Army Chief General V K Singh has opposed the withdrawal of the Armed Forces Special Powers Act (AFSPA) from parts of Jammu and Kashmir anytime soon, saying this could result in the "emergence of terror sanctuaries and safe havens", reports IANS. He said one summer of peace does not mean normalcy has returned to the troubled border state and warned that if the contentious special powers are withdrawn, the army would feel constrained in operating against terror groups if the situation deteriorates. "The partial revocation of AFSPA will result in the emergence of sanctuaries and safe havens for terrorists while the army will be constrained from operating against them," Singh said in an interview.

All Party Hurriyat Conference-Mirwaiz (APHC-M) Chairman Mirwaiz Umar Farooq said his faction was not against dialogue and they were ready for a meaningful dialogue between India, Pakistan and leadership of Kashmir. "The talks should not be held for the sake of talking. The process should be result oriented," Mirwaiz said in response to Chidambaram's statement on dialogue with separatists. Mirwaiz, whose moderate faction has held several rounds of talks with the Centre till 2005 before pulling out, said dialogue process so far has not yielded any results as the government was "never serious" about talks. The Hurriyat Chairman said his group had given four point proposal that included de-militarising Kashmir, repeal of "black" laws and release of political prisoners, for making forward movement on the resolution of Kashmir issue. "The government's various wings seem to be confused. Home Minister offers dialogue but Army chief is against it... New Delhi could not reach a consensus on revocation of the AFSPA, which is a minor issue. How will they evolve consensus for resolution of Kashmir issue?" he added.

A civilian was killed and two others were injured in the firing over the protesters by the Central Industrial Security Force (CISF) personnel, who were guarding NHPC installation at Boniyar in Baramulla District, reports Daily Excelsior. The dead has been identified as 25 year old Altaf Ahmad Sood of Berneth, and injured as 70-year-old Abdul Majid Khan and 25-year-old Parvaiz Ahmad Khan of Bimyar village. Replying to question on reasons behind the people's protest, Principal Secretary Home, B R Sharma said the preliminary reports have revealed that the people wanted power supply to the area directly from the NHPC manned power station. He added, "As the people were protesting against the NHPC, it was appropriate for the NHPC authorities to seek assistance of local law and order machinery rather than dealing with the situation on their own.'' He further said that the CISF was not a part of the Counter Insurgency (CI) Grid operating in the State as they have been deployed by the NHPC exclusively for the security of their installations across the State. He also said that all paramilitary forces and State Police have once again been reminded of the SOP devised by the Home Department in consultations with the Union Home Ministry and asked to strictly adhere to it to avoid civilian casualties during the protests. The SOP was devised after 2010 summer unrest in Kashmir. Under the SOP, the protests would be quelled by ensuring that there were no or minimum injuries. The SOP was put in place in early 2011.

troubled by inflammatory and obscene postings on social networking sites, the Jammu and Kashmir Police is establishing three special Police Stations to fight cyber crime in the State, according to DNA. The special cyber police stations will now be entrusted with the job of cracking down on hi-tech crimes relating to cyber frauds and inflammatory postings on social networking sites. “We did not have this facility earlier. Cyber crimes will be registered separately in these special police stations,” said Raja Aijaz Ali, Inspector General of Police (Crime branch). “Complaints against people who post objectionable content against anyone or launch defamatory campaigns on Facebook will also be covered and investigated. Plus lottery frauds and credit card misuse will also be tackled,” he added.

Jammu region recorded "zero infiltration" for the first time in 2011 despite several attempts along the Indo-Pak border, Police said on January 3, according to Hindustan Times. "2011 is the first year that has witnessed 'zero infiltration' (along Indo-Pak border). There has been no infiltration anywhere along the border in Jammu region," said Inspector General of Police (IGP, Jammu Zone) Dilbagh Singh. "There have been ceasefire violations. There have been dozens of infiltration attempts but they have not been successful," he added. To a question about the state of militancy in Jammu region, Singh said, "It was the best year as far as security, militancy and peace are concerned." Referring to militancy, he said while Doda and Reasi Districts are free from the menace, there is presence of militancy in Kishtwar, Rajouri and Poonch, though it is very marginal in Ramban District of Jammu region. Singh said 32 listed militants were operating in Jammu region at present. Police and security forces have eliminated 32 militants, including 11 top commanders in 2011, he said, adding that due to fear of Security Forces, militants have gone underground. "But our endeavour is to stamp out militancy completely from the region," he added. Daily Excelsior reports that militants are also working on recruiting local youth in certain areas of the State, including Pulwama, to expand terror network and the task has been assigned to a person, Usman Bhai alias Chhota Rehman.

The Lashkar-e-Toiba (LeT) is raising a group of 21 female terrorists at its training camps in Pakistan occupied Kashmir (PoK) for carrying out sabotage activities in India, Army sources said on January 3, according to Times of India. "We have confirmed reports that LeT is imparting training to 21 selected female terrorists at its training facilities in Muzaffarabad in PoK for carrying out terrorist activities in India," an unnamed Army official said in New Delhi. Army said the new group, named as Dukhtareen-e-Toiba, is planned to be made active in the Kashmir Valley by the LeT. The women terrorists are planned to be infiltrated into India through routes in Uri sector or using the aerial route through some other country. DNA quoted sources as saying, "Inputs reveal that 21 girls are being trained by LeT at Divalia, Muzzafarabad, under the name of Dukhtaran-e-Toiba." The group, after training, have been placed under the command of an LeT ‘commander’, Sayeed Sadaqat Hussain, for future deployment in Kashmir, the sources added. Intercepts indicate that the new front is being activated since the earlier formation of women Dukhtaran-e-Millat (DeM) led by Asiya Andrabi has not been successful in mobilising people as it had in the past, adds The Hindu. According to reports, the sources said, the effort is to try and infiltrate these trained cadres into India either through the Uri sector or even Nepal. Another training camp, according to other information, is located at Turbeladem in PoK in which over 400 terrorists in various groups are being trained and that the facility is being commanded by a senior officer of Inter-Services Intelligence (ISI). The sources said the ISI asked the LeT and other terror groups to carry out attacks against the Indian troops deployed on the Line of Control (LoC). These groups, the reports said, carried out reconnaissance in areas on the other side of the LoC facing the Indian forward defence locations.

