ATS told the court on January 1, that the conspiracy to cause serial bomb blasts on Jangli Maharaj Road was hatched by the seven arrested suspects in Saudi Arabia, reports The Times of India. The ATS said the custodial interrogation of the suspects, revealed that they were constantly in touch with the absconding suspects, Fayyaz Kagzi, Riyaz Bhatkal and three others involved in a string of terror attacks in India so far. Investigations also revealed that one of the absconding suspects is a militant of the terror outfit Lashkar-e-Toiba (LeT) and he is involved in inciting youths from Aurangabad, Beed and Ahmednagar (three District of Maharashtra) to indulge in terror activities. A Pakistani national, identified as Mohammed Hussain alias Julfikar Ali, who was on death row since 2006 until the Supreme Court set aside his conviction and ordered his retrial in August, 2012, was acquitted by a Sessions Court in New Delhi on January 4, reports The Hindu. The court noted “substantial lapses” in the Delhi Police investigation into the 1997 blast in a Blueline bus near Punjabi Bagh in West Delhi killing four persons and injuring 24. Among the lapses, Additional Sessions Judge Pawan Kumar Jain found that the Delhi Police did not prepare a site plan, did not consider taking photographs of the inner portion of the bus, exhibits lifted from the spot were not sealed and no effort was made to prepare the sketch of the suspect. “The prosecution has failed to bring home the guilt of the accused beyond the shadow of reasonable doubt,” the Judge said.

Mumbai Police arrested two persons, identified as Farooq Naiku and Mohammed Talukdar, suspected to be linked with Hizb-ul-Mujahideen (HM) from a guest house at Masjid Bunder in Mumbai (Greater Bombay District) along with Fake Indian Currency Note (FICN) worth INR 27, 200 on January 16, reports Indian Express. They were produced before a local court the next day and remanded in Police custody till January 23, 2013. They had also carried out recce of various vital installations across the country. Farooq has been to Pakistan and Pakistan occupied Kashmir (PoK) via Wagah border in Amritsar (Punjab) on several occasions since 2001 form training. Officially, he has crossed the Indo-Pak border three times. Farooq had been reporting to a HM "commander" in Jammu and Kashmir (J&K) and also took part in the agitation over the Amarnath land transfer controversy in the state in the year 2008, Police added. Joint Commissioner of Police (Crime) Himanshu Roy said, "We have evidence that he has photographed Uri Dam, Uri power project, Baramulla Bridge and graves of terrorists killed during operations by security forces… He had even attempted to infiltrate into the Indian Army”. Farooq has been tasked with gathering information related to Indian troops' movements in J&K, public protests and other developments. He passed on the information either through telephonic conversations, mails or by crossing the border, to his Pakistani handlers and intelligence agencies. The second accused Talukdar, who hails from Assam, is also suspected to be an active member of the terror outfit and had been helping Farooq in FICN operations. "We are ascertaining Talukdar role in detail," Roy said, adding Police were trying to find out if the accused had played any role in violence in Azad Maidan (Mumbai) on August 11, 2012.

Headley was ordered to serve 35 years, followed by five years of supervised release by US District Judge Harry Leinenweber. "Mr Headley is a terrorist," the judge said while imposing the sentence in the court. Leinenweber also said, "He commits crime, cooperates and then gets rewarded for the cooperation. No matter what I do, it is not going to deter terrorists. Unfortunately, terrorists do not care for it. I do not have any faith in Mr Headley when he says that he is a changed person now. I do believe that it is my duty to protect the public from Mr Headley and ensure that he does not get into any further terrorist activities. Recommending 35 years is not a right sentence."

