The chairman of United Jihad Council (UJC) and ‘supreme commander’ of Hizbul Mujahideen, Syed Salahuddin on January 5 said those calling for settlement of the Kashmir issue through peaceful means were in fact deceiving the innocent Kashmiris, adding that an armed struggle was the only way to resolve the dispute, reports Dawn. Salahuddin said that experience of the past 65 years should convince anyone that only a strong and target-oriented armed struggle across Indian-held Kashmir could win freedom. Addressing a press conference, he said that the Kashmiri people, leadership and the State of Pakistan should prepare themselves for it. Otherwise freedom will remain a distant dream. The press conference was held at the end of a procession staged by the supporters of Hizbul Mujahideen to mark the ‘right to self-determination day’. The UJC leader said he supported political movement, but was opposed to what he called a fragmented and fractured political struggle. According to the report, he claimed that about 150 rounds of talks with India had failed to produce anything.

National Security Advisor (NSA) Shivshanker Menon on January 10 asserted there has been an increase in the incidents of ceasefire violations and in infiltration attempts, reports Times of India. "There has been an increase in ceasefire violations. There been an increase in infiltration attempts, not only in the last few months. In 2012 there was an increase overall over 2011. That is a fact and that is something we are dealing with, both ourselves and with the Pakistani authorities," he said. Reports suggest that the ceasefire was violated by Pakistan as many as 117 times in 2012. The number stood at just 61 in 2011. In 2010 there were 57 violations. In the first 10 days of this year, there have already been at least four violations. The Army assessment is that while 2011 witnessed only 52 "successful" infiltrations, the number jumped to 121 in 2012.

Union Minister of Home Affairs (UMHA) Sushil Kumar Shinde on January 10 said Lashkar-e-Toiba (LeT) chief Hafiz Mohammad Saeed had visited the border areas in Pakistan occupied Kashmir (PoK) a few days before the killing of two Indian soldiers, reports Daily Excelsior. He said the information about the movement of Saeed in PoK was received by Intelligence agencies about four to five days back and the Government was trying to get details of his visit. "It has been our information that in PoK area, Hafiz Saeed had entered and talked to some people," he said. Asked whether militants were involved in carrying out the raid on Indian Army soldiers, Shinde said, "I do not have that information. But we are very keen to get such information. We are on the line".

Talking to Headlines Today, Deputy Inspector General of Police (DIG, Poonch and Rajouri Range) Danish Rana on January 11 said that the heightened tension in the bordering areas of Poonch District was because most of the other parts of the LoC were covered by snow and Pakistan was trying to push infiltrators into Indian territory through this stretch. He said violation of ceasefire by Pakistani Army along the LoC was on for about two months in the area because they want to push more and more terrorists to the Indian side. Rana said almost 90 per cent of the 700 kilometers long LoC was covered with snow in the peak of winter and the only possible way to push militants into India was through Poonch as snow level has been quite low in this part. The DIG also said that there were some patches in Mendhar Sector of Poonch District where fencing was not done along the LoC due to water bodies in the area and difficult terrain. So this area has been most suitable for infiltration.

General Bikram Singh, the Chief of Army Staffs, on January 14 opposed any dilution of the Armed Forces Special Powers Act (AFSPA) in Jammu and Kashmir, saying that any decision to revoke it from any part should be taken only after getting inputs from security agencies and stakeholders, reports Daily Excelsior. He said, "I am of the view that we should not dilute provisions of the AFSPA. Terrorists are afraid of this because this gives us powers to carry out operations against inimical elements and enemies of the state who defy the rule of law.” Calling AFSPA an enabling act, General Singh further observed, AFSPA "gives us additional powers to operate in an environment which is marked by very high degree of uncertainty and complexity and an asymmetric environment where you cannot differentiate between a friend and a foe as the terrorist merges with the backdrop and hides amongst the locals." He also disfavoured demilitarisation of Siachen Glacier area against the backdrop of the trust deficit existing with Pakistan.

