A Dantewada District court has granted bail to the Essar general manager, who is one of the accused in the alleged payouts of the protection money by the multinational to the Communist Party of India-Maoist (CPI-Maoist) in Chhattisgarh, reports The Economic Times. Observing that the case of the accused DVCS Verma is different from that of the other accused, the district and sessions court judge A K Beck granted him bail saying the Police have failed to produce enough evidence against him even three months after his arrest, defence counsel K K Dubey told reporters on January 4. The court ordered Verma's release on two bonds of INR 200,000 each, he said.

A local court on January 5 acquitted five persons, including four former activists of Babbar Khalsa, in a case related to unlawful activities, illegal possession of explosives and fire arms, according to CNN-IBN. The acquitted Babbar Khalsa activists were identified as Baljit Singh Bhau, Sukhwinder Singh Sukhi, Buta Singh, Balwinder Singh Dekwala. Daljit Singh Bittu, president of Akali Dal (Panch Pardhani), was also acquitted. However, the court found one person, Harminder Singh Cherrian, guilty and sentenced him to three years imprisonment and also imposed a fine of INR 5000 on him. A case was registered on November 15, 2009, against seven persons under Unlawful Activities Act, Arms Act, Explosives Act and various sections of the IPC and they were arrested. Apart from the four Babbar Khalsa activists, Daljit and Harminder, Khalistan Liberation Force terrorist Daya Singh Lahoria had also been arrested in the connection. However, Lahoria was acquitted by a court few months back.

A Court in Allahabad on January 12 sentenced Amir Mahfooz, the main accused in a Fake Indian Currency Note (FICN) case to eight years of rigorous imprisonment and imposed a fine of INR 75,000 under Section 389 B and 389 C of Indian Penal Code (IPC), reports Times of India. FICNs worth INR 6,500 were recovered from his possession on August 14, 2008 by a team of Ghoorpur Police near Iradatgunj Railway Station. At that time, Mahfooz's links were also traced with the the Students Islamic Movement of India (SIMI) and he was found involved in illegal activities.

The Bombay High Court (BHC) on January 14 cleared the way for a Islamabad’s Judicial Commission to visit Mumbai in connection with November 26, 2088 (also known as 26/11) terror strikes probe in the first week of February, reported The Times of India. The Court informed the Centre that the in-principle approval for the Commission's trip has been given and they could come in the first week of February. "India will in a day or two convey the High Court's view and availability of dates to Pakistan. The exact date will, however, be decided by Islamabad depending on convenience of the panel," said an official. The Commission is supposed to take statements of officers linked to the 26\11 probe, including additional chief metropolitan magistrate R V Sawant Waghule and Investigating Officer Ramesh Mahale, and also the doctors who carried out the post-mortem of the terrorists killed during the attack. The delegation will include Khalid Qureshi, the head of the Federal Investigation Agency's Special Investigation Group and two main prosecutors Muhammad Azhar Chaudhry and Chaudhry Zulifqar. Since representatives of the defence lawyers too would be part of the Commission, five counsel of seven Pakistani suspects charged with involvement in the 26\11 attacks had informed the Anti-Terrorism Court there that they were prepared to go to India.

A suspected sympathizer of the Liberation Tigers of Tamil Eelam (LTTE) was arrested by Kochi city Police from Chengalpettu in Chennai in connection with a human trafficking case involving Sri Lankan Tamils, reports Times of India. "We brought the accused from Chennai on Sunday [January 15] and presented him before the local magistrate, who remanded him in judicial custody," Police officials said. The case pertains to the incident in which an international human trafficking racket attempted to illegally transport 39 Sri Lankan Tamils to Australia from Kerala on a fishing boat.

Two persons, identified as Ghulam Ahmed Khawaja and Yaqoob Ali, who were arrested from Jammu District on January 17, were remanded in Police custody till January 25, according to Daily Excelsior. The arrestees had allegedly collected the consignment of Fake India Currency Notes (FICNs) from Pakistan border and brought it to Delhi in a train, an unnamed senior Police official said on January 18. With this, four persons have been arrested and Police is on the lookout for another person, Hassan, who allegedly went to Pakistan to meet counterfeiter Iqbal Kana, who is allegedly linked to Inter Services Intelligence (ISI). Police had on January 12 seized the FICNs consignment from two tempos in Dabri in south-west Delhi and arrested two persons Ash Mohammed and Zeeshan Khan.

