A total of 7,031 civilians and Security Force personnel have lost their lives due to violence in Jammu and Kashmir (J&K) in the last 10 years, reported Daily Excelsior, reported on January 3. "4,812 civilians and 2,219 Security Force personnel have lost their lives since 2001 to August 2010 in Jammu and Kashmir," the Union Home Ministry said in reply to a Right to Information (RTI) query. Many areas of J&K have witnessed several incidents of violence in terms of stone pelting, violent protests, encounters with armed terrorists and terror attacks in the recent past resulting in death of and injuries to civilians and security men. "Law and order is a State subject and measures are taken by the Jammu and Kashmir Government to maintain peace and public order," the Home Ministry said.

Director General of Police (DGP) Kuldeep Khoda said on January 3 that five out of 10 Districts of Jammu region were completely free of militancy while in other Districts the militancy has sharply declined even as he announced that five special battalions of Police will be ready during next two months to meet the law and order situation and take up the challenge posed by stone throwers in future, reports Daily Excelsior. ‘‘Jammu, Kathua, Samba, Reasi and Udhampur Districts are totally free of militancy in Jammu region. On infiltration, the police chief said 48 infiltration attempts were reported last as year as compared to 100 during 2009 recording a drop of 52 per cent. After the largest ever single year drop in militancy related incidents percentage wise in 2007 when 1092 incidents were reported as compared to 1667 in 2006, the number came down to 708 in 2008, 499 in 2009 and 488 in 2010. in 2009, 232 militants including several top commanders were killed. The civilian killings came down from 90 in 2008 to 71 in 2009 and 47 in 2010.Security forces also suffered lowest ever losses in 21 years. Twenty brave policemen laid down their lives last year while fighting militants.

The Task Forces constituted to assess special developmental needs of Jammu and Ladakh regions, are going to submit their interim reports to the Union Home Ministry by middle of February, reports Daily Excelsior. However, submission of final report will take time and recommendations will be implemented during 12th five-year plan. Sources said that as the three months time-frame given by the Union Home Ministry is expiring on January 31 (today), the heads of the Task Forces for Jammu and Ladakh regions respectively have decided to submit interim reports by middle of February keeping in view the time to be required for preparation of the final reports. While Task Force on Jammu headed by Planning Commission of India member, Abhijit Sen paid first visit to the region on November 16, 2010 after holding introductory meetings at Delhi, the second Task Force headed by another Planning Commission of India member, Narendra Yadav held detailed interaction with cross sections of society in Leh and Kargil Districts during its three day visit from November 13 to November 15, 2010.

Chidambaram would be visiting militancy-infested Kishtwar District on February 4 and review security, law and order and terror situation in five districts of Doda, Kishtwar, Ramban, Udhampur and Reasi with Police and civil administration, reports Daily Excelsior. The visit to Kishtwar District, which was once known as a hub of militancy with writ of Lashkar-e-Toiba (LeT), Harkat-ul-Jehad Islami (HUJI) and Hizb-ul-Mujahideen (HM) running large, was aimed at giving a signal that terrorism has mostly been wiped out from these five Districts, authoritative sources said. Sources said 50 militants, mostly top ‘commanders’ of LeT, HUJI and HM outfits were killed in Doda, Kishtwar and Ramban Districts in 2010 while 48 militants were killed in Doda District alone in 2009. In Reasi District, more than 30 militants, including some ‘commanders’, were eliminated in 2010. Doda District was left with not even a single foreign mercenary. Recently, Director General of Police Kuldeep Khoda had stated in a press conference that five Districts of Jammu region including Jammu, Samba, Kathua, Udhampur and Reasi were "free of militancy’’.

According to a cable dated July 18, 2008, published by The Daily Telegraph, “With the continued presence of militant training camps in Kashmir and over half a million U.K. passport-holders with ties in the region, HMG (Her Majesty's Government) is concerned that U.K. nationals will be recruited to conduct terrorist activities in the U.K.''

Number of the applications received under Rehabilitation Policy for the militants held up in Pakistan and Pakistan occupied Kashmir (PoK) has crossed 300 during past two weeks, reports Daily Excelsior. More than 100 applications have been received in the twin border Districts of Rajouri and Poonch alone. A sizeable number of applications have also been received in Baramulla District. Sources said most of the militants, whose parents have come forward for the return of their kin from Pakistan and PoK, had crossed over to other side of the border for the period ranging between a decade to two decades. Parents of the militants have claimed before police that their kin have given consent on telephone that they were ready to return to their homes getting an opportunity. Sources said all the applications received from parents of the kin were being subjected to scrutiny and would reach concerned authorities after proper verifications. Authorities were, however, trying to keep names of the militants, on whose behalf their families have filed applications for return from Pakistan and PoK, as secret to the best possible extent to ensure that their identity didn’t manage to reach Pakistan.

