Having been out of power for seven years, Federal Socialist Forum-Nepal (FSF-N) - the fourth largest party in the federal Parliament - joined the Government on June 1 by taking two Ministries, reports Kathmandu Post. In the fourth extension of the cabinet, Prime Minister KP Sharma Oli inducted FSF-N Chairman Upendra Yadav as Deputy Prime Minister and Minister for Health; and Mohammad Istiyak Rai as Minister for Urban Development. The Nepal Communist Party (NCP), which was formed after the unification of the erstwhile Communist Party of Nepal-Unified Marxist-Leninist (CPN-UML) and the Communist Party of Nepal-Maoist Centre (CPN-Maoist Center), has a total of 174 members in the 275-member House of Representatives. Altogether 16 legislators have been added to the ruling combination after the inclusion of FSF-N in the cabinet. Inclusion of the Upendra Yadav-led FSF-N in the already strong Cabinet headed by KP Sharma Oli has bolstered the Government, which now commands more than a two-thirds majority with 190 lawmakers in the 275-member House of Representatives. Meanwhile, the provincial assembly in Province 2 has a total of 107 members. While NCP has 32 members in the assembly, FSF-N has 30. Similarly, RJP-N and NC have 25 and 19 members respectively. Independent candidate Rizwan Ansari was also elected during the recent election.

Upendra Yadav, Chairman of Federal Socialist Forum-Nepal (FSF-N) on April 1 said the lackluster attitude and unwillingness to amend necessary section of the constitution could sprout conflict and protest, reports Republica. He argued that the current Government was aware that an amendment was required. However, what was concerning is that “they are not willing to do so by signing an agreement,” Yadav said, adding that “such lackluster attitude and unwillingness to amend necessary section of the constitution could sprout conflict and protest.” In turn, he urged the Government to act responsibly and redress concerns and reservations of the Madeshi based parties. “Unless our demands are met, we will not join the government and are in no hurry whatsoever.”

Election Commission (EC) officials said that the newly formed Nepal Communist Party (NCP) violated Party Registration Act with low representation of women, reports Republica on June 3. NCP will have to at least double the number of women in its central committee to be eligible to register the party at the EC, according to officials. According to article 15 (4) of the Party Registration Act 2074, a political party is required to ensure 33 percent representation of women in all committees. But the NCP has only 72 women, which accounts for 16 percent of the 441-member strong central committee. Similarly, only 2 women, or around 4 percent women, have made it to the 45-member strong standing committee, while the party's central secretariat is without a woman.

Chaudhary said constitution amendment was not the issue of only Madhesis, but also of the people from hilly areas. “Most people from Madhes and Hilly areas are dissatisfied with the new statute. But KP Oli and Pushpa Kamal Dahal have been paying no attention to constitution amendment. The government and political parties have to move towards prosperity with a political way-out,” she said.

The Co-chairperson of the Nepal Communist Party (NCP), Pushpa Kamal Dahal addressing a press meet organized by the Federation of Nepali Journalists (FNJ) at Pokhara city in Kaski District of Province 4 on June 4 said that Constitution amendment now possible with two-third majority, reports The Himalayan Times. Dahal said, “We will make an amendment to the constitution in line with past agreements as this process has been backed by a two-third majority which the government has now attained. Rastriya Janata Party-Nepal (RJP-N) on June 5 decided to continue its support to the Federal Socialist Forum-Nepal (FSF-N) in Province 2, reports Kathmandu Post. Brushing off rumours that the coalition partners were parting way after the FSF-N joined the KP Sharma-led federal Government, a meeting of the six-member presidium of the RJP-N decided to keep the provincial coalition intact. “We have decided to continue with our strong support to the government under the FSF-N in Province 2 despite the latest development in the central government,” said Anil Jha, a leader of party’s presidium. Another influential leader in the presidium, Rajendra Mahato, also said “We have agreed on the fact that the developments in the central government will not have any affect whatsoever on the existing coalition in Province 2 government.”

Chief Election Commissioner Ayodhi Prasad Yadav handed over the certificate to NCP General Secretary Bishnu Poudel. Thakur said the aim of every political party was to join the Government and the party was established with the same objective. The request was made in a meeting between Joint Secretary at the Ministry of Foreign Affairs (MoFA) Bharat Raj Poudyal, head of the Ministry’s UN Division, and Cathering Sung, head of the UNDPA-Kathmandu. In his meeting with Sung, Poudyal also made references to “smooth transition” of two previous UN Missions in Nepal- United Nations Mission in Nepal (UNMIN) and Office of the High Commissioner for Human Rights (OHCHR)-and hoped that the UNDPA will follow suit. For its part, the UNDPA-Kathmandu has communicated to the Government of Nepal that it is committed to a timely withdrawal and is currently waiting for instructions from its headquarters in New York to plan exit. The Government’s decision follows its stated position that Nepal’s political transition that started in 2006 has come to an end with the successful conclusion of elections to three tiers of Government-local, provincial and federal-as envisaged in the new federal constitution.