The Brigade Commander level flag meeting between India and Pakistan at Chakan-Da-Bagh crossing point in Poonch District ended without any positive result as both sides stick to their positions. However, India issued a stern warning to Pakistan that it reserved the right to retaliate at appropriate time and place against the provocative act of the troops from across the Line of Control (LoC). An official handout issued by PRO Northern Command Headquarters, Lieutenant Colonel Rajesh Kalia reads, “It was conveyed to the Pakistan delegation that such a dastardly and cowardly act is totally unacceptable and is a premeditated attempt to undermine the Ceasefire Agreement (CFA) of 2003, which can lead to further escalation. It was conveyed in no uncertain terms that repetition of such acts will not be tolerated and the Indian Army reserved the right to retaliate at the place and time of our own choosing in case they recur”.

We would continue our endeavor in this regard", he added. "Addressing of political issues and finding out solution to these would be achieved only through dialogue process between the two countries. Colonel (retired) Ashfaq Hussain, a former aide to the retired General and former President of Pakistan, Pervez Musharraf, revealed that weeks before hostilities erupted between Indian and Pakistani troops in the Kargil sector (Kargil District of Jammu and Kashmir) in 1999, General Pervez Musharraf crossed the Line of Control (LoC) in a helicopter and spent a night at a location 11 km inside Indian territory, reports Kashmir Times on February 1. Accompanied by Brigadier Masood Aslam, then commander of 80 Brigade, Musharraf spent the night at a spot called Zikria Mustaqar, where Pakistani troops commanded by Colonel Amjad Shabbir were present. Ashfaq Hussain first made the revelation in his book 'Witness to Blunder: Kargil Story Unfolds' published in late 2008. He further said Pakistani troops first intruded into the Indian side of the LoC on December 18, 1998. Besides troops from the Northern Light Infantry, soldiers from 31 Azad Kashmir Regiment, 24 Sindh Regiment, Frontier Force Regiment and artillery units participated in the Kargil operation. Hussain also dismissed Musharrafs’ claim that the operation was a success. He said, "It was a success only till Pakistani forces came face to face with the enemy. In winter, both sides abandoned their positions under a recognised procedure. Our troops crossed the LoC at a time when the enemy was not present. Our troops were not even informed why they were being sent across the LoC." Hussain also dismissed Musharrafs’ recent assertion that Pakistan had lost only 270 troopers during the Kargil conflict. "According to my research, there were over 1,000 casualties on the Pakistani side. The official data (on casualties) was hidden and cannot be accessed," Hussain said. He also said he believed Musharraf overthrew the democratically elected Nawaz Sharif's government because he wanted to escape a probe into the Kargil episode.

He said majority of them are camping in the hilly areas of District Poonch, Rajouri, Mahore, Ramban, Doda and Kishtwar but most of them have almost stopped their activities for some time now. When asked about the strength of foreign militants, the IG said foreign and local militants are in the ratio of 60: 40 this time in his area of operation (Jammu region). He said the local people hesitate these days even to provide shelter and food to the terrorists. In plain areas of Jammu, their strength is negligible and most of them are operating in the hilly areas. He said due to increasing domination of Security Forces and reducing level of infiltration from across the borders, the strength of militants operating on this side, has considerably gone down in last few years. "The terrorists are lacking local support and changing mindset of the local youth has contributed a lot towards reduction in the number of ultras," he added. He further informed that nearly 15 CRPF Battalions were presently deployed in Jammu zone while in Kashmir, their number is around 52. He said the CRPF has totally taken over from Border Security Force (BSF) deployed in Internal Security duty in Jammu and Kashmir.

Addressing to the joint session of State Legislature, he said, "Terror-related incidents have decreased from 188 in 2011 to 118 in 2012, marking a decline of 73 percent." He further added, "Similarly, 31 civilian deaths in 2011 came down to 15 in 2012 and against 33 security personnel who lost their lives in 2011, only 14 were killed in 2012." In a written reply to a question in Jammu and Kashmir (J&K) Legislative Assembly on March 11 the government said that 3974 Kashmiri militants are still living in Pakistan and Pakistan occupied Kashmir (PoK), reports Daily Excelsior. 241 ex-militants have returned but none through the identified routes under the policy and procedure for return of ex-militants notified by the State Government Vide Order No. Home-1376(ISA) of 2010 dated November 23, 2010, which means that the benefits under the Return and Rehabilitation Policy of the Government cannot be extended to these ex-militants. As reported earlier, four routes prescribed under the Policy included Rawlakote (PoK)-Poonch (Poonch District) in Jammu region, Muzaffarabad (Muzaffarabad District in PoK)-Uri (Baramulla District) in Kashmir region, Wagah border in Amritsar District and Indira Gandhi International (IGI) Airport in New Delhi (South West Delhi District). The government further said that a total of 1089 applications were received on behalf of the ex-militants, willing to return under the aforementioned policy out of which 191 have been recommended. The rest of the applications are being scrutinized and verified.

