The Principal Sessions Judge of Jammu, J. R. Kotwal, convicted and sentenced an Inter-Services Intelligence (ISI) trained militant, Raja Muzaffar Ahmed, to undergo 18 years imprisonment, Daily Excelsior reported. According to the prosecution, on May 1, 2000, one Sanjeev Kumar helped the security forces in arresting two persons, who had come from across the border and enquiring about the road leading to Jammu. The duo disclosed their identity as Raja Muzaffar (code name Rashed) and Bilal Ahmed (code name Siraj Ahmed). From the possession of Raja Muzaffar, maps of Hiranagar sector, railway line and national highway were recovered while a pistol along with loaded magazine was recovered from Bilal Ahmed. On the disclosure of Raja Muzafar Ahmed, two hand grenades, one pistol magazine loaded with seven cartridges, one packet containing five kilograms of RDX, three time pencils, three detonators and a compass were recovered. Further investigation revealed that the duo were active militants and they, at the instance of Pakistan’s ISI, entered India through International Border in Hiranagar sector to carry out disruptive activities in the State. "The offence committed by the accused Raja Muzafar Ahmed is serious as well as heinous. Normally, a person involved in commission of such offence does not deserve leniency and the court can see mitigating circumstances in the case as to how meekly the accused and the co-accused, who is proceeded under Section 512 CrPC, had made their way to police custody", the Court observed.

A top leader of the National Democratic Front of Bodoland (NDFB), Sunil Brahma, was acquitted by the Terrorist and Disruptive Activities (Prevention) Act (TADA) Court in Guwahati in connection with an attack by the group in the Kokrajhar district in 1994 that claimed 21 lives. According to reports, the Maoists were arrested In Tamil Nadu in June 2007 while imparting training to local unemployed youths in a forest range using looted arms of Koraput. According to police sources, these CPI-Maoist cadres were involved in looting the Koraput armoury on February 6, 2004. After confirming the arms belong to Koraput armoury, a court in Tamil Nadu shifted the case to Koraput SDJM jurisdiction for further legal proceedings. A police team from Koraput under the direction of Superintendent of Police Deepak Kumar rushed to Trichy jail in Tamil Nadu and took custody of the five Maoists on January 14. The five Maoists, including a top leader Sundar Murty (30), were produced before the Koraput SDJM court on January 15. The arrested Maoists were Velu Murugam (19), Palani Velu (26), Muthu Selvam (27) and Kartik (27) apart from Sundar Murty. Sources said 550 arms, including 25,000 live bullets, were looted from the district armoury and these were later distributed to various groups in Chhattisgarh, West Bengal, Orissa, Andhra Pradesh, Jharkhand and Bihar for imparting training to unemployed youths.

On January 23, a fast track court in Lucknow, capital of Uttar Pradesh, sentenced five militants of the Harkat-ul Jihad-al Islami (HuJI) to life term for waging war against the State, sedition, conspiracy and other charges, reports Press Trust of India. The convicts, Mehboob Ali, Sayeed Shoaib, Mohammad Rizwan, Farhan and Mohammad Saad, were arrested by the Special Task Force from Lucknow on April 5, 2006, along with Waliullah, the prime accused in the Varanasi twin blasts which occurred in the Sankat Mochan temple and near the railway station in March 2006. The court also awarded them 32 years of additional imprisonment under various sections of the Indian Penal Code, besides imposing a fine of INR 40,000 each. All punishments will run concurrently. At the time of their arrests, police had seized an AK-47 rifle, a large number of hand grenades, detonators, six kilograms RDX, three kilograms PETN explosives and a loaded pistol.

On February 12, the Supreme Court rejected the bail plea of Rubina and Yusuf Memon, both convicts in the 1993 Mumbai serial blasts case, reports Economic Times. Rubina and Yusuf Memon, sister-in-law and younger brother of the prime accused Tiger Memon, were convicted of abetment and conspiracy and have been awarded life sentences. While Rubina's plea was summarily dismissed, the court ordered setting up of a medical board to assess Yusuf's mental health. Both had moved the court challenging the Terrorist and Disruptive Activities Prevention Act (TADA) court verdict convicting them in the case.

