Quoting a Central Bureau of Investigation (CBI) official, media reports said that the Portuguese Supreme Court has passed an order granting the extradition of Abu Salem, accused in the March 1993 Mumbai serial blasts, to India. Sources said the CBI had moved the Supreme Court against the order of the High Court of Lisbon in July 2004 granting Salem's extradition for trial only in minor cases of offence and not in the Mumbai serial blasts. After hearing the arguments, the Supreme Court of Portugal observed that the Indian Government had already promised that Salem would not be awarded capital punishment and granted his extradition for trail in all the cases in which he was involved. Abu Salem along with his associate, Monica Bedi, was arrested in Lisbon during September 2002 and was sentenced to four-and-half years of imprisonment on different charges.

After a two-year trial, a Canadian judge on March 16 acquitted two Indian-born Sikhs of murder and other charges in the deaths of 329 people killed in the June 1985-bombing of an Air India plane. On June 23, 1985, Air India Flight 182 from Montreal to London exploded and crashed into the Atlantic Ocean off the coast of Ireland. The British Columbia Supreme Court cleared Ripudaman Singh Malik and Ajaib Singh Bagri of all eight charges against them. Justice Ian Josephson reportedly said the prosecution's witnesses in the case were not credible.

Shabir Ahmad Khan of the Tehreek-e-Hurriyat, headed by Geelani, was released as the Jammu and Kashmir High Court quashed his eight-month detention last month, official sources said. Another separatist leader, Firdous Ahmad Shah of the Democratic Political Movement, was also reportedly released on the same day.

They were accused in the January 22, 2002-terrorist attack on the American Centre in Kolkata, in which four police personnel were killed and 18 persons wounded. The Chief Judicial Magistrate, Basudeb Majumdar, however, reserved the delivery of sentence till April 27, today.

On April 27, a Special Court in Kolkata, the capital city of West Bengal, sentenced to death Aftab Ansari and six others for the attack on the American Center. Ansari and his six accomplices, convicted by the Court on April 26, were sentenced to death under Section 121 of the Indian Penal Code for waging war against the State. They were also awarded life imprisonment under Section 302 (murder) and given seven years under Section 307 (attempt to murder). The death sentence, however, is subject to confirmation by the West Bengal High Court. They were accused in the January 22, 2002 attack on the American Centre in Kolkata, in which four police personnel were killed and 18 persons were injured.

According to Hindu, a court in Jalandhar, Punjab, on June 4 sentenced two Sikh terrorists to life imprisonment for the murder of a former police official's son in 1986. The Additional Sessions Judge, S K Garg, sentenced Daljit Singh Bittu and Gursharan Singh Gama to life imprisonment for the murder of Ashok Bedi, son of former Senior Superintendent of Police Ram Kishan Bedi, on June 10, 1986. Kashmir Times has reported that Jagtar Singh Hawara, 'operations chief' of the Babbar Khalsa International (BKI) in India, who is prime accused in the Delhi cinema blasts case will be taken to Jammu and Kashmir to probe his alleged links with terrorists there. "During interrogation, Hawara revealed his plans to revive terrorism in Punjab and also his links with the terror network in Jammu and Kashmir," Assistant Commissioner of Police (Special Cell), Rajbir Singh, told the Chief Metropolitan Magistrate Vinod Kumar while seeking his further police custody for taking him to Jammu and Kashmir to "effect some vital recoveries". One person was killed and at least 60 others were injured in bomb blasts at the Liberty and Satyam cinema halls on May 22, 2005.

On July 12, the Supreme Court of India repealed the controversial Illegal Migrants (Determination by Tribunals) [IM (DT)] Act, which has been applicable in the State of Assam. In a verdict delivered by Justice G. P. Mathur on behalf of the three-member Bench headed by Chief Justice R. C. Lahoti, the Court said "The IM (DT) rules and tribunals are declared to be ultra vires of the Constitution and are struck down." The 114-page ruling further said, "All the tribunals and appellate tribunals under IM (DT) Act shall cease to function. All cases pending before tribunal shall stand transferred to Foreigners (Tribunal) Order and be decided under Foreigners’ Act."

