The Supreme Court (SC) on August 2 refused to issue an interim order in the case filed by four former lawmakers representing the Communist Party of Nepal-Maoist Centre (CPN-Maoist Centre) who had joined the KP Sharma Oli Government, reports The Himalayan Times. Top Bahadur Rayamajhi, Lekh Raj Bhatta, Prabhu Sah, and Gauri Shankar Chaudhary had filed a writ petition at the SC on July 28 demanding reinstatement of their House of Representatives seats that they had lost after the CPN-Maoist Centre took disciplinary action against them for defecting to the Communist Party of Nepal-Unified Marxist-Leninist (CPN-UML).

The Election Commission (EC) scrapped registration of 41 political parties, reports My Republica on August 4. With this, there are now 95 political parties in the country. Earlier, 136 political parties were registered at the EC. The EC dismissed 41 political parties after they failed to submit audit reports for three consecutive years. The EC has maintained that Names, Flags and Symbols used by these parties cannot be used by any other political parties for one year. According to EC Spokesperson Raj Kumar Shrestha, the EC has scrapped these political parties and office bearers of their working committee have also faced action. These parties will now need to file Rs 50,000 each. "In order to prevent the central office bearers and members of the dismissed parties from becoming office bearers of other parties for a period until the fine is collected, it has been decided to proceed with the proceedings in accordance with the law only after registering a new party and updating the existing parties," said Shrestha. The EC had earlier sought clarification from 86 political parties failing to submit audit reports for three consecutive years.

Pokharel had issued a press release warning party leaders not to take part in the meetings scheduled by the Nepal-Khanal faction. The Nepal-Khanal faction leader Metmani Chaudhary told that Nepal had asked the establishment faction to settle unity issues by August 8. "Nepal's implied message was that if the establishment faction did not agree for party unity by August 8, then Nepal faction would chart out its new course," Chaudhary added.

The Election Commission (EC) on August 9 updated the record of 35-member executive committee of the Janata Samajbadi Party-Nepal (JSP-N) recognising Upendra Yadav as the only party chair, reports The Himalayan Times. Spokesperson for the EC Raj Kumar Shrestha said Mahantha Thakur was not listed as the party's co-chair among its 35 executive members. JSP-N leader Ram Sahay Yadav said the party had demoted Thakur to a general member after he went against the party's decisions. The EC updated the party's record after the JSP-N made changes to the 51-member executive committee removing supporters of Mahanatha Thakur and Rajendra Mahato. On July 27, the EC gave authenticity to Upendra Yadav-Baburam Bhattarai faction of the party after 34 members of the party's 51-member executive committee supported the faction during the support verification process. Only 16 members of the executive committee had supported the Thakur-Mahato faction.

Addressing the HoR for the first time after the House was restored, Oli said the Government had stated in the CMP that it would review unequal treaties and agreements, but did not clearly state which treaties or agreements were unequal. The disgruntled faction has decided to break away to form a new party concluding that party chair KP Sharma Oli is bent on moving ahead with unilateral decisions. The Nepal-Khanal faction has accused Oli of making preparations for the upcoming genera conventions through the unilateral amendment of party statute, renewal of memberships and the reformation of organizations at various levels. Most of the leaders of the Nepal-Khanal faction are in favour of joining the Government by forming a new party.

The Supreme Court (SC) on August 16 upheld the decision of the Election Commission (EC) and given the official recognition of Janata Samajbadi Party-Nepal (JSP-N) to Upendra Yadav, reports Republica. Refusing to issue an interim order in the case of leader Mahanta Thakur, the apex court has recognized the decision of the election body to recognize the Upendra Yadav-led faction of JSP-N as the official party. A joint bench of Justices Deepak Kumar Karki and Ananda Mohan Bhattarai ruled in favour of the EC in a writ petition filed by the Mahanta Thakur-led faction of the JSP-N. Considering the vote expressed by the majority members of the party, the apex court stated that an interim order should be issued as the EC decided on the party's authenticity on July 26, 2021.

A meeting of the Cabinet had recommended to the President to prorogue the parliamentary session with effect from August 16. Even though the House of Representatives was reinstated for the second time, the Government failed to give enough business to the Parliament. Lawmakers have complained that the House of Representatives has become ineffective due to lack of business. A source said that the government is preparing to bring some ordinances after concluding the parliamentary session.

