Andhra Pradesh Police arrested Tushar Kant Bhattacharya alias Srikant (50), a top leader of the Communist Party of India-Maoist (CPI-Maoist), from Warangal on an unspecified date and was produced in a Warangal court on January 8, reports Telegraph. Unspecified sources said the Maoist was arrested in Hyderabad city two days ago but the Police had kept the news under wraps till the evening of January 8. Bhattacharya, a Bengali from Andhra Pradesh’s Adilabad District, is chief of the "Triple U" unit, the CPI-Maoist militant wing that operates in Uttarakhand, Uttar Pradesh and "Uttar" (north) Bihar. He is also a member of the Maoist outfit’s "international forum", which interacts with foreign rebels and rights groups.

Chhatradhar Mahato, convener of the People’s Committee against Police Atrocities (PCPA) and 151 inmates at the Midnapore Central Correctional Home began a fast-unto-death on January 8, demanding withdrawal of all cases on charges of their links with the Maoists and those under the Unlawful Activities Prevention Act (UAPA). Mahato was produced at the Jhargram court along with seven others including Sukhshanti Baskey, treasurer of the PCPA, and Raja Sarkhel and Prasun Mukherjee, two social activists who were charged with helping the Maoists in fundraising. They were charged under sections of the UAPA, Indian Penal Code, Explosive Substances Act and the Arms Act.

The Hindu reports that charge sheet has been filed against the 62 accused in connection with the July 26, 2008 Ahmedabad serial bomb blasts in which 57 people were killed by a special court on January 11. Among the 95 accused, 33 are still absconding (of whom, three are dead). The remaining 62 are in jail and were present in court. The 62 accused belong to 11 different States and were arrested at different times and from different places. Charges include hatching a conspiracy, waging war against the State, murder, attempt to murder, organising training camps for training terror activities, encouraging youths to join terror camps, and others. However, the charge sheet named Abu Bashar, Qyamuddin, Abdul Razeek and Zahid Sheikh as the main conspirators and masterminds of the blasts. The charge sheet mentioned that the conspirators had stolen a few cars from Mumbai, which were then laden with explosives and placed at strategic points in Ahmedabad, including the trauma centre of the Government civil hospital to cause greater damage. The explosives, however, were purchased in Ahmedabad. In other incidents, old bicycles fitted with bombs were used.

Two Lashkar-e-Toiba (LeT) militants on January 12 were sentenced to seven years of rigorous imprisonment each by a Delhi court for possessing RDX in connection with a conspiracy to carry out a suicide attack at the Indian Military Academy in 2005, Hindustan Times reported. Convicts Hamid Hussain and Mohd Shariq, who were arrested with about 10 kilograms of RDX, were also fined of INR 125000 and INR130000 respectively.

Chief Metropolitan Magistrate Kaveri Baweja allowed the Special Cell to keep Shahzad, arrested from Uttar Pradesh on February 1, in their custody till February 25. He has to be interrogated in connection with the recovery of a laptop and two mobile phones from Azamgarh in Uttar Pradesh at his instance. He is also to be interrogated with regard to whereabouts of 14 absconding IM terrorists for their alleged role in the serial blasts in the Delhi. Arrested Indian Mujahideen (IM) cadre and September 13, 2008 Delhi serial bomb blast accused Salman Ahmed was remanded to eight-day Police custody on March 8 (today), report Economic Times. The investigators claim that he has already provided some details of the Lashkar-e-Toiba’s (LeT) plans to launch fresh attacks on Delhi, Mumbai and Bangalore. As reported earlier, Ahmed was arrested on March 6 by the Anti Terrorist Squad (ATS) of Uttar Pradesh Police from Siddarth Nagar District. However, Police claimed that they recovered a Nepali passport obtained under a fake name and an international SIM card from Salman’s possession. After his name cropped up in the bomb blast cases, Police claimed, he moved to Nepal, where he reportedly got the passport issued in June 2009. With the help of the passport, which was issued in the name of Mohd Fahad Ansari, the IM operative travelled to Pakistan and other countries. Ahmed is believed to have gone to Pakistan in December 2009 and returned to Nepal in January 2010. According to Police, Ahmed is an expert in carrying out blasts. He is also alleged to have received training in handling weapons and explosives during his stay in Pakistan.

