Colombo District Court on January 7 rejected a request made by former President Maithripala Sirisena that he be released from several civil lawsuits filed by the victims of Easter Sunday attacks, reports Daily Mirror. The relatives of those who have died during the suicide bomb blasts took place in Colombo and individuals who injured had filed 128 lawsuits before Colombo District Court claiming compensations from former President Maithreepala Sirisena and several others. President's Counsel Faizer Mustapha appearing for the former President made a request to release his client from these cases. He further contended that there is no legal basis to proceed with these lawsuits. President's Counsel Shamil Perera appearing for the aggrieved party raised objections for the request and said the application to release the defendant from the cases is contrary to the provisions of Civil Procedure Code. The victims alleged that the defendants including former President Sirisena have failed to perform their official duties entrusted to prevent the terrorist attacks that took place on April 21, 2019 which caused irreparable damages to them.

The Colombo High Court Trial-at-Bar on January 19 concluded recording evidence in a case filed against former Defence Secretary Hemasiri Fernando relating to the Easter Sunday bomb attack, reports Daily Mirror. Deputy Solicitor General Sudarshana de Silva appearing for the Attorney General informed court that the prosecution has concluded hearing evidence in the case. Accordingly, the High Court Trial-at-Bar bench announced that order regarding calling for defence evidence will be delivered on February 18. The Attorney General filed indictments consisting of 855 charges against former Defence Secretary Hemasiri Fernando and former IGP Pujith Jayasundara. The two former top officials have been accused of failing to take measures to prevent the Easter Sunday attacks despite having prior knowledge of the attack.

Former Liberation Tigers of Tamil Eelam (LTTE) spokesman Daya Master alias Velayudam Dayanidhi has been sentenced to two years in prison suspended for a period of five years on January 24 by the Vavuniya High Court Judge Manikkavasagar Ilanchelian on charges of aiding and abetting the uprising of the LTTE, reports Daily News. Attorney M. A. Sumanthiran appearing for Daya Master in High Court accepts the fact that he is guilty and that he served the LTTE for a monthly salary. The case was filed against Daya Master on October 19, 2018 by the Attorney General on the grounds that he had committed an offense punishable under the Prevention of Terrorism Act No. 7 of 2006, according to information provided by the Counter-Terrorism Unit.

A former Liberation Tigers of Tamil Eelam (LTTE) ‘intelligence chief’, Thangavelu Nimalan was sentenced to life imprisonment on March 4 for allegedly possessing 2 kilograms of Research Department Explosive (RDX), reports Tamil Guardian. Colombo High Court delivered the sentence after a case was filed against Nimalan in 2011. A number of other cases have also been filed against Nimalan, including an alleged claymore attack on a Sri Lanka Special Task Force (STF) truck on May 28, 2007 in Ratmalana. The Supreme Court (SC) on March 14 began the hearing of Fundamental Rights (FR) petitions filed against the state for its failure to prevent the Easter Sunday bomb attacks on April 21, 2019, despite having prior knowledge, reports Colombo Page. FR petitions filed against former President Maithripala Sirisena, former Prime Minister Ranil Wickremesinghe, former Defense Secretary Hemasiri Fernando, former IGP Pujith Jayasundara and others were taken for hearing before a seven-judge bench of the apex court. The bench headed by Chief Justice Jayantha Jayasuriya comprised justices Buwaneka Aluvihare, LTE Dehideniya, Murdu Fernando, S. Thurairajah, A.H.M.D. Navaz and Shiran Guneratne. The FR petitions had been filed by 12 parties including the Bar Association of Sri Lanka (BASL), Catholic priests, a father who lost his two children in the attack, businessman Jagath S. The cases were taken up before Colombo Additional District Judge Chathurika de Silva. Accordingly, the Additional District Judge for the last time set a date to the respondents to file the relevant submissions on May 2. The Colombo High Court on March 21 released retired doctor Shirley Herath, who was remanded on suspicion of placing a hand grenade in the All-Saints Church in Borella, on bail, reports Colombo Page. Colombo High Court Judge Manjula Tillekeratne ordered the release after considering a bail application filed on behalf of the retired doctor. Announcing the order, the High Court Judge stated that although the suspect was initially produced before the Magistrate’s Court under the Prevention of Terrorism Act (PTA), the plaintiff has decided not to pursue the charges so far. He further stated that the petitioner’s party has stated that there is a possibility of the High Court considering the bail application as it is pursuing charges against the suspect under the Offensive Weapons Act. Accordingly, the suspect was released on a cash bail of SLR 100,000 and two personal sureties of SLR 2.5 million each and the High Court Judge also ordered that the sureties should be residents of the Colombo District.