The Government on August 17 introduced a new ordinance related to splits in political parties, reports Republica. A Cabinet meeting held at Baluwatar decided to introduce the ordinance and send it to the President’s Office for approval. The new ordinance, once it is approved by the President, will allow a split in a political party if 20 percent of the central committee members or the parliamentary party members of that party want so. The existing Political Parties Act allows a split in a party only if the proposal to split the party is supported by at least 40 percent of the central committee members or parliamentary party members of that party.

The establishment faction of the Communist Party of Nepal-Unified Marxist-Leninist (CPN-UML) led by party Chairman KP Sharma Oli on August 18 (today) removed 14 lawmakers belonging to the Madhav Kumar Nepal-Jhalanath Khanal faction from the party and wrote to the Parliament Secretariat seeking their expulsion from the House, reports The Himalayan Times. The establishment faction also sent a copy of its letter to the Election Commission (EC). Lawmakers who were expelled from the party are Madhav Kumar Nepal, Birodh Khatiwada, Met Mani Chaudhary. Ending months of wrangling with the Communist Party of Nepal-Unified Marxist-Leninist (CPN-UML), leaders Madhav Kumar Nepal and Jhalanath Khanal have registered CPN-UML Samajwadi Party with the Election Commission (EC) on August 18, reports Khabarhub. According to Nepal-Khanal faction leader Rajendra Pandey, 28.57 per cent of the 203-member central committee of the CPN-UML signed the petition to split from the party. He said that while Madhav Kumar Nepal is the Chairman of the party, Jhala Nath Khanal is the senior leader. Pandey further informed that 58 central members have come to the new party from the CPN-UML.

Six writ petitions have been registered at Supreme Court (SC) against ordinance to amend Political Parties Act on August 19, reports The Himalayan Times. Advocates Arjun Kumar Aryal, Sakuntala Bhusal, Nikesh Kumar Lamsal, Anup Aryal, Pravesh KC, Shrikant Baral, Dal Bahadur Dhami, Saroj Budhathoki and Ashish Shrestha have filed separate writ petitions at the Apex court. According to SC spokesperson Baburam Dahal, six writ petitions have been filed in the Court against the ordinance on political parties. The hearing is scheduled for coming September 25. The writ petition seeks an interim order to overturn the Government's decision as it is unconstitutional to bring the ordinance the day after the Government ends session of the federal Parliament. As soon as the ordinance came into force, the Communist Party of Nepal-Unified Marxist-Leninist (CPN-UML) Madhav Nepal Group and Janata Samajwadi Party-Nepal (JSP-N) led by Mahanta Thakur have already applied to the Election Commission (EC) for registration of a new party.

The Election Commission (EC) on August 25 registered and certified both the breakaway factions of the Communist Party of Nepal-Unified Marxist-Leninist (CPN-UML) and Janata Samajbadi Party-Nepal (JSP-N), reports The Himalayan Times. The two new parties have now been recognised as Communist Party of Nepal-Unified Socialist (CPN-Unified Socialist) and Democratic Socialist Party-Nepal (DSP-N) respectively. 55 Central Committee members, and 30 lawmakers, including seven National Assembly members of the CPN-UML had verified their signatures. Similarly, 17 Executive Committee members of JSP-N and 14 lawmakers, including one National Assembly member, verified their signatures.

In the first media conference organised by his party after getting a letter of certificate from the Election Commission (EC) of Nepal on August 25, Nepal said "Our party CPN (Unified Socialist) will cooperate with all the leftist-democratic parties. We will continue to extend cooperation to the Nepali Congress, Maoist Centre and Janata Samajbadi Party-Nepal." Stating that his party would be devoted to the welfare of the country and people, Nepal argued that his party wouldn't be confined to petty interests and ill-practices. The ruling Communist Party of Nepal-Maoist Centre (CPN-Maoist Centre) on August 31 revived its much-criticized youth wing - the Young Communist League (YCL) - forming a 231-member central committee of the youth wing through a national gathering in the capital Kathmandu city, reports Republica. The office-bearers of the YCL, however, could not be picked due to disagreements. The meeting has decided to hand over the responsibility of selecting office-bearers to the central committee. According to Ram Prasad Sapkota, the national in-charge of the YCL, the selected members of the central committee will pick the office-bearers in the upcoming events.