The Supreme Court on August 4 confirmed the death sentence of Jaish-e-Mohammed (JeM) activist, Mohammed Afzal, in the Parliament attack case, but condoned the death sentence of Shaukat Hussain Guru and passed the order of 10 years rigourous imprisonment and Rupees 25,000 fine. The apex court also upheld the Delhi High Court judgment of acquitting S. A. R. Geelani and Afsan Guru, wife of Shaukat Guru. On December 13, 2001, five Pakistani terrorists, identified as Mohammed, Haider, Hamza, Rana and Raja, had attacked the Indian Parliament and were subsequently killed by the security force (SF) personnel. Nine SF personnel were killed and 16 others sustained injuries in the attack.

According to The Hindustan Times, Sheikh Mohammed Muzamil, acquitted by a special Prevention of Terrorism Act, 2002 (POTA) Court in the Ghatkopar bomb blast case, surrendered before the trial court, which took him into custody on August 16. The accused had surrendered after the POTA court issued warrants against him in view of the Bombay High Court admitting an appeal filed by the Maharashtra Government challenging acquittal of five accused in the Ghatkopar bomb blast of December 2, 2002. Three other accused in the case - Abdul Mateen, Imran Rehman Khan and Mohammed Altaf - had surrendered earlier while co-accused Toufiq Ahmed is still at large.

With the 60-day-old economic blockade of Manipur by Naga students associations affecting normal life in the State, the Supreme Court on August 22 issued notices to the Centre and the State Governments on a Public Interest Litigation (PIL) seeking an early end to the hardships faced by the people of the State. According to Press Trust of India, the apex court issued notices on the PIL filed by Kh. Jibon Singh alleging that the blockade had led to violation of the right to equality, life and free movement of the people of Manipur. The petition said the blockade, led by the All Naga Students’ Association Manipur (ANSAM), has increased the price of essential commodities like petrol, cooking gas and kerosene out of the reach of common man. The ANSAM had initiated a blockade to protest the Manipur Government’s declaration of June 18 every year as ‘Solidarity Day’ in memory of Manipuris killed in 2001 when the Centre extended the area of cease-fire with the National Socialist Council of Nagaland - Isak-Muivah (NSCN-IM) beyond Nagaland. The petitioner said Manipur was connected to the rest of India by National Highway-39, which has been blocked, and the other road NH-53 had not been secured by the security forces in addition to it being non-motorable in many parts.

A court in the national capital New Delhi on August 23 convicted a Kashmiri terrorist who planted a bomb in a building in the busy Connaught Place area on May 2, 2001. Additional Sessions Judge, S. C. Rajan, convicted Arzad Ahmed Qureshi, an activist of the Muslim Front, under various provisions of the Explosives Act after he pleaded guilty to the offence. However, the court acquitted him of charges under Section 121 and 121A (waging war against Government of India) of the Indian Penal Code as the prosecution could not prove the specific accusations. Qureshi was arrested on May 4, 2001 from a lodge in the Jama Masjid area of Old Delhi and recovered one kilogram of RDX, two hand grenades, a timer pencil from his possession.

The Delhi Police is expected to file a review petition in the Supreme Court against the acquittal of S. A. R. Geelani in the Parliament attack case. "We have written to the Home Ministry and will move the apex court for a review of its judgment in the Parliament attack case as soon as we get the permission," Deputy Commissioner of Police (Special Cell), Ashok Kumar, told UNI on August 23. Geelani was on August 4, 2005, acquitted in the case, when the Supreme Court upheld the High Court decision in this regard. The court also reduced the sentence of another death-row-convict Shaukat Hussain Guru to rigorous imprisonment of ten years. However, it had confirmed the death sentence on another accused Mohammad Afzal, an activist of the Jaish-e-Mohammed (JeM).

