Speaking in New Delhi, on January 7, Jammu and Kashmir State Chief Minister Farooq Abdullah said Al-Qaeda terrorists had started trickling into the State. He was speaking to newsmen after a meeting with Prime Minister Atal Behari Vajpayee. The Chief Minister added that the international community must understand that Al Qaeda activists, driven out of Afghanistan, "cannot be militants in one part of the globe and freedom fighters in another". Commenting about the withdrawal of troops from the counter insurgency grid in the State, Farooq Abdullah said the Union government would be sending additional para-military forces to the State to fill the gap. He added, "The State as well as the [Union government] realises the fact that the noose around the militants cannot be allowed to be loosened even by an inch".

On the political front, the secessionist All Parties Hurriyat Conference (APHC), in a statement, on January 13, welcomed the stand taken by Pakistan President Pervez Musharraf during his speech on January 12. APHC chairman Abdul Ghani Bhat, speaking in Srinagar, while welcoming the President’s statements on Kashmir asked India’s Union government to respond positively to find a solution. Meanwhile, in a separate statement, senior APHC leader Syed Ali Shah Geelani, while reacting to President Musharraf’s remarks, said "… the speech is a realistic one if viewed in its totality" and added "… the speech is appreciable as far as Musharraf’s stance vis-a-vis Kashmir is concerned." However, referring to the ban imposed by Pakistan on the Lashkar-e-Toiba (LeT) and the Jaish-e-Mohammed (JeM), he said "Nobody has the right to ban such individual acts where Muslims come to help their brethren."

A patrol party of the Border Security Force (BSF) killed the two Dutch nationals. BSF sources said that the Dutch nationals were killed after they attacked the patrol party with swords and injured two personnel. In Srinagar, Justice O P Sharma presented the report of one-man Commission of Inquiry on a firing incident at Haigam, Baramulla to Jammu and Kashmir Chief Minister Farooq Abdullah on January 16. After receiving the report, Farooq Abdulla said, "… a follow up action will be taken after examination of report at an appropriate level". The Chief Minister ordered the Commission on February 19, 2001, to inquire into the incident where SFs fired on a procession at Haigam on February 15, 2001. The commission was specifically asked to enquire into the causes and circumstances which led to the event of firing resulting in the death of seven persons and causing injuries to others; to probe whether the firing opened by SFs on the crowd was justified or not; and fix responsibility for using excessive force, if any.

Referring to the pilot project in Jammu and Kashmir in this connection, the US Co-ordinator for Counter-terrorism, Ambassador Francis Taylor, said on January 21 that this was "a key part of efforts to enable nations to protect themselves" against terrorism. The declared objective is to "end terrorism as a political tool". "The fact that terrorists can cross and not be identified is a big challenge. September 11 too is a reflection of this, and we have constituted a group on border security for the US as well," he added.

On the political front, the Centre’s interlocutor on Jammu and Kashmir (J&K), K C Pant, asked terrorist groups to shun violence in order to ensure free and fair elections to the State Legislative Assembly, which he said, would provide an opportunity to the All Parties Hurriyat Conference (APHC) to prove its "much acclaimed" representative character. "If free and fair elections are to be held in Jammu and Kashmir, violence must stop. Power of the bullet must be replaced by the strength of ballots", Pant said in New Delhi on January 24. Meanwhile, in a separate statement, a Hurriyat constituent, Jammu and Kashmir People’s League (JKPL) strongly objected to the decision of having polls under Hurriyat’s own election commission. The statement said that "Hurriyat’s dramatic announcement has raised doubts about its representative character thereby putting the whole leadership of the movement into crisis". A Hurriyat spokesperson clarified that the statement issued by JKPL was that of rival faction of the League headed by Pakistan-based Mohammad Farooq Rehmani. Six constituents of the alliance namely Kashmir Mass Movement, Traders Federation, Khawateen Kashmir, Khawateen-e-Markaz, Bazam-i-Tawheed and Tahreek-e-Alhahlihadees, boycotted the January 31 meeting.

The General Council of the All Party Hurriyat Conference (APHC) met in Srinagar on January 31 and endorsed the APHC Executive Committee to have elections in Jammu and Kashmir under Hurriyat’s own election commission to prove its representative character. News reports citing Hurriyat members who attended the meeting said that the alliance’s leadership overcame stiff resistance from members of the general council before the controversial January 28 decision of Hurriyat’s executive was ratified. The dissenting members were reported to be agitated over the manner the decisions are taken by the executive without taking them into confidence.