Bandipora Police on January 4 neutralized two militant modules, one each of Lashkar-e-Toiba (LeT) and Hizb-ul-Mujahideen (HM), who were planning the target killings in the District. Superintendent of Police (Bandipora) Bashir Ahmed Khan said that Police arrested six youths in two separate raids from Hajin area of Sonawari in the District. They were affiliated with HM and LeT. Khan said that Police arrested a youth, identified as Fayaz Ahmed of village Hajin. He said that during the questioning Fayaz disclosed that he was working with the HM since last nine months. Khan said that on his disclosure, Police arrested two of his accomplices from Hajin. They have been identified as Zubair Ahmed Parray. Khan said that the trio confessed that they were working with the HM and were recruiting the youth into militant ranks. During the questioning they said that they were tasked to kill some influential political workers and Police personnel in the District. A matrix sheet and list of people of few political workers and police personnel were recovered from their possession, Khan added. Also, Police neutralized an LeT module, believed to be planning target killings, operating in Sonawari area and arrested three militants, identified as Zahoor Ahmed Dar, Ghulam Muhammad Bhat and Nissar Ahmed Ganie. Zahoor Ahmad Dar had visited Pakistan at the behest of LeT for computer training in May 2011. After staying in training camps for 15 days he returned back. Later, Zahoor Ahmed contacted a surrendered militant, Ghulam Mohammad Bhat, for sending across some educated youths for computer and arms training. Ghulam Mohammed motivated Nissar Ahmed Dar at the behest of Zahoor Ahmed and sent him across for computer training and was transporting money and other material for the LeT cadres. These youths were assigned the job of targeting political activists and police personnel in the District. The arrested militants had earlier threatened Panches and Sarpanches during 2011 Panchayat elections.

"Police arrested three members of a militant gang involved in the attack on an army man - Reyaz Ahmad Lone - at Naidkhai Bus Stand on November 24 last year," a Police spokesman said. During investigations, Police zeroed in on Tariq Ahmad Wani, who had a militant background, he said. Wani was called to The Police Station where he confessed to the crime, he said. "During questioning, Wani disclosed that he along with Mohammad Yousaf Dar, Ghulam Mohammad Wani and Ghulam Hassan Wani hatched a criminal conspiracy to eliminate Lone," he said. On November 24, the accused found Lone, a trooper in Territorial Army, at the bus stand in Naidkhai and opened fire injuring the trooper and two others. "All the members of the gang except one have been arrested and the weapon used has been recovered," the spokesman added. He said Tariq Ahmad Wani and Ghulam Mohammad Wani were also involved in militancy-related incidents in Srinagar, Sopore and Sumbal where cases are already registered against them. His two accomplices in the crime — Shahnawaz alias Bilal Ahmed Khander and Mohammad Rafiq — have already fled and rejoined militant ranks, according to the police. As many as three CRPF battalions have been de-linked, 39 security bunkers removed in Srinagar city and 52 buildings vacated from forces occupation,” Chief Minister Omar Abdullah said on February 29. The Government has also identified 15 more bunkers to be removed from Srinagar as situation continues to improve on the ground. “The improvement in law and order during the last three years is visible on ground. Though attempts were made during last year to disrupt the peace, credit goes to people who denied the vested interests to opportunity,” Omar said. Figures released by the Chief Minister said militancy related incidents in 2009 were recorded at 385 in which 71 civilian, 13 Police personnel and 52 Security Forces (SFs) were killed. In 2010, militancy related incidents plummeted to 268 in which 47 civilian, 15 Police personnel and 49 SFs were killed. “During the year 2011 the militancy related incidents were 192, civilian killed were 30, Police personnel killed were 13 and Security Forces killed were 18,” said Omar. Talking about Armed Forces Special Powers Act (AFSPA) he said, “Our efforts for gradual revocation of AFSPA from some parts of the state where militancy has died down and the army has no role to play will continue as it possesses logical reason. I would continue to work for it.”

The decision has come at a time when LeT has changed its strategy and shifted control and command structure to Rawalpindi and the Pakistan occupied Kashmir (PoK), in a bid to directly control and guide the militants operating in Jammu and Kashmir (J&K). An unnamed Police officer said, “Mostly, the [LeT] commanders based in Pakistan use latest technology like SKPE and VOIP to communicate with their men in J&K. Asserting that terror infrastructure across the border is intact and militants are operating there, Director General of Police (DGP) Kuldeep Khoda said on April 7 that there is no change in the intention of Pakistan to continue terrorism in the State. "There are different figures of different agencies as far as terrorist camps, launching pads and militants (operating across the border) are concerned. But launching pads are there, militants and their training camps are still there. The intention in the capability of our neighbouring country (Pakistan) to continue terrorism in our State—that continues.” As far as infiltration is concerned, he said the reports are that there is no change in the intention—whether it is training camps or launching pads, adding, "there is no report of successful infiltration with us in the entire State." He further said that "this year militancy-related incidents have decreased. In the first three months of 2012, 26 militancy-related incidents took place as compared to 48 last year, showing a 45 percent overall decrease". Khoda said there was 47 percent dip in militancy during first three months of 2011, as compared to the same period in 2010. Civilian killings this year [2012] have decreased by 50 percent and there was no killing of Security Force or Police personnel this year [2012] as compared to last year’s [2011] figure of three troopers, the DGP said. To another question about the number of militants operating in the State, he said "our figures suggest they are in the range of 85-90". "The presence of militants is decreasing in the State due to better operational capabilities of the forces and we are sure that we will be able to ensure peace in the summer", Khoda said. Answering a question about stone-pelters being brought under the ambit of youth clubs set up by Police, the DGP said "we do not discriminate for sports activities. The focus is on youth. We have got positive results in those areas where we have set up youth clubs. Those areas witnessed peace. We will open more youth clubs and the focus this time would be those areas, which were not attended to last year including that of Jammu.”

