Earlier, on July 1, the major three parties had agreed to introduce a supplementary amendment bill along with the Fifth Amendment bill to the interim constitution to address the demands floated by the Madhes-based parties. A joint-meeting of the ruling three parties - NC, CPN-Maoist and CPN-UML - and the agitating Madhes-based parties MPRF, Terai-Madhes Democratic Party and Rajendra Mahato-led Nepal Sadbhawana Party at the Ministry of Peace and Reconstruction in Singhadurbar agreed in principle to tackle the contentious issues that have cropped up after the Madhesi lawmakers began to continuously disrupt the CA meet since June 26. The meeting agreed to incorporate the provisions of an autonomous Terai region and mass recruitment of Madhesis into the security bodies in the proposed supplementary bill along with the Fifth Amendment bill. As per the agreement reached between the political parties, a taskforce has been set up to prepare the draft of the supplementary proposal. The Seven Party Alliance will ratify the proposal prepared by the draft committee, which will be passed later by the Council of Ministers. The government will then present the proposal at the CA sitting, according to leaders.

Kantipuronline reports that indigenous groups residing in the Terai region have expressed objections to the demand of ‘One Madhes, One Province’ forwarded by the Madhes-based parties. They have threatened to launch a strong struggle if the demand is fulfilled. Federal Republican National Front, Chure Bhawar Ekata Party and Nepal Loktantrik Samajwadi Dal have jointly announced a general strike in the Terai region on July 3 (today). Addressing a programme in the capital Kathmandu on July 2, representatives of the indigenous groups said the country will fall into the trap of segregation if the demand calling for ‘One Madhes, One Province’ is fulfilled. The identity of over five million people including those of the Tharu community will disappear if the demand is fulfilled. They also urged the CPN-Maoist, CPN-UML and Nepali Congress (NC) not to kneel in front of the Madhes-based parties just because they disrupted the Constituent Assembly (CA) session. Meanwhile, the Madhesi People’s Rights Forum (MPRF) leader Kishor Kumar Biswas has also resigned from the party to express opposition against the demand.

Senior Nepali Congress leader Sher Bahadur Deuba has blamed Maoists for failing to understand their new political responsibility even as they are poised to lead a new government, according to Kantipuronline. Addressing the 23rd meeting of Socialist International, a forum of more than 160 political parties from 120 countries, Deuba said Maoists are yet to shed off the characteristics of an insurgent movement. "Their behavior still rouses fear in the minds of many," he said, adding, "Their cadres are yet to realize that every citizen - despite political orientation - must enjoy unfettered human rights, liberty and freedom." Deuba also informed the meeting about the progress made so far toward establishing lasting peace in Nepal through dialogue with Maoists, the recently concluded Constituent Assembly election and the future road of Nepal. He said there are still challenges ahead for Nepal to ensure a functioning democracy. "There are other political questions to respond to - including laying the foundations and modalities for establishing a functional federal state," he said, and added, "The law and order situation in the southern part of Nepal still poses a problem as a few militant groups are still operating in these areas. We also have to find answers as how to live in harmony despite our diversity."

Police later recovered Shrestha's dead body from a jungle nearby Manohari River in the Kisanpur Village Development committee of the same district. The whereabouts of Shyam Gupta, another businessman, who was abducted along with Shrestha, is still unknown. A group of armed men had abducted the two businessmen from Aurahi at Bardibas-Jaleshwor road section of Mohattari while they returning home on their motorcycles.

Normal life in several Terai districts has been hit hard by a bandh (shutdown strike) called by indigenous Tharus and fringe political outfits based in Terai in protest against the demand for 'single Madhesh province', reported Nepal News. Eastern Terai districts like Jhapa, Morang and Sunsari saw partial effect of the bandh. Effect of the bandh was also seen in mid and far-western districts like Dang, Banke, Bardiya and Kailali. However, there were no reports of violence during the bandh.