Eight Lashkar-e-Toiba (LeT) ‘commanders’, operating in Pakistan occupied Kashmir (PoK) for past about one and a half decade, have responded to Rehabilitation Policy of the Government and asked their families to file applications on their behalf for return to homes in Doda and Kishtwar Districts. Six applications have been filed in Kishtwar District and two in Doda district. As many as 265 militants of Doda, Kishtwar and Ramban Districts have been identified by Police and security agencies, who were in Pakistan and PoK for past several years. Recently, the number of applications under the Rehabilitation Policy had crossed 300. The applications are reviewed every week.

A maximum number of 53 youth were booked under PSA in Srinagar District followed by 24 in Baramulla and 23 in Budgam, 19 in Anantnag, 15 each in Shopian and Pulwama, 9 in Sopore, 6 in Kulgam, 8 in Awantipora, one in Ganderbal, 4 in Handwara, 5 in Bandipora and 13 in Kupwara. Police in 10 districts of the Valley have arrested a total of 4294 stone pelters. While 3680 of them were arrested till December 31, 2010, 614 others have been arrested during 50 days of 2011. The highest number of 1299 arrests of stone pelters have been made in Srinagar District followed by 404 in Baramulla, 395 in Anantnag, 348 in Budgam, 342 in Pulwama, 319 in Kupwara, 273 in Kulgam, 243 in Awantipora, 164 in Sopore, 151 in Shopian, 128 in Ganderbal, 69 in Handwara and 159 in Bandipora. According to Daily Excelsior, over 51,000 arms licenses have been issued across Jammu and Kashmir during the past two years and maximum of them were obtained by the people of Doda District. Divulging these details in the Legislative Assembly in response to a question, the Minister in-charge Home said that the District Magistrates and Home Department issued a total of 51,622 arms licenses during the past two years. Of these, District Magistrates issued 51616 licenses and Home Department only six. No arms license was issued in Shopian and Kulgam Districts. Doda District with 15876 licenses is followed by Ramban District where 9976 licenses were given to the people during the past two years. The Srinagar District with 6297 arms license is at third place while as Jammu District holds 4th place with 6073 licenses. Among the Districts where over 1000 arms licenses have been issued are Poonch (3153), Kishtwar (5154) and Udhampur (3170). The Minister, however, said that these licenses were issued under Section 13 of Arms Act, 1959 and Rule 4 of Arms Rule 1962 Schedule-II read and as per the instructions issued by Union Ministry of Home Affairs. He further stated that, four sale/ keep arms licenses have been issued since January 2008 till date while 21 such licenses are under process in the Home Department. The Minister said that a total of 48,197 weapons were manufactured during the past two years across the State generating revenue of INR 30, 64,661. The arms licenses are issued for the purpose of acquisition/ possession, acquisition/ possession/ carrying and use for protection/ sport/ target practice/ display, for protection of crops and cattle and carrying on journey in or through any part of India.

Kud Police (Udhampur District) had intercepted a vehicle on March 23, 2002 and recovered USD 70,000 from Shamima and USD 30,000 along with INR 19,000 from Mushtaq Ahmed Dar. During questioning, both the passengers disclosed that they had received this money from Altaf Qadri, Executive Member of All Party Hurriyat Conference (APHC) presently in Pakistan and was at Kathmandu (Nepal), at the instance of JKLF chief Mohd Yaseen Malik. Being a close associate of Malik, Mushtaq Ahmed Dar was allegedly directed by Malik to proceed to Nepal to collect USD 100,000 from Altaf Qadri. Accused Mushtaq Ahmed Dar along with Shamima went to Kathmandu in the month of March 2002 and allegedly collected USD 100,000 which was to be distributed among the militants’ ranks and organisation including Hizb-ul-Mujahideen (HM) and Lashkar-e-Toiba (LeT). After completion of the investigation, Crime Branch presented charge-sheet in POTA Court, which issued general arrest warrants against Altaf Hussain Qadri on the request of Police to initiate proceedings under Section 512 Code of Criminal Procedure (Cr. "I hope the day is not far when we will approve these 600 applications for the return and rehabilitation of youth gone across," Omar said, adding that those, who had gone across for arms training to PoK will return without guns but along with wives and children to live a life of honour and dignity. The applications have been filed with Police chiefs of various Districts of Jammu and Kashmir during the past 2 months. The State Government has formally announced the rehabilitation policy on November 23, 2010. The policy has been launched to facilitate the return of ex-militants who belong to Jammu and Kashmir and had crossed over to PoK for arms and explosive training but had later given up and are willing to return to the State. The policy states that those who have gone to PoK or Pakistan between January 1 1989 and December 31 2009 and their dependents will be eligible for consideration under the policy. The applications would be scrutinised by District Superintendents of Police (SPs) and then forwarded to Crime Investigation Department (CID), which will prepare a dossier and give it to the Home Department which will take a final call on whether the person can be permitted to return, the policy states. The militants would be allowed to enter only through Wagah Border in Punjab and Salamabad and Chakan-Da-Bagh Line of Control (LoC) points in Jammu and Kashmir.