Three Khalistan Zindabad Force (KZF) militants were on February 15 sentenced to five years rigorous imprisonment by a court in the national capital New Delhi for a bomb blast in the Kailash Hotel in Paharganj area on March 13, 2000 in which three persons were wounded. The court sentenced the KZF militants, Sukhdev Singh, Satbir Singh and Purushottam Singh, after holding them guilty for entering into a conspiracy to wage war against the country, PTI reported. The court convicted them under Sections 120-b (criminal conspiracy), 121 (waging war against the country), 121-a (conspiracy to wage war), 186 (obstructing public servant in discharge of his function), 353 (assault on public servant), 307 (attempt to murder), 489-b and c (using and possessing counterfeit currency) of the Indian Penal Code. They were also convicted under sections 4 and 5 of Explosive Substances Act and sections 25 and 27 of the Arms Act.

Military intelligence officials along with special cell of Delhi Police arrested Captain Salim Zafar Azad, a suspected agent of Pakistan’s Inter-Services Intelligence (ISI) from a residential colony in East Delhi on February 27 and produced him in a court on February 28. Assam Tribune reports that the army official who served as an army doctor had deserted his services on May 18, 1997 when he was posted at Military Hospital in Dinjan Cantonment in the Dibrugarh district. Judge T Ramasamy said that the accused Nallarasu, Ravi, Sundaram, Radio Venkatesan, Kalai, Varadan, Punniyamoorty, Uthirapathi, Peter, Senguttuvan and Murugesan, had intended only to snatch away arms and ammunition from the police station. Economic Times quoting from an affidavit filed by the State Government in the apex court reported, "They (Naxals) destroyed 55 primary school buildings, eight panchayat bhawans (buildings of village level self-government institutions), nine ashram bhawans (buildings of religious institutions), nine hostels, eight anganwadi centres, 18 other buildings in the last three years. There were also cases of destruction of electric towers resulting in blackouts in many parts of the Naxal-affected regions". The affidavit said that the people of Chhattisgarh, due to the fear of the Maoists, were living in the camps. "The state cannot stifle any people’s initiative to resist a patently illegal organisation and its activities", the affidavit said.

The Additional Solicitor-General Gopal Subramanium told the apex court, “To assume that the Salwa Judum was an army of people with weapons and asking for it to be disbanded will be no more than asking for these people to be pushed out to be killed (by the Naxalites).” "Salwa Judum, activists of which are designated as special police officers, is consciously funded by the Centre to save the tribals, who were displaced from the jungles by Naxalites, and protect people from being killed by Naxalites", Subramaniam added. He further said, “Situation is of considerable concern both to the Centre and state. Policemen are not ready to step into the forests. Though 17,000 posts are sanctioned for anti-naxal force, the state government is finding it very difficult to fill them. A fast track court on June 9 sentenced two Communist Party of India-Maoist (CPI-Maoist) cadres, Surendra Manjhi and Saryu Manjhi, to death in connection with the attack on the Chhabilapur Police station in Nalanda district on August 11, 2005, reports PTI. Two persons including a constable and a person lodged in the lock-were killed in that attack. After the police contingent surrendered, the extremists had looted seven rifles, two carbines and 213 rounds of ammunition from them. They had also set ablaze the newly constructed police station building nearby before retreating. Justice Geeta Mittal of the Delhi High Court, who headed the tribunal, held that there was no new evidence submitted by the Government against the SIMI to justify the extension of the ban. A senior law officer said that the Government only came out with the evidence of the Malegaon blasts in Maharashtra in 2006 to show the complicity of the organisation in unlawful activities which was not sufficient to come out with the notification to ban it. However, the Union Home Ministry (MHA) said it will challenge the order of the tribunal which lifted the ban. A MHA spokesperson said, "The ministry will examine the order of the specially-designated tribunal in detail and take remedial action on a priority basis."

A Bench of the Supreme Court stayed the order on a mention made by Additional Solicitor-General Gopal Subramaniam about the Union Government filing a special leave petition against the lifting of the ban. The Bench, consisting of Chief Justice K.G. Balakrishnan and Justice A.K. Mathur, ordered notice to the SIMI seeking its response in three weeks. In his petition, Subramaniam said the tribunal, in its 264-page order passed on August 5, did not express anything on the merits of the case though the Government had provided Intelligence Bureau reports pointing to the involvement of SIMI members in terrorist activities. He said the tribunal had done something above the law and if the order was not stayed, it would result in serious consequences.