A special Central Bureau of Investigation (CBI) court in Lucknow sentenced a State Bank of India (SBI) official and two others to six years rigorous imprisonment in a Fake Indian Currency Notes (FICNs) recovery case, the investigation agency said on January 18, reports CNN-IBN. Sudhakar Tripathi, the then Cashier of SBI at Domariaganj and two persons, Abid Ali and Ram Shankar Singh, were sentenced to six years Rigorous Imprisonment and a fine of INR 500,000 was imposed on each of them in connection with the recovery of FICNs from their possession, an unnamed CBI spokesperson said. "Further, the genuine currency to the tune of Rs 17.19 lakh [INR 1.71 million] which was recovered from the residence of Sudhakar Tripathi was ordered to be confiscated in favour of the State," he said. The agency had seized FICNs with a face value of INR 500,000 from the possession of Abid Ali while INR 5,000 worth FICN were recovered from Tripathi and Singh, the official said. CBI had filed a chargesheet against all the three accused on October 21, 2008. "The trial Court found the accused guilty and convicted them. One of the accused Ram Shankar Singh has also been earlier sentenced to four years Rigorous Imprisonment with a fine of Rs 5,000 on October 24, 2011 in another FICN case investigated by CBI," he added.

While upholding the trial court's 2010 judgement, a bench of justices S Ravindra Bhat and S P Garg, however, modified the order on their sentence and reduced the life term awarded to them to eight years on the ground of parity. The high court reduced the sentence, acceding to the pleas of the HuJI militants that three other key accused, who had earlier confessed to their crime, were awarded 8 years' jail term in 2007 under the Prevention of Terrorist Activities (POTA) Act. The court's verdict came on appeals by three Pakistani convicts Tariq Mehmood, Arshad Khan and Ishaq Ahmed and their three Indian accomplices, Ghulam Mohammed Dar, Ghulam Qadir Bhat and Mufti Mohammed Israr, who had been convicted under the provisions of the POTA, the IPC and the Arms Act.

Sessions Judge Poonch Kishore Kumar on February 1 awarded life term to a man and his son for hiding a militant in his house who had shot dead a civilian and one Security Force personnel during searches in Mendhar area of Poonch District in Jammu and Kashmir, reports Daily Excelsior. The judge awarded life imprisonment to Mohd Rafiq (Govt teacher) and his son Rayees Hayat, residents of village Keneti Banola in Mendhar tehsil (revenue unit). The judge observed that the accused persons beyond any doubt had hidden the militant at their house and during searches huge quantity of arms and ammunition was recovered from the almirah. It indicated that he used to help terrorists. The accused persons were convicted for the commission of offence under Section 302 RPC read with Sections 120-B and 307 RPC and sentenced to undergo life imprisonment and fine of 25,000 and 10 years rigorous imprisonment for the commission of offence under Section 307 RPC.

A fine of Rs 21,000 each was also imposed. The sentenced persons were identified as Sonu, Guddu Singh Bhadoria and Gyanendra. Police had arrested Sonu from Yashoda Nagar in Kanpur in May 1998 and recovered two fake currency notes of Rs 1000 and 500 denominations and 26 notes of Rs 100 notes. Sonu's interrogation revealed that Guddu Singh Bhadoria was running the FICN racket. The Police raided his den and arrested him. Bhadoria said that Gyanendra was also involved in printing of fake currency.

Aftab Ahmed Ansari, the alleged mastermind of the 2002 attack on the American Center in Kolkata, was on February 21 brought to the Central Bureau of Investigation (CBI) special court Ahmedabad where the probe agency filed a charge sheet against him in connection with the landing of arms consignment in Radhanpur town of Banaskantha District of Gujarat in 2001. Ansari, who was lodged in a Kolkata jail, was escorted by a team of Special Task Force of West Bengal. Ansari, who had fled to Dubai in 1999, was arrested by the police there while he was boarding a flight to Karachi on January 23, 2001, a day after the American Center attack that had left six dead. Ansari was deported to India on February 9, 2002.

Four militants of Sikh separatist group Babbar Khalsa International (BKI), arrested for planning to target religious figures, were on February 23 sentenced to imprisonment already undergone after they pleaded guilty for being member of the banned outfit. A session’s court in Delhi convicted Kulwinder Singh, Jaswant Singh, Bikkar Singh and Surender Singh under various provisions of the Unlawful Activities Prevention Act and the Arms Act. Jaswant Singh is a close associate of Jagtar Singh Hawara who, along with two others, was arrested in Punjab for the assassination of the then Chief Minister Beant Singh. All the four men were arrested by Special Cell of Delhi Police in year 2008 from Punjab and have been in custody since then. The names of the four had surfaced during police probe into June 2005 twin blasts at Liberty and Satyam Cinema halls here.