According to Police records 158 youth were arrested across the Ganderbal District on charges of alleged stone throwing and protests in last summer. Almost 156 youth were bailed out in local Police Stations and rests of the youth were bailed out by the Court. Nobody was booked under PSA. The records also mention the injuries of Security Forces (SFs) while clashing with protestors who had taken to streets against the civilian killings. The records suggest that more 150 Central Reserve Police Force (CRPF) Personnel and around 50 Police personnel were injured in clashes between protests and men in uniform in four month long unrest. As the hunt for youth for alleged stone throwing and disrupting of peace is going on across the valley, Ganderbal Police is not looking for any youth.

According to India Express, Security Forces (SFs) during October 2008 operations in Jammu and Kashmir found that four Lashkar-e-Toiba (LeT) militants killed in a series of encounters were from Kerala. Subsequently, they learnt that the group had a fifth member, who managed to escape. The revelation set the Police and later the National Investigation Agency (NIA) on a trail that showed how the LeT was recruiting youths from Kerala, training them in Kerala and in Hyderabad of Andhra Pradesh, and then using them for operations in Jammu and Kashmir. Three years on, the NIA has retraced much of the trail with information from two suspected LeT militants from Jammu and Kashmir. Unnamed except as A and B, they have disclosed the identity of the LeT leader who allegedly supervised the recruitment. A and B are mentioned as witnesses in the NIA charge sheet submitted recently in a Special Court in Kochi in Kerala. They were examined under Section 164 of the Criminal Procedure Code (Cr. PC). According to the charge sheet, they have named Wali alias Rashid Abdullah, Baitullah Mujahideen of LeT training camp in Muzaffarabad of Pakistan occupied Kashmir (PoK), as having supervised the recruitments. Though the number of trained militants camping at forward launching pads across the LoC and International Border (IB) was about 1000, the MAC report said 489 militants were fully prepared to try to intrude into the border of Jammu and Kashmir in the approaching summer. These militants have been issued weapons, combat dresses, mobile telephones, explosive devices and medical kits etc to carry them while infiltrating into the State. As per the MAC figures, 195 militants had infiltrated into Jammu and Kashmir during last two years of 2009 and 2010. While exactly 100 militants sneaked into this side in 2009, the number went down to 95 in 2010. Intelligence and Police agencies of the State said the figure almost tallied with their inputs.

The annual report for 2010-11 of Ministry of Defence stated on March 16, "The continued infiltrations across the Line of Control (LoC) and the existence of terrorist camps across the India-Pakistan border demonstrate the continuing ambivalence of Pakistan in its attitude and approach to terrorist organisations", according to Daily Excelsior. Observing that the security situation in Jammu and Kashmir had "stabilised", the Ministry of Defence said the terror threat continued to be "real" as terrorist infrastructure in Pakistan is still intact. The annual report said the situation was stabilised by the persistent efforts of the Indian Army, which in 2010 killed 238 terrorists and apprehended 62 of them while 52 suffered casualties. "The continuous infiltration attempts in Jammu and Kashmir by terrorists from Pakistan and Pakistan occupied Kashmir (PoK) are a matter of concern," it added. The report said despite Army's strict vigil, infiltration attempts along the LoC were on where 40 terrorists were killed and 31 such bids were foiled. It added that the incidents of terrorist violence remained low in the State due to the "operational ascendancy" gained by the Army.

The force officials say that the removal of bunkers would help in better movement of people especially in the downtown areas of the Srinagar. The CRPF personnel could be seen removing the bunkers from places like Batamaloo, Karan Nagar, Zaina Kadal, Saraf Kadal, Babademb, Rainawari, Nowhatta, Islamia College, Hawal and Amar Singh College. The CRPF official said that the step has been welcomed by both the people as well as jawans (troopers). 40 bunkers have been removed from Srinagar since the process was started in October, 2010. While 16 bunkers were removed in the first phase, 12 bunkers each were removed in the subsequent two phases. The removal of bunkers was one of the eight points proposed by Union Government to bring the situation to normal in Kashmir after 2010’s summer agitation.

Daily Excelsior reports that, the District Magistrate (DM) of Jammu has ordered the cancellation of licenses of three Gun firms to the State Home Department and the Police authorities have seized 53 fake licenses from Rajouri and nearly 70 from Doda, Poonch and Kathua Districts of Jammu region. Besides the above seizure, 29 more licenses, which had been sent to the Home Department for seeking all India permission of carrying weapon, were also seized by the investigating team. While from Kathua thirteen (13) fake gun licenses were recovered, 30 more were seized in District Poonch, 53 in Rajouri and 27 in District Doda. During further intensive investigation, it was found that 29 such fake licenses were awaiting clearance in the Home department for the All India level status issued by Sub-Divisional Magistrate (SDM) of Mendhar in Poonch District. As reported earlier, on February 17, 2011 two persons namely Mohammad Naseer and Mohammad Rafiq of Kotranka in tehsil (revenue unit) Budhal of Rajouri District were intercepted by Janipur Police along with two .12 guns and the fake licenses. It was found during investigation that these had been issued by the SDM Mendhar and an FIR No. 18/ 2011 was registered in this connection.