Chidambaram on April 10 said that Interlocutors’ report on Jammu and Kashmir would be taken up with the Cabinet Committee on Security (CCS) first before being made public, reports Daily Excelsior. “The report would be taken up with the CCS and then made public for debate and discussion,” the Home Minister said. The three Interlocutors, appointed by the Ministry of Home Affairs (MHA) in October 2010, had submitted their report to Chidambaram on October 12, 2011. He also said that his Ministry has proposed three amendments in Armed Forces Special Powers Act (AFSPA), which would be placed before CCS for implementation wherever AFSPA was applicable if they were cleared by the CCS. “If the amendments were approved by the CCS, they would be implemented wherever AFSPA was applicable’’, he said. The amendments proposed by the MHA in AFSPA included making it mandatory for armed forces to take arrest warrants in advance before conducting searches for arrests of any person, taking away the power of the armed forces to open firing causing deaths and setting up of a Grievance Redressal Cell. He informed that there was a constant decline of more than 30 per cent of militancy related incidents as compared to 2010. Against the 488 terrorist-related incidents in the year 2010, there were only 340 such incidents in 2011 and as against 47 civilians killed in 2010, 31 civilians were killed during 2011. “About 45.26 per cent decline has been registered in Net Infiltration during 2011. The Net Infiltration during 2010 was 95 as against 52 in 2011," he added. Underscoring the need for enhancing honorarium of Special Police Officials (SPOs), the Chief Minister said that SPOs have been playing an important role in assisting the Police in fighting militancy in the State. He declared, "As many as 12 battalions of BSF [Border Security Force] and CRPF [Central Reserve Police Force] have been withdrawn from the state since 2009. 24 bunkers are being removed from Srinagar city in the coming months in addition to the 39 bunkers which have already been removed". He stressed that reconciliation and dialogue will always remain the best medium for seeking a solution to all contentious issues. "I am hopeful that peace dividends achieved in the year 2011 will continue to percolate to the people, and usher in a new era of peace and development in the State," he said. The Chief Minister spoke about Rehabilitation Policy announced in 2010 and said that 1034 applications have been received from the parents and relatives of the prospective returnees under the Policy. "Of these, 67 cases have been recommended in high level committee meetings. A decision on these is required to be taken at the earliest", he said. On cross-Line of Control (LoC) trade between two sides of Kashmir, Omar said, "There is a need for restoration of telephonic links between Jammu and Kashmir and PoK and putting in place a proper institutional arrangement by replacing the current barter system of trade which will also address the security concerns". Speaking on the issue of Armed Forces Special Powers Act (AFSPA), he said he was of the firm belief that the Act had played a useful role in providing much-needed legal protection to the Army and paramilitary forces while dealing with insurgency. "However, now that there is a distinct change in the security environment in the State, there is a good case for reviewing the continuation of AFSPA. I am not advocating the withdrawal of AFSPA from districts and areas which are still infested with militancy, but a beginning can be made by withdrawing AFSPA from areas and districts which are not affected by the insurgent and terrorist activities." He also sought a proper mechanism for surrender and rehabilitation of militants currently camping in Pakistan-controlled territory. He flagged that off late, some youth were using Nepal route to return to their homes, adds DNA. He expressed fear that they may again join militancy, in the absence of any proper mechanism. Sources in State Government say around 65 youth have returned using Nepal route. Amongst these, reports say, at least five from Sopore region have re-joined militancy.