The Union Ministry of Home Affairs (MHA) has asked the Jammu and Kashmir (J&K) Police to run background checks before ex-militants settled in Pakistan occupied Kashmir (PoK) are allowed to return to the state via Nepal border, Kashmir Times reported on May 13. Union Home Secretary R K Singh, in an interaction said, "We have received comments from all stakeholders and the new policy will be in place soon. J&K Police will escort these people to the state and will also carry out background checks." This is part of the joint effort by the MHA and the J&K Police to draft a standard operating procedure for those coming via Nepal. The route had created controversy after the Delhi Police arrested a former Hizb-ul-Mujahideen (HM) militant, Liyaqat Ali Shah, from Sanauli at Nepal border on March 22. The Police had alleged that he was on his way to Delhi for a fidayeen (suicide) strike ahead of Holi. The J&K Police, however, claimed that he was coming back to surrender and that his wife had already applied to authorities for his return. Union Minister for State for Home Affairs, R P N Singh, had told the Lok Sabha quoting J&K Police report that between 2010 and April 10, 2013, about 262 ex-militants have returned via Nepal as part of the state government's surrender and rehabilitation policy. He said the State Government has received 1,094 applications. None of those who have returned to India came via the designated routes such as Poonch, Uri, Wagah and IGI Airport, New Delhi.

Every facility is with police and they have been asked to avail all such facilities,” Prasad said, adding that police is fully equipped to counter attacks. The DGP said there seems a “changing trend” in attacks and that is being studied. “The matter was discussed in Core Group meeting and every security agency has been asked to study the trend. He said, “We have also found that militants killed in recent encounters were qualified and most of them were products of Kashmir University and Islamic University.” The CM said the least qualified of them was a 12th standard student. 20-year old Saifullah Ahangar, killed in an encounter in May 24 in Pulwama District had a diploma in civil engineering. Sajad Yousuf, a Hizb-ul-Mujahideen (HM) militant from Pulwama District had a post-graduate degree in Islamic Studies. Others included Omar Ahsan (22) who was undergoing post-graduation in Physics and Lashkar-e-Toiba (LeT) militants Muzamil Amin and Hilal Ahmad Rather, both of whom were qualified in Islamic teachings. He said, “There is no such phenomenon that educated people are suddenly taking up arms or that there is a great deal of motivation for educated people to join militancy. This is an aberration in a few cases they were educated. All these militants killed recently are old identified commanders and there is nothing new in it.” He further said, “In fact in grenade throwing incidents in Anantnag District the profile of arrested youth indicates that most of them were extremely poor with very low levels of education and had joined militancy only to secure their livelihood. However, the enquiries into the matter are continuing and details of the individual militants deceased would be made available in due course.” Additionally, he observed that there were around 200 militants present in the State as per Police assessment. “On the basis of our assessment the number of militants is roughly around 160 to 180 in the valley (Kashmir region) and about 20 to 25 in Jammu region,” he said and added that 10 to 12 of the militants are important commanders who are the backbone of militancy.

