Nepal Communist Party (NCP) on November 1 issued a statement denying involvement of its cadres in the shooting incident in which an opposition Nepali Congress (NC) cadre died and seven others suffered injuries in Ramnagar Rural Municipality of Sarlahi District in Province No. 2 on October 30, reports The Himalayan Times. Moreover, in its statement NCP has asserted that the shooting incident which occurred during a clash between NCP and NC cadres was politicised by NC for publicity. “Enough premises exist to conclude that the incident was fueled by personal hatred towards the victim and was not political. However, NC has orchestrated a conspiracy adding political color to the incident,” the statement reads.

The high-level political talk’s team formed by the Government is preparing to officially invite the Netra Bikram Chand-led Communist Party of Nepal (CPN) for dialogue right after the Tihar festival, reports Kathmandu Post on November 4. A panel member said they would discuss the former Maoist splinter group’s demands if the outfit agrees to sit for talks. The CPN is holding a crucial meeting of its high-command. The party has announced a rally in Kathmandu on November 24 but has yet to decide the venue since the Khula Manch ground has been occupied. The Chand party is also considering merger with the Mohan Baidya-led CPN Revolutionary Maoists and the Gopal Kirati-led CPN (Maoist Centre). All the leaders have worked under Dahal in the erstwhile Maoist party.

He said, “The present government should not fail. The federal government has to develop laws as early as possible and hand over the responsibility of police administration and employees adjustment to the provincial governments. Delay in this regard must be prevented as this may ignite protests. Cordiality must exist among political parties in order to take the country on the path of development and prosperity.”

Amid delay in probing war-era crimes and cases of human rights violations, conflict victims are coming up with a demand paper to exert pressure on the Government and the political parties to expedite the transitional justice process, reports Kathmandu Post on November 13. Conflict Victims Common Platform (CVCP), the umbrella body of 13 organizations advocating justice for the war-era victims, is holding a national gathering on November 20 to finalize the demand paper. Around 250 conflict victims will gather in the Capital to finalize the document that will present their position on how the transitional justice process should move ahead. The platform has already held regional gatherings to take inputs from victims living across the country. The demand paper will have victims’ position on amendment to the existing Transitional Justice Act, works of Truth and Reconciliation Commission (TRC) and Commission of Investigation on Enforced Disappeared Persons (CIEDP), and the role of political parties.

Fed up with the Government’s continued reluctance to address its concerns including amendment to the constitution, leaders of the Rastriya Janata Party-Nepal (RJP-N) have warned the KP Oli administration of launching a struggle as part of preparations for the party’s first general convention, reports Kathmandu Post on November 14. The third largest party in the federal Parliament led a Madhes movement in 2015 in which dozens of people were killed in violent clashes with security forces. The party has been pressing for constitutional amendments to remove “discriminatory provisions against Madhes”. Both the RJP-Nepal and the ruling Sanghiya Samajbadi Forum-Nepal want the provincial boundaries redrawn as one of their major demands.

The Commission of Investigation on Enforced Disappeared Persons (CIEDP) is mobilizing four teams in Bardiya — the District with the highest number of cases of conflict-era disappearances — for the first phase of detailed investigations, in which statements from victims are recorded by November 19, reports The Himalayan Times on November 15. The transitional justice mechanism will mobilise the teams in Bansgadi, Bhurigaon, Gulariya and. A total of 274 complaints of disappearance were filed with the CIEDP from the District. CIEDP has recommended 255 for detailed investigation.

Mohammed, who was on two-day visit in Kathmandu, that the Government will make some progress on resolving decade-old transitional justice issues by next month, reports Republica on November 17. “They had a message to us that they want to do this in their own time and own space. The UN will continue to remain hopeful about the unfinished task. Let's hope in the coming months they will do something,” Mohammed told journalists amid a press briefing at Tribhuvan International Airport before her departure. During her visit to Nepal, Mohammed held meetings with President Bidya Bhandari, Prime Minister K P Oli, Foreign Minister Pradeep Gyawali and Nepal Army Chief Purna Chandra Thapa.