Times of India reports that the Centre on April 22 decided to depute Jammu and Kashmir Police along with Sashastra Seema Bal personnel to help identify Kashmiri militants using the Indo-Nepal border to re-enter the Valley and former militants will be assisting them in this task. Report said that the Jammu and Kashmir Government will soon deploy former militants as "spotters" along the India-Nepal border to stop infiltration. The personnel, besides being deployed at 15 points from where the people from India and Nepal enter, will also be part of patrolling parties to man areas used for illegal infiltration, the sources said. The State Government announced the Rehabilitation Policy in 2010, under which former militants, who crossed over to Pakistan-occupied Kashmir (PoK) between 1989 and 2009, were being considered for safe return. Government identified four entry points – Poonch-Rawalakote (Poonch), Uri-Muzaffarabad (Uri), Wagah (Punjab) and Indira Gandhi International Airport, New Delhi, from where the youth, given clearance, can enter the State. However, during the past few months, there were some cases detected of militants holed up in PoK entering the Valley through Nepal and claiming they had returned according to the 2010 policy. Some of these youth were later found involved in militant activities. In fact, the Indo-Nepal border has been increasingly used as an entry route ever since the announcement of the Rehabilitation Policy in 2010. Notably, while favouring a mechanism to ensure safe return of former militants to the State to facilitate their transition for leading peaceful lives, rejoining the national mainstream and contributing towards peace, Chief Minister Omar Abdullah had said that there are reports that some youth are using Nepal route for returning to Jammu and Kashmir. "There is a growing concern about the possibility of the recycling of the surrendered and released militants as well as these prospective returnees from PoK. In a written reply in Rajya Sabha (Upper House of Parliament), Defense Minister AK Antony said 44 cases of ceasefire violations along the LoC in Jammu and Kashmir were registered in 2010. While there were 51 cases in 2011, seven such instances have come to notice this year [2012], he informed. Outgoing Director General of Police (DGP) Kuldeep Khoda on May 31 said that militancy was in last phase in Jammu and Kashmir, reports Greater Kashmir. “Now there are militant foot soldiers and I hope JK Police will take on them,” DGP said, adding that Police has played pivotal role in tackling militancy. “We have lost more than 1500 men, including officers, policemen and SPOs in the fight against militancy,” he said. Giving the break-up of number of active militants in the state, Khoda said 147 militants were presently active in Kashmir valley and around 100 in Jammu region. “Most of their commanders were killed in last year and an active hunt to track them was continuing,” he said. “I hope police will make an end to militancy by end of this year.” The outgoing DGP did not mention anything about the 2010 summer unrest, however, said that Standard Operating Procedure (SOP) drafted to deal such unrest is a role model now. “Ministry of Home Affairs (MHA) selected our SOP and other states of India have been asked to follow,” he said. DGP Khoda said that to minimize the civilian casualties and injuries, State Police was now trained and equipped with non-lethal weaponry. “We have given training to cops about the non-lethal weapons. Earlier, on June 5, Jaish-e-Muhammed (JeM) had asked panchayat members in the area to resign triggering mass resignations of panchs (member of panchayats) and sarpanchs (head of panchayats) in south Kashmir, where Kulgam is located. Reports said the JeM’s purported threat along with a similar warning from the Lashkar-e-Taiba (LeT) earlier is the reason why around 20 panchs and sarpanchs have quit. A number have been shot at, mostly in their legs. Meanwhile, officials have denied such resignations. "None of the panchayat members have submitted their resignations officially," an unnamed official said. Another unnamed Police officer said, “(We are verifying) whether the posters were actually issued by militant organisations or someone else to keep them away from day-to-day work." India Today adds that locals say that posters of JeM were seen in villages of Pulwama and Shopian Districts this week, warning elected rural body members to resign within a week's time or face consequences. The posters were reportedly pasted on electricity poles, walls of mosques and shops in public places. Pulwama Superintendent of Police, Amit Kumar, admitted that three to four posters were seen in a few areas. "At some places posters were of LeT, at others they were of Hizb-ul-Mujahideen [HM] and Jaish. We are investigating the case. They might be posters of militants and there is possibility it could be foul play as well," the officer said. On June 8, more than a dozen such resignations and non-affiliations of rural body members, including women members, appeared in the local newspapers in the shape of advertisements, the report further added. "There is no force in the world that can bring the infiltration to zero level… it is never possible for us to bring the graph of infiltration level to zero level. Like the previous years, some incidents of infiltration have taken place but the number of attempts has definitely come down," said General Hasnain. He said that some incidents of infiltration have remained un-reported adding that the infiltration attempts made in strategically important areas get coverage in the media. "Usually the infiltration that takes place in the Uri sector gets media coverage while as occurrence of such incidents at other places do not find a place in media. We established contact with militants at some other places and even yesterday an infiltration attempt was foiled." He said that infiltration usually takes place in April and May adding that this year [2012] as the winter has been prolonged the attempts of infiltration may take place in June as well. He said Sopore, Baramulla, Kupwara and other areas of North Kashmir have direct impact of the infiltration attempts since they fall in vicinity of the Line of Control (LoC). Hasnain said that 300 militants are operating in the Kashmir Valley and that most of them are operating in North Kashmir. He also said that militants are trying to regroup in South Kashmir especially in Pulwama District. "We have reduced the night patrolling in the areas of South Kashmir and this may be the reason that militancy has been revived to some extent in South Kashmir especially in the Pulwama district. We are working in collaboration with Jammu and Kashmir Police and over the next two weeks we would be able to wipe militants who have come up yet again," said Hasnain. He further said that militants have changed their strategy and they are using cars for planting bombs. He said the car bomb blast at Bijbehara along with the recovery of explosives laden car from Chanapora area in Srinagar are significant reminders about this development on the militant front. "There are enough explosives with the militants operating in the Kashmir valley although the weaponry is less. It is quite possible that the militants may strengthen their ranks in Kashmir in the months to come. As such it is important to notice their movements and take steps that would defeat their designs," said Hasnain.

With the pressure of the Security Forces (SFs) building up on militants they are desperate to aim at soft targets across Kashmir Valley to make their presence felt, Director General of Police (DGP) K Rajendra said on June 11, Daily Excelsior reported. He said that there is lot of pressure on the militants operating in the State from their handlers across to act, adding, "And there are large numbers of soft targets available which militants aim at to show their presence." The DGP also said that all those strikes that were carried out in Srinagar in recent months have been carried out by militants who came from outside Srinagar for the purpose and fled soon after. He said that there are no known sleeper cells of the militants in Srinagar but didn't rule it out also. He said that militants target Srinagar and other towns for their high news value. The DGP said that there are no fresh recruitments of militants taking place in the State. He, however, didn't rule out few odd cases in parts of Kashmir Valley. He said that Lashkar-e-Toiba (LeT) is making desperate attempts to recruit youth in Sopore but they are finding it very difficult. "There is hardly any recruitment as there is no support for it. One odd child they may recruit," he said. The Police Chief said that despite the elimination of top ‘commanders’ and coming down of the infiltration, the militancy is not over yet. He said that there are still around 200-250 armed militants in the State. "They are mostly in South and North Kashmir with Central Kashmir being least affected", he added. The DGP said that Tral, Shopian, Sopore and Kulgam are affected by the militancy and any one can sneak in other areas of Kashmir Valley to carry out the strike due to easy connectivity. He said that location of Sopore and its background is the cause behind survival of militants in the area. He said proximity of Sopore to the Line of Control (LoC) through Bandipora, Kupwara and Baramulla, easy to operate and easy escape routes in the area are behind the growth of the militancy in the area. On the recent threat to Panchs (member of Panchayat, village level local self Government institution) and Sarpanchs (the head of Panchayats), the DGP said that some elements are spreading rumours and causing panic to subvert the elected system in the State. He said that there have been some incidents and some of the Panchs and Sarpanchs have been targeted for various reasons other than militancy. "It is not something alarming", he added. Rajendra, however, said that Police is investigating these cases where the Panchs and Sarpachs have been targeted and have been threatened through posters. "We have mapped these areas, mostly in South Kashmir, where these incidents have taken place and joint patrolling is being done by the security forces in these areas", he added. On financing of militancy, he said that SFs have managed to block various channels of funding militancy in the State. But, he said, they are using multiple channels. He said that Police have identified the people who are channeling hawala money and have managed to choke the funding to a great level. Rajendra said that there are various channels like money transfer and depositing of money into the accounts of Over Ground Workers (OGWs) from third country. "Other banking channels of funding militancy are also being used", he added. The Police Chief said that LoC trade is also being used to fund militancy in the State. He said that modus operandi is under invoicing of the goods. He said that six cases have been registered in funding of militancy through LoC trade routes of Uri and Poonch.