The State Government in a written reply told the Legislative Council that a total of 13, 215 civilians have been killed in violence since 2009, reports Daily Excelsior. The Minister-in-charge Home disclosed that this included a total 698 political activists/ leaders. The highest number of 101 politicians were killed during 2002, followed by 76 in 2001, 62 during 2004, 61 in 1996 while 58 each during 1997 and 1998. During 2008, 09 and 10, four each political activists were killed by terrorists while during this year up to February 25, 2011, only one political worker was killed in such incident. It was further disclosed that 341 persons have been allegedly killed in custody in the State in last two decades. However, no such custodial death has taken place in Poonch and Rajouri Districts. Out of the total 113 persons missing in Poonch and Rajouri Districts during militancy, 99 belonged to Poonch, whereas, only 14 missing persons have been reported from District Rajouri since 1990 so far. It was also informed that 5363 Security Force personnel were killed in the State since 1990 up to now. In reply to another question regarding withdrawal/ repeal of Armed Forces Special Powers Act (AFSPA)-1990 and Public Safety Act (PSA) it was disclosed that the Government has constituted two committees; one each for Jammu and Kashmir regions, respectively, to look into the areas where from AFSPA could be withdrawn. It was informed that with the improvement in the security environment, the State Government is committed to the gradual withdrawal of AFSPA-1990. Notably, the AFSPA-1990 is not applicable in the Leh and Kargil Districts of Jammu and Kashmir, while, the PSA is in vogue in the entire State since 1978.

The Director General of Police (DGP), Kuldeep Khoda, stated on April 1, that while nearly 45 per cent reduction in the militancy related incidents has been recorded in the first quarter of 2011, over 300 to 350 terrorists are still active in the Jammu and Kashmir State, reports Daily Excelsior. He further said though a total 232 militants were eliminated by the Security Forces (SFs) during the year 2010, but nearly 300-350 terrorists were still active in the Jammu and Kashmir State. Out of these total ultras operating, nearly 45 per cent of them are foreigners. Referring to the infiltration attempts along the borders / Line of Control (LoC) and the infrastructure raised on that side for facilitating the terrorists, the State Police Chief said there seems to be no change in the attitude of Pakistan. Militant infrastructure (launching pads and training camps) was still intact on that side and attempts from that side are also continuing. But the forces were on the high alert and capable to thwart any attempt from across or within. He further added that, "we expect better over all law and order situation in the State in the coming summer months.” The DGP stated that in 2010, nearly 450-500 militants were operating in the State. There have been reports of nearly 100 odd more militants having infiltrated into this side during the year, whereas, the number of militants killed during 2010 were 232. The incidents of killings in Tral and Kupwara recently show that the militants are trying to show their presence. But during first quarter of this year a total 70 incidents of militancy were reported as against 127 occurred during the corresponding period of last year (2010). The DGP further disclosed that during first three months of this year three SFs personnel including two Army jawans (troopers), were killed during anti-militancy operations whereas, last year (from January 1 to March 31), 19 SFs personnel lost their lives. So, nearly 84 per cent decline on this count has been witnessed. A total 13 militants were eliminated during last three months while 37 were shot dead during first quarter of last year. The number of civilians killed by the terrorists during the first quarter of 2010 was 13. Mr Khoda disclosed that a total 30 militants were arrested by the SFs during first quarter of this year while during the corresponding period of 2010, total 16 militants were arrested in the State. The number of militants surrendered during first quarter of this year and the corresponding period of the previous year, however, remained the same which is seven the DGP added. On coming Panchayat elections, Kuldeep Khoda said where ever the demand arises as per the situation, additional police personnel from Armed and Indian Reserve Police (IRP) battalions will be placed there.

Daily Excelsior reports that a number of the militants seeking return from Pakistan and Pakistan occupied Kashmir (PoK) to Jammu and Kashmir after over two decades has crossed 800. Almost all militancy infested districts have received applications from families of the militants on behalf of their kin expressing their desire to return to the State under Rehabilitation Policy of the Government. CID has compiled data of nearly 2500 to 3000 militants, who were holed-up in Pakistan and PoK for last eight to 20 years where they had gone for arms training. However, after completion of training, the stranded militants were unable to cross into this side due to surveillance on the Line of Control (LoC) as well as the International Border (IB) or other measures taken by the SFs. Under the Rehabilitation Policy of the Government, the militants, once cleared for return from all quarters, could come back through identified routes like Poonch-Rawlakote, Uri-Muzafarrabad, Wagah border and Indira Gandhi International (IGI) Airport, New Delhi. While scrutinising applications, Police authorities have also come across the details of some unlisted militants. Former Sub Divisional Magistrate (SDM) of Mendhar in Poonch District, Choudhary Mukhtiar, who had gone underground as his involvement figured in issuance of fake gun license was arrested on April 12 by a Special Investigating Team (SIT) of the Police from the house of his brother-in-law at Dalpatian Mohalla in Jammu more than two months after he went racket, reports Daily Excelsior. The former SDM Mendhar is also wanted by Tulja Police Station in Pune, Maharashtra where three First Information Report (FIRs) have been registered by Police in connection with fake gun license racket, which also had its roots in states of Haryana, Rajasthan and Gujarat besides Maharashtra. He was immediately whisked away to Janipura Police Station where a FIR under Sections 467, 468, 420 RPC, 5(2) Prevention of Corruption Act and 161, 165 has been registered against him along with other accused involved in fake gun license racket. So far, Police have arrested eight persons involved in the gun racket. Nearly 2000 fake gun licenses have been detected or seized so far, while the number could go up as many youth from twin border Districts of Poonch and Rajouri were working outside the State especially in Gujarat, Maharashtra, Haryana and Rajasthan as security guards on the basis of guns procured by them with the help of fake gun licenses for which they had paid between INR 35,000 to INR 50,000. Police is also investigating the name of political leaders and police officers, who had helped Mukhtiar escape police custody during past more than two months.