Awarding the sentence, the judge said they did not deserve capital punishment as the case was not the rarest of rare. Rahman (30) was arrested from Hazrat Nizamuddin Railway station with 1.5 kilograms explosives and a timer. Raghuvanshi said on March 14, reports The Hindu. The duo, identified as Abdul Latif Shaikh (29) of Bandra and Riyaz Ali (23) of Dahisar, were arrested at 8.30 p.m (IST) on March 13 from Matunga area on information given by Central agencies. Raghuvanshi said that the two were suspected of working on plans to target Bhabha Atomic Research Centre, offshore installations of the ONGC in Mumbai and Nhava Sheva, fuel storage tankers of oil companies in Sewri, Thakkar Mall in Borivili and Mangaldas cloth market, adds Times of India. However, they were produced in court on March 14 and remanded to Police custody till March 18. The ATS Chief said both were in touch with a person from Pakistan, whom they referred to as “uncle.” They had received instructions from Pakistan to get their passports readied. Two suspected BKI militants, identified as Daljit Kumar alias Deepak of Baltana from Mohali District and Purshotam Singh alias Bunty from Rajoura in Patiala District, were arrested at the Zirakpur-Patiala road near Zirakpur in an operation conducted by the Mohali Police and the Special Cell of Delhi Police in the night of March 18. The third militant of the outfit, identified as Karwinder Singh, a native of Ropar, was arrested in Delhi on March 19. The arrests indicate that BKI is being pressured, just like Indian Mujahideen (IM) terrorists hosted by Pakistan, by its ISI handlers to revive terrorist activities. Senior Superintendent of Police, Mohali, Gurpreet Singh Bhullar said that two France-based terrorists identified as Purshotam Singh of Matheri and Goldy of Ghel, both from Ambala District, were funding the terrorists activities. INR 100000 recovered from the two militants was sent by them. Police also recovered a .455 bore revolver with three cartridges from the two militants. Purshottam Singh, a proclaimed offender, is reportedly one of the accused involved in the assassination of former Punjab Chief Minister Beant Singh, but could not be arrested. He had also tried to eliminate former Haryana Chief Minister Bhajan Lal before Benat Singh's assassination. Preliminary interrogation of the accused revealed that they were planning to carry out blasts in the region to create terror, the cops said, adding that more revelations are expected in the coming days. A case against them was registered at the Zirakpur Police Station and they were produced in the Derabassi court from where they were sent to Police remand till March 21.

The order for such jackets was placed way back in 2001, when the 26/11-like situation was not anticipated, says an affidavit filed by Deputy Commissioner of Police Vijaysingh Jadhav. On May 3, the court will give its verdict on the various charges against Lashkar-e-Toiba (LeT) militant Mohammad Ajmal Amir Kasab, and co-accused Fahim Ansari and Sabahuddin. The recording of the judgment will be done in April 2010. The trial, which began on April 15, 2009 had 191 hearings during which 653 witnesses were examined by the prosecution. The final arguments began on March 9, 2010 and lasted through the month with the prosecution laying out its case over a span of 11 days.

A Delhi court has convicted a former Jammu and Kashmir Police Constable for being a cadre of the Lashkar-e-Toiba (LeT), PTI reported on April 13. Mushtaq Ahmed Wani, who was posted as guard at the residence of Fazal Hussain Beigh, brother of ex-Finance Minister of Jammu and Kashmir Muzaffar Hussain Beigh, was arrested from a place near Red Fort in Delhi on November 25, 2006, by the Delhi police's Special Cell personnel. Wani, hailing from Baramulla District, was arrested along with INR 6 lakh alleged hawala money. It alleged the convict had come to the national capital to collect a consignment of arms, ammunition and hawala money which were to be used for terror activities in Jammu and Kashmir. The convict came into contact with his Pakistan-based handler Mohammad Ahmed, a ‘deputy commander’ of LeT, in September, 2006, and started working for the banned organisation at his instance. Additional Sessions Judge Dharmesh Sharma held Wani, 30, guilty of the various offences under the Unlawful Activities (Prevention) Act. The court is likely to pronounce the quantum of sentence on April 19.