In its affidavit, the Government said investigations revealed that the accused in the bomb blasts in Ahmedabad and Surat on July 26 were members of the SIMI. Annexing the depositions made by witnesses, the Government further said intelligence sources and secret surveillance by the Police made it clear that the accused had nexus with international terrorist outfits. Further, these persons were persistently involved in more than one offence or other unlawful activities and the nature of activities indulged in by the outfit would show secessionist tendencies and the potential damage to the secular fabric of society. Annexing a list of over 350 terrorist-related cases registered in Maharashtra, Andhra Pradesh, Gujarat, Kerala, Karnataka, Tamil Nadu, Delhi, Madhya Pradesh, Rajasthan, West Bengal since 2001 and the arrest of over 1,400 SIMI cadres, the Centre said that despite the ban, the outfit had continued with its activities and managed to keep its network alive clandestinely. The organisation was revived through the front outfits, Tahreek-e-Ehyaa-e-Ummat, Tehreek-Talaba-e-Arabia, Tehrik Tahaffuz-e-Sha`aire Islam and Wahadat-e-Islami. The Centre said the confessional statements of some of the accused revealed that SIMI cadres had secret meetings to mobilise Muslim youth to spread jihad in the entire Indian subcontinent especially in Gujarat, and that they had planned to wage a war against India by indoctrinating and training Muslim youth in the use of arms and ammunition. The court on August 6 stayed an order passed by the Special Tribunal, set up under the Unlawful Activities (Prevention) Act, quashing the Centre’s February 7 notification banning the SIMI. As the tribunal order has been stayed for three weeks, the matter is listed for further hearing on August 25.

The Supreme Court on September 15 affirmed a tribunal order upholding the ban on the Muslim outfit, Deendar Anjuman, for its subversive and anti-national activities, reports The Hindu. Dismissing a special leave petition filed by the outfit, Justice Arijit Pasayat, who, along with Justice Mukundakam Sharma was on a Bench, said, "Your professed activities may be something, but your general activities are different." The judge pointed out that the Special Tribunal, set up under the Unlawful Activities (Prevention) Act, gave findings that the organisation was actively involved in anti-national and anti-religious activities in Goa, Karnataka, Andhra Pradesh and Maharashtra. The tribunal, headed by Justice Mukul Mudgal of the Delhi High Court, had on February 27 upheld the Centre’s fourth notification extending the ban on the outfit, accused of attacking churches to foment Hindu-Christian animosity. It was first banned in 2001 for two years and thereafter after every two years and the last notification was issued in August 2007. The organisation contended that there was no fresh evidence to show that it was still involved in anti-national activities.

On September 19, the Supreme Court asked the Chhattisgarh government to implement some of the recommendations of the National Human Rights Commission (NHRC), which went into the activities of the Salwa Judum (anti-maoist vigilante movement) set up by the State to tackle left-wing extremism, reports The Hindu. The NHRC had been asked by the Supreme Court to probe the allegations that the Salwa Judum was committing atrocities on innocent people. A Bench comprising Chief Justice K.G. Balakrishnan and Justices P. Sathasivam and J.M. Panchal told senior counsel K.K. Venugopal, appearing for Chhattisgarh, that the commission “has done a meticulous work. It has given a series of recommendations. It is very painful to read the report. It says there is arson and looting, people are armed and they [Salwa Judum] are committing serious offences. It says people who are subjected to serious problems are still afraid of coming out.” The Chief Justice observed, “When somebody [Salwa judum] is given arms, he claims to be a pseudo police. Once he is given arms, he will commit an offence though he has no right to do any such act. Some remedial measures have been suggested in the report and the State may consider implementing them. Whatever is urgently required to be done, do it.” Mr. Venugopal assured the court that the government would implement the recommendations “which are of immediate concern.”

The NHRC report, submitted to the apex court also dismisses most of the allegations of human rights abuses made by the petitioners in the apex court, including widely reported use of minors by Salwa Judum. The report blames the Naxalites for human rights abuses and sees action by Salwa Judum activists from the prism of necessary retaliation. The report further says that 15 years after Jan Jagran Abhiyan, an earlier attempt to deal with Naxalites, "local tribals once again mustered courage to stand up to the Naxalites, which only goes to show their sense of desperation."

