Sangai Express reports that arrested United National Liberation Front (UNLF) ‘chairman’ Sanayaima alias RK Meghen was produced before the Special Court of National Investigation Agency (NIA) at Guwahati on March 7. Talking to media persons inside the court complex, arrested UNLF ‘chairman’ reacted strongly to the remarks of Union Home Secretary GK Pillai who is quoted to have said in media that militant outfits have shown interested in talks after many leaders including Meghen have been arrested. In this regard, Meghen retorted, ‘‘we have never said we are interested in talks, nor they have made any offer’ and the stand of UNLF is right to self determination of the people of Manipur who firmly believe in the proposal of plebiscite announced by UNLF in 2005. The growing demand of the people for holding plebiscite to resolve the Manipur-India conflict is appreciable. So, there is no question of any talks with India from the side of UNLF".

The Supreme Court on March 7 directed the Jharkhand and Tripura Governments to ensure that all schools and hostels of educational institutions are free from the occupation of Security Forces (SFs) within two months, reports Times of India. The apex court also expressed its displeasure against the Assam Government for not furnishing details about the number of schools occupied by the SFs and threatened that non-compliance of its orders would compel it to summon the Chief Secretary. A Bench comprising Justices BS Sudershan Reddy and SS Nijjar refused to give longer breathing period to the State Governments for implementing its direction. The Jharkhand Government counsel said 26 of the 47 school buildings have been freed from the presence of the para-military and State Police and sought another six months to fulfil the apex court order. Declining the plea, the Bench said, "the Jharkhand Government is directed to free the schools from the occupation of security forces within two months". The identical direction came for the Tripura Government which said only 16 schools out of 4000 are under the occupation of the central forces and due to insurgency reason it would take another six months for its removal. Further, the bench, which had asked the Ministry of Development of North Eastern Region (DONER) to hold meetings with seven North Eastern States on various aspects of development, made it party to the petition. The court during the earlier hearings had expressed its displeasure that Government did not respond to its order on the "serious" issue of ensuring that all schools and hostels of educational institutions should be kept away from the occupation of SFs.

According to India Express, Security Forces (SFs) during October 2008 operations in Jammu and Kashmir found that four Lashkar-e-Toiba (LeT) militants killed in a series of encounters were from Kerala. Subsequently, they learnt that the group had a fifth member, who managed to escape. The revelation set the Police and later the National Investigation Agency (NIA) on a trail that showed how the LeT was recruiting youths from Kerala, training them in Kerala and in Hyderabad of Andhra Pradesh, and then using them for operations in Jammu and Kashmir. Three years on, the NIA has retraced much of the trail with information from two suspected LeT militants from Jammu and Kashmir. Unnamed except as A and B, they have disclosed the identity of the LeT leader who allegedly supervised the recruitment. A and B are mentioned as witnesses in the NIA charge sheet submitted recently in a Special Court in Kochi in Kerala. They were examined under Section 164 of the Criminal Procedure Code (Cr. PC). According to the charge sheet, they have named Wali alias Rashid Abdullah, Baitullah Mujahideen of LeT training camp in Muzaffarabad of Pakistan occupied Kashmir (PoK), as having supervised the recruitments. A and B claim to have attended a jihadi (Holy War) training camp with Wali and the Kerala youths at Lolab forest in Kupwara District.

The Hindu reports that the Supreme Court granted bail to Binayak Sen on April 15, rejecting the plea of Chhattisgarh Government which had opposed Sen's bail saying that the documents and pamphlets found in his house suggested that he was actively associated with Communist Party of India-Maoist (CPI-Maoist). A Bench of Justices H.S. Bedi and C.K. Prasad, after hearing senior counsel Ram Jethmalani for the petitioner and senior counsel U.U. Lalit for the State, granted bail to Sen. Justice Prasad told Lalit that “We are a democratic country. He may be a sympathiser. That does not make him guilty of sedition.” Drawing an analogy, he asked Lalit that “if Mahatma Gandhi's autobiography is found in somebody's place, is he a Gandhian? No case of sedition is made out on the basis of materials in possession unless you show that he was actively helping or harbouring them [Maoists].” Jethmalani advocating for Sen said: “I have never seen such oppression from the State Government. This literature, what they call sedition is available in the market. ” Quoting various Supreme Court and other judgments, he argued that mere possession of some materials would not amount to the imperialistic concept of sedition, as the law relating to sedition had undergone a sea change. Not a single material was produced against Sen to show that he was involved in preaching or propagating Maoist ideology. Reacting on the Apex court’s decision, Chief Minister Raman Singh said his Government respects the Apex court’s order, reports Deccan Chronicle. “Supreme Court has only granted him the bail. The pending legal process will continue in high court at Bilaspur,” Singh said.