"We have been able to crack the conspiracy that was hatched to plant IED [improvised explosive device] in a car at Chanapora Bridge on May 17 and so far five arrests have been made. We are on lookout for the others and hopefully they too would be tracked down soon," said Mujtaba. "In order to disturb prevalent peace and public order a criminal conspiracy was hatched by the active militants of LeT outfit operating in the Tral and adjacent villages of the South Kashmir. Bilal Ahmad Bhat alias Bilal Lalihari resident of Lelhar-Pulwama, Sajad Ahmad Bhat alias Shadak resident of Zewan-Pantha Chowk and a Pakistani militant Qasim alias Qasim Bhai along with their other associates were entrusted with the responsibility to carry out IED explosion in the Srinagar city," said Mujtaba. He said Qasim Bhai was instrumental in supplying the ignition gadgets besides imparting training to other members of the module to trigger the IED. "Qasim Bhai coordinated the whole operation by providing money and arranged other logistics through a well knit over ground worker module. Mohammad Yusuf Lone coordinated with other members of the module to carry out the task. Yusuf used to work as source for the law enforcement agencies but later on switched over his loyalty to LeT," he said. "The explosive material was provided by Muzaffar brother of Sajad, who is an active militant of LeT. The explosive material was procured clandestinely from some of the magazines, which provide blasting material to the quarries operating in the Zewan and Khonmoh areas," he said. He added that on May 16 the explosive laden vehicle was brought by Sajad, Qasim, Bilal and other associates to the assigned place. The DIG further said, "An LeT explosive expert who is a foreigner had devised the car bomb which was detected in time and defused through a controlled explosion in Nowgam area of the city on May 17 by us. The explosive material used to prepare the bomb was locally procured by the militants. It comprised of gelatin sticks used locally for rock blasting," adds IANS. The attorney made this claim in his explanation of reasoning for the sentencing of Syed Ghulam Nabi Fai, executive director of US based Kashmiri American Council (KAC). He said the KAC was run by the ISI. "The KAC was incorporated on April 4, 1990. Fai admitted in a letter to the ISI in 1995 that he had already by that time been working with the ISI for more than a decade," MacBride said. Fai, however, had claimed the ISI-KAC link was only limited to receipt of funds from the spy agency. Fai had said he was approached by an ISI official with an offer to provide funding to KAC. Fai claimed he concealed his connections to the ISI because revealing them would have undermined "his credibility with his constituents and particularly with the government of India and the indigenous Kashmiri resistance." Fai was arrested in July 2011 and charged with being part of a long-term conspiracy with associate Zaheer to act as agents of the Pakistani government in the US without disclosing their affiliation. Fai was sentenced to two years in prison followed by three years of supervised release for conspiracy and tax violations last [2011] March. The sentencing was made in connection with a decades-long scheme to conceal transfer of at least USD 3.5 million from the Pakistani government to fund his lobbying efforts in the US. Police said that on June 15, Muhammad Abas Rather of the criminal investigation department (CID) was summoned for questioning regarding an incident. "During his search, police recovered a document written in Urdu containing information about how to prepare IEDs and how to use them. It indicated that the person was in league with militants and was planning to explode IEDs to terrorise people. Even though the person was with department of police and was an employee of the CID wing, he was in league with anti-national people and involved in terrorist activities," a remand application of Police reads. The accused, the application said, met Hizb-ul-Mujahideen (HM) militant Shabir Ahmad alias Adil in Tral area of Pulwama District. During the meeting, he demanded lakhs of rupees from the militant in lieu sharing information, it added. "Then he met Muhammad Ilyas, Riyaz Ahmad and Mukhtar Ahmad Sheikh. It was decided that militants would be provided pictures of police officials and their residential houses. They also decided to provide information regarding movement of police officials in lieu of huge money," the application reveals. Moreover, the remand application said that during investigation it was found that Rather was involved in ferrying weapons from one place to another. The Police hinted that more arrests are expected. The court remanded the four accused cops till June 30. On June 16, four intelligence sleuths - Muhammad Abas Rather, Riaz Ahmed, Mohammad Ilyas and Mukhtar Ahmad Sheikh - were arrested for their alleged links with militants. Of the four, Mukhtar is the same Policeman who was arrested in the aftermath of 26/11 Mumbai attacks for giving SIM cards to the attackers. "There is no change in the position. MHA’s position is that the Act must be amended and we have proposed three amendments to the Act which is under consideration of the CCS," he said. "Position of several people is that the Act must be repealed," he added. Chidambaram also said that the State Government wants some areas in the State, which are designated as disturbed areas under the Act, to be withdrawn from the purview of the Act before the amendments take place. "The position of the Government of Jammu and Kashmir is that pending the amendment of the Act in respect of some areas a notification declaring those areas as disturbed areas should be withdrawn. So these are well known positions. So we have to see how to go forward," he said. Chief Minister Omar Abdullah has proposed Districts like Jammu, Samba and Kathua in the Jammu region and Srinagar and Budgam in the Kashmir Valley, where form the start can be made. He said there were a few attempts by militants to cross into this side after snow started melting on higher reaches, particularly infiltration routes, but alert troops guarding the Line of Control (LoC) foiled their attempts and neutralised the infiltrators. "There are reports that the militants are trying to revive routes of infiltration in Rajouri and Poonch border Districts and also of ceasefire violations there", Dibagh Singh said. "There have been several attempts of infiltration in the past and also ceasefire violations in Rajouri-Poonch belts. Any infiltration attempt in this regard would be dealt with effectively on the ground along the border. There is a threat of militancy along the Moghal road", the IGP said. He said there have been increased infiltration attempts from across the border, possibly with the aim to sending more terrorists into Jammu and Kashmir before the onset of winter. "The militant groups are making concerted attempts to push the terrorists through the border. Security forces are dealing with them," he added. Sources further said inputs indicated that some terrorists belonging to Hizb-ul-Mujahideen (HM), Lashkar-e-Toiba (LeT) and Jaish-e-Mohammed (JeM) had crossed into the State during May while some more entered it by early July. The terrorists have started using infiltration routes from Uri and Nowgam sectors in Kupwara in North Kashmir that were being used in the 1990s and early 2000 and which have been since been lying dormant, the sources said.