A local court in Jammu on February 24 charged Jammu and Kashmir Liberation Front (JKLF) chief Yasin Malik under the Prevention of Terrorism Act (POTA) for allegedly raising funds to strengthen militancy in the State, reports Times of India. Additional sessions judge (Jammu) Sanjay Parihar charged Malik with raising funds to strengthen "armed activity" in the State and "to strike terror among people''. Malik pleaded not guilty to the charges. Malik was charged with allegedly deputing two people - Mushtaq Ahmad Dar and Shameema - to collect USD 100,000 from Kathmandu (Nepal) in 2002. The money was recovered from them after they were arrested later that year. Though POTA was repealed in 2003, cases registered under it prior to that can still be pursued.

A fast track court Coimbatore (Tamil Nadu) on February 29 found five activists - Shajahan, S Shameem Ul Islam, A Syed Muhammed, Syed Abdul Raheem and Khader Bhawa - of banned Students Islamic Movement of India (SIMI) guilty of publishing an article against the unity and integrity of the country in the tabloid Seithi Madal way back in 1999. Another accused, Abu Tahir was exonerated. Though they had been sentenced to three years of imprisonment and a fine of INR 10,000, they had to be released as they already served their prison term during the course of the trial. The tabloid carried an article by SIMI activist SHM Moideen (who succumbed to illness before arrest) comparing the then social situation in Kashmir with strife torn Kosovo and targeted the Indian Army and territorial integrity of India. Police found that the content threatened the federal structure and unity of the country.

Second Judicial Magistrate First Class (JMFC) court, through a judgment delivered on February 29, absolved six youth, who had been arrested by Policemen of Doddapet Police Station in Shimoga District in 2009, on charges of being involved with the Communist Party of India-Maoist (CPI-Maoist) activities. Anita, Jagannath, Devendrappa, Asha, Gangamma, and Mallesh, had been arrested on the allegation of being suspected Maoists, and getting involved with illegal activities. Because of the Maoist tag, they were lodged in Mysore jail. Judge of the court, Arjun Malloor, who heard the case, held that the prosecution had failed to prove the charges levelled against the youth. He ordered release of all the accused, observing that there are no evidences against them. It is said that Anita and Jagannath will be released immediately, as other cases filed against them have also been decided in their favour. The other four will continue to face some other cases. Therefore, their release will be dependent on the outcome of these cases.

A Delhi court on March 3 framed charges against Ghulam Mohammad Bhat, suspected aide of All Party Hurriyat Conference-Geelani (APHC-G) Syed Ali Shah Geelani, and three others for alleged involvement in money laundering to fund terror, according to IANS. The National Investigation Agency (NIA) Special Judge H. S. Sharma framed charges against Bhat, Muhammad Sidiq Ganai, Ghulam Jeelani Liloo and Farooq Ahmed Dagga, for committing offences under various provisions of anti-terror law Unlawful Activities (Prevention) Act. The court fixed April 16 to begin the trial against the accused. The NIA, in its charge sheet filed in August 2011, alleged that Bhat collected over INR 45.7 million during a period of three years, starting January 2008, through money laundering channels for terror activities. Bhat was arrested from Kashmir in January 2011 by a joint team of Delhi and Jammu and Kashmir Police and INR 2.1 million were allegedly recovered from him.