Dhiren Boro was the first person to be booked and convicted under the POTA law in Sikkim. The act was repealed in September 2004. The NDFB vice-president, his wife Pratima and two of his accomplices, Bablu Sargari and Prabin, were picked up from a hideout at Samdur, near 5th Mile of Gangtok, in a police raid on January 1, 2003. Explosives, two hand grenades, a mobile phone, a computer, some e-mail addresses and Indian and Nepalese currency notes had been recovered from them. Boro’s wife and the two accomplices were acquitted in 2003 soon after their arrest. Dhiren was wanted in several cases in Assam, other north eastern states and Bhutan. He could be awarded 10 years imprisonment, half of which he has already served as an undertrial, a public persecutor said.

According to the report, the decision to eliminate the VHP leader was taken by the Central Committee of the CPI-Maoist about seven months ago, and a group of about six hardcore extremists killed the VHP leader at the Jalespata ashram (hermitage) in Kandhamal. The extremists who committed the crime were armed with automatic weapons, including AK-47 rifles, Police sources said. The local youths also took part in the crime and stood guard around the ashram when the Maoists executed their plan. The youths belonged to about four different groups from nearby villages. Three youths belonging to the local groups have been arrested so far. On October 16, they were produced before a court at Baliguda in Kandhamal. The court remanded them to judicial custody.

Mohammad Ali was brought on transit warrant from Jabalpur jail in Madhya Pradesh by the City Crime Branch for his alleged involvement in the July 26 serial blasts. He is allegedly involved in the blast at the city civil hospital. According to Crime Branch officials, Ali was the key financier for the Students Islamic Movement of India (SIMI) and used to bring money from outside India through Hawala. "Mohammad Ali was present in the SIMI camp held in Halol (near Vadodara). His name propped up during interrogation of those under our custody," Joint Commissioner of Police (JCP), Crime Branch, Ashish Bhatia, said, adding, "It is believed that he was involved in the conspiracy of conducting serial blasts in Ahmedabad and other places in the country. On November 18, the Special Investigation Team (SIT), filed charge sheets against 11 Students Islamic Movement of India (SIMI) cadres, identified as Mohammad Qureshi, Mahndi Hassan, Imran, Nazakat Hussain, Shahbaz Hussain, Mohammad Toufiq, Munnavar Khan, Ateeq-ur-Rahman, Mohammad Iliyas, Mohammad Sohail and Mohammad Azam, in the court of chief judicial magistrate in Jaipur, reports Times of India. The charge-sheets claimed that they were associated with the SIMI and had taken part in the meetings held by the organization across the country. They were also accused of conspiracy against the nation for giving shelter to main accused of the Jaipur serial blasts, Sajid, Karimudeen and Taukir. Sajid reportedly prepared a core group and Rajasthan’s command was given to Munnavar and Ateeq alias Atiq-ur-Rahman was given the post of secretary and Raja alias Imran was made treasurer. "The group was to carry out destructive activities and collect funds," said an SIT officer. Theses cadres were arrested from different parts of Rajasthan on different dates.

"The attack is directly on the Constitution of India," the Judge S.M. Shivanagoudar said. The court convicted them on charges of waging a war against the State under Section 121 of Indian Penal Code (IPC), conspiracy to wage a war under Section 121-A of IPC and sedition under Section 124-A of IPC. Some of them were also found guilty under the provisions of Explosives Act. This is the first time those accused of terrorist activities in the Sate have been convicted and the order on the sentence are reserved till November 22 (today).

He had managed to escape from an encounter site in Jammu and Kashmir in October 2008. Investigation revealed that Jabbar is the relative of Abdul Sattar, another terror suspect. Abdul Jabbar confessed that he had received training in making bombs and assembling and dismantling of guns. After obtaining a transit warrant, he was brought to Kerala and would be produced before the Additional Chief Judicial Magistrate Court at Thalassery on November 25 (today).

Earlier, also both had submitted a bail plea in 2007, which was subsequently rejected by the HC as well as the Supreme Court.