He also stated that the Security Forces (SFs) have never misused it. He said, "The Army might have got increased powers under the Act (AFSPA), but the ethos of the Army and the drill which we go through train us to have restraint on ourselves. So, to say AFSPA has been misused would not be right. The Army has always used AFSPA in the right way." Observing that there was a possibility that militants might use this revocation to their advantage, he stated, "We need to consolidate our position. The peace which you see is very fragile. It might get disrupted with a couple of triggers from the militants. So, we need to control the situation." Additionally, the GOC cautioned that militants might attack Hindu pilgrimage in the State. He said, "As far Amarnath (Hindu shrine) pilgrimage and tourism are concerned, I would say in the last two years, we witnessed very fruitful seasons.” However, "As per intelligence reports, their (militant) intention is to disrupt both." Further, Lieutenant General Parnaik claimed that suspected militants sneaked into this side at Sawjian area in Poonch District along the Line of Control (LoC) on May 14, and threatened Border Security Force’s (BSF) porters. The BSF had hired porters to carry supplies and they were walking towards the post when some persons intercepted them and asked where they were headed. Chief Minister Omar Abdullah, in a meeting chaired by Prime Minister (PM) Manmohan Singh in Srinagar, said in the night of June 25 that the footprints of Security Forces (SFs) are being progressively reduced in the State, reports Kashmir Life. He said local Police were visibly involved in counter- insurgency operations. He said 54 bunkers had been removed from Srinagar while 179 schools, 37 hospitals, 33 hotels, 919 private, 264 government buildings and 26 industrial units had been vacated from the SFs. The Chief Minister also expressed satisfaction over the rehabilitation policy of those who had gone to Pakistan occupied Kashmir (PoK) and wanted to return back and lead a normal and peaceful life. He said 422 cases had been sanctioned under the policy out of 1094 applications received. The Chief Minister, however, underlined the need for political resolution of grievances and aspirations of the pluralistic state. Stating that positive atmospherics marked by hope, optimism, peace and harmony was rooting in the state, the Chief Minister stressed on giving a start to the implementation process of the recommendations made by Interlocutors Group. He also sought comprehensive review of Cross-Line of Control (LoC) travel trade of Control Travel and demanded early provision of full body scanners to be installed at Poonch and Uri besides easing trade restrictions. He also advocated for early completion of demining of areas across the LoC. Abdullah also talked about resumption of sustained and meaningful dialogue with Pakistan. He expressed hope that new Pakistan premier Nawaz Sharif would create conducive atmosphere for resumption for talks.

"I won't talk about AFSPA right now. Last 10 days, we have seen two incidents which have given evidence both for presence and revocation of AFSPA," he stated. Omar said the advocates of continuation of AFSPA in the state cite the example of attack on Army convoy in Srinagar on June 24 in which eight soldiers were killed and a dozen others were injured. "They say that AFSPA cannot be revoked when such incidents take place. Those who want the Act to go cite the Sumbal [Bandipora District] incident, saying there was wrong use of powers ... which led to death of two youths. If there was no AFSPA it would not have happened," he said. Omar said he would continue the discussion with the Centre on the issue of partial revocation of AFSPA in the state. "I will only say that our discussions about AFSPA (with the Centre) will continue," he added.

General Officer Commanding (GOC, 16 Corps), Lieutenant General D S Hooda said on July 3 that firing, ceasefire violations and infiltration attempts from across the border have increased and the situation along the LoC is tense, reports Daily Excelsior. “Firing (from across the border) has increased in the past two to three months. Ceasefire violations have increased. The situation on the border (with Pakistan) is tense but under control,” he said. “Infiltrators are now attacking our security forces, targeting our posts more openly as they are desperate to infiltrate. Attack on security forces to inflict more and more casualties is the new strategy of infiltrators,” the Army officer said. He also said that they are able to infiltrate because of heavy snowfall which damages the fencing erected for checking infiltration. On Border Action Team (BAT) attacks from across the border, the Army Commander said “there are strong possibilities of BAT strikes on our forces from the Pakistani side as experienced previously.” Replying to a query, he said “it is premature to attribute escalation in tension on the border to the change of Government in Pakistan.”

Official sources said troops observed four militants trying to sneak into the Indian Territory from near Durga Post in Digwar sub sector of Poonch District in the wee hours of the morning. Troops immediately opened firing to neutralize the militants before they could enter into this side. Within 15 minutes of firing, the troops were able to push back the militants to Pakistan occupied Kashmir (PoK) from where they had been launched. All four militants were heavily armed and appeared to be Pakistanis. They retreated without offering much resistance after finding heavy presence of Army on this side of the LoC. Inspector General of Police, Jammu Zone, Rajesh Kumar said that there had been no successful infiltration attempt on the LoC or International Border (IB) in Jammu sector in current year. “We have been watching the situation completely but so far Army and BSF [Border Security Force] haven’t allowed any militant to intrude into this side,” Kumar said adding though a number of intrusion bids have been made on the LoC in the recent past “all of them have been successfully thwarted”.