Student unions affiliated to the CPN-Maoist, the Nepali Congress and CPN-UML and other fringe parties have concluded that the demand for "One Madhesh Province" raised by the Terai-based parties is illegitimate and that it will prove to be counter-productive for the Madhesi people themselves. A meeting of eight students' union held in the Kathmandu called on the government to address the demands raised by Terai-based parties through the new constitution, but advised against explicitly stating "Madhesh as autonomous region" in the interim constitution. They were of the firm opinion that this demand can't be accepted under any circumstances. "Since it has already been said that the issue of state restructuring would be tackled by the Constituent Assembly, the demand of the Terai-based parties for inclusion of the phrase 'Madhesh as autonomous region' and 'group entry' of Madhesis in the draft of the supplementary constitution amendment bill is not legitimate," said Pradip Poudel, president of Nepal Students' Union.

The explosion took place at the toilet of Land Revenue Office, damaging the roof of the toilet. Irfan Khan, Sunsari in-charge of the Jwala Singh faction of the JanatantrikTerai Mukti Morcha (JTMM-J) took responsibility for the blast over the phone. He said the blast was carried out to warn the office employees, who had refused to pay donation to the Morcha.

Saying that over 250000 families would be directly affected if such centres were closed without making arrangements for alternative employment, they called upon the Maoist leadership to take back their suicidal decision. "This is a suicidal decision of the Maoist party," said Gopalman Gurung, former mayor of Lekhnath Municipality while speaking at a function organised by Nepal-India Friendship Association in Pokhara on July 5. The Constituent Assembly (CA) meeting passed the Fifth Amendment to the interim constitution on July 13-night clearing the way for Government formation on majority basis – a major departure from the three-year-old practice of moving on the basis of consensus politics, reports Nepal News. The amendment also permits election of the President on the basis of majority. It sets provision for the opposition party and makes the opposition leader a member of the Constitutional Council. The meeting of the CA – which also holds the responsibility of legislative – passed the amendment with 442 votes in favour and seven votes against it. The meeting also rejected various amendment proposals put forth by 16 groups of CA members and a proposal presented by the cabinet (with the backing of Nepali Congress) to place a leader of opposition in the National Defence Council – which oversees army-related matters. The new amendment states that the President, Vice President, CA chairman, Deputy Chairman and Prime Minister would be chosen on the basis of political understanding. And if such understanding is not forthcoming, they can be elected by simple majority. The CA will formulate further procedures for the election of President. The amendment states that a Prime Minister will have to resign before the President. The election of President and CA chairman will start after its election procedure is finalised. The CA meeting was boycotted by the Madheshi parties.

Peace and Reconstruction Minister Ram Chandra Poudel has said the People Liberation Army (PLA) of the Communist Party of Nepal-Maoist (CPN-Maoist) cannot be integrated into any national security organs, Nepal News reports. Speaking at a programme in the capital on July 18, Poudel, who is also the vice president of the Nepali Congress (NC), opined that integration of the PLA combatants into security agencies would complicate the overall security situation. He said even the Maoists might not be safe in the future if the politically indoctrinated PLA men were merged with any of the national security units. "The PLA men should be adjusted in others areas," he added, but didn't elaborate what he meant by other areas. Stressing the need for political consensus in the present transitional period, the NC leader said the Maoists were going against the tradition of consensus. "Maoists have failed to implement the past agreements and it's hard to believe they will in future," he added, urging the Maoists to return the properties seized during the insurgency. They, according to Poudel, are trying to centralise power whereas the need in the current transitional period is of balance of power.