Sources said the applications of 28 militants had already been cleared by a committee comprising representatives of the State Government, Union Ministry of Home Affairs and the Army. “Eighty more names will be cleared by the end of this month. Hopefully, all these 108 militants will return home next month,” an unnamed Home Ministry official said. Sources said the identity of the rehabilitated militants would be kept a secret. Over 3,000 Kashmiri youths went to PoK to receive arms training. Their return is being made possible under the Government’s Rehabilitation Policy announced in 2010. It covers all people and their dependents who crossed over to PoK between 1989 and 2009 to take up the gun.

According to sources, assessments of insurgency situation in Kashmir until May 31 showed there was an almost 50 percent drop in most parameters used to measure militancy. In the first four months, no terrorist managed to enter the Valley from Pakistan, while in May, a group of 17 entered. In 2011, there were 42 infiltration attempts in the first five months, while in 2010 it was about 100. The Security Forces killed 30 terrorists in the first five months, against almost 100 killed in 2010 in the same period. A similar drop in the number of violent incidents in the first five months was noticeable — in 2011 it was 84, against 200 in 2010 for the same period. The number of civilians killed remained around the same, with 21 people killed in militancy violence in the first five months.

Prominent among these terrorist groups are Lashkar-e-Toiba (LeT), Jaish-e-Mohammed (JeM) and Harkat ul-Mujahideen (HuM), which are having hundreds of armed supporters in Kashmir. LeT, designated as a Foreign Terrorist Organisation in 2001, is one of the largest and most proficient of the traditionally Kashmir-focused militant groups. "It has the ability to severely disrupt already delicate regional relation," said the State Department in its annual report on terrorism. The actual size of LeT is unknown, but it has several thousand members in Pakistan occupied Kashmir (PoK), Pakistan's Punjab and in southern Jammu, Kashmir, and Doda regions. "Most LeT members are Pakistanis or Afghans and/or veterans of the Afghan wars. The group uses assault rifles, light and heavy machine guns, mortars, explosives, and rocket-propelled grenades," the State Department said. LeT maintains a number of facilities, including training camps, schools, and medical clinics in Pakistan. It has global connections and a strong operational network throughout South Asia, the State Department said. Based in Muzaffarabad, Rawalpindi, and several other cities in Pakistan, HuM conducts insurgent and terrorist operations primarily in Kashmir and Afghanistan. It trains its militants in Afghanistan and Pakistan. Designated as a Foreign Terrorist Organisation in 1997, HuM has conducted a number of operations against Indian troops and civilian targets in Kashmir. HuM has several hundred armed supporters located in PoK, and southern parts of Kashmir, Doda regions, and in the Valley. "Supporters are mostly Pakistanis and Kashmiris, but also include Afghans and Arab veterans of the Afghan war," the report said, adding that it uses light and heavy machine guns, assault rifles, mortars, explosives, and rockets. "During 2011 up to July, 19 ceasefire violations have been reported along the LoC," a home ministry official said. In 2010, 44 cases of ceasefire violations along the LoC were reported while the number of such cases in 2009 was 28 and 77 in 2008. Apart from the ceasefire violation, there have been 52 attempts of infiltration by militants till June along the border in Jammu and Kashmir. Infiltration attempts from across the border in the state have shown a marginal increase during 2009 and 2010 in comparison to 2008. In 2010, 489 militants have attempted to infiltrate into Jammu and Kashmir while 485 militants tried to enter the state in 2009 and 342 militants in 2008. 112 militants were killed by security forces while trying to enter India in 2010 while the number was 101 in 2009. Interrogation of the arrested persons and investigations by the intelligence agencies have revealed that Firdous Ahmed Dar, arrested on August 20, was not the only conduit but nearly half a dozen persons had received hawala money and weapons through the cross-LoC route which had been supplied by Pakistani agencies. Sources said the cash received by the conduits had been distributed among the militant ‘commanders’ and the separatists according to directions received by them from across the LoC. The ‘commanders’ of Hizb-ul-Mujahideen (HM) and separatists affiliated to All Party Hurriyat Conference-Geelani (APHC-G) were major beneficiaries of the cash sent by Pakistan through the cross-LoC route. Firdous Ahmed Dar along had admitted having received INR 15 million through cross-LoC route of Uri-Muzaffarabad. Of this amount, he had distributed INR 300000 to Aiyaz Akbar, the spokesman of APHC-G and a trusted lieutenant of its chairman Syed Ali Shah Geelani, in three equal installments of INR 100000 each.