The Supreme Court (SC) stayed a Calcutta High Court judgment directing West Bengal to treat arrested members of the Communist Party of India-Marxist-Leninist (CPI-ML) as “political prisoners” by declaring the outfit a “political movement,” reports The Hindu. A Bench of Justices, Aftab Alam and Ranjana Desai, was acting on the State Government’s appeal challenging the rationale of the August 8, 2012 High Court verdict. The High Court had declared CPI-ML Spokesman Gour Nararayan Chakraborty, who was facing charges under the Unlawful Activities (Prevention) Act, a “political prisoner” under the West Bengal Correctional Services Act, 1992. Six other Maoists facing similar charges — V. Venketeswara Reddy, Sambhu Soren, Sagan Murmu, Chatradhar Mahato, Sukanti Baskey and Prasun Chatterjee — had also secured similar privileges from the High Court. The State asked whether an active member of a declared terrorist organisation could claim to be a political prisoner. “The judgment has wrongly held that even terrorist activities would amount to a political movement and therefore participants in such terrorist acts would be political prisoners.”

Supreme Court today (March 21) upheld death penalty to March 12, 1993 Mumbai (Maharashtra) blasts case (which killed 257 people and injured 700) mastermind Yakub Memon, reports IBNLive. The apex court reduced death sentence of 10 others to life imprisonment. Yakub is brother of Ibrahim Mushtaq 'Tiger' Memon, one of the prime accused of the attacks. Yakub Memon was convicted in the 1993 Mumbai blasts case and has been in jail since he returned to India and surrendered in 1994. Supreme Court observes, "Yakub Memon and all absconding accused including Dawood Ibrahim were archers and rest of the accused were arrows in their hands." Supreme Court says, "Police, customs and coastal guards are also to be blamed for 1993 Mumbai blasts." Court further added that the training of convicts materialised in Pakistan. The apex court adds that management and conspiracy of 1993 blasts were done by Dawood Ibrahim and others in Pakistan. Supreme Court says that Pakistan's intelligence agency Inter-Services Intelligence (ISI) was also involved in the 1993 blasts. Supreme Court upheld life terms of 17 convicts in the 1993 Mumbai blasts case and commuted death sentence of 10 convicts to life imprisonment on the ground that the convicts were behind bars for 20 years and their economic condition was weak. Supreme Court asks all accused to surrender within four weeks. Actor Sanjay Dutt is also sentenced for five years in jail by the Court. However, the apex court has reduced his sentence from six years to five. Sanjay has not been granted any probation and will have to spend three years and six months in jail.

The Shillong Times reports on May 31 that the magisterial probe into the killing of three breakaway factions of Achik National Volunteer Council (ANVC-B) militants at Dobu, Chittingbing village in East Garo Hills District of Meghalaya on March 9, 2013 revealed that no sufficient time was given by the Security Forces to the cadres to surrender. There were only one or two houses nearby and the nearest being the house of Bialson Sangma, who is also the father-in-law of Sengkut Sangma”.

The court upheld the prosecution's contention that Mozawala, provided information regarding key defence establishments and public infrastructure to his handlers posted at the Pakistan High Commission in Delhi, and convicted him for spying, establishing contacts with foreign agents, and abetting violation of secrecy under sections 3(1)(c), 4(2), and 9 of the Act. The court, however, didn't find him guilty of criminal conspiracy under the Indian Penal Code (IPC). At the time of arrest he was found in possession of incriminating documents that included maps and photographs of Western Naval Command in Mumbai (Maharashtra), another defence establishment in Lonavala, the Bandra Worli Sea Link, and the Koyna Dam in Satara. The investigators also found pen drives and CDs that contained coded telephone numbers of 87 defence establishments across the country, besides a handbook which listed tips on how to not raise suspicion, evade arrest, and communicate with other aides through cryptic emails. The National Investigation Agency (NIA), probing conspiracy of Indian Mujahideen (IM), in its first chargesheet filed on July 17, traces the origins of the banned outfit and details its agenda but fails to find any exhaustive evidence, according to Indian Express. The 42-page chargesheet was filed in a case against 12 IM operatives, including Yasin Bhatkal, Riyaz Bhatkal and Iqbal Bhatkal registered in September 2012. In what reads like a compilation of previous chargesheets filed by various state police and the special cell of Delhi Police, it states that "IM was formed in or around 2003 end in the wake of communal mobilisation due to factors like Babri Masjid demolition and Gujarat riots". According to the NIA, IM was formed after a group of certain ultra radicalised Muslim youths segregated themselves from Students Islamic Movement of India (SIMI). Without substantiating, NIA claims, "Source information revealed that IM is receiving regular funding from abroad..." It goes on to say that IM is undertaking "large-scale recruitment" for acts of terror with "active support from their Pakistan-based associates and sleeper cells within the country". NIA further says, "IM does not believe in the Constitution and believes in waging war against India." However, the NIA has no idea on the means of communication used by the outfit to contact its cadre. The chargesheet says the group recruits cadre by "engaging them in discussions".

