Netra Bikram Chand, the General Secretary of Netra Bikram Chand-led Communist Party of Nepal-Maoist (CPN-Maoist-Chand) issuing a press note on May 1 clarified their party had not been split though Krishna Prasad Dhamala announced the formation of a new party Jana Samajwadi Manch, reports Khabarhub. In the press note, the NCP said that Krishna Prasad Dhamala had left the party while their group was still facing a Government ban and was independent from earlier. It pointed out that since Dhamala was not associated with the party for long, forming a new party did not mean the CPN-Maoist-Chand had split. Nevertheless, they welcomed Dhamala’s move of forming a new party. “Jana Samajwadi Manch’s idea of contributing to socialism and revolution will be positive for the communist movement,” the statement read.

The Netra Bikram Chand-led Communist Party of Nepal-Maoist (CPN-Maoist-Chand) on May 1 split after politburo member Krishna Prasad Dhamla (Gambhir) revolted to form a new party called Jana Samajwadi Manch, reports Khabarhub. Issuing a statement coinciding with May Day, Dhamala said a new party has been formed to accomplish the ‘unfulfilled revolution’. The CPN-Maoist-Chand, which had reached a three-point agreement on March 5 with the incumbent Government, had been facing contradictions and intra-party disputes for a long time. Dhamala said the revolution has betrayed the Nepali people in the name of revolution, stressing the need to create a whirlwind of fierce struggles against feudal, imperialist and fundamentalist tendencies. “We are the witnesses of the history where the movement took the leadership to new heights but in the end, it was the leadership that betrayed the people and the revolution,” said Dhamala in the statement.

Advocacy Forum-Nepal, a leading non-profit, non-governmental organization working to promote the rule of law and uphold international human rights standards in Nepal, on May 2 expressed solidarity with Purnimaya Lama and her family in their relentless struggle for truth and justice for Arjun Bahadur Lama, reports The Himalayan Times. She has been waiting for impartial investigation and prosecution of the perpetrators for the past 16 years. Arjun was abducted by cadres of the then Communist Party of Nepal-Maoist (CPN-Maoist) on April 29, 2005. Although the Maoist party initially denied it had any role in the abduction, it reported that he died in an aerial attack of the Nepali Army while he was held captive by the Maoists. However, there is evidence to show that he was tortured to death by Maoist cadres. "Maoist cadres Agni Prasad Sapkota, Suryaman Dong, Yadav Poudel, Bhola Aryal, Karnakhar Gautam, and Norbu Moktan were allegedly involved in Arjun's killing," said Advocacy Forum-Nepal in a press release. Despite the Supreme Court order requiring impartial and prompt investigation, no investigation has been carried out in the case. On the contrary, despite the pending Police arrest warrant, Sapkota was promoted. Now he serves as the speaker of the House of Representatives. Despite an outstanding warrant for his arrest in relation to the abduction and murder, Constitutional Assembly Member Dong was appointed as the Minister of Energy in 2011. Advocacy Forum-Nepal has called upon the Government to Implement the Supreme Court's order to investigate and prosecute the perpetrators, enact laws that prevent those alleged perpetrators of human rights violations from serving in public posts, immediately amend the TRC Act and make it functional and establish the special court.

Prime Minister KP Sharma Oli during the Cabinet meeting held on May 2 has said he was preparing to seek a confidence motion on May 10 from the House of Representatives, reports Kathmandu Post. Prime Minister Oli told Ministers that he will face Parliament to prove the majority of the Government. Lila Nath Shrestha, Minister for Law, Justice and Parliamentary Affairs, said Oli wants to take a vote of confidence to take the political process which has been stuck now, forward.

Leaders of the Communist Party of Nepal-Unified Marxist–Leninist (CPN-UML) faction led by Madhav Kumar Nepal and Jhalanath Khanal faction is preparing to resign en-masse without casting votes in favour of Prime Minister KP Sharma Oli, reports Khabarhub on May 5. Out of 121 lawmakers in the ruling CPN-UML, the Nepal-Khanal faction has been claiming to have over 35 lawmakers. In the 275-member House of Representatives (HoR), the CPN-UML has 121 lawmakers, Nepali Congress (NC) has 63 (two suspended), Communist Party of Nepal-Maoist Centre (CPN-Maoist Centre) has 49 (four defected to CPN-UML), Janata Samajwadi Party (JSP) has 34 (two suspended) and Nepal Workers and Peasants Party (NWPP), Rastriya Janamorch (RJM), Rastriya Prajatantra Party (RPP) and Independent have one seat each.