In an interview on February 5, the former chairman of the secessionist alliance, All Party Hurriyat Conference (APHC), Mirwaiz Umer Farooq, denied that any constituent of the alliance would be participating in the forthcoming elections to the State Legislative Assembly, to be held in the second half of 2002. Miwaiz Farooq was responding to a statement by K C Pant on February 4, indicating that some members of the alliance would participate in the elections. K C Pant is the Union Government’s representative mandated with the task of holding talks with Kashmiri organisations and individuals. The Mirwaiz also said that that the announcement of the formation of an Election Commission by the executive body of the conglomerate was aimed at proving the representative character of the leadership and resolving the Kashmir issue. The proposed APHC’s Election Commission, he said, would be " an Independent Commission and will comprise people who have an international credibility and are acceptable to India, Pakistan and people of the State." He denied reports that indicated that there were differences within the alliance on the issue of the Commission. Meanwhile, another senior leader of the alliance, Abdul Gani Lone, accused the Union government of attempting to create dissension within the alliance. He added that the decision taken by the APHC in 1996 regarding its non-participation in Assembly elections that are "conducted and supervised by the Election Commission of India" still stands.

"It will not be prudent for us to talk to a bureaucrat less in rank and status than that of Planning Commission deputy chairman KC Pant," said senior APHC leader Abdul Gani Lone. "When we had earlier categorically refused to hold negotiations with Pant, how can any one expect us now to talk to a person who is much junior in bureaucratic hierarchy?" he asked. On whether the secessionist conglomerate would consider negotiations if "a bigger name" is assigned to the job, he said "if the Hurriyat has to talk, it should be somebody having proximity to prime minister Atal Bihari Vajpayee". When asked if he had any specific name in his mind, Lone said "it can be anyone...Someone like Brajesh Mishra". Speaking at a press conference in Srinagar, the 23-party separatist alliance’s chairman Abdul Gani Bhat said that the APHC was seeking to prove its representative character in order to hold talks for resolution of the Kashmir issue and not membership in the State Assembly, which he claimed, had no role to play in the resolution of the issue. The ‘six member commission’ has two former Pakistani judges. While Justice Sajjad Ali Shah, former chief justice of Pakistan would head the ‘commission’ in Pakistan occupied Kashmir (PoK), Tapan Bose, an Indian human rights activist based in Kathmandu would head the ‘commision’ in J&K. The two would also be co-chairmen of the ‘commission’. A day after the seizure of one hundred thousand US dollars from two persons at Kud, on the Srinagar Jammu highway, police on March 25 arrested the senior All Parties Hurriyat Conference (APHC) executive member and chairman of Jammu and Kashmir Liberation Front (JKLF), Yaseen Malik, for his alleged involvement in the Hawala (illegal money transfer) transaction and booked him under the Prevention of Terrorism Ordinance (POTO). Malik was arrested during a press conference at the APHC’s Central Office, at Rajbagh, Srinagar and questioned briefly and later sent for sustained interrogation to Udhampur. At the press conference Yaseen Malik said that the incident was "a campaign of vilification against the Kashmiri separatist leaders." He claimed that it was aimed at sabotaging the Hurriyat’s election process. He also claimed that the Government of India had launched a "media war" against the APHC immediately after the separatist alliance had rejected the suggestion of participating in the forthcoming State Legislative Assembly elections. Malik denied that the Pakistan-based JKLF functionary Altaf Qadiri had handed over the money to the two persons arrested on March 24 in Kathmandu. Responding to terrorism related questions during the State Legislative Assembly session, he said that with the withdrawal of army from interior areas of Udhampur, Mahore, Rajouri, Budhal, Poonch and Doda and other areas in Kashmir valley, terrorists have started moving freely and had resorted to trigger killings of innocent civilians. He admitted that civilian killings in several areas had increased after deployment of army on borders. According to him, in several places, the para-military forces have been deployed but the State does not have sufficient forces to tackle the prevailing situation. The Chief Minister said that he had taken up the issue with the Central government and has requested them to send additional forces to the State in order to provide adequate security.