On the fourth day of the trial in Chicago in US, Mumbai terror attack (November 26, 2008, also known as 26/11) co-accused (along with the Pakistani- Canadian national Tahawwur Hussein Rana), Pakistani- American national David Coleman Headley on May 26 testified that he had attended over 50 training sessions with Inter-Services Intelligence (ISI), reports The Hindu. He confessed of having received espionage] training from the ISI. Other important details revealed by Headley were as follows: A Pakistani Navy man was present during discussions with his ISI handler Major Iqbal on landing sites and arrival of Lashkar-e-Toiba (LeT) terrorists by sea. Sajid Mir, the LeT commander of transnational operations, had overall control of the tactical planning of the operation, and issued directions to the attackers using Internet and satellite phone links. He was instrumental in the decision that the assault team would fight until its members were killed, and personally ordered the execution of two hostages held at Mumbai's Chabad House. LeT ‘supreme commander’ Hafiz Muhammad Saeed told the 10-member assault team, which attacked Mumbai in November 2008, that “being shot would feel like a pinprick, bloodstains would be like rose petals, and that angels would come down to take their souls.” Muzammil Bhat, a long-standing veteran of the LeT's operations in Jammu and Kashmir, was responsible for training the assault teams to the high standards needed to execute Mir's plans. Rana told co-accused Pakistani-American David Coleman Headley, in a September 2009 conversation, that the nine LeT operatives, who died in the attack, deserved the Nishan-e-Haider — Pakistan's highest military honour. Headley and Rana also discussed plans for future operations during the conversation, which was being secretly recorded by the Federal Bureau of Investigation.

UNLF chairman RK Meghen on June 9, urged all to shun culture of extortion and start earning their own livelihood instead of draining the public, reports Sangai Express. Speaking to reporters after being produced before a special court by the NIA in Guwahati, the militant leader said that serving extortion notices and lobbing bombs, opening fire and threatening the public, in case the demand is not met is not a healthy trend for the future of the land and the people. On the announcement of the Chief Minister daring the militants to come forward and take part in the election process to see whether they enjoy the support of the people or not, Meghen said that the plebiscite model mooted by the UNLF is akin to what the Chief Minister said. The UNLF leader said, “We welcome the Chief Minister's challenge to see whether the public support the militants or not” and added that the UNLF will respect the mandate of the people in any forum held under the supervision of the United Nations. Deploying a large number of security forces and asking the people to come out and vote in an atmosphere of fear and intimidation can never be free or fair, said the UNLF Chairman.

The Supreme Court on July 4 referred to a Constitution bench the plea of Jammu and Kashmir (J&K) National Panthers Party challenging the legality of the return and rehabilitation policy of J&K Government allowing the return of youth, who had crossed over to Pakistan in 1990s, to the Valley, reports Daily Excelsior. The court referred the matter to the constitution bench which is seized of another issue relating to the validity of the Resettlement Act, 1982. National Panthers Party, through its president Professor Bhim Singh, had moved against the ‘return and rehabilitation policy’, terming it as "highly dangerous" for the security of the State and submitted it may create a serious conflict. In his application, Bhim Singh alleged the Union Ministry of Home Affairs has already approved the return of 1300 Kashmiri youth on the recommendation of the State Government headed by Chief Minister Omar Abdullah. The party requested the Court to "issue an order restraining the Centre and the Government of J&K and its officials not to allow any militant or ex-militant from Pakistan occupied Kashmir (PoK) or Pakistan to enter J&K who had voluntarily migrated illegally from J&K and defected to PoK or Pakistan in the past".

The ruling - issued by Justices B. Sudershan Reddy and S.S. Nijjar on the writ petition filed by social anthropologist Professor Nandini Sundar and others - strongly indicted Chhattisgarh for violating constitutional principles in arming youth who had passed only the fifth standard and conferring on them the powers of police. The Bench said: “The State of Chhattisgarh shall forthwith make every effort to recall all firearms issued to any of the SPOs, whether current or former, along with any and all accoutrements and accessories issued to use such firearms. The word firearm as used shall include any and all forms of guns, rifles, launchers, etc, of whatever calibre.” The court also directed the Centre and the State to provide appropriate security forthwith, and undertake such measures “as are necessary and within bounds of constitutional permissibility, to protect the lives of those who had been employed as SPOs previously, or who had been given any initial orders of selection or appointment, from any and all forces, including but not limited to Maoists/Naxalites.”