Three of those charge sheeted are Y. Brojobidhu Singh, N. Bomi Singh, A. Ibomcha Singh the trio are lodged in Guwahati Central Jail following their arrest from Manipur in January 2012.These three were office-holders of a registered society called the Association for Extensive Growers Innovative Service (AEGIS) in Manipur, where the UNLF had allegedly invested the money they had extorted from individuals and business houses. Paving the way for the trial, additional sessions judge Pawan Kumar Jain framed charges against 65-year-old Ghandy under various provisions of the IPC relating to cheating, forgery and impersonation in the case in which he is accused of trying to set up a base for CPI-Maoist. In November 2010, the tribunal rejected the pleas of Marumalarchi Dravida Munnetra Kazhagam (MDMK) leader Vaiko Gopalaswamy and others, on the ground that no member of the banned organization had challenged the ban. Justice Sen had said: "Indian soil is being used for unlawful activities propelled by the remnant cadres of the LTTE. There is sufficient material to declare the LTTE as unlawful association as contemplated under the Prevention of Unlawful Activities Act. Illegal immigration of LTTE cadres through coastal areas, smuggling of narcotics to raise funds and supply of fuel and explosives from the Indian soil are all evidence of the active presence of LTTE in India." The Police made this claim in its charge sheet, filed in the court of Chief Metropolitan Magistrate Vinod Yadav and indicting five Indians, arrested along with the FICN consignment on January 12. The seizure of the counterfeit notes with a face value of over INR 11.8 million, concealed in 33 cloth bundles and loaded in two tempos, was made from near a godown at Dabri in West Delhi. A Delhi court on April 17 commenced the trial of a close aide of All Party Hurriyat Conference-Geelani (APHC-G) leader Syed Ali Shah Geelani, Ghulam Mohd Bhat, and three others, for allegedly running a hawala (illegal money transfer) racket to fund Hizb-ul-Mujahideen (HM) in Jammu and Kashmir (J&K). The three other accused include Mohammad Siddiq Ganai, Ghulam Jeelani Liloo and Farooq Ahmed Dagga. The court had framed charges against all the four accused under various sections of the Unlawful Activities (Prevention) Act on March 3, 2012. The National Investigation Agency (NIA) in 2011 had filed the charge sheet against the four, indicting them for procuring over INR 45.7 million from Pakistan through hawala channels within three years after 2008 for funding the terrorist activities in the Valley. Detailing their modus operandi, the NIA had said Ganai developed a close relationship with Delhi-based Raj Kumar and his brother-in-law Rajeev Nankani and motivated them to collect money on their behalf from hawala operatives in New Delhi. "Between November 2008 to October 2010, Raj Kumar alone collected Rs 2.25 crore [INR 22.5 million] in various instalments from hawala operators here," the charge sheet had said. The Special Cell of Delhi Police on January 22, 2011, had arrested Srinagar-based lawyer Bhat, Ganai, Liloo and Dagga from J&K on a tip-off that they were carrying hawala money, allegedly meant for the HM. Two other accused Mohammad Jamal Alvi and Habib Ahmad have been acquitted. The case relates to three low profile blasts that took place in Manak Chowk, Jalupura and in Sadar Police station area in Jaipur. These bombs were kept in tiffin boxes and tied to bicycles. A boy was injured in the blast. The court held both the accused guilty under different sections of TADA and the Explosives Act. In its 263 page judgment, it also upheld the view that the blasts were the result of conspiracy by Jalees and his accomplice after the demolition of Babri Masjid in Ayodhya (Uttar Pradesh).

A court in Delhi on April 30 took cognisance of the charge sheet filed against Communist Party of India-Maoist (CPI-Maoist) Politburo member Kobad Ghandy by Delhi Police indicting him of offences under the Unlawful Activities (Prevention) Act (UAPA), reports The Hindu. Ghandy was discharged of UAPA charges by a Sessions court on March 28 owing to a defective prosecution sanction obtained by Delhi Police. Following this, the Delhi Police filed a fresh charge sheet before Chief Metropolitan Magistrate Vinod Yadav. On April 30, Yadav took cognisance of the charge sheet for offences punishable under Sections 20 and 38 (membership of terrorist organisation and furthering its activities) of the UAPA. With this, Ghandy's case will again be put up for arguments on charge in a Sessions court. Ghandy has been accused of trying to set up a base for the CPI-Maoist in Delhi.

There is also no evidence on record that the accused were found negotiating with any militant organization or any member of any such organizations or in any manner had any links with such organization and as such cannot be held to be enemy agents. There is also no evidence of conspiracy with any militant organization and had ever supported their cause directly or indirectly prejudicial to the interest of the Country or the State."With these observations, Court acquitted both the accused of the charges leveled against them. The court has also directed the Central government and governments of Uttar Pradesh (UP) and Uttrakhand to take immediate steps to provide adequate security to the judges. The three judges who delivered the Ayodhya verdict are Justice Sudhir Agarwal, Justice SU Khan and Justice DV Sharma. The court issued order after UP anti-terror-squad (ATS) informed court that activists associated with the Student Islamic Movement of India (SIMI) may attack the three Judges. The SIM cards were from a set of cards provided to operatives of Indian Mujahideen (IM). According to the chargesheet filed by the anti-terrorism squad (ATS), suspected Pakistani bombers Waqqas Shaikh and Tabrez alias Danish, arrested accused Naquee Ahmed and Nadeem Akhtar and wanted accused Tehseen Shaikh and Muzaffar Kola had used SIM cards which were obtained using forged documents. "Pathrija (42) used three such SIM cards," said an ATS officer. "We have obtained the call detail records of these SIMs." The ATS chargesheet in the 13/7 case also mentions that the DNA of a woman was found in Byculla's Habib Mansion, the building where the suspected bombers stayed. "We had sent several seized items to the state forensic science laboratory for analysis. The forensic reports state that one of the three toothbrushes seized by the police from the room contains a woman's DNA," said an ATS officer. "It is likely that a family stayed in the room before the bombers rented it. Our probe has not reaveled the involvement of a woman, but we are probing all angles," the officer added.