Security agencies have arrested 98 persons and seized INR 12.3 million since 2009 as part of efforts to check pumping of hawala money into Jammu and Kashmir for funding secessionism and militancy, the State Government on September 27 informed the Legislative Assembly, according to Hindustan Times. Of the arrested persons, 48 were found misusing trade across the Line of Control (LoC) and INR 73, 34,410 along with en-cashed cheque worth INR 100,000 one lakh recovered from them. The highest number of 66 arrests were made in 2009 and INR 7.7 million was recovered that year. Only 15 persons were arrested and nearly INR 1 million was seized from them in 2010. As many as 17 persons were arrested till July 2011 and INR 36, 17,000 were recovered from them, the Government said. The money was meant for Hurriyat Conference, Jammu and Kashmir Liberation Front, Islamic Students Front, Mass Movement, Peoples Conference, Mahaz-e-Azadi and Democratic Freedom Party, besides militant outfits – Hizb-ul-Mujahideen (HM), Lashkar-e-Toiba (LeT), Jaish-e-Mohammad (JeM), Al-Badr, Harkat-ul-Mujahideen (HuM, Al-Umer, Jamiat-ul-Mujahideen, Al-Burq and Islamic Front.

While avoiding the "pre-1952 status" phraseology, the report speaks about ensuring "meaningful autonomy" for the state, while preserving its distinct regional and ethnic diversities, it is learnt. The interlocutors are learnt to have also recommended the withdrawal of the Armed Forces Special Powers Act (AFSPA) and the Disturbed Areas Act (DAA) from the State. The report, sources said, has recommended developmental councils for all the three regions - Kashmir, Jammu and Ladakh - and devolution of powers to the sub-regions. It also recommends a massive economic package to tackle the huge unemployment in the state and major infrastructure development to provide connectivity and boost tourism, officials in the know said.

According to official sources, the highest number of 30 ceasefire violations has been reported from the LoC in Rajouri and Poonch Districts alone during 10 months of 2011, the number being only 18 during the corresponding period of 2010.The rise in ceasefire violations by the Pakistan Army has been attributed to increased number of militants, who have been camping across the LoC, awaiting an opportunity to sneak into this side. The number of infiltration attempts made from different parts of the LoC in the two Districts have also gone up to 42 but number of successful intrusion bids had considerably come down or reduced virtually to zero, sources said, adding this has been possible due to sustained pressure maintained by the troops all along the LoC, which exists only in Rajouri and Poonch Districts or some areas surrounding to Sunderbani, in Pallanwalla sector of Jammu region. "There were 35 separatist-sponsored strikes in 2009 and the number increased to 131 in 2010. However, only 21 protests took place till November 15 this year, indicating a six-time decrease," an unnamed senior Police officer said. According to State Home department data, a total of 2,096 separatist-sponsored processions and demonstrations took place in Kashmir Valley in the past two decades. 1,692 such protests were recorded so far from January 1990. The State witnessed highest 416 demonstrations in 1992, while 207 strikes took place in 1991, the report said. Noting that terrorism and insurgency threaten the very foundation of democracy in Jammu and Kashmir, Minister of State for Home Nasir Aslam Wani on November 28 emphasised on better intelligence network and proper vigilance to meet this challenge, according to IBN Live. "There should be better intelligence network in Jammu and Kashmir as there is a need to be extremely vigilant in meeting the challenge of terrorism and insurgency," he said, adding there was a need to revise the strategy for the counter-terrorism operations.

Nine security force personnel were killed and around 52 injured in various firing incidents reported in 2008-11 along the international border. Besides, two civilian porters were killed in cross LoC firing, he added. "All incidents of ceasefire violations are investigated and protests are lodged with Pakistan military authorities at appropriate level through the established mechanism of hotlines, flag meetings and meetings between the Directors General of Military Operations (DGMO) of the two countries," he told. According to data compiled by the State Home Ministry, as compared to 77 grenade blasts, explosions and rocket attacks in 2010, there were only 39 such incidents in 2011 up to November 15, he said. While incidents involving hurling of grenades have fell from 31 in 2010 to 21 in 2011, improvised explosive device (IED) explosions have shown a dip from 25 to 15 and rocket attacks fell down to three from 21. In 2009, there were 56 grenade incidents and 25 IED explosions besides 29 rocket attacks, shows the data, he said. There were 11,961 grenade attacks and explosions in the past 20-year period, 6,242 hurling of grenade incidents and 5,719 IED explosions reported since January 1990, the official said. Highest number of 821 grenade attacks were reported in the year 1994 and the highest number of 1,280 explosions took place in 1990, according to the data. Director General of Police (DGP) Kuldeep Khoda said that the Jammu and Kashmir Police will take all measures to ensure lasting peace in the State. "Police will take all measures to maintain lasting peace in the state. People's cooperation has encouraged our will to curb militancy and bring the state back on the rails of development," he said. "With the active cooperation of the people, the force has succeeded in eradicating the menace of militancy and restoring peace in the state," Khoda added.