Sources in the Intelligence Agencies added Pakistan's Army wants to give message to the Government regarding maintaining its superiority over the civil administration by fomenting trouble near the LoC. Major General SK Singh, General Officer Commanding (GOC), infantry division, said it is too early to comment on Pakistan's relation with its Army. But he agreed that the army, involved in machination with the militant outfits, has often been targeting the Indian troops. "There is no doubt that Pak commanders and the local militants are plotting against us," said the GOC. According to the intelligence agencies, LeT and HM have jointly decided to send the latter's force in Jammu and Kashmir, as they have huge support in the state. On Wani’s disclosures, the Anantnag Police arrested three of his associates ---- Mohammad Rafiq Wani, Imtiyaz Ahmad Banday and Bashir Ahmad Wani, all residents of south Kashmir. The police investigations revealed that Wani and Banday were “planning to execute a firing incident on the National Highway between Qazigund and Mirbazar”, 60 kilometres south of Srinagar. The Police said militant Nawaz Ahmad Ahanger, a close associate of the slain LeT ‘commander’ Ashraf Sheikh alias Molvi of Rampora and Moosa alias Qari Banihal, was behind the designs to disturb normal life on the crucial national highway. “This whole module was being organized and handled by Ahanger. Ahanger and Mohammad Younis Bhat had arranged the weapons in 2010 to deliver it to Moosa. However, because of the killing of Ashraf Sheikh alias Molvi they could not execute their plans,” said the Police spokesman. On the instances of the arrested militants, two AK 47 riffles, two magazines and 43 rounds were recovered from the agricultural fields of Bashir Ahmad Wani.

NC [National Conference], PDP [Peoples’ Democratic Party], Congress and BJP [Bharatiya Janta Party] say we will solve the issue within the constitution and they are talking with the Centre. But those who want to solve it outside the constitution (meaning, the separatists), are not ready for talks," the news agency quoted Omar as saying. "The last time the Prime Minister told them (separatists) that they should put their demands in the shape of a memorandum. Let them show it to the people whether they have put it before the PM. 42 terror training camps are operating in Pakistan and Pakistan-occupied-Kashmir (PoK) and nearly 270 militants have entered into Jammu and Kashmir (J&K) from across the border through Line of Control (LoC) in the last three years, says Minister of State for Home RPN Singh in Lok Sabha on August 6, reports Kashmir Times. RPN Singh said there were 1000 attempts of infiltration by militants from Pakistan and PoK through the LoC between 2010-12. Singh informed Lok Sabha that 160 militants were killed by Security Forces (SFs) while trying to infiltrate while 570 others went back to the other side of the border due to strict vigil by SFs. However, he said, 95 terrorists could infiltrate into Jammu and Kashmir in 2010, 52 could infiltrate in 2011 and 121 could infiltrate in 2012. The Minister said J&K has been facing Pakistan-sponsored terrorism, spearheaded by Pakistani intelligence agency Inter Services Intelligence (ISI) for more than 20 years. "The reason for increase in terror attacks is due to stepping up of the attack on security forces planned by the militant groups in the aftermath of Afzal Guru's execution in February 2013," RPN Singh told Lok Sabha in a written reply on August 6, reports Times of India. Giving statistics, Singh said that in 2012, there were 50 incidents of encounters between militants and Security Forces in J&K in which 15 security personnel were killed and 65 were injured. In 2013 (up to July 28), there were 16 incidents of encounters in which 35 security personnel were killed 29 were injured. However, the casualties were not merely the result of the belligerence of militants; there were also security lapses. "In most of the cases of casualties, the laxity and non-adherence to standard operating procedures by SFs have also been evident," Singh said. The figures show that in just seven months of this year, casualty on the side of SFs had more than doubled. Sources said this was also due to an increased thrust from Pakistan on infiltration across the border which grew by close to 80% this year.