A Delhi court on April 19 sentenced a former Jammu and Kashmir Police Constable to eight years rigorous imprisonment for being a cadre of the Lashkar-e-Toiba (LeT), reports PTI. Mushtaq Ahmed Wani, who was posted as guard as the residence of Fazal Hussain Beigh, brother of ex-Finance Minister of Jammu and Kashmir Muzaffar Hussain Beigh, was arrested from the Red Fort in New Delhi on November 25, 2006, by personnel of the Delhi Police's Special Cell. Besides the prison term, Additional Sessions Judge Dharmesh Sharma, who pronounced the quantum of punishment, also imposed a fine of INR 50,000 on Wani (30), holding him guilty of various offences under Unlawful Activities (Prevention) Act (UAPA). The messages said Agarwals would have to pay INR 10 million or face dire consequences. The messages also mentioned that the time and venue where the money should be sent would be communicated later. A KLO militant, Gopal Barman alias Marang Singh, was arrested while trying to abduct the trader on April 22. Gopal, who hailed from Kanturka in Habbibpur, had been trained in Bangladesh and had been in the Korkajhor forest of Assam for 12 years. He had been remanded in Police custody for 14 days and was handed over to the Criminal Investigation Department (CID) on April 30 for further interrogation.

The 1,522-page judgment convicted Kasab of conspiring to wage war, along with nine other terrorists and 20 co-conspirators in Pakistan, and of murder and abetment to murder, among other offences. Among the 20 wanted accused indicted by the court are LeT Chief Muhammad Hafeez Saeed and other operatives Zaki-Ur-Rehman Lakhvi, Zarar Shah and Abu Hamza. The arguments for the quantum of sentence will begin on April 4 (today). Special sessions judge M.L. Tahaliyani at the Arthur Road jail court in Mumbai acquitted the other two accused, Indians, Fahim Ansari and Sabahuddin Ahmed, of “all the charges framed against them.” The two had been accused of making and conveying maps of target locations in Mumbai. The court said: “The preparations made for the attacks by Kasab and nine other attackers, and the co-conspirators, the training imparted to the gunmen, the arms and ammunition involved and the quantity of cartridges reached proved beyond reasonable doubt that this was not a simple case of murder but an offence punishable under Section 121 of the Indian Penal Code [IPC].”

The Special Sessions Court in Mumbai on May 6 sentenced the lone surviving Lashkar-e-Toiba (LeT) militant, Mohammad Ajmal Amir Kasab, to death for his involvement in the November 26, 2008 (also known as 26/11) Mumbai terrorist attacks, reports The Hindu. Mohammad Ajmal Amir Kasab "shall be hanged by neck till he is dead", the court pronounced. Kasab was given the death penalty on five counts: murder, abetment to murder, waging war, criminal conspiracy and committing terrorist acts. He was also awarded life imprisonment on five counts: attempt to murder in furtherance of a common intention, kidnapping and abducting in order to murder, conspiracy to wage war, collecting arms with the intention of waging war and causing explosion thus endangering life and property. "You have been given the death penalty for murdering Indian citizens, Police Officers, conspiring with Lashkar [LeT] leaders and committing terrorist acts. The court has said while giving the judgment that you shall be hanged unto death," Judge M.L. Tahaliyani told Kasab. The Indian Penal Code Sections under which Kasab has been given death penalty are: 302 (murder), 302 read with 120 B (criminal conspiracy), 121 (waging war), 302 read with 34 (common intention) and 302 read with 109 (abetment) read with 120 B. In addition, he has been given death for the offence punishable under Section 16 of the Unlawful Activities (Prevention) Act. For the other offences, he was awarded rigorous imprisonment, simple imprisonment and imposed with fines. Special Public Prosecutor Ujjwal Nikam told reporters that a confirmation of the death penalty from the Bombay High Court was awaited. Kasab would continue to be housed at the high security Arthur Road jail till further orders by the Government.