Union Home Minister Home Minister P Chidambaram said the efforts of Jammu and Kashmir Chief Minister Omar Abdullah are to denotify the Disturbed Areas Act (DAA) from some places in the State, a move which will pave way for removal of Armed Forces Special Powers Act (AFSPA), according to IBN Live. Chidambaram also made it clear that the decision to denotify areas from DAA would be taken by the State Governor on the advice of the State Government. "At the moment, what the Jammu and Kashmir Chief Minister wishes to be done is to denotify areas which had been originally notified as Disturbed Areas. That is his effort now. That, as I said earlier, is in accordance to the Cabinet Committee on Security decision which requested him to review the matter in the Unified HQs," he said. As many as 158 people, including 99 terrorists, killed this year up to November 15, there were 323 people killed in Jammu and Kashmir last year during the same period, showing a dip in killings by over 55 per cent, as per the statistics. Giving further details, it said as against 40 civilian killed up to November 15 last year, as many as 28 civilian died this year during the same period. Similarly, against 66 SF personnel killed in 2010, only 31 died this year and 99 militants were killed this year against 217 last year. "There has been a decrease in the killing of the civilians and security personnel in the militancy-related incidents in Jammu and Kashmir this year as compared to last year," an unnamed senior Police officer said. There has been nearly 50 per cent fall in militancy-related incidents this year in the State with no such activities taking place in three Districts and 13 others registering just single digit terrorism cases. "There was a fall in militancy-related incidents from 336 in 2010 to 179 this year up to November 15. It shows nearly 50 per cent dip," the official added. Of the 179 cases, Jammu region witnessed 27 incidents and Kashmir region witnessed 152. As per official statistics, 13 Districts have witnessed less than 10 militancy cases this year, while no such incident occurred in Reasi, Samba and Kathua Districts in Jammu region. In Kashmir valley, Budgam witnessed three terrorism cases followed by four in Kulgam, five in Anantnag and eight each in Shopian, Ganderbal and Bandipora. In Jammu region, Kishtwar witnessed eight such cases, Ramban (5), Doda (6), Poonch (4), Rajouri (2) and one each in Jammu and Udhampur districts. Attacks directed against SFs too saw a dip from 69 cases in 2010 to 36 up to November this year. There is around 50 per cent decrease in the grenade attacks, explosions and rocket attacks this year up to November 15 as compared to the corresponding figure last year. There were 11,961 grenade attacks and explosions in the past 20-year period, 6,242 hurling of grenade incidents and 5,719 IED explosions reported since January 1990, it said. Highest number of 821 grenade attacks were reported in 1994 and the highest number of 1,280 explosions took place in 1990.

"Use of non-lethal equipments and body protectors by Police have resulted in zero death of civilian or security personnel and injuries to only 58 persons in law and order disturbances this year," an unnamed Police official said. The injured persons include 13 civilians and 45 Policemen, he said. Security personnel this year used grenades, modified plastic body tear smoke shell, dye-maker grenade (which dyes protesters), water cannons to deal with demonstrators and stone-pelters in down-town and Srinagar city, the official said. The State Police had approached the State Government and Ministry of Home Affairs, seeking non-lethal weapons and appropriate gear to avoid damage to life and property after the 2010 unrest, he said. In 2010, 112 civilians and Policemen died and 1,049 civilian and 4,000 SF personnel were injured in law and order disturbances in the Valley, he said, adding that of these 825 SFs suffered critical injuries due to stone pelting.

The use of non-lethal equipments and body protectors by Police in 2011 has resulted in zero death of civilians and security personnel. It has also resulted in less number of injuries during law and order disturbances in the State, Director General of Police (DGP) Kuldeep Khoda said. "The new equipments include Blast Dispersal Cartridges (BDC), Vehicle mounted tear-smoke devices and Stun-lac grenades," he said, adding, "The supply is underway in addition to the other equipments which are already being used by the police in the past." The items ordered also include body protectors, polycarbonate shields, polycarbonate lathis, helmets and visors, bullet proof bunkers, pump action guns, water canons, anti-riot rifles, rubber pellets and plastic pellets. In addition to this, the State Police has also set up exclusive five law and order battalions to deal with protestors in Jammu and Kashmir. The training imparted to the troopers and officers in using non-lethal equipments would help them in controlling the situations without causing any damage to the human lives.