The Supreme Court on August 14 dismissed Khalistan Liberation Force (KLF) terrorist Devinderpal Singh Bhullar's plea seeking a review of its verdict refusing to commute his death sentence to life imprisonment on the ground of delay in deciding his mercy plea by the government, reports NDTV. A bench headed by Justice GS Singhvi refused to review its April 12, 2013, verdict by which it had rejected his plea for commuting the death sentence to life imprisonment Bhullar was convicted and awarded death penalty for triggering a bomb blast here in September 1993, killing nine people and injuring 25, including then Youth Congress president MS Bitta. The National Investigation Agency (NIA) has got a non-bailable warrant issued against former Kashmiri militant Liyaqat Ali Shah’s aide Sabir Khan Pathan in case related to Shah’s arrest, Hindustan Times reports on August 19. “Investigators suspect that a person named Sabir Khan Pathan, who had been seen in and around the Lodhi colony office of the special cell for the past eight years, planted arms and ammunition at a guest house in the Jama Masjid area. Witnesses have seen moving him around the special cell office and in the guest house. The NIA sleuths managed to find Sabir’s photograph from the album of a marriage he attended in Madhya Pradesh a few years back,” said an unnamed Union Ministry of Home Affairs official. “Sabir had given the special cell barrack as his address to obtain the mobile number. Investigators have tallied his movement by tracking the location of his mobile phone,” said the official. Sabir is missing ever since his name figured in the investigation. Liyaqat Ali Shah, who had been living in the Pakistan occupied Kashmir (PoK) for the past 17 years, was arrested by the Delhi Police special cell on March 20, 2013, from Sanauli in Uttar Pradesh on the Indo-Nepal border. The Delhi Police which arrested him on charges of plotting terror strikes had claimed that an associate of Liyaqat had left the arms and ammunition in the guest house. However, the NIA took over the investigations later and Shah got a bail on May 17, 2013, and is at present in his home in North Kashmir. Meanwhile, the NIA on August 19 examined Deputy Commissioner of Delhi Police Sanjeev Yadav and Assistant Commissioner of Police Manish Chandra in connection with the probe.

Indian national Mohammad Niaz Abdul Raseed was sentenced to eight years of prison for “criminal conspiracy for the preparation of a terrorist act” by the Paris (France) Criminal court on September 30, reports Hindustan Times. Niaz was part of the group of eight in which rest were sentenced to between 18 months and five years. Niaz had been under detention since his arrest in France in 2011. Nearly all the evidence produced in the court against Niaz was through internet surveillance carried out by French authorities. A French version of a website (Ansar-alhaqq.net), which also exists in English and Arabic, seems to have been an important source not just for Niaz and his group but also for Mohammad Merah, the “scooter killer” who gunned down seven people, including children and French soldiers, in the south of France in 2012.

The National Investigation Agency (NIA) on October 2, secured first conviction in a terror case involving Lashkar-e-Toiba (LeT) operatives, reports The Times of India. An NIA special court convicted 13 operatives linked to LeT, including T Nazeer and Sarfaraz Nawaz, for recruiting youth from Kerala for terror training and planning attacks across the country. Four of these recruits had been killed in an encounter in Kupwara, Jammu and Kashmir, by Security Forces in 2008. Sarfaraz Nawaz was the key conspirator who had also provided finances and logistic support to the LeT network operating in Kerala under T Naseer, NIA sources said. "We have conclusively proven that the accused persons facilitated the movement of five boys from the state of Kerala to the Jammu and Kashmir to undertake arms training and wage 'jihad' against the country. These boys had not only been trained by LeT in 2008, but had also taken part in an armed action against the security forces in the Lolab forests of Kupwara which had resulted in the death of the four of the five youth," said an NIA officer.