A single bench of Justice Anil Kumar Sinha issued the notice to the poll panel in response to a case filed by 14 people, including Senior Advocate Surendra Bhandari and Advocate Indu Tuladhar, against the EC. They had filed the case at the apex court on June 14 arguing that the EC’s June 6 decision to register the NCP without the party fulfilling the registration conditions was wrong. The Government has finally prepared a draft for amending the Act governing the two transitional justice bodies Truth and Reconciliation Commission (TRC) and Commission of Investigation on Enforced Disappeared Persons (CIEDP), adhering to the Supreme Court (SC) verdict and international standards on transitional justice, reports Kathmandu Post on June 22. The proposal is likely to be tabled in Parliament for endorsement in two weeks. The draft was prepared three years after the apex court in 2015 struck down a dozen provisions of the CIEDP and TRC Act, 2014 saying that they were inconsistent with transitional justice norms and practices. The 22-page draft has proposed changes in a majority of 42 clauses of the Act. The amendments are based on the Comprehensive Peace Agreement, the SC verdict, basic principles of transitional justice, consultation with stakeholders including the international community and the local reality. As per the apex court’s ruling, the draft defines conflict-era cases as “severe” and “others”, denying amnesty in cases under the first category. It says there will be no amnesty for extra-judicial killings, enforced disappearance, rape and torture while those involved in other criminal offences could get conditional reconciliation after fulfilling the given conditions. There would also be no statute of limitation for registering a case against the perpetrators.

In a 21-point Hetauda Declaration issued at the end of a jamboree, they also concluded that the Government was acting against people’s aspirations. Some of the recent moves of the Government against “the media, statements against the judiciary, and terror in bureaucracy” were interpreted as the government’s attempts at totalitarianism. According to the document, the party stands firm to defend democratic norms to ensure press freedom, judicial independence, trade union rights and professional rights. We have already issued theoretical approval to draft the laws to ministries, and the law ministry is continuously following up the issue with other ministries.”Meanwhile, Conflict victims and Human Rights defenders at an event organized by the Conflict Victims Common Platform (CVCP) in collaboration with the International Center for Transitional Justice (ICTJ) and Justice and Rights Institute Nepal in the Capital Kathmandu on June 26 raised serious objections to the proposed amendments to existing Transitional Justice law, mainly over concessions in penalties to convicted perpetrators of war era crimes, reports Kathmandu Post. CVCP Chairperson Bhagi Ram Chaudhary said the punishment recommended is unacceptable since it is just ‘symbolic’. He said “Though the draft lacks word amnesty, the proposed provisions ultimately are guided towards providing the amnesty. We want full revision in the draft after meaningful consultations with the victims.” Similarly, ICTJ Reparative Justice Programme Director Ruben Carranza said the draft has many conflicting and ambiguous provisions that need corrections. He pointed out that there are several flaws in the draft bill though it has some good provisions as well.

Although there are concerns that the Nepali Army lacks the experience to undertake such big projects and that quality may be compromised, Minister Pokharel said the expressway would be constructed strictly adhering to the government’s prescription on quality. The proposed 76-km expressway is one of the national pride projects. “The Nepali Army will complete the project on time and all quality standards set by the government will be met,” said Pokharel, addressing the House of Representatives.

The Government on June 28 tabled a bill to replace the ordinance introduced two months ago to extend the terms of two transitional justice bodies - Truth and Reconciliation Commission (TRC) and the Commission of Investigation on Enforced Disappeared Persons (CIEDP), reports Republica. Minister for Law, Justice and Parliamentary Affairs Sher Bahadur Tamang tabled the bill at the National Assembly after the Cabinet earlier in the day decided to replace the ordinance, which expires on July 7. An ordinance issued in the absence of Parliament, must be replaced by a bill within 60 days of the commencement of the Parliament session. The new bill to amend the transitional justice-related acts was formulated in the presence of the law minister, attorney general, former attorney generals and leaders of major parties, has stressed the need for reconciliation rather than prosecuting the perpetrators. It has proposed withdrawing cases now being investigated by the courts and bringing them under the transitional justice mechanisms.

Conflict victims at an interaction held on June 29 at the National Human Rights Commission (NHRC) have rejected the draft amendment to transitional justice act that addressed none of their demands, reportsThe Himalayan Times. The Cabinet on June 28 decided to table the first amendment bill on the Truth and Reconciliation Commission (TRC) and the Commission of Investigation on Enforced Disappeared Persons (CIEDP). As per the bill, perpetrators will not get amnesty in serious human rights violations but could get waiver in sentences as per the prevailing laws — up to 60 per cent if they did not reveal the truth and did not assist the court, but if they assisted the court, revealed the truth, apologized to the victims and pledged not to commit such crimes again, they could get up to 75 per cent punishment waiver. The bill, which proposes to have retroactive effect, also proposes a maximum jail term of three years in other crimes, and provisions withdrawal of cases lodged by police officials against Maoist cadres. Perpetrators of other crimes could also be sent to open prison if they helped the cause of transitional justice and assisted the investigation. Expressing reservations over the provision of punishment waiver and open prison, Conflict Victims Common Platform Chairman Bhagi Ram Chaudhary said “After waiving 75 per cent of the sentence and other departmental actions faced by the perpetrators, there will virtually be no punishment left. Cases related to serious human rights violations should be addressed through the criminal justice system.” On the occasion, NHRC Chairman Anup Raj Sharma said a ‘syndicate’ of political parties was trying to sabotage the whole transitional justice process with an amendment draft that had been ‘translated’ and ‘guided by a motive’. “The draft is focused at providing immunity to perpetrators, and the whole design is to tire the victims. So we should not stop exerting pressure,” he said.