The centre on June 6, 2012 told the Supreme Court that a red corner notice has been issued against Indian Mujahideen (IM) operative Fasih Mehmood for his alleged role in various terrorist activities, but refuted his wife's claim that he was abducted in a joint operation by Indian and Saudi Police in Dubai, according to Hindustan Times. Additional Solicitor General Gaurab Banerjee also submitted to the bench of justices K.S. Radhakrishnan and J.S. Khehar, a copy of the "red corner notice (RCN)" which was issued through Interpol and carried a warning, that Fasih "may be armed, dangerous and violent." The notice stated that 30-year old Fasih, a resident of Bihar's Darbhanga district, was a member of the IM and responsible for the Pune German Bakery blast on February 13, 2010; Bangalore Chinnaswami Stadium blasts on April 17, 2010 and Delhi's Jama Masjid shootout and blast on September 19, 2010. During the course of investigation, 7 persons were arrested and interrogated. They voluntarily confessed that they along with Fasih Mehmood and other absconders belong to the banned outfit called IM. The absconding accused Fasih Mehmood is an active member of IM since 2003. At present the absconding accused is hiding himself in Kingdom of Saudi Arabia. It was submitted that several cases under various Indian Penal Code (IPC) sections like 120B (criminal conspiracy), 121 (waging or attempting to wage war against India), besides various provisions of the Explosives Substances Act and Prevention of Damage to Public Property Act have been lodged against Fasih. Further, the centre told the Supreme Court that its agencies had no role in alleged arrest of Fasih Mehmood on May 13, 2012, according to The Times of India. Responding to the court's notice, Gaurab Banerjee told a bench of Justices K S Radhakrishnan and J S Khehar that its investigating agencies neither accompanied Saudi Arabian Police in effecting the alleged arrest nor had he been brought to India. Banerjee said "The external affairs secretary and the home secretary have conveyed that neither Indian agencies nor its officials were part of any alleged action to arrest Fasih in Saudi Arabia. It is not correct to say that Indian police arrested him. He is not in India”.

In its objections, the State Police has appealed to the court not to grant him bail stating that incriminating documents, newspaper cuttings and pro-Maoist literatures were found in his possession. One of the defence lawyers, Advocate Abdul Vahab Khan, moved an application seeking permission to examine a metropolitan magistrate, who had recorded statements of arrested accused under the Code of Criminal Procedure (CrPC). Special judge Yatin D. Shinde will decide on the application on Tuesday (today). The court, meanwhile, allowed another application seeking permission to recall a witness, who had already deposed before the court as a prosecution witness. “This witness is a sanctioning authority and sanctioned most cases between 2005-08 and has claimed that the banned organisation Indian Mujahideen (IM) was responsible for all the blasts between this period. We need to examine him on certain aspects, which he has earlier told the court,” said Advocate Khan. The Maharashtra Anti-Terrorism Squad (ATS) probing the case had arrested 13 accused claiming they were members of the banned organisation Student’s Islamic Movement of India (SIMI) and Lashkar-e-Toiba (LeT). The agency in its chargesheet had charged them under various sections of Indian Penal Code, MCOCA and Unlawful Activities (Prevention) Act.

The court noted, “It has been established that accused were found in possession of fake currency notes and they were trafficking in the same. Communist Party of India-Maoist (CPI-Maoist) leader Kobad Ghandy was charged with membership of a terrorist organisation under the Unlawful Activities (Prevention) Act (UAPA) on July 16, reports The Hindu. He pleaded not guilty and sought trial which will now begin on September 4. Additional Sessions Judge Pawan Kumar Jain had on March 28 said that UAPA Sections 20 and 38 relating to membership of a terror organisation were made out against Ghandy. However, he refused to frame charges on these counts pointing out that the prosecution sanction that was taken was defective. The court ruled that the police had violated Section 45(2) of the UAPA by not submitting the charge sheet to an independent authority constituted by the Central or State Government, which after vetting the documents was to recommend the sanctioning authority (Lieutenant-Governor) to grant sanction for prosecution. Jain had on that occasion discharged Kobad Ghandy for the offences punishable under Section 10/13/18/20/38 of UAPA pointing out that no case was made out against the accused qua these sections. The Delhi Police on March 30 filed a supplementary charge sheet with fresh prosecution sanction following which arguments on charge were taken up again. The defence did not contest the charges of cheating, impersonation and forgery under the Indian Penal Code that were framed on March 28.