Hindustan Times adds that the NIA has unearthed a hawala operation of front organisations of Pakistan-based terror outfits Lashkar-e-Toiba (LeT) and HM for providing money to families of terror operatives killed all over India. The NIA has detected in the last few years a well-oiled hawala operation to tune of around INR one Billion. According to sources in the NIA, a part of the money received by HM operatives goes to certain separatist leaders in Kashmir and another chunk is devoted to fuel militancy. The NIA has registered two FIRs based on the information gathered by it. “The funds received from Pakistan are transferred to Jammu & Kashmir, Delhi and other places in India through the hawala channel by a front organisation of HM which goes by the name of Jammu & Kashmir Affectees Relief Trust (JKART),” states one of the FIRs. The JKART, according to the FIR, has its head office in Rawalpindi and branch offices in Islamabad and Muzzafarabad in PoK. The sources in the NIA said that Delhi had emerged as a major hub for this operation. Once money reaches the national capital, it is disbursed through conduits based in Jama Masjid, Lajpat Nagar and Bhogal areas. The NIA suspects the use of normal banking channels to disburse the money once it reaches Delhi. “The HM is getting significant funding from Pakistan based Hizb-e-Islami which led by Masood Sarfaraz. In case of LeT, the money is coming from the Gulf too,” said an NIA source.

It said of the 132 cases it has documented, militant groups were responsible for 24 cases of enforced disappearances compared to 22 by the SFs, including Police. "According to documented findings, out of 132 disappearance cases, 21 have been perpetrated by forces of the Indian army, 24 by different militant groups and one by the personnel of Jammu and Kashmir police," spokesman of APDP Yasin ul Hassan Malik said. In 43 other cases, the perpetrators were unidentified gunmen and in the remaining 43 cases, the victims disappeared in unknown circumstances. The APDP on December 10 submitted a list of 132 cases of enforced disappearances in remote Banihal area to the state human rights commission (SHRC). In the 24 cases of disappearances, as reported by the families of the victims, Hizb-ul-Mujahideen (HM) militant Nazir Ahmed Wani alias Papplu was blamed for 10 cases. Over the years, the separatists and human rights activists in Kashmir have been blaming security forces for the enforced disappearances, which APDP puts at 8,000, since militancy erupted in the State in 1990.

A total of 1,766 people were killed and 15,685 others injured in these blasts, it mentioned. Of the total number of blasts, 5,722 were triggered using (Improvised Explosive Device) IEDs while the remaining 6,248 by hurling grenades, the data said. Further, it stated, the highest number of blasts took place in 1990 (1,522), followed by 1,005 explosions in 1993. While the maximum number of casualties were reported in 1995 (153 deaths, 1,021 injured), the year 2001 came a close second with 133 deaths and 1,443 injured, the report said. However, there has been a fall in grenade attacks during the past two years as only 39 and 65 blasts were reported in 2011 and 2010 respectively as compared to 79 and 170 blasts in the preceding two years.

While 19 militants surrendered in 2011 year till November, 20 militants surrendered in 2010, it said. 15 militants surrendered in 2009, while 38 in 2008, 122 in 2007, 190 in 2006, 64 in 2005, 137 in 2004, 119 in 2003, 159 in 2002, 85 in 2001 and 104 in 2000, the data said. The highest number of 655 terrorists had surrendered in 1996, followed by 612 in 1991, 601 in 1995, 444 in 1992, 270 in 1997, 187 in 1998, 109 in 1999, 98 in 1993 and 32 in 1994. The State Government has formulated a rehabilitation policy for the surrendered militants under which 2,876 of them have been provided INR 300000 as fixed deposit for three years and a monthly relief of INR 3,000. Reports indicate that 900 to 1,000 militants are ready to sneak in from Pakistan Occupied Kashmir (PoK), reports Daily Pioneer. This figure is double the number of militants who were poised to infiltrate in 2010. Sources said while 500 to 660 militants were poised to infiltrate in October 2010, the figure 2011 stood at 900 to 1000. In November 2010, the figure stood at 350-400 and in 2011 in the corresponding period it was 750-850. The 15 Corps chief, Lieutenant General Syed Ata Hasnain said, “There has not been any major effort (of infiltration) or contact (with militants) during the past two or two and a half months. But this doesn’t mean that no attempts would be made in future. There have been attempts in January and February also,” he said. He said the terrorists and their launch pads were intact across the Line of Control (LoC) and the infiltrators have shifted their focus from the traditional routes. “The infiltrators are focusing on Uri and Lipa sectors rather than the traditional Gurez, Macchil and Keran sectors,” he added.

Although the exact number of Peoples Liberation Army (PLA) men and engineers engaged in building infrastructure across the Line of Control (LoC) is not known, their number has increased in recent months, he added. "Our intelligence reports about the presence of PLA (men and engineers) have been authenticated now, and their number is on the rise," he stated. The Indian Army had the knowledge of the deepening Chinese presence in PoK, especially after the 2005 quake, when many construction works were given to Chinese companies. New York Times had published a report of the presence of 15,000 Chinese troops in PoK, including Gilgit and Baltistan.