"We have discovered a tunnel running between Pakistan and India in Samba District," Senior Superintendent of Police (SSP, Samba) Israr Khan said. The tunnel was detected after an area caved-in at two or three places due to rains near the Border Security Force's Chillayari Border out Post (BoP), he added. "After the cave-in, the area was dug out to know the reason. But, the authorities were surprised to find a tunnel," the SSP said. The tunnel, with a dimension of 3x3-feet, was running between Chillayari BoP and Pakistan's Numberiyal BoP, he said. Dug at a depth of 25-feet below the ground level, it was 400-metres long on the Indian side, the SSP said adding, "We are confirming whether the tunnel is operational or not." The tunnel, which seemed to be freshly constructed, had air supply through a 2-inch pipe, he said adding “we are looking into all aspects”. A local news agency reported that newspaper offices in Srinagar received a hand-written letter on August 1 that accused "some media men" of "working on the payrolls of the state and Indian government machinery" and warned "of strict action for anti-freedom movement journalism". One Abu Irfan has issued the letter. "We warn journalists to mend their ways or face dire consequences," it said. The letter warned editors against ignoring the warning and asked them to publish it in their newspapers. Earlier, KNS reported that members of eight little-known terrorist groups met under the ‘chairmanship’ of Lashkar-e-Toiba’s (LeT’s) Abdullah Ghaznavi and warned journalists "to remain away from security agencies and police officers". Journalists were warned against "strengthening the occupation and instead highlight the pain and suffering of Kashmiris due to oppressive state-sponsored policies" at the meeting, it reported. He, however, said that no advisory has been issued to the Police or protected persons barring them from going to Masjids or market places. The IMK in its statement issued to a local news agency announced "Operation Revenge" against the Police personnel and what it said "anti-movement elements." The spokesman of the outfit, Omar Mukhtar, told the news agency that the operation will be launched against the Policemen and officers on a large scale in a couple of days. He, however, asked the Policemen who have not been "anti-movement" to go to Masjids and other places without any fear. The IMK in its statement also claimed responsibility for the killing of Deputy Superintendent of Police (DSP, retired) Abdul Hamid Bhat, recent killing of Policemen in Kulgam District and at Daresh Kadal and Batmallo in Srinagar District and that of Inspector Bashir Gull at Tengpora in Srinagar in 2001. The IMK came to limelight in 2011 when it claimed assassination bid on the life of Law and Parliamentary Affairs Minister Ali Mohammad Sagar that took place in December 2011. Since then, it claimed several attacks that were carried out in Srinagar, mostly against Policemen. Of these, 28 were reported in 2009, 44 during 2010, 51 in 2011 and 31 between January and August till date, Minister of State for Home Affairs Mullappally Ramachandran told the Lok Sabha (lower House of Parliament) in a written reply. A total of nine security personnel were killed in the ceasefire violations during these years, he said. "Border Security Force (BSF) is the border guarding force along the Indo-Pakistan border. However, on the Line of Control (LoC), the BSF is deployed under the Army operations control in Jammu and Kashmir," the minister said. Altogether 49 incidents of firing were reported and six BSF personnel were killed between 2009 and July 2012. Of these, seven were reported in 2009, 26 in 2010, 11 during 2011 and five between January and July this year. While one BSF man was killed in 2009, two each died during 2010 and 2011, respectively, and one this year.

Jammu and Kashmir (J&K) Chief Minister (CM) Omar Abdullah on August 15 assured that Armed Forces Special Powers Act (AFSPA) would be revoked during our tenure in office, reports Daily Excelsior. Abdullah said: "Talks on AFSPA are going on. I regret so far we have not reached a stage when AFSPA can be removed permanently. Talks are still going on and I am satisfied with these talks. I have no hesitation in saying that we wanted to reach a position where we could revoke the AFSPA from some areas of the State. But, unfortunately, we have not reached that point yet. There are several reasons for it. I can say with surety that the revocation of AFSPA would take place during our tenure in office." Omar said that it is his endeavour to reduce the footprints of the Security Forces (SFs) in the State. “I am taking pride in revealing it that all schools have been vacated by the security forces. 250 other buildings under the occupation of the Security Forces have also been vacated. More than 40 bunkers have been removed from Srinagar city. Perhaps nobody hoped we could remove the bunker from Lal Chowk. Ten battalions of the CRPF have already been de-inducted and sent back", the CM said. On rehabilitation he said, "We are slowly implementing the rehabilitation for those who want to return back without guns and the policy is producing encouraging results. This policy is only for those who return not to join militancy, but live peacefully." The Chief Minister said that during last year, 60 people have returned under the policy and this year 70 such cases have been cleared. He made it clear that this policy is available only for those youth who have gone for training but not took to gun and indulged in militancy. He said the press reports regarding a person who was arrested after his return do not reflect the factual position. He said the said individual was involved in militant activities and had crossed Line of Control (LoC) on various occasions. Omar said that the graph of violence has come down during past few years. He said 370 violence incidents took place in 2010, 190 militancy related incidents took place in 2011 and only 90 in 2012. He said that 50 civilians were killed in the militancy related incidents in 2010, 31 in 2011 and 8 in 2012. He said that 70 SF personnel were killed in 2010, while 33 were killed in 2011 and 7 in 2012. Abdullah also urged separatists to shun path of violence and join the dialogue process for lasting peace in the State. "Let you come forward and talk for achieving a breakthrough on table which gun could not deliver in 20 years", said Omar, adding, "Dialogue process is only way forward to address it effectively and meaningfully. When they are ready to talk with one country there should be no reason for them not to talk with other country."