As many as 42 launch pads have been set up on the Pakistani side of LoC to facilitate the infiltration of the militants into the Indian side. “Terror infrastructure is intact (on the Pakistani side of the line of control),” said Lieutenant General Gurmit Singh, General Officer Commanding (GOC), 15 corps. Official figures reveal 53 militants, including 34 from Lashkar-e-Toiba (LeT), 18 from Hizb-ul-Mujahideen (HM), and one from Jaish-e-Mohammed (JeM), were killed by the Security Forces (SFs) in 2012 in the Valley. In the first six months of 2013, 19 terrorists have been killed in the Valley alone. Similarly, 12 civilians were killed in entire 2012 while 14 civilians have died across Kashmir Valley in the first six months of 2013. According to official figures 264 terrorists attempted infiltration from across the LoC in 2012, compared to 247 in 2011. There was sharp rise in successful infiltration by Pakistani militants. Around 121 terrorists entered into Jammu and Kashmir in 2012 as compared to 52 in 2011. “There are number of terrorist camps and launch pads (across the LoC)... We have an efficient Intelligence network,” said Lt Gen Singh. Counter infiltration grid of the army on the Line of Control (LoC) has foiled 17 infiltration bids this year. “A total of 13 hardcore Pakistan trained terrorists were killed. The numbers of such attempts have doubled this year in comparison to the corresponding period last year,” said an Army officer in Jammu. Despite foiling the large number of infiltration bids the number of active militants in J&K stands at 250 to 300 militants. Around 12 militants and a soldier were killed in one of the biggest operations on the LoC and hinterland in the Kupwara district last week. Pakistan army’s desperation is also evident by the fact that there has been substantial increase in the number of ceasefire violations this year. “There have been 57 ceasefire violations this year which is almost 80% more than 2012,” said the officer.

"Naturally, this incident will have consequences on our behaviour on the line of control and for our relations with Pakistan. Our restraint should not be taken for granted; nor should the capacity of our armed forces and resolve of the government to uphold the sanctity of the LoC ever be doubted," he added. Meanwhile, Army sources said on August 8 that the operatives of the Musa Company of the Special Service Group (SSG), which is tasked for carrying out such 'hit' operations, may have carried out the attack. According to the Indian Army, the SSG comprises seven battalions along with four company level formations. Musa Company specializes in amphibious operations and tasks in riverine areas. In the January attack in which one Indian Army jawan was beheaded by the Pakistan army teams, SSG troops had taken part in the operations along with Lashkar-e-Toiba (LeT) terrorists. The SSG leads the Border Action Teams of Pakistan army which also includes terrorist elements.

The operation was started after 30 to 40 terrorists had tried to infiltrate from multiple points on the LoC in Keran Sector on the night of September 24. General Officer Commanding (GOC) Northern Army command, Lt General Sanjiv Chachra said, “I have now given the direction to call off concerted search but our counter-insurgency deployment is being strengthened. We are now going to launch operations which are intelligence based, which are surveillance based so that we can eliminate and meet the challenges.” The Army Commander said that there were desperate infiltration attempts at multiple points in Keran sector and Army knew it and planned operations accordingly. “There was a desperate attempt of infiltration in Keran sector during 10 to 14 days at multiple points. We had very specific intelligence of their operation. We knew they were coming and we were prepared for it. Some of these infiltration attempts have been eliminated and some of them have been foiled. We had eight terrorists killed and 59 major weapons including 18 AK Rifles and war like stores recovered”, added the Northern Army chief. The total number of militants present in the state is 200”. However, he said that there could be the variation in the numbers between various security agencies operating in the state. “Holding gun alone does not qualify to be a militant. For that, we need to change our strategy and it is the evidence of a fact that militants have understood that there is a pressure on them from security forces,” he told on the sidelines of passing-out parade for paramilitary Central Reserve Police Force (CRPF) men at Humhama in Budgam District. The Chief Minister said militants want to down the morale of Security Forces (SFs). “And by attacking them, they think their morale is increasing. But this is not the case. Neither does their morale increase nor is the security forces’ morale decreased,” Omar added. “To ensure such incidents don’t take place in future, we have already prepared for that.”