The Gujarat High Court (HC) on July 26, reduced jail terms of 21 persons convicted in the Inter-Services Intelligence (ISI) or Jehadi conspiracy case after they decided not to challenge their conviction by the Prevention of Terrorist Activities Act (POTA) court in 2010, as reported on July 28, by The Times of India. The bench also reduced their fines to just INR 100 per offence against them. With this, liabilities of INR 45,000 in some convicts' cases will come down to just INR 500, which is to be paid within a month. The POTA court had acquitted 22 others in this case. Moreover, 44 accused are still absconding, and many of them are considered masterminds. The big names include Dawood Ibrahim, Chhota Shakeel, Sharif Khan, Rasool Party and Mufti Sufiyan Patangia.

The Supreme Court (SC) on July 27, refused to interfere with the Andhra Pradesh High Court order granting bail to the alleged top Communist Party of India-Maoist (CPI-Maoist) leader Kobad Ghandy in a 2005 case of murder of nine persons including a senior Congress leader, reported IBN Live. "Our order will be meaningless. The entire exercise will end in futile," said a bench of Justice B S Chauhan and Justice Swatanter Kumar, pointing out that Ghandy's status will remain same as he is in Tihar Jail for the cases registered in the Capital against him. The bench said Andhra Pradesh government's plea against the High Court's order could be heard later if Ghandy is granted bail in cases registered by the Delhi Police. "We will keep your appeal pending," the bench told senior advocate Mahabir Singh, who, appearing for the Andhra Pradesh Government, sought cancellation of bail to Ghandy. The apex court had on January 27 stayed the Andhra Pradesh High Court order, which had granted bail to Ghandy, accused of killing the erstwhile Deputy Assembly Speaker Narsi Reddy and eight others on August 15, 2005. While staying the bail order, the apex court had issued notices to Ghandy who is at present lodged in Delhi's Tihar Jail. The alleged Maoist leader, who has been in jail since 2009 after his arrest, is facing trial in around 20 criminal and terror cases in different parts of the country. Congress leader Chittem Narsi Reddy and eight others were killed by Maoists in Narayanpet in Mahbubnagar District on August 15, 2005. The High Court had granted bail to Ghandy on August 10, 2011. The State Government had claimed Ghandy had confessed to his role in a statement made after his arrest in Delhi in 2009.

A Jammu court on July 28 sentenced a former Hizb-ul-Mujahideen (HM) 'commander' and Pakistani national to nine years of imprisonment, according to The Times of India. Principal Sessions Judge Jang Bhadur Singh Jamwal awarded the term to Noor Ahmed Baloch and imposed a fine of INR 10,000 on him. Baloch, a resident of Chak Zahir Peer in Khanpur (Pakistan), was arrested in Doda District on October 26, 2004, where he was operating as a HM ‘area commander’. On the day, Police recovered a Chinese-made pistol among other things from his possession. Codenamed as Rashid, Baloch had obtained militant training in Pakistan occupied Kashmir (PoK) and was operating in Doda hills in the state.

The Supreme Court on August 29 reserved its verdict on the appeals of 99 persons, including actor Sanjay Dutt, who were convicted and sentenced for the 12 March 1993 Mumbai (Maharashtra) serial bomb blasts, reports The Times of India. A bench of Justices P Sathasivam and B S Chauhan completed hearings on 128 appeals, which included those filed by Central Bureau of Investigation (CBI) challenging acquittals completing a long-drawn process that had started on November 1 2011. The hearing was deferred as the special public prosecutor Raja Thakare had sent a plea to the court for seeking an adjournment as he was busy in the Mumbai railway bomb blast case. The Maharashtra state Anti Terrorism Squad (ATS) had taken over probe in the blast case from the Pune Police and had filed a charge sheet against Mirza Himayat Inayat Baig. The bench upheld the acquittal, dismissing the Police appeal against the trial court's verdict. The court, however, modified the trial court's order for registration of an FIR against four Policemen for faking the encounter and giving false evidence. Police claimed that, acting on a tip-off that the accused, planning a strike in Delhi and its satellite towns, including Gurgaon, would be coming to the capital, arrested four of the seven accused after a shootout on the intervening night between July 1 and 2 in 2005 near Delhi-Gurgaon border, and seized a huge cache of arms and ammunition. The remaining three were arrested later. As the accused, later identified as Saqib Rehman, Nazir Ahmed Sofi, Gulam Moinuddin Dar and Bashir Ahmed Shah, did not stop their car, they were chased by a team led by Sub-Inspector Ravinder Tyagi, who fired from his service revolver in response to firing by Saqib, Police said. Police also claimed to have recovered one AK-47 rifle, two magazines, 130 live cartridges, 2 hand grenades and 3 UBGL grenades at the instance of Saqib and this crucial evidence was ignored by the trial court. The lower court had acquitted all the accused saying the alleged encounter did not take place at all and a false encounter was projected.