Expressing the hope that a consensus on the issue would be evolved between various political parties and the States and a controversy like that of on the Prevention of Terrorism Act (POTA) would be avoided, he said, "Union Home Ministry will always be ready to accommodate wide ranging views on the issue." He said SFs had reports that there were a number of terrorists waiting across the border to infiltrate. The Premier said importance would be laid on generation of new employment opportunities for the youth of the State and relief for migrants affected by terrorism and cross-border shelling. With regard to strengthening the security grid, he announced that two India Reserve Battalions (IRB) would be raised over the next two years at a cost of Rs 26 crore and provision of Rs five crore would be made over five years for better training and weaponry for the Jammu and Kashmir Volunteer Force (elite group of Special Police Officers). Rs 25 crore is expected to be provided over the next five years for incentive schemes for 4,000 police personnel who are members of the Special Operations Group (SOG). Vajpayee also said that the Village Defence Committees (VDCs) would be provided better weaponry and higher allowances on a selective basis.

The editor of a Srinagar-based magazine has been arrested in this connection. A J&K Police spokesperson said that editor and printer-publisher of a Srinagar magazine Mountain Valley , Imtiaz Ahmed Bazaz of Batmaloo, had reportedly made a number of visits to Pakistan and other countries during the last 12 years of militancy in the State. Besides operating an insurance claim investigating agency, Bazaz was also operating as a private television producer. According to the spokesperson, police discovered that the London-based president of World Kashmir Freedom Movement, Ayub Thakur, and Pakistan-based ‘supreme commander’ of the Hizb-ul-Mujahideen (HM), Syed Salahuddin, had been regularly sending money secured from the Pakistani external intelligence agency Inter Services Intelligence (ISI) to Kashmiri terrorists through Bazaz and his associates. Bazaz and two of his close associates, namely Ghulam Hassan and Abid Hussain, was arrested by Srinagar Police on May 25. During preliminary interrogation, Bazaz is reported to have confessed that he had approached Ayub Thakur for funneling ISI funds to the Dukhtaran-e-Millat (DeM) chief Asia Andrabi. He also reportedly confessed that he had been in regular contact with Syed Salahuddin and other HM terrorists. According to police sources, Bazaz revealed that he had been receiving money from Salahuddin for delivering the same to Saiful Islam, HM’s ‘chief command of operations’, ‘divisional commander’ Abdul Rashid Dar alias Shardar Peer and ‘district commander’ (Srinagar) Javed Ahmed Sheikh. According to a media report, cash worth Rs 6.00 crore has already been seized by the J&K Police while destroying different Hawala channels and financial transactions of terrorist functionaries since December 2001.

These four police personnel, who had separately met Abu Akassa in Sunjwan and Prem Nagar locality of Gujjar Nagar, have been identified, but had not been arrested thus far. As reported earlier, Akassa when arrested was reportedly in possession of a state subject and an identity card issued by Zonal Relief Officer (ZRO) and was allegedly planning to carry out a fidayeen attack on the Central Jail and Police Control Room (PCR) in Jammu. Five persons, including a ZRO, two employees in the offices of Deputy Commissioner and Tehsildar (Settlement) Jammu, and a political leader have also been arrested by police for assisting the terrorist in getting a state subject and an identity card. Akassa also claimed he dumped a huge consignment of arms, ammunition and explosives in a village in the Gool area of Udhampur district. This consignment, which was to be used by the fidayeen, is yet to be recovered. Akassa had reportedly stayed in Gool after his infiltration from Pakistan through the Rajouri sector.

The separatist All Parties Hurriyat Conference (APHC) on June 19, while announcing that it was keeping in abeyance its 'election commission', also set certain conditions for normalisation of the situation in the State of Jammu and Kashmir (J&K), including the "return of security forces to barracks". While claiming that the Union government's "stubborn attitude" was responsible for the inability of the nearly six-month old 'election commission' to get into action, APFHC chairman Abdul Ghani Bhat urged the Union government to permit APHC representatives to travel to Pakistan occupied Kashmir (PoK) for ‘motivating’ terrorists there to accept a cease-fire proposal. Addressing a press conference in Srinagar, Bhat said these conditions were essential to make the peace process a "meaningful" exercise. As reported earlier, the APHC had set up a "People's Election Commission" on January 28, 2002 to ascertain the APHC’s representative character in the State.