NCP leaders are awaiting the next meeting of the party’s secretariat to vent their ire on the PM. The secretariat meeting is expected to be held on November 22. Conflict victims after a two-day ‘National Conference of Conflict Victims on Transitional Justice’ that concluded in Kathmandu on November 21 adopted the ‘Conflict Victims’ Charter’ and demanded that a high-level mechanism be set up to create conducive environment for the transitional justice process by bringing all stakeholders, including political parties, security agencies and the victims, on the same page, reports The Himalayan Times. The charter adopted by the victims organized under the Conflict Victims Common Platform (CVCP) states the two commissions have lost their relevance, purpose or utility, given their non-performance over the past four years. It warns the victims will seek ‘alternative recourse to justice’ if the commissions’ tenure was extended under the existing circumstances. The victims also demanded that the existing transitional justice mechanisms —Truth and Reconciliation Commission (TRC) and Commission of Investigation on Enforced Disappeared Persons (CIEDP) — be restructured on the basis of laws rewritten or amended with the consent of victims. “Conflict victims will not support decisions and processes designed according to the interests and convenience of the state, the then insurgents and the major political parties. The commissions to be established thereafter must be impartial, independent, empowered and autonomous with the goal of ending impunity and ensuring lasting peace through a transitional justice process that is transparent, gender-sensitive, inclusive and participatory,” states the charter.

Conflict Victims Common Platform (CVCP)which comprises 13 organizations advocating for justice for the victims of the decade-long Maoist insurgency, on November 21 noting that the Truth and Reconciliation Commission (TRC) and the Commission on Investigation of Enforced Disappeared Persons (CIEDP) have done very little in the last four years, has called for establishing a credible mechanism with the participation of all stakeholders to take the transitional justice process to its logical end, reports Kathmandu Post. Theplatform suggested in its charter that was issued on the 12th anniversary of the signing of the Comprehensive Peace Accord (CPA). The platform also advised the Government against extending the terms of the two commissions under current circumstance. National Human Rights Commission (NHRC) on November 21 warned that the culture of impunity had been institutionalized in the country as its recommendations to the Government of Nepal to take legal action against those involved in incidents of human rights violation during the conflict were not duly implemented, reports The Himalayan Times. A brief report on ‘Twelve Years of Comprehensive Peace Accord: Human Rights Situation’ released by the rights watchdog paints a dismal picture of the implementation status of NHRC’s recommendations to the government for justice to conflict victims. According to the report, NHRC made 810 recommendations to the Government for necessary action from 2000 through to mid-July 2017. Of the recommendations, 12.5 per cent were fully implemented and 48.3 per cent partially. Similarly, 39.2 per cent of the recommendations are still under consideration of the Government. The fully implemented recommendations are just related to providing compensation to conflict victims. The recommendations for legal action against the perpetrators of human rights violation have yet to be implemented.

Ministry of Defense has denied Nepali Army officials’ permission to participate in a six-day meet on transitional justice scheduled to be held in Bangkok, beginning November 25, reports The Himalayan Times on November 22. The Army had written a letter to the Ministry of Defence seeking the latter’s approval for its two senior officials to participate in the programme being organized by the Swiss Government. “However, the ministry has decided that army representatives will not attend the event,” said the Ministry’s Spokesperson Babu Ram Gautam. Nepali Army Spokesperson Brig Gen Gokul Bhandaree said the Army had yet to receive the ministry’s decision. “The chances of the army’s participation in the event are slim,” he said. Other invitees to the programme include political leaders, conflict victims, civil society members and human rights activists.

The transitional justice officials worry the political mechanism could invite legal complications if the existing bodies are terminated. They also warn that questions could be raised against the political mechanism at national and international forums if it does not meet national and international standards. “We don't demand our continuity but discontinuation of the existing commissions will further delay justice delivery. It may raise legal questions as well,” Commission of Investigation on Enforced Disappeared Persons (CIEDP) Chairman Lokendra Mallik told Republica. Issuing a press release, CVCP said the conflict victims had not yet had the chance to share their tales of sufferings.