Subhasish Roy, counsel for the Maoists said that under the West Bengal Correctional Services Act, 1992, these prisoners were entitled to the status of political prisoner. Lashkar-e-Toiba (LeT) operative Abu Jundal on August 9, has shown his willingness to confess his role in 26/11 Mumbai attacks before the magistrate court under section 164 of the Criminal Procedure Code, reports Hindustan Times. He is also willing to confess his involvement with the LeT network. Jundal was brought to court at 4:30pm amid tight security and was produced before the additional chief metropolitan magistrate. He then told the court that he wanted to confess. Soon the court was vacated and all the other litigants were asked to leave. During the in-camera proceedings, the court explained to him the procedure of recording the confession and also informed him that his confessional statement could be used against him; Jundal replied in the affirmative when he was asked if his decision to give the confession was voluntary. Further, the magistrate informed Jundal that he would be given time till August 13 to rethink his decision and the statement would be recorded only if he still wanted to make the confession. As reported earlier, Jundal was arrested on June 21, 2012, by Delhi Police at New Delhi's Indira Gandhi International Airport after being deported from Saudi Arabia.

The National Investigation Agency (NIA) on August 9 filed a supplementary charge sheet in the 2007 Samjhauta Express blast case in a Panchkula (Haryana) court, reports Times of India. The charge sheet, second in the case, was filed against former Rashtriya Swayamsevak Sangh (RSS) activist Kamal Chauhan and Amit Chauhan alias Amit Totala and for the first time mentions Lokesh Sharma and Samunder alias Rajender Chaudhary as bomb planters along with Kamal and Amit. Sharma, who was arrested in 2010, is mentioned only as a conspirator in the previous charge-sheet in the case that was filed in June 2011 against him, Naba Kumar Sarkar alias Aseemanand, Ramji Kalsangra, Sandeep Dange and Sunil Joshi. While Joshi is dead, Dange, Kalsangra, Amit and Samunder are absconding. The charge sheet, however, makes no mention of RSS leader Indresh Kumar whose name had earlier come up as an alleged conspirator in various cases, including Samjhauta blast. NIA sources said the agency has not found any evidence against Indresh. On February 18, 2007, a series of blasts ripped through Samjhauta Express near Panipat, Haryana, leading to the death of 68 people, most of them Pakistani nationals.

The court found Ahmed guilty under Section 19 of the Unlawful Activities (Prevention) Act in the NIA case number 01/2009. This was the first case registered by the agency since it came into existence in January 2009. It had registered the case during investigation of allegations about diversion of Government funds released to Dima Hasao Autonomous Council (DHAC) to militant coffers of Black Widow (BW). The court rejected the prosecution's plea to defer framing of charges till the Maharashtra Anti Terrorist Squad (ATS) filed a charge sheet against one of the prime handlers of the November 26, 2008 (26/11) Mumbai (Maharashtra) attacks and arrested Lashkar-e-Toiba (LeT) operative Abu Jundal alias Zabiuddin Ansari. The trial in the arms haul case was stayed by the apex court after one of the accused challenged the constitutional validity of certain provisions of the MCOCA. The apex court had, in May 2009, lifted the stay and the trial was to commence in June 2010. As per the prosecution's case, in May 2006, the ATS booked 21 persons for carrying a large amount of explosives and arms. The ATS claimed to have seized 43 kg of RDX, 50 hand grenades, 16 AK-47 rifles and over 3,000 live bullets from Chandaud in Aurangabad.