A 35-year-old man, wanted in connection with seizure of communication equipment meant for terrorists in Jammu and Kashmir five years ago, has been extradited from Dubai (United Arab Emirates) and arrested in New Delhi, Police said on May 11. Sheikh Sajjad, suspected to be linked to terror outfit Al Badr, was extradited on May 8 from Dubai where he was detained for his alleged involvement in sending hi-tech communication equipment, including satellite phones, meant for the militants. Upon his arrival here, Sajjad was arrested by Special Cell which produced him before duty magistrate on May 9. On May 10, he was again produced before the court which sent him to police custody till May 16. The consignment from Jeddah was seized at Indira Gandhi International Airport. Mohd Amin Khan, a resident of Srinagar who approached the customs officials to claim the consignment, was arrested a week later after the seizure of the consignment. At his instance, one Ubaid was also arrested, an unnamed senior Police official said, adding their interrogation led them to Sajjad. Ubaid was later acquitted by a court while Amin, who had a shoe shop in Chandni Chowk (New Delhi), was sentenced to 10 years’ imprisonment in this case.

Azmi represented Fahim Ansari, who was acquitted in the 26/11 terrorist attacks case. He was shot dead in his office at Taximen's colony in Kurla on February 11, 2010. Ramesh Mahale, senior Police inspector of the Mumbai Crime Branch, said that the 600-page charge sheet cited four persons as accused and five others wanted as accused. The arrested are: Devendra Baburao Jagtap alias JD (28), Pintoo Devram Dhagle alias Raju (25), Vinod Yashwant Vichare (32) and Heshmukh Shankar Solanki alias Rohit. Instead of coming to the aid of Additional Commissioner Sadanand Date, who engaged the terrorists in a gunfight on the terrace of Cama Hospital and got grievously injured in the process, the officers from the Police station possibly "ran away", Judge M. L. Tahaliyani said in the judgement, a copy of which was made available to PTI on May 24. In addition, the 26/11 special court has come down heavily on the prosecution and investigating agency for submitting "doubtful" and "fragile" evidence against accused Faheem Ansari and Sabauddin Ahmed that led to their acquittal in the terrorist attacks case. "The evidence of the only prosecution witness is doubtful and unreliable. The investigating agency has failed to provide quality evidence against the duo (Faheem and Sabauddin)," the 1600-page judgement, said.

Seven RDX bombs kept in first class coaches of Mumbai’s suburban trains exploded on July 11, 2006. The Anti Terrorist Squad said that the conspiracy was hatched in Pakistan and at least five of the 13 arrested persons had gone to that country for terror training. The Police also said Pakistan-based militant outfit Lashkar-e-Toiba (LeT) had used the banned organisation, Students Islamic Movement of India (SIMI), to engineer the blasts. The trial started in a special court in December 2007. However, matters could not progress as the accused had challenged the application of certain provisions of law. The legal dispute was finally settled by the Supreme Court in April 2010 before the trial court in Mumbai could hear the case again. The process involved a delay of more than two years. In 2007, Saeed Ahmed, son of serial bombing accused Sohail Shaikh Shabbir Masiullah arrested for the 2006 Malegaon blast, and Zameer Rehman, accused in the Aurangabad arms haul case, had filed petition in the Bombay high court challenging the constitutional validity of Maharashtra Control of Organised Crime Act (MCOCA). When the High Court upheld the decision to slap MCOCA, the accused moved the Supreme Court in 2008 and it stayed their trials.

Three days after the team arrived in the US to question Headley, there was no confirmation from US authorities as to when and what kind of access would be granted to the team. An FBI Chicago spokesperson said that the federal agency would not comment or provide any information on the Headley interrogation. US Attorney's office spokesperson in Chicago Randall Samborn said he "does not have any comment on anything related to David Headley whatsoever". The 49-year old Pakistani-American has been held at the downtown Metropolitan Correctional Center. Headley had pleaded guilty to conspiring in the 26/11 Mumbai attacks but struck a deal with US authorities in a plea bargain that saved him from the death penalty and extradition to India. The plea agreement had however said Headley would cooperate with foreign authorities and can be interviewed by them only on US soil.

Samad was arrested on May 24, 2010 for allegedly supplying arms to three persons on August 5, 2009. Samad, a resident of Bhatkal Taluk (revenue unit) in Uttara Kannada District of Karnataka, was arrested at the Mangalore airport. Shortly after the arrest, Union Home Minister P. Chidambaram termed Samad the “prime suspect” in the Pune bomb blast case. However, the ATS has not yet confirmed his links to the blast.

