The Unified Communist Party of Nepal-Maoist (UCPN-M) after the central committee meeting of the party at Kathmandu decided not to join the CA unless the EC orders an independent investigation into the accusations of ‘systematic rigging’ in the CA election, reports The Himalayan Times on December 2 (today). “None of the victorious UCPN-M candidates has received winner certificates and the party will also not submit the list of candidates for the allocated proportional representation seats unless the EC investigates into the poll rigging,” said party Spokesperson Agni Sapkota. Another leader of the party, Khim Lal Devkota, said, “If the parties wished to continue with the peace process they must join hands with us by accepting our proposals or else they will have to join hands with pro-monarchy leaders like Kamal Thapa.”

UCPN-M making an “Executive Summary” of its report on election rigging public at its headquarters in Kathmandu on December 4 concluded that there was “procedural, structural and policy-level” cheating in the November 19 election, reports Nepal News. The party also hinted that there was involvement of State as well as the Election Commission (EC) in the rigging. The party also expressed serious reservation on the issue of transport of ballot boxes from the polling centers after the conclusion of the voting. Speaking on the occasion, UCPN-M chairman Pushpa Kamal Dahal said that his party would not participate in the CA until a high-level probe committee is formed to investigate massive election rigging and other fraudulent activities during the CA election.

The Central Committee (CC) meeting of Mohan Baidya-led Communist Party Nepal-Maoist (CPN-Maoist) kicked off in Kathmandu on December 8 with the party likely to broach up the issue CA disbandment, reports Kantipuronline.com. Sources informed that Chairman Mohan Baidya 's political document that includes party's future working guideline, the one with the idea of CA dissolution, has been distributed to the CC members. Party spokesperson Pampha Bhusal informed that the CC meet would review party's role after the general convention and the recently concluded CA election which the party had boycotted. Police on December 16 arrested Siyaram Kushwaha alias Firoj, the main accused in the murder of Kashi Tiwari in Chitwan District, reports The Himalayan Times. The founding chairman of Hindu Youth Association Tiwari was shot dead on June 26, 2010, in Birgunj District. Firoj is a Unified Communist Party of Nepal-Maoist (UCPN-M) candidate under Proportional Representation (PR) category for the Constituent Assembly (CA). Police investigation so far has concluded that the murder was planned to settle an old score as Tiwari had defied an indefinite strike called by the Maoist party about three years ago.

Communist Party of Nepal-Unified Marxists Leninist (CPN-UML) senior leader Madhav Kumar Nepal speaking with journalists in Kathmandu on December 17 said that one year from here on is sufficient to draft and enact a new constitution, reports Nepal News. He said his and other parties are making efforts to bring the disgruntled parties on board the constitution making process. "We will be highly flexible for consensus," he said. Commenting on the new extension of one week to submit the Proportionate Representation (PR) list to the Election Commission, Nepal said it will help create conducive environment for consensus among parties. "Our party is ready to submit the list of PR nominees at any time. To facilitate the process, UML central committee has delegated this task to the Standing Committee," he said.

The Federal Socialist Party (FSP) chaired by Ashok Rai has decided to join the newly elected Constituent Assembly (CA), reports Nepal News. The FSP took a decision to this effect in a meeting of standing committee held at the party's central office in Kathmandu on December 18. "We will finalize the names of our Proportionate Representation (PR) members in a couple of days after holding internal meetings," said the party's spokesperson, Ajambar Kangmang Rai. The FSP failed to win first-past-the-post (FPTP) seats in the recent CA election, but secured 5 seats under the Proportionate Representation (PR) category.

Irate cadres of Unified Communist Party of Nepal (UCPN-M) party have vandalised their own party office in Dhading District on December 13 following a row over the handing out of the Proportional Representation (PR) seats, reports Nepal News. The District level leaders and activists burnt important documents they seized from the office, vandalized office equipment, furniture and sign board and set them on fire while chanting slogans against the party leadership. Later, they padlocked the party office to show their dissatisfaction over party leadership’s unilateral decision while selecting the party’s list of final 54 PR candidates. The Maoist activists took such a drastic step to express their resentment and dissatisfaction after Maoist District leader Ram Bahadur Bhandari, who they claimed has devoted many years of his life in the service of the party, didn’t appear in the final list of candidates under the PR electoral system submitted to the Election Commission (EC) on December 30.

The Supreme Court (SC) on December 31 directed the Government to attend a hearing on January 8 on whether to issue a stay order against it to let President Ram Baran Yadav summon the first meeting of the Constituent Assembly (CA), reports The Himalayan Times. The Government has maintained that Chairman Khil Raj Regmi should summon the first meeting. It has said that a presidential inauguration is not possible without suitable amendments to the Interim Constitution. Political parties, on the other hand, want President Ram Baran Yadav to summon the first CA meeting. A single bench of Justice Tarka Raj Bhatta issued the order following a hearing.