Nepali Congress (NC) President Sher Bahadur Deuba and Communist Party of Nepal-Maoist Centre (CPN-Maoist Centre) Chairman Pushpa Kamal Dahal on May 7 reached an understanding to foil the bid of Prime Minister K P Sharma Oli to secure vote of confidence from Parliament, reports Republica. The two top leaders of the opposition parties have also agreed to make efforts necessary to garner requisite majority votes in Parliament to foil Oli's attempt to secure majority votes and prolong his stay in power for another two years. Sources said the two leaders have expressed suspicion that Prime Minister Oli is seeking reappointment as Prime Minister as per the Article 76(2) of the Constitution instead of seeking vote of confidence in Parliament.

PM Oli, who opted to seek House’s trust on his government as per the Article 100 (1) of the Constitution of Nepal, managed to garner only 93 votes, which fell short of 43 votes to reach the 136-mark and win the confidence. At least 28 lawmakers of the party close to the senior leaders’ duo Madhav Kumar Nepal and Jhala Nath Khanal abstained from voting. Main opposition Nepali Congress (NC) and Oli’s former coalition partner, Communist Party of Nepal-Maoist Centre (CPN-Maoist Center) voted against the Oli-led Government. NC has a total 61 lawmakers while the Maoist party has 49 votes including Speaker Agni Prasad Sapkota. The Janata Samajbadi Party (JSP), however, got divided during the voting process. Emerging out from the meeting, CPN-UML leader Bhim Rawal said talks centered around keeping the party united and to achieve this end, a task force would be formed under the leadership of faction leaders i.e. PM Oli and leader Nepal. Rawal also said talks would be held again. Four former Chief Justices Sushila Karki, Kalyan Shrestha, Min Bahadur Rayamajhi and Anup Raj Sharma warned of mockery being made against rule of law as the Constitutional Bench of the Supreme Court on May 28 began hearing on the 30 petitions filed against dissolution of the House of Representatives (HoR) and announcement of midterm elections, reports The Kathmandu Post. “By dissolving Parliament time and again, punishing the House for no reason, introducing a number of ordinances, bringing a full budget instead of interim one, mockery has been made of the rule of law in the country,” said the joint statement by four former chief justices.

Nepali Congress (NC) President Sher Bahadur Deuba on May 28 said that President Bidhya Devi Bhandari and Prime Minister KP Sharma Oli had put democracy at stake, reports The Himalayan Times. Addressing a virtual even organized to mark the 30th establishment day of Nepal Press Union in Kathmandu, he alleged that both Bhandari and Oli had grossly violated the constitution. "We approached the president with the signature of majority of lawmakers after she called on political parties representing the HoR to stake their claim on the prime ministerial post in accordance with Sub-article (5) of Article 76 of the constitution. But the president did not appoint the person, who commanded majority, as prime minister. Instead, she dissolved the HoR overnight in collusion with Oli. Had she doubted the signature of majority lawmakers, she should have asked the signatories to present themselves physically. The incumbent president and prime minister are threats to democracy and I appeal to all political forces to stand united against their interference in the democratic system," Deuba said.

In a statement on May 30, the opposition alliance that includes Nepali Congress (NC), Communist Party of Nepal-Maoist Centre (CPN-Maoist Centre), Madhav Kumar Nepal faction of the Communist Party of Nepal-Unified Marxist–Leninist (CPN-UML), Upendra Yadav-Baburam Bhattarai of the Janata Samajbadi Party-Nepal (JSP-N) and Rastriya Janamorcha Nepal (RJN) warned the Government not to take any decision having long-term effects, reports Kathmandu Post. The alliance has also requested all state bodies not to support the Government’s undemocratic and unconstitutional activities. The statement comes a day after the Government announced the budget of the fiscal year 2021-22 through an ordinance on May 29 which the opposition claims the Caretaker Government does not have the right to do.

A faction of the Janata Samajbadi Party (JSP) led by Chairman Mahantha Thakur and senior leader Rajendra Mahato, which is in talks with Prime Minister KP Sharma Oli to join the Government, on May 30 seek an ordinance to split the party before joining the Government, reports Kathmandu Post. Oli wants to transform his government into a ‘national government’ in order to hold mid-term elections in November and has been trying to induct a faction of the JSP. During their meeting with Prime Minister Oli, Thakur and Mahato urged the Prime Minister to bring an ordinance to pave the way for splitting the JSP. As per the Political Parties Act, one needs over 40 percent support in both the Parliamentary Party and the Central Committee to split a party. Though the Thakur faction has over 40 percent support in the Parliamentary Party, it is in a minority in the Central Committee. Thus, the Thakur-Mahato faction leaders could be expelled from the party if they joined the Government.