Sify reports that 13 people, including three intellectuals, arrested for alleged links with Maoists in West Midnapore District were remanded by a court to judicial custody for 14 days. The 13, who have been booked for waging war against the State and charged under various sections of penal code, were presented in a lower court in Jhargram in the District. West Midnapore Superintendent of Police Monoj Verma said all three city intellectuals -- scientist Nisha Biswas, college teacher Kaniska Chowdhury and writer Manik Mandal -- went to the villages to meet Maoists and leaders of their frontal body People's Committee against Police Atrocities (PCPA). They were also present in a kangaroo court (peoples’ court) besides providing financial help to the outfit. The CPI-Maoist West Bengal State Committee spokesperson Khokon, however, denied any link with the three intellectuals saying, ”We never met them and have no links with them. The first additional chief metropolitan magistrate on June 16 has ordered a Non-Bailable Warrant (NBW) against People’s Democratic Party (PDP) president Abdul Nasar Madani, in connection with the July 25, 2008 Bangalore serial bomb blasts case, reports Times of India. The court has issued body warrant against two more accused in the case — Tadinyandavaeeda Naseer and Safaz — who are now lodged in a Kerala jail. Police sources said that a team would leave for Kerala to get custody of Naseer and Safaz. With Madani’s supporters warning of consequences if their leader was arrested, Kerala Chief Minister V. S. Achuthanandan told reporters in Thiruvananthapuram on June 16 that necessary steps would be taken to maintain law and order. Earlier on June 11, Bangalore Police filed an additional charge sheet in the court against Madani and five others. In the chargesheet, Madani was reported to be absconding. The judge admitted the charge sheet on June 16. However, it will take some time for Police to take the NBW from the court and execute it. Cops said they would take the NBW only after some groundwork is completed. The case hearing is on June 23. Since the trial is yet to begin, the accused have to be produced before the magistrate.

Sources said that the persons were brought for interrogation at the special branch cell and senior Police officials had been interrogating them. Sources said, all the secret services of the country would interrogate the arrested ISI agent during the remand. On July 5 he was produced before the court by East Agartala Police Station. Investigating Officer Sub Inspector Jahangir Hussain sought 14 days Police remand for all the seven arrested. The court granted 10 days Police Remand for the accused. ISI agent Munir Khan, a resident of Bahawalpur in Pakistan, was tasked to monitor Indian Army movements in Punjab as a deep cover operative. The ISI operative- a Pakistani Punjabi himself- was having several aliases like Mahim Khan and Lemar Asraf Khan. His complete identity was also established as ‘son of one Abu Ashraf of Bhawalpur, Mocan (House) no 1180 in Punjab Province of Pakistan’. Officials said Khan, who looks like a common place man with no special feature to attract attention, was handpicked by ISI. He was then trained for three and half months on espionage tradecrafts at Bahawalpur and Multan in Pakistan. The accomplices Ramu Ghosh, Rana Roy, Sujit Saha, Gauranga Dey, Uttam Barman and Tajul Islam gave the ISI operative shelter and provided him with transport facilities. Sources further said that Intelligence Bureau (IB) was monitoring Khan’s movement right from the time he took Dhaka’s flight from Pakistan of before.

Madani was recently made one of the accused in the Bangalore serial blasts case after the Police filed a second chargesheet saying he had sheltered its masterminds and also visited Somawarpet to participate in the conspiracy. Madani was shown as absconding and the court, after accepting the chargesheet, issued a non-bailable warrant against him. Madani (45), who formed Islamic Seva Sangha (ISS) in Kerala, was earlier an accused in the Coimbatore (Tamil Nadu) blast case, which targeted former Deputy Prime Minister L K Advani. The case, as a result, has been transferred back to the Special MCOCA court. The High Court also held that the bail applications of the accused would be heard afresh by the MCOCA court. The court's order was with reference to an appeal filed by the Maharashtra Anti-Terrorism Squad (ATS), challenging the revocation of the MCOCA. A Division Bench of Justices B.H. Marlapalle and Anoop V. Mohta noted that “all the orders [of the Special Court] are required to be quashed and set aside and all the bail applications would stand restored to the file of the Special court for being decided afresh on their own merits.” Sadhvi Pragnya Singh Thakur, Lt. Col. Prasad Shrikant Purohit and Ajay Rahirkar are the accused, who had applied for bail. The arguments pertaining to the application of the MOCCA in the Malegaon case hinged on the issue of cognisance on the two charge sheets filed against accused Rakesh Dhawade prior to the Malegaon blast – one in Parbhani and the other in Jalna. Two previous charge sheets against one of the accused persons of an organised crime syndicate is a requirement for applying the MCOCA. The High Court restored it on the ground that cognisance was taken on Dhawade's charge sheets. It observed that the Special Court's basis for revocation of the Act on the issue of taking cognisance was “against well settled legal position.”

