-UML leaders said the circular was issued after concluding that the parties had no alternative to fresh polls given the dissolution of the Constituent Assembly (CA) without a new constitution. The circular stated that CPN-UML is in favour of parliamentary elections with the mandate of completing the remaining tasks of a new constitution. “Fresh elections are our official line to complete constitution writing,” said CPN-UML Central Committee member Karna Bahadur Thapa. Rejecting the options of reviving the CA, the party, in the second week of July, had opted for a fresh mandate to complete the remaining tasks of the new constitution. The CPN-UML’s instruction comes just as former lawmakers have been pressurising the party leadership to not abandon the option of reviving the CA, arguing that even fresh elections aren’t possible without the CA. The government’s earlier plan to hold fresh CA election on November 22 was postponed due to its failure to make timely amendments to electoral laws and the Interim Constitution. However, CPN-UML believes that fresh elections will be possible once a national consensus government is formed and the President amends the Interim Constitution at the request of political parties, using the provision to remove difficulties. The Interim Constitution authorises the President to remove any constitutional difficulties at the request of the Cabinet.

Acting Chief Election Commissioner Nilkantha Uprety said that parties should arrive at a consensus before November 30 to address the legal and constitutional difficulties in holding the polls. A political decision should stipulate the type and process of the election, members to be represented in the assembly and allocate funds for the task.

The Government on November 20 announced a budget of NPR 351.93 billion, ending long-running confusion over fiscal operations for the remaining eight months of fiscal year 2012/13, reports myrepublica.com. But it drew widespread criticism from the 19 opposition parties, including Nepali Congress (NC) and Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) as it was taken without broader political consensus. The Government said there was no need to oppose the move because the budget is devoid of any new programs. The new budget has set aside around NPR 3 billion for holding fresh elections to the Constituent Assembly (CA) and around NPR 3 billion for completing the integration of People’s Liberation Army (PLA) combatants. According to Nepal News, the Government announced fresh CA elections in the month of Baisakh (April-May) next year, and submitted a budget ordinance to the President Dr. Ram Baran Yadav for approval. A Cabinet meeting had taken the decision to this effect. However the date of the elections has not been determined yet and will be fixed after consultation with political parties.

"We, the agitating political parties, have concluded that the decision of the Government, which has completely lost legitimacy as it failed to conduct the election it had declared earlier, has pushed the country towards more political uncertainty, disagreements and a constitutional crisis," a joint statement issued by the opposition parties said.