The second additional district and sessions judge, M. Rajamouli Sharma, held the accused, Ashiq Ali alias Shahneel Tahir Ahmed alias Raza Khan, guilty of various offences under the Indian Penal Code (IPC). Ashiq Ali was sentenced to undergo rigorous imprisonment for life and to pay a fine of Rupees 500 for the charge under section 121 of the IPC. 25-year-old Ali was arrested at Sarangapur village in the Nizamabad district on January 26, 2002, while he was passing information relating to the Indian defence forces to Pakistan from a telephone booth. He was subsequently found to be a native of Hyderabad in the Sindh province of Pakistan.

On October 24, a court in New Delhi convicted a Pakistan-based Lashkar-e-Toiba (LeT) terrorist, Mohammad Arif alias Ashfaq, and six others while acquitting four accused in the Red Fort attack case. Ashfaq and his Indian conspirators, Nazir Ahmed Qasid and his son Farooq Ahmad Qasid, have been found guilty of waging war against the state, which can attract a death sentence. The quantum of punishment will be pronounced on October 29. The lone woman accused and Ashfaq's Indian wife Rahamana Yousuf Farooqui was found guilty under section 216 of the Indian Penal Code (harbouring an offender) and 218 (trying to save a person from punishment) for providing shelter to the LeT cadre. However, the court acquitted her of the charges of waging war against the country and the conspiracy to attack the Red Fort. The court also convicted Babar Mohsin Baghwala, Saddaqat Ali and Matloob Alam for their complicity in the attack. On December 22, 2000, LeT terrorists had sneaked into the fort and killed two Army personnel and a civilian.

Co-accused Nazir Ahmed Quasid and his son, Farooq Ahmed Quasid, both of Indian origin, were awarded rigorous life imprisonment. Arif's wife, Rehmana Yusuf Farooqui, who is of Indian origin, was sentenced to seven-year rigorous imprisonment and a fine of Rupees 10,000 for sheltering him before and after the incident. Additional sessions judge O.P. Saini reportedly said: "I sentence Mohammed Arif alias Asfaq alias Abdul Hamad to death along with a fine of Rs.1 lakh, subject to its confirmation by the Delhi High Court, under Section 121 of the Indian Penal Code (IPC) for waging war against the Government of India." Three Army personnel were killed in the attack on December 22, 2000.

Tariq Ahmed Dar, who was working as a sales representative with the pharmaceutical firm Johnson and Johnson, had allegedly hatched the plot along with two LeT cadres, Abu Al Qama and Abu Huzefa, DP Commissioner K. K. Paul informed at a press conference in Delhi. Huzefa was a Pakistani and a LeT commander in Kashmir Valley. Just days before the blasts, Rupees 4.86 lakh had been deposited to Tariq’s bank account in Srinagar from a Middle-East country. The money was meant for financing the blasts in which RDX, though not in its pure form, was used, Paul said. Dar had been arrested by DP from Srinagar on November 10 and was brought to Delhi the next day where a local court remanded him to 14 days police custody, Paul informed. He also said that at least four persons were involved in the blasts, which killed at least 62 people and injured more than 200 others. While two of the conspirators and executers are from Jammu and Kashmir, the others were "foreign nationals," Paul said without identifying their nationality. The Commissioner said that though Dar himself was "probably" not in Delhi at the time of the blasts, he was the "financer, coordinator, spokesperson and front-man" of the LeT.

According to Press Trust of India, two more Lashkar-e-Toiba (LeT) cadres have been arrested in connection with the October 29 serial bomb blasts in the national capital Delhi, raising the number of persons detained in the case to three. Ghulam Ahmed Khan and Rafiq were arrested in Jammu and Kashmir by a Delhi Police team on the basis of information provided by Tariq Ahmed Dar who was arrested on November 10. Khan, who was detained in Srinagar, was produced before a local court which remanded him to police custody till December 7. Khan and Rafiq are believed to have been instrumental in arranging of funds for carrying out the blasts.