A Delhi court on July 21 issued non-bailable warrants (NBW) against five Pakistanis in a case filed by the National Investigation Agency (NIA), charging them with facilitating terrorist attacks in India, but rejected its application for NBWs against Lashkar-e-Toiba (LeT) chief Hafiz Mohammed Saeed and Zaki-ur-Rehman Lakhvi, the first and second accused, reports The Hindu. While agreeing with the prosecution’s charges against the seven, Special Judge (NIA) S. P. Garg said no purpose would be served by issuing NBWs against Saeed and Lakhvi. For, a Mumbai trial court had issued NBWs against them and subsequently Interpol also issued Red Corner Notices. The NIA counsel had on July 20 said that Saeed and Lakhvi could be issued the “Special Notice” as the Security Council had imposed sanctions on them for their ties to the al-Qaeda and the Taliban. The five persons against whom NBWs have been issued are Karachi residents Sajid Mir alias Wasi and Abdur Rehman Hashim, Pakistani army officers Major Iqbal and Major Sameer Ali, and Pakistan-occupied Kashmir (PoK) resident Illyas Kashmiri. He was brought to Raichur and produced before the Judicial Magistrate First Class in Raichur on July 22. After the death of Bhaskar, a Naxal leader from Srikakulam of Andhra Pradesh, in an encounter in a village in Raichur taluk in 1987, Nandakumar is said to have shifted his activities to the Western Ghats. "Dar has given details of the whole outfit including the names of the leader and other companions and the confession also refers to the firearms brought by the group of terrorists from Pakistan and the training which was for bringing into effect the terrorist activity in the Kashmir valley," the SC said. "It has also come in the confession that Dar had visited Pakistan, Lahore and Muzaffarabad to meet other members of the group namely Hyder, Hanif Hyder, Nasir Khan and Yusuf Bangroo on fake passport. The said confession also gives details that the said passport was issued in Sikar, Rajasthan, with visa of Pakistan," the Bench noted. It said: "We are thoroughly convinced that this confession is not only a good, voluntary and truthful confession but a reliable one also and the trial court has committed no mistake whatsoever in relying upon the said confession."

The Karnataka High Court, on August 3 , denied anticipatory bail to Abdul Nasir Madani, chairman of the People's Democratic Party (PDP) in connection with the July 25, 2008 Bangalore serial bomb blasts case, in which one woman was killed and 20 people were injured, according to The Hindu. The Karnataka government opposed the petition, saying that Mr. Madani was involved in a criminal conspiracy and prima facie there was a case against him. The PDP leader was one of the 32 people charge-sheeted in the case and the city police had established his role in the case. Justice N. Ananda accepted the arguments of the State and rejected the petition. Madani is yet to appear in court, which has issued a non-bailable warrant against him.

They also recovered two driving licenses from Ali issued in Agra (Uttar Pradesh) and Hissar (Haryana). Chandhikok made this submission before Justice Vikramajit Sen of the Delhi High Court, who constitutes the one-man tribunal hearing arguments on the validity of the notification extending the ban. The ASG read out material to show that LTTE leaders, operatives and supporters had been inimically opposed to India's policy on their organisation, and the outfit continued its unlawful activities, using remnant cadres as well as local smugglers and pro-LTTE operatives for procuring explosives, detonators, chemicals and ammunition. Various cases registered against LTTE cadres, sympathisers and agents under the Act and other provisions of law would amply prove that the outfit, though based in Sri Lanka, had sympathisers, supporters and agents in India to carry out unlawful acts for the organisation, he pointed out. The ASG also observed that clandestine support was being extended to the LTTE by Sri Lankan Tamils who entered India in the guise of refugees and indulged in smuggling of even narcotic drugs to raise money for their activities.