Sahai said that arrested policeman, Abdul Rashid Shigan, a constable of the armed Police and posted with the security wing, was operating under the shadow name of Omar Mukhtar and General Usman. "He was acting as spokesman for Kashmir Islamic Movement, a shadow outfit of Hizb-ul-Mujahideen", the IGP added. He said that Shigan was working in coordination with a released militant, Imtiyaz Ahmad alias Raashid, in carrying out the attacks. He said that Shigan had a militancy background before he joined Police force in 1998. "He was an Over Ground Worker of Harkat-ul-Mujahideen. He was discharged from Police department while undergoing training for his involvement in militant activities and detained under Public Safety Act for one year. He was reinstated on court orders in Police department in 2002", added Sahai. He was recently transferred to security wing of the Police and was performing duty with Superintendent of Police Bandipora. The IGP said that Shigan confessed carrying out 13 attacks in Srinagar since January 2011. The IGP said that during the raid and searches conducted on the house of Shigan one coil electric -wire, one mine, two radio sets kenwood , 11 Batteries, one radio set Frequency setter, four Chinese pistols, six pistol magazines, 100 rounds of pistol ammunition, five grenades, two knifes, 13 UBGL shells, one Kiran Kove rifle, two AK 47 rifles, 16 AK 47 magazines, large quantity of AK ammunition, two UBGL thrower, two kits for cleaning, two pouches, one fire extinguisher, three bags, one water bottle, one first aid kit, one ladies hair wig, two scooter helmets, four grenade pins, one IED and 11 detonators were recovered. Sahai said that besides this, his hand writing matched with the statements he was issuing to the press and a cell phone that he used to call a local news agency was also recovered. S M Sahai also said that Police have to rethink and conduct scrutiny of Police Force that has been on the forefront of fighting militancy in the State after involvement of Policemen in militant activities came to light. Sahai said that militants are adopting new tactics of forming small modules, which were very difficult to uncover. He said that normally any militant attack that took place in Srinagar was solved in a couple of months but for the past 18 months [January 2011 to July 2012] police had failed to uncover these 13 attacks which took place in Srinagar. He said that subversive activities of such kind where Policemen are involved are possible in militancy infested areas but Police have been able to uncover it. He said that such modules are working independently and they are difficult to uncover. He further said that the attacks they carried out had given an impression that militancy is on the rise in Srinagar. "However, this is not correct. Statistically also the number of incidents has come down compared to last year," he added. It may be mentioned here that four Policemen were arrested in June 2012 for militant links and carrying out subversive activities in Srinagar city. "With the arrest of Shigan all these cases have been solved," Sahai said, adds India Today.

Infiltration attempts and the number of terrorists successfully entering Jammu and Kashmir from across the Pakistani border has come down in the last five years based on figure collated by intelligence agencies, Parliament was informed on August 22, reports Newstrack India quoting IANS. Defence Minister A.K. Antony told the Rajya Sabha (Upper House of Parliament) during question hour that only 103 terrorists had attempted to infiltrate from January to June 2012. Just 38 were successful. The numbers were 342 in 2008, 485 in 2009, 489 in 2010 and 247 in 2011. Of them, 57 terrorists were successful in 2008, 114 in 2009, 95 in 2010 and 52 in 2011. These figures are based on the assessment of the Multi-Agency Centre on Infiltration into Jammu and Kashmir. The Security Forces have not apprehended any terrorists and none have surrendered in 2012. But in 2008, the number of apprehended/surrendered terrorists was six. The figure was nine in 2009 and one each in 2010 and 2011, Antony added.

He ruled out re-settlement of the border villagers from the firing range to other places. In another context he did not rule out the presence of other tunnels similar to 540-metre underground passage along India-Pakistan border in Samba District, which was detected on July 28. Eight incidents of firing and ceasefire violations have been reported from IB within a span of over 20 days after detection of the tunnel. Regarding the firing from the Pakistani side, he said, "One reason which we could make out is to that probably it was to mask the construction of tunnel, which is in our sector. Normally what we used to see was sporadic firing that they wanted to cover infiltration. In other sectors (Chilyari) —we understand that firing would have been done to show that we do not detect the tunnel". Singh said while in some sectors, "some reasons for firings are apparent, but in other areas it makes us suspicious and we need to take it up with Pakistan." Asked if the firing was aimed at halting the Geological Survey of India from uncovering any "tunnel network", he said, "they cannot stop them (GSI. Survey will happen. Army on September 16 intensified its operation in Uri forests after militants trapped by them in the evening of September 15 proved to be a group of recently infiltrated militants from Pakistan occupied Kashmir (PoK). An unnamed Army officer said that they had information about the presence of two militants in the Lacchipora forests of Uri when they launched an operation. Now it has been established that it was a group of at least 3-4 militants of Lashkar-e-Toiba (LeT), who had managed to infiltrate through Kamalkote sector of Uri on September 2. The Army had claimed on September 2 that the infiltration bid was foiled by Army after they found a group of heavily armed militants trying to infiltrate into Kashmir valley by crossing the fence in Kamalkote sector of Uri. However, the General Officer Commanding (GOC, 19 Division), Bipin Rawat, had told reporters then that Army had apprehensions about infiltration of some of the militants as they had noticed marks near the fence. The GOC had said that day that Army had noticed movement of around three infiltrators near the fence on September 3 but they were fired upon and after that they didn't notice any forward movement.

"We condemn the killing of village Palhalan sarpanch and demand security for the elected members in the areas affected with militancy," Kulbhushan Khajuria, working president, All Jammu and Kashmir Panchayat Coordination Committee (AJKPCC). "The brutal killing of elected representatives is a murder of democracy," he said, adding that so far seven Panchayat members have been killed, since about 33,000 members were elected in 2011 polls. "The government ignored the security concern besides safety of the Sarpanches and Panches in vulnerable areas that has led to the repeated killings," he added. He stressed, "If immediate steps are not taken, the panchayat members would tender their resignations as about 500 members had already resigned following threats from militants." As reported earlier, militants in the evening of September 10 shot dead Ghulam Mohammad Yatoo, Sarpanch of Palhalan as soon as he came out of the Mosque after offering evening prayers.

Terming the security situation in Jammu and Kashmir (J&K) “very fragile” as the State was passing through a sensitive stage of transformation, General Officer Commanding-in-Chief (GOC-in-C), Northern Command, Lieutenant General KT Parnaik said on September 19 that the terror attacks on sarpanches (head of Panchayats, village level local self Government institution) and civilians are a cause of worry. Parnaik said, "We (state) are transforming from high intensity proxy war to lower levels of violence but the situation never the less is very fragile. The security situation in the state today as general-- I would say is passing through a sensitive stage of transformation." He cautioned against "triggers" which could alter the situation in a short span of time. Talking of solutions, he said, "Therefore, there are three things which are important-- first thing-- ability to check and prevent infiltration-- to that extent we have strengthen our deployment along LoC [Line of Control] and we are ensuring that maximum infiltration attempts are negated. However, some infiltration bids do succeed and as result there is influx of some new terrorists in the state-- but they have not been able to create any perceptible violence. The worry is that they have been targeting police, sarpanches and other civilians-- it is a cause of worry. The need of the day is to dominate areas and not to allow resurgence of terrorism in the state that is our focus". Regarding another question about the killing of militants this year, he said that 44 militants have been killed and 24 have been arrested in 2012. The militants have been neutralised, their leadership have also been eliminated and infiltration is down, he added.