Constituent Assembly (CA) acting chairman K.B Gurung announced in the CA meeting that Yadav had been elected President by winning a simple majority. Yadav bagged 308 votes while his rival Ram Raja Prasad Singh, who was supported by the CPN-Maoist, ended up with 282 votes. The 15-member body adopted resolution 1825 that renewed the mandate of UNMIN until January 23, 2009, taking into account "the ongoing work on the monitoring and the management of arms and armed personnel in line with the June 25 agreement among the political parties." It also backed UN chief Ban Ki-moon's view that the current monitoring arrangements "should not be necessary for a substantial further period and expects to see them concluded within the period of this mandate." The resolution endorsed Ban's recommendation for a "gradual, drawdown and withdrawal of UNMIN staff, including arms monitors." The UN has said the parties need to consider the long-term future of the 19,000 former rebel fighters, as well as Nepal's army. The UN was invited to assist in Nepal's peace process when a deal was signed between Maoist insurgents and mainstream parties in 2006 to end a decade-long civil war.

In an interview with Nepal News, he said cultural and ethnic factors should also be considered after the geographical area is fixed for a federal unit. The CPN-Maoist chairman Prachanda has warned that his party would launch nationwide agitation if Girija Prasad Koirala becomes the Prime Minister (PM), again, according to Nepal News. Speaking at a programme organised by Muslim Mukti Morcha in the capital Kathmandu on July 26, Prachanda claimed ‘foreign forces’ were plotting to make Koirala PM again. “Domestic and foreign forces are conspiring to make Koirala prime minister. If that happens, that will be against the people’s mandate. We will bring people in the streets against such move,” said Prachanda, without elaborating who he meant by such forces. He added that his party can easily topple what he called ‘petty Kings’ in reference to Koirala. Prachanda also ruled out any possibility of Maoists returning to jungle. “Petty Kings are making every effort to block Maoists from climbing to power. Kantipuronline reports that cadres of the Young Communist League (YCL) on July 29 allegedly attacked and injured a petrol station proprietor with iron rods and khukuri (sharp edged knives) at Birtamode in the Jhapa district. Approximately 30 YCL cadres surrounded the Navin Traders and attacked Niraj Giri accusing him of bullying the YCL cadres. Giri's father Krishna Kumar, who tried to stop the indiscriminate assault, also sustained minor injuries. According to the petrol pump workers, the YCL cadres also looted NR 125,000 from the counter. However, the district YCL unit, issuing an immediate press statement, said that Giri had attacked them when they had gone there for interrogation over an attack by Giri on their district secretary Pushpa Bhandari and accused Giri of keeping gangsters and terrorizing locals with weapons.

Police on July 29 arrested two activists of the Jwala Singh faction of the Janatantrik Terai Mukti Morcha (JTMM-J) in connection with a murder case, The Himalayan Times reports. Area No. 2 in-charge of the JTMM-J, Balaram Kurmi alias Chaudhary Singh and Binod Gadariya alias Abjoon Khan of Naurigaudi in Betahani-3, were arrested from Kamdi village, according to Banke Superintendent of Ghanashyam Bhatta. Bhatta said Singh was involved in the murder of Land Reform Office Banke's Kharidar Purna Prasad Dhakal and Muktihar Darji of CPN-Maoist on April 13. Police also seized one revolver and four rounds of bullets from Singh. Likewise, the Police arrested Gadariya along with a homemade pistol and three rounds of bullets. In a crackdown on the armed outfit, police have arrested 13 activists of the JTMM-J, including its district secretary Halchal, in Banke district so far. Bhatta said three JTMM-J cadres - Bhagat Singh, Pappu Yadav and Ashok Barma - were on the wanted list. He claimed that criminal activity has decreased after the crackdown on JTMM-J began.

Yadav said, "We are not going to join the Government by putting the Madhesh agenda on hold. Instead, we can play an active role in writing the new constitution by remaining in the opposition." He also said that the Maoists should take the initiative to form a Government on consensus and if they failed to forge a consensus, other parties would have to come forward to form the Government. Saying that the Nepali Congress and CPN-UML are not in a position to claim Government's leadership, the MJF chief, however, emphasised that the Maoists, too, should also be adjusted in the current [three-party] coalition. He also ruled out the possibility of an exclusive MJF-Maoist alliance as the Maoist party had "betrayed the parties repeatedly".