Additional Sessions Judge Santosh Snehi Mann ordered framing of charges against Mishra and his wife Anu for allegedly having links with the Maoists and committing various offences under the Unlawful Activities (Prevention) Act, saying the documents recovered from them "lay emphasis" on capturing political power through armed rebellion. "The magazines, books and booklets recovered from the residential premises of the accused persons in bulk, besides promoting ideology of (CPI-Maoist), lay emphasis on capture of political power in the country by armed rebellion.... Text of the books speaks in strong words about bringing political and social change in the country through violence and by spreading hatred against the democratically elected government," the court said. Mishra was arrested by Special Cell of the City Police on April 26, 2010 from Shahdara in East Delhi and was found carrying various documents and a CD containing material related to CPI-Maoist. Anu was arrested a day later. Kashmiri separatist leader Ghulam Nabi Fai, accused of being an Inter Services Intelligence (ISI) agent and funneling its money into the US to influence American lawmakers on Kashmir, has admitted to taking money from ISI, reports Indian Express. During his detention hearing on July 26 at the US District Court in Alexandria, Virginia, a suburb of Washington, the prosecution said that Fai, the head of Kashmiri American Council, had admitted to receiving funds from the ISI. His attorneys, Nina Ginsberg and Khurram Wahid, claimed that though Fai took money from ISI, he never toed their line. The federal prosecutors, however, told the court that Fai not only received USD 4 million from ISI, but also strictly followed their agenda on Kashmir. Special FBI Agent Sarah Webb Linden told the court that Fai’s agenda was heavily dictated by the ISI. In fact, for his every meeting, agenda and speeches, he received bullet points from his ISI handlers in Pakistan. Fai did, what “ISI asked him to do,” she said. Also, US Attorney Gordon Kromberg said Fai has been an ISI agent for the past two decades. He told the court that during his interrogation after his arrest on July 19, Fai acknowledged to his links with ISI and having received money from the ISI.

The Supreme Court order on appointment of Special Police Officers (SPOs) in neighbouring Chhattisgarh was being examined by the Odisha Government which would give regular appointment to them, reports IBN Live. "The court order may not be applicable for the state. The method of recruitment and engagement of SPOs in Orissa is totally different from Chhattisgarh," Chief Secretary B. K. Patnaik said on July 28. SPOs appointed in tribal-dominated districts in Orissa did not directly confront Maoists and would be taken as regular constables after completion of a three-year tenure, he said. The youths appointed as SPOs in tribal areas received an opportunity to remain in mainstream instead of joining the Maoist brigade, he said. As many as 4,500 youths have so far been appointed as SPOs in the State and the Government was not averse to recruit more, a home department official said.

A close aide of All Parry Hurriyat Conference-Geelani (APHC-G) leader Syed Ali Shah Geelani is among four persons charge sheeted by National Investigation Agency (NIA) in connection with alleged hawala racket used to channelise money to terrorists of Hizb-ul-Mujahideen (HM) in the Kashmir Valley, reports PTI on August 3. The chargesheet names Ghulam Mohammed Bhat, Geelani’s aide, along with three other accomplices, including Mohd Sidiq Ganai, who had allegedly collected over INR 4.57 crore during a period of three years from January, 2008 through hawala channels from Pakistan for promoting "terrorist" activities in the valley. "The investigation has disclosed that four arrested accused acted as a gang and indulged in unlawful activities pursuant to criminal conspiracy and mobilised/raised funds for terrorist activities and thereby they committed offences under the Unlawful Activities (Prevention) Act," said the NIA in its 17-page charge sheet. The chargesheet said that "funds through hawala channels were being sent to Jammu and Kashmir for funding terror and secessionist acts in the state and Pakistan-based Maqbool Pandit, a member of banned Hizb-ul-Mujahideen, and Aizaz Maqbool Bhat, at present living in Saudi Arabia, were the key accused behind it." Special judge H S Sharma took the charge sheet on record for taking cognizance and issuing summons to the accused who are at present lodged in Tihar jail in New Delhi. IBN Live adds the special cell of Delhi police, on January 22, had arrested Srinagar-based lawyer Ghulam Mohammed Bhat, Mohd Sidiq Ganai, Ghulam Jeelani Liloo and Farooq Ahmed Dagga from a place in Jammu and Kashmir on a tip off that they were allegedly carrying hawala money for fomenting terror activities in the valley. It had also recovered INR 21.20 lakh hawala money from them. The charge sheet said investigation revealed that "huge consignments" of funds have been collected at various places in Delhi and one of accused Mohd Sidiq Ganai was in touch with Inter Services Intelligence (ISI) operatives Major Iqbal, an accused wanted in the 26/11 Mumbai attacks, and Colonel Abdullah. Ganai, who has been identified as an active member of People's League, a constituent of APHC-G, had gone to Pakistan in 1998 through Wagah border on Indian travel document and returned via Nepal on a Pakistani passport.