To a query whether a repeat of 1962 was possible, the Army Chief, without naming any nation, asserted that such an event would not be repeated as the forces had got plans in place to protect the nation’s territorial integrity. Jammu and Kashmir (J&K) Chief Minister Omar Abdullah on September 26 describing the attack on Panchayat (village level local self Government institution) members as militancy issue said that the Government will not bear the attack on defenceless Panches (member of Panchayat) and Sarpanches, (head of Panchayat) according to Daily Excelsior. Omar said that Government would not remain a silent spectator to these attacks and would take all necessary measures to ensure the security of Panches and Sarpanches in vulnerable areas of the State. Though he made it clear that Government can't provide security to each Panch and Sarpanch, Omar said that Government will take threat assessment of these members and if need is felt for personal protection of Panches and Sarpanches Government has no reservation in providing security to them at individual level. He said that Government will secure the areas where these members face security threat. Terming the militants as cowards for attacking Panchayat members, he dared them to attack him and said that they will not do it fearing befitting reply. He said: "They are attacking defenseless people. If they have the courage let them carry out an attack on me. But they will not do it as they know they will get a befitting reply." He also rejected the implementation of 73rd and 74th amendments of Indian Constitution empowering Panchayats in the State. "There is no need to implement 73rd and 74th Amendment of Indian Constitution in the State. I am not accepting it", added the Chief Minister. Omar said that the State has its own constitution and "we will make major amendments in it to empower the Panchayats". Omar said that his Government is strengthening the Panchayat Raj system in the State and so far powers of 14 departments have been transferred to the Panches and Sarpanches. He also said, “So far, we have only received 50 resignations since the Panchayat elections were held last year [2011]. None of these resignations have been accepted so far." He said that Government will hold by-elections wherever the Panches and Sarpanches resign. "Even if vacancies through resignations arise, I will ensure that the byelections are held at the earliest," he asserted. The Times of India quoted him as saying, "I want to remove the misgiving that panchayat chiefs are being killed and the Government is silent. The media is also overstating their resignation claiming 120 have quit whereas the Government has received resignations of only 50 panchayat chiefs. No resignation has been accepted." While 50 sarpanches have already sent in their resignation letters, they were joined by 70 others who issued advertisements in newspapers declaring they were quitting after threats from Lashkar-e-Toiba (LeT), the report added. India Today reported that mass resignations by panchayat members and heads continued unabated in the Kashmir valley. As many as 90 panchayat members resigned from their posts on September 26. Earlier, more than 70 of them had quit on September 25.

"Slowly and steadily our numbers are reducing...Footprints are reducing. It is a solid and positive indicator," the DG said when asked if the force would bring its numbers down in the militancy affected State. "We are now undertaking joint training with the State police and the year 2011 has been fairly successful for us," said. Senior officials said that from 70 battalions, the CRPF is down to 66 battalions over the last few years. Each battalion has about 1,000 personnel.

Army on September 28 said that around 600 militants are waiting across the Line of Control (LoC) in Pakistan occupied Kashmir (PoK) ready to infiltrate into Kashmir valley before the onset of winter, reports Daily Excelsior. General Officer Commanding (GOC) of Kupwara based 28-Division of Army, Major General Lalit Pandey, said that Army this year [2012] foiled infiltration bids along the LoC and have killed some of the militants while others have fled back to the PoK. "This has made militants desperate and they will make last ditch efforts to infiltrate in large numbers", he added. Major General Pandey said that the militants are using both LoC in Kashmir valley and neighbouring country, Nepal, as infiltration routes. The GOC said that it is the new trend of the militants to smuggle arms and ammunition into Kashmir and dump it near the LoC before transporting it to Kashmir valley. He described it as an alarming situation. Commenting on the earlier reported recovery of arms and ammunition on September 27 he said, "All these weapons are Chinese make and were wrapped in Chinese and Pakistani newspapers." He, however, ruled out Chinese support to militants in Kashmir. He said that Army has no intelligence inputs about China supporting militancy in Kashmir. The General also said that by smuggling this type of weaponry into Kashmir valley, the militants are intending to increase the level of violence. "The smuggling of short range weaponry suggested that militants are aiming at soft targets like Panchs and Sarpanchs", he added.

The Jammu and Kashmir (J&K) Government on October 3 said that at least 117 Kashmiris have returned home from Pakistan via Nepal in last three years in the wake of ‘rehabilitation policy’ announced by the State Government, reports Kashmir Watch. In a written reply to the State Assembly, Chief Minister Omar Abdullah, who is also Minister in-charge Home, said out of these 117 persons, 34 have brought their families along with them. As reported earlier, the State Government had announced the ‘rehabilitation policy’ in November 2010 for the youth who had crossed over to Pakistan occupied Kashmir (PoK) from 1989 to 2010 for arms training and now want to return home after abjuring violence. Daily Excelsior reported that Chief Electoral Officer (CEO) Umang Narula, the Election Authority under Panchayati Raj Act announced election to the posts of chairpersons of 143 Block Development Councils (BDCs), including 77 in Kashmir Valley and 66 in Jammu region, which would be held on November 7. Counting of the votes shall start immediately after the elections and results will be declared by the evening. The elections will be held on non-party basis, like the Panchayat elections. This is going to be the first ever elections to the BDCs. The Electoral College for the BDCs comprised 33,500 Sarpanches and Panches. Out of a total of 4098 Sarpanches, 2145 were in Kashmir division and 1953 in Jammu division while out of 29,402 Panches, 15,767 were in Kashmir divisional and 13,635 in Jammu division.
