Mohan Baidya-led Communist Party Nepal-Maoist (CPN-Maoist-Baidya) General Secretary Ram Bahadur Thapa on September 1 directed the party’s rank and file to be mentally prepared to even take up weapons, should the need arise, to disrupt the Constituent Assembly (CA) elections scheduled to be held on November 19, reports The Himalayan Times. Thapa said, “The government and major political parties are planning to deploy Nepali Army personnel to hold Constituent Assembly poll. So, you have to be ready even to carry arms.” He further said his party would supply weapons to its cadres in every village to foil the election at any cost. He also directed party cadres and leaders to initiate discussion on nationalism and democracy with the public and other political parties too. “The weapon of ideology is the strongest one in the world. So, make your ideology revolutionary,” Thapa added.

A meeting of the High-level Political Committee (HLPC) on September 3 agreed to increase the Constituent Assembly (CA) seats to 601 to make a final attempt to bring the poll-opposing parties on board the election process, reports Kantipuronline.com. The decision was taken after the Federal Socialist Party Nepal (FSPN) led by Ashok Rai said it will go to the polls if the CA has 601 members. On March 13, the parties agreed to form a 491-member CA, while on August 15 the HLPC decided to form a 585-member assembly to address the demands of the Federal Democratic Front (FDF), led by the Madhesi Janadhikar Forum-Nepal (MJR-N). Cross-party leaders seem confident that the FSPN will join the election process if 601 will be the number of lawmakers.

The agitating Mohan Baidya led Communist Party of Nepal-Maoist (CPN-Maoist-Baidya) has conducted an underground combat training for its cadres in Rukum District with a view to preparing them for disrupting the Constituent Assembly (CA) polls scheduled for November 19, reports Myepublica.com on September 5. During the weeklong residential training held at Garayala village in western Rukum District, 36 cadres were trained in warfare skills. CPN-Maoist-Baidya District leader Sher Bahadur KC said, “For now, we have trained our cadres in self defense. We gave only theoretical training on using weapons as giving a practical training would send a wrong message.”

The Communist Party of Nepal-Maoist-Baidya (CPN-Maoist-Baidya) led 33-party alliance claimed on September 4 that the High Level Political Committee’s (HLPC) plan to mobilise the Nepal Army in upcoming Constituent Assembly (CA) elections scheduled to be held on November 19 is a plot to ignite conflict in the country, reports Nepal News. In a meeting, the alliance reached a conclusion that if Nepal Army is misused in the name of security in the elections then the “consequence could be very serious”. According to officials, preference will be given to those who have retired from the Nepal Army, Nepal Police, and the Armed Police Force. Such a policy will help make the temporary Police more impartial and less likely to be influenced by poll-opposing forces. Preference will also be given to people who had applied for jobs in the country’s security agencies, but failed to get selected. However, the Terms of Reference for such a force is yet to be prepared. The ministry is likely to invite applications for the 45,000 posts by September 17. The temporary personnel will be recruited for a period of two months and paid a monthly salary of Rs 15,000, while daily and ration allowances will be given as per the rules and regulations of the Nepal Police.

The party has prepared a list of around 500 people including Government and non-Government staffers, entrepreneurs, businessmen and contractors as possible donors. The party has demanded donations ranging from Rs 20,000 and Rs 2, 00,000.The campaign has unleashed terror among businessmen, entrepreneurs and employees in the District. The CPN-Maoist-Baidya leaders claimed that the "donation campaign" has bearing on the current political situation and insisted that it is totally a political campaign. The Government on September 22 proposed to form a four-tier security mechanism for the upcoming Constituent Assembly (CA) elections scheduled for November 19, reports Republica. The Home Minister, Home Secretary and top officials of all four security agencies - Nepal Army (NA), Armed Police Force (APF), Nepal Police and National Investigation Department (NID) - briefed the Election Commission (EC) about the integrated security plan for the elections. According to the integrated security plan prepared by the Government, around 62,000 Nepal Army personnel will be deployed as backup force during the CA polls. Similarly, 54,000 personnel from Nepal Police, 22,000 from APF and over 44,000 temporary personnel will be used for election security. The EC will form a Joint Election Operations Committee (JEOC), which will coordinate the security committees.

A meeting of the Council of Ministers on September 23 recommended President Ram Baran Yadav to remove constitutional hurdles so that the national army could be assigned security role during election, reports Nepal News. As per the provision of Article 145(5), army can be mobilized only during natural disasters. If army has to be mobilized for any grave reason, the Council of Ministers has to pass a proposal to be endorsed by the parliament within one month. As there is no parliament at present, it is necessary that the President removes constitutional barrier by amending this article by enforcing the President's prerogatives as per Article 158 of the constitution. Once the President approves the Cabinet proposal, Nepal Army can be mobilized along with police, armed police and the temporary police for the election purpose.

The party has sent electronic messages, letters and made threatening phone calls, demanding donation from individuals, state-owned institutions and private companies, including schools, banks, manpower agencies and industries. CPN-Maoist-Baidya leader Haribhakta Kandel admitted collecting ‘monetary assistance’ from the business community. Though he said the way they are collecting funds does not amount to extortion, those who received the letters and the phone calls said it was clear extortion. An official of a leading commercial firm in Narayanghat District said “We have received some emails from CPN-Maoist cadres, demanding money and they have also made follow-up calls which sounded very threatening. They have also said that the staff will have to raise the money themselves if the firm fails to pay the party.”

A special bench of Justice Susheela Karki, Girish Chandra Lal, and Prakash Wosti issued an order to this effect in response to a writ petition filed at the SC against the Prime Minister’s Office and the EC demanding that the murder convicts as well as those against whom charges of heinous crimes have been framed by a court of law be debarred from contesting the Constituent Assembly (CA) polls. The SC also scrapped the September 23 stay order by SC Justice Tarka Raj Bhatta that effectively allowed murder convicts to contest elections. The latest SC verdict has now barred all murder convicts, including Unified Communist Party of Nepal-Maoist (UCPN-M) leader Bal Krishna Dhungel, to file candidacy for the November 19 elections to the second CA.