Centre on August 13 filed a petition in the Supreme Court, seeking recall and review of two crucial paras in its July 5 ruling, through which a bench banned the use of Special Police Officers (SPOs) in the fight against Naxalites [Left-Wing Extremists]. In the petition filed in the SC registry, the Ministry of Home Affairs (MHA) has sought recall of the two paras, 75 (ii) and 76, on the ground that they were in violation of the spirit of the Constitution. Sources said the Centre is of the view that this part of the judgment is an example of judicial overreach into executive functions. Para 75 (ii) of the SC’s Naxal judgment orders the “Union of India to cease and desist, forthwith, from using any of its funds in supporting, directly or indirectly the recruitment of SPOs for the purposes of engaging in any form of counter-insurgency activities against Maoist/Naxalite groups”. In Para 76, the bench of Justices B Sudershan Reddy (now retired) and S S Nijjar held the “appointment of SPOs to perform any of the duties of regular police officers, other than those specified in Sections 23(1)(h) and 23(1)(i) of Chhattisgarh Police Act, 2007, to be unconstitutional”.

The executive director of the foundation in London is Nazir Ahmad Shawl. The foundation hosted Maulana Fazlur Rehman, whose party the Jamiat Ulema-e-Islam (JUI) is said to have links to the Taliban, during a controversial visit to Britain in 2010. Turning down the appeal made by the arrested extremist leader Swami Aseemanand who had sought directions to restrain National Investigation Agency (NIA) from re-examining samples gathered after bomb blasts in Samjhauta Express on February 18, 2007, the Punjab and Haryana High Court, on September 2, ruled that NIA's move cannot be termed as re-investigation, but is further investigation in the case, which is permissible under law, The Times of India reported. Special NIA court, Panchkula, where trial against Aseemanand is pending, had allowed the agency to examine the samples, but he had moved the HC against the trial court's decision. In his appeal before the HC, Aseemanand had pleaded that the NIA wanted to re-examine the sample just to create evidence against him. He also submitted that since the agency had already investigated the matter and chargesheet has been filed in the case, such examination amounted to re-investigation.

A special Maharashtra Control of Organised Crime Act (MCOCA) court on November 5 granted bail to all nine persons accused in the Malegaon blasts case (September 8, 2006) after the National Investigation Agency (NIA) told the court it had no objection to any of their bail pleas, according to The Hindu. However, two of the accused were denied release from prison as they are accused in the Mumbai train bomb blast case (July 11, 2206) as well. While the investigating agency did not oppose their bail plea, it did not dismiss any of the charges slapped on them either. All the nine accused have been in prison for the past five years. The Anti-Terrorism Squad (ATS), which investigated the case initially, had claimed that many of the arrested accused were members of the banned Islamic outfit Students' Islamic Movement of India (SIMI). Even the Central Bureau of Investigation (CBI), which was later handed over the investigation, took the same line. It was only after the arrested extremist Swami Aseemanand's confession about the alleged involvement of right-wing Hindu fundamentalists in the 2006 Malegaon blast was leaked, that the line of investigation changed.

The Times of India reports that the Supreme Court on November 18 lifted its July 5 ban on central funding of anti-naxal [Left-Wing Extremism] and anti-insurgency operations through Special Police Officers (SPOs) in all states except Chhattisgarh. On July 5, a bench of Justices B Sudershan Reddy, since retired, and S S Nijjar had clamped a complete ban on central funding, which accounted for a major chunk of the budget for anti-naxalite and anti-insurgency operations in many states on a petition filed by Nandini Sundar alleging illegal recruitment of tribal youth as SPOs in Chhattisgarh and large-scale illegalities committed by them. On an application moved by the Ministry Of Home Affairs (MHA), a bench of Justices Altamas Kabir and S S Nijjar clarified that the July 5 judgment would operate only in Chhattisgarh. During the arguments on Nandini Sundar's petition, the Raman Singh government had clarified that SPOs, whose salary budget is borne mainly by the central government (80%), were not peculiar to Chhattisgarh. If there were 6,500 SPOs in Chhattisgarh, their number in Jharkhand was 6,400, Bihar 6,353, Orissa 4,480, Andhra Pradesh 2,130 and Maharashtra 1,500, it had said.