A court in New Delhi on August 23 asked Delhi Police to supply copies of remand papers to journalist Syed Mohammad Kazmi, who has been listed as an accused in the charge sheet in the Israeli diplomat car bombing case of February 13, 2012, reports Zee News. Meanwhile, the court extended Kazmi's judicial custody till September 6, 2012. Kazmi is the sole person to have been named as accused in the charge sheet filed in the case. The charge sheet also names Iranian nationals Houshang Afshar Irani, Masod Sedaghatzadeh, Syed Ali Mehdi Sadr and Mohammed Reza Abolghasemi as suspects in the case. The charge sheet says Kazmi had facilitated Irani in executing the attack. It said that while Irani, on the one hand, was in touch with Kazmi through mobile phone, on the other hand, he was in contact with Sedaghatzadeh and Mehdi Sadr. Kazmi has been charged under various provisions of the anti-terror law, Unlawful Activities Prevention Act (UAPA) and other sections of the Indian Penal Code (IPC) including attempt to murder. The Shillong Times reports that the court of the Judicial Magistrate, Shillong has remanded Garo National Liberation Army (GNLA) ‘chairman’ Champion R Sangma to 14 more days of judicial custody after he was produced in the court on August 26. The GNLA chairman would now be locked up at the special security cell in Shillong District Jail. While coming out of the court, Sangma expressed his willingness to hold talks with the State Government. “I have already given some suggestions in this regard,” the GNLA chairman, whose face was covered, told reporters outside the court. The Supreme Court (SC) on August 27 refused to direct the Union Government on extradition or deportation of Indian Mujahideen (IM) militant Fasih Mohammed from Saudi Arabia Authority, reports The Times of India. After going through all the correspondence between the Centre and the Saudi Arabia Government, a bench of justices P Sathasivam and Ranjan Gogoi said it is for the Centre to pursue the case further as it cannot pass any direction for bringing him back. Additional Solicitor General (ASG) Gourav Banerjee informed the court that Bihar native Fasih Mohammed, alleged to be involved in several terror acts in the country, is in the custody of Saudi Arabia Police and the Government is trying to get access to him through diplomatic channel. He also told the court that the Government will take steps for his extradition or deportation.

A trial court has reserved the pronouncement of its judgment in the 2005 twin blasts at Satyam and Liberty cinema halls in New Delhi for August 30, reports The Times of India on August 28. The Special Cell of the Delhi Police had charge sheeted Jagtar Singh Hawara, the Babbar Khalsa International (BKI) chief in India, and seven others in the case. The blasts had taken place on May 22, 2005 and the bombs injuring sixty persons. While the first explosion rocked Liberty cinema on the busy G T Karnal Road in central Delhi around 8.15 pm, the second one took place at the Satyam cinema at Patel Nagar some 20 minutes later.

Eight other witnesses were also examined in the case relating to the murder of Piniti Suresh at Basnaput under Bandhugaon Police Station limits of Koraput District on September 7, 2009. Suresh was a supporter of Bandhugaon based CMAS and it was alleged that Narayanpatna CMAS group had killed him.

Supreme Court (SC) on August 29 (today) upheld the death sentence for lone arrested 26/11 Mumbai attacks accused Pakistani national Ajmal Kasab, reports The NDTV. The top court rejected a plea by Kasab to commute the death sentence handed to him by the Bombay High Court (HC), to life imprisonment. Confirming the death sentence, the top court observed that the primary and foremost offence that Kasab was charged with was waging war against India and "We are left with no option, but to uphold the sentence." Kasab had moved the Supreme Court on February 14, 2012 against the High Court verdict of October 10, 2011 which upheld a lower court order sentencing the 25-year-old terrorist to death. The lower court had pronounced its judgement on May 6, 2010, 18 months after he was captured. The Supreme Court has also upheld the Bombay High Court's acquittal of alleged Indian conspirators Faheem Ansari and Sabauddin Ahmed in the 26/11 Mumbai attacks case. The two were let off by the Bombay High Court for want of corroborative evidence and the Maharashtra Government had appealed against that order.

A Delhi Court convicted five persons on August 30 for their involvement in the May 22, 2005, twin blasts at Satyam and Liberty cinema halls in New Delhi, reports The Times of India. Babbar Khalsa International (BKI) terrorist Jagtar Singh Hawara and four others were sentenced to seven years of imprisonment that would be adjusted against an equal length of period they have already spent in jail during the trial. The court also slapped a fine of INR 25,000 on each of the convicts. Balwinder, Jaspal, Vikas and Jagannath pleaded guilty for the conspiracy to commit offences against the state, attempt to murder and culpable homicide not amounting to murder under the Indian Penal Code (IPC) and the Explosives Substance Act (ESA). The five also pleaded guilty under the terror charges. Hawara was charged with harbouring Jaspal and Vikas, who were actively involved in executing the blasts. The court observed that the intention of the accused persons was not to kill people but to create panic. Hawara, awarded life term for the assassination of then Punjab Chief Minister (CM) Beant Singh, would remain in jail but the other four convicts would be released.

The massacre occurred during the night of February 11, 1997, when NLFT militants stormed into Jarulbachi village and sprayed indiscriminate firing at villagers.