Hindustan times reports that 14-year-old Barun Munda, a cadre of the Communist Party of India-Maoist (CPI-Maoist) who surrendered before the court of Additional Chief Judicial Magistrate, Ghatsila on November 8 has pleaded before the Jharkhand Police to help him pursue studies claiming that he had been 'trapped' by the Ghurabandha squad of the Maoists, Superintendent of Police (Rural), Ranjit Prasad said. Barun was a VIth standard student at Jamua. A nephew of hardcore Maoist Phogra Munda, he was in the squad for about a year when he was asked to do errands like carrying the Maoists' fire-arms and preparing food except when on particular "assignments like murder or act of sabotage on specific days." Barun was accused in the killings of two persons a few months ago and of blowing up rail tracks near Dalbhumgarh during a bandh called by the Maoists early this year. The boy claimed before the Police that he was lured by the Maoists since he wanted to earn fast bucks "for studies". Barun had made up his mind to flee from the group after the Maoists repeatedly refused to pay him, the SP Ranjit said.

"Recovery of the arms and ammunitions have not been proved, by no stretch of imagination, the charge of sedition can be said to be proved against the accused (Irshad Ahmed Malik)," Additional Sessions Judge J R Aryan said. Malik, hailing from Doda District of the State who was staying at Rajdhani hotel in South Delhi, was arrested on the evening of March 27, 2004, by the special cell of the Delhi police on a tip off. The police had recovered INR 2.75 lakh cash, alleged hawala money and a pistol along with eight live cartridges, the charge sheet said. During the probe, the militant also helped recover an AK-56 assault rifle and 60 cartridges from a place near the Humayun's tomb in the national capital, it added.

PTI reports that Government counsel Ujjwal Nikam told the Bombay High Court on November 19 that Pakistani Lashkar-Toiba (LeT) terrorist Mohammad Ajmal Amir Kasab, the lone arrested terrorist in the November 26, 2008 Mumbai terrorist attacks (also known as 26/11), and his companions were instructed by their LeT handlers on telephone to hold as many hostages as possible during the terrorist attacks to demand from the Indian Government the creation of a "separate state for Muslims". To fulfil the demands for a separate State for Muslims in India and liberation of Kashmir, LeT advised the militants on phone to take VIPs as hostages to compel the Government to act on them, Nikam told the court. He said that LeT handlers had also advised the attackers to identify themselves as Indian Muslims belonging to Indian Mujahideen and hide the fact that they had come from Pakistan. The designated Terrorist and Disruptive Activities (Prevention) Act (TADA) Court in Guwahati on November 23 granted bail to the United Liberation Front of Assom (ULFA) ‘deputy commander-in-chief’ Raju Baruah against a sum of INR 100,000 with two sureties in connection with three cases, i.e., TADA case Nos. 32/01, 43/01 and 350/91. The Court also imposed four conditions on Baruah while granting the bail. These are: the accused shall not leave the Court till disposal of the cases and shall deposit his passport, if any, with the Court; shall not leave Assam without informing the officer-in-charge of the local Police Station where he is a resident; shall not threaten the victims and their near and dear ones besides the witnesses of the cases; and shall not commit any offence during pendency of the cases.

The filing of the FIR came following a directive from a local court on November 27 on a petition filed by one Sushil Pandit who alleged that Geelani and Roy made anti-India speeches at a conference on "Azadi-the Only Way" on October 21, an unnamed senior Police official said. Roy and others were charged under Sections 124A (sedition), 153A (promoting enmity between classes), 153B (imputations, assertions prejudicial to national integration), 504 (insult intended to provoke breach of peace) and 505 (false statement, rumour circulated with intent to cause mutiny or offence against public peace. "These Sections have to be read with Section 13 of the Unlawful Activities Prevention Act of 1967," the official said. Roy and Geelani had shared the dais with Communist Party of India-Maoist (CPI-Maoist) sympathiser Vara Vara and others. Geelani was heckled by the audience.

The NIA had sought custody of 20 days on the strength of NIA case number 10/10 under section 120(B)/121/121(A) -122-468 Indian Penal Code and under Sec 10/13 of Unlawful Activities(Prevention) Act. The next hearing is fixed on December 16. In the course of their interrogation it has emerged that the Maoists have links with terrorist outfits in Manipur and relations with the People's Revolutionary Party of Kangleipak (PREPAK) have reached a practical level over the past six to eight months.