Approximately 2275 foreign terrorists besides 1225 locals are active in the State of Jammu and Kashmir and more are infiltrating, State Director General of Police (DGP) Ashok Kumar Suri said in Srinagar on July 7. "We have information that about 3500 militants are active in the state. About 65 per cent are foreigners while rest are locals," he said. Suri added, although there was a marginal decline in infiltration from Pakistan occupied Kashmir (PoK) as compared to the corresponding period last year it has not stopped completely. This disclosure was made by Jammu and Kashmir Chief Minister Farooq Abdullah in the State Legislative Assembly on July 16. He said the Central Bureau of Investigation (CBI) would take up the inquiry and seek trial of the accused in a court of law. While making a suo moto statement in the State Assembly, the Chief Minister said, "It has been clearly established that the deceased were not foreign terrorists, as claimed by the forces who led the operation, but they were innocent civilians for which the people agitated". He also said, "In view of the gravity of the offence made out, as well as the attempt made by certain officials to destroy the evidence and to ensure fair investigation, I have recommended that the investigation of the case be taken by the Central Bureau of Investigation, who will be requested to expedite the investigation to bring the accused to the trial court." Terrorists at the Chittisinghpura village of Anantnag district had massacred 35 members of the minority Sikh community on March 20, 2000. Five civilians of different localities in Anantnag disappeared under mysterious circumstances on March 23-24, 2000. On March 25, a security force official had reported to the Anantnag Police that they had killed five "foreign terrorists" in an encounter at Panchalthan. On April 3, residents of Anantnag had formed a procession while expressing apprehension that the "foreign terrorists" killed at Panchalthan could be the five civilians. Eight civilians died when armed personnel of the Special Operations Group (SOG) opened fire on the procession at Brakpora, Anantnag. The Chattisinghpora massacre took place before a visit to India by the then US President Bill Clinton.

He said Pakistan’s Inter Services Intelligence (ISI), its external intelligence agency, continues to harbour, train and fund the terrorist organisations operating in Jammu and Kashmir and suitable military measures have been put in place by the Army to address the problem of cross-border terrorism. Infiltration into Jammu and Kashmir continues though there is a marginal reduction, he said, adding that four infiltration bids were foiled last month in which 14 terrorists were killed. The marginal reduction in infiltration can be attributed to enhanced vigil by Indian troops and these trends would need to be watched for some more time before any conclusive assessment can be made, he said.

Among those who the police were specially looking for included Ghazi Baba, an ‘area commander’ of JeM, and suspected mastermind of the December 13, 2001 terrorist attack on Indian Parliament. The IGP also said that on top of the hit list of Fidayeen squads were J&K Chief Minister Farooq Abdullah followed by important civil and defence installations, including Radio Kashmir and Civil Secretariat in Srinagar. Giving the district-wise figures of polling percentage, he said in Poonch recorded 48 per cent; Rajouri 47 per cent; Kargil 67 per cent; Baramullah 37 per cent and Kupwara 40 per cent. In its recommendation, the Commission said, despite the proposed law to reform madrassas, "too many of Pakistan's Islamic religious schools continue to provide ideological training and motivation to those who go on to fight in Afghanistan and Kashmir, and who take part in violence targeting religious minorities in Pakistan”. Once a country is designated CPC, the International Religious Freedom Act (IRFA) requires that the US "oppose these egregious and systematic violations, whether the government itself commits them or tolerates them."

Malik was released from the high security Kot Balwal Jail in Jammu, and a court granted him parole. Malik, an Executive Committee member of the separatist All Parties Hurriyat Conference (APHC), was arrested on March 25 under the Prevention of Terrorism Act 2002 (POTA). He was later released in July but was immediately re-arrested under the Public Safety Act that provides for detention for two years without trial. Besides Malik, others who have been released after the new coalition government took office are JKLF ‘commanders’ Shaukat Bakshi and Nazir Ahmad Sheikh and top Hizb-ul-Mujahideen (HM) terrorist Ayyub Dar. Meanwhile, Jammu and Kashmir Law Minister Muzzafar Beig said, on the same day, the State government is under no pressure from any quarter or in a hurry to release terrorists. On December 28, speaking in New Delhi, Deputy Prime Minister L K Advani said the Jammu and Kashmir (J&K) government should not grant "general amnesty" to those arrested for terrorist activities. He also said such detainees should be released only after appropriate consultations with the Union government. While talking to press persons on the sidelines of the 63rd Raising Day of the Central Reserve Police Force (CRPF), he said that the setting up a review committee by the J&K government to screen the process of the releasing terrorists was "heartening move and a right step." He said, "We have always been stressing for a review committee. There should be no general release of arrested persons". The J&K government had issued a notification on the formation of the committee on December 26.