Colombo Fort Magistrate Thilina Gamage, on May 18, has remanded four suspects, including Sri Lanka Podujana Peramuna (SLPP) Member of Parliamentarians (MPs) Sanath Nishantha and Milan Jayatilake, who were arrested in connection with the recent attacks on Maina Go Gama near Temple Trees and Gota Go Gama at Galle Face in Colombo, until the 25th of this month, reports Colombo Page. The Magistrate further stated that the bail applications of Sanath and Milan will be rejected under the Bail Act as the investigation into the suspects has not been completed and if they are released on bail there could be a public disturbance. In addition, the Magistrate ordered that former Western Provincial Councilor Amal Silva and an employee of the Dehiwala Mount Lavinia Municipal Council who were arrested in connection with this incident be remanded until the 25th and produced before an identification parade on that day. Deputy Solicitor General Riyaz Bari, appearing for the Criminal Investigations Department (CID), said that investigations conducted by the CID had revealed that the two MPs Sanath and Milan, who are currently under arrest, had been actively involved in the recent attacks on Gota Go Gama and Maina Go Gama.

The Colombo High Court, on May 25, ordered the release on bail of millionaire businessman Mohamed Ibrahim, the father of suicide bombers Mohamed Ilham and Mohamed Inshaf in the Easter Sunday attack, and another suspect, identified as Mohamed Hijaz, on a Rs.200,000 cash bail and three surety bails of Rs.1 million each, reports Colombo Page. The judge granted bail on the grounds that the accused had been remanded for nearly three years and considering their health condition. The Attorney General had filed the case under the Prevention of Terrorism Act against three suspects, including Mohamed Ibrahim, for allegedly concealing information from the Police despite having knowledge of a terrorist attack on Easter Sunday. Court ordered the defendants to be banned from traveling abroad and to report to the Criminal Investigations Department (CID) on the first and last Sunday of each month. Reportedly, Mohamed Ilham and Mohamed Inshaf, carried out the suicide bombings at the Cinnamon Grand and Shangri-La Hotels respectively on Easter Sunday, April 21, 2019, in which at least 279 persons including 42 foreign nationals were killed.

A three-judge bench of the Colombo High Court trial-at-bar, on June 20, ordered that a pre-trial hearing be held on August 4 against 25 suspects, including Naufer Moulavi, on charges including conspiracy to commit, aiding and abetting the suicide bombing on Easter Sunday, reports Colombo Page. The case was taken up before a three-judge bench comprising Damith Thotawatte, Amal Ranaraja and Navaratne Marasinghe, and the suspects including Naufer who were remanded at that time were also produced before the court. The bench directed that a preliminary hearing be held on August 4. The three-judge bench also directed the lawyers of the accused to file their bail applications two weeks before the next hearing. The case has been filed by the Attorney General against 25 accused including Naufer Moulavi, Sajeed Moulavi, Mohammad Milhan, Sadiq Abdullah, Adam Lebbe, Alias Gouper Uncle, Mohammad Sanas Deen, and Mohammad Rizwan on 23,270 charges including conspiracy to carry out terrorist attack aiding and abetting the attack on Easter Sunday.

The Colombo High Court on September 15, indicted six defendants on charges including manufacturing, and aiding and abetting the manufacture of 21 explosive devices together with Mohamed Insaf, who carried out the Easter Sunday suicide bombing, without a legal license, reports Colombo Page. The indictment papers filed by the Attorney General were handed over to the defendants before Colombo High Court Judge Navaratne Marasinghe on September 15. After that, the judge ordered that the fingerprints of the defendants be taken and a report be called. He also ordered that the original report of the case be called before the court. Colombo Fort Magistrate Thilina Gamage issued a notice on September 16, to former President Maithripala Sirisena, ordering him to appear in court on October 14, to present facts regarding his failure to prevent the terrorist attack on Easter Sunday despite having prior knowledge of the Easter Sunday attack while being the Defense Minister, reports Colombo Page. The former President has been named as a suspect in a private complaint filed by Father Cyril Gamini and Yesuraj Ganesan, who lost a leg in the terrorist attack on Easter Sunday in April 2019. The magistrate issued the order after considering a complaint submitted before the court by the President’s Counsel Rienzi Arsekularatne on behalf of the complainants. The President's Counsel stated that despite receiving information that a terrorist attack would be launched on Easter Sunday, Sirisena, as the defense minister, committed an offense under Section 298 of the Penal Code by acting negligently to prevent it.

The Supreme Court ruled, on September 26, to remove the current President Ranil Wickramasinghe, who is named as a respondent in the fundamental rights petitions filed against the State for its failure to prevent the Easter Sunday bomb attacks on April 21, 2019 despite having prior knowledge, from the case, reports Colombo Page. The apex court’s decision said according to Article 35(1) of the Constitution, a case cannot be maintained against a sitting President and Ranil Wickramasinghe is entitled to immunity as the current President. It has been further stated in the judgment that a case cannot be maintained against a president who is holding the office of president and that the interim clause of the Constitution has been prepared for the head of State to carry out his official duties without any hindrance. This judgment was announced, on September 26, when the petitions filed against the State were taken for consideration before a seven-judge bench of the Supreme Court presided by Chief Justice Jayantha Jayasuriya, and comprising Justices Buwaneka Aluwihare, Priyantha Jayawardena, L. T. B. Dehideniya, Murdu Fernando, S. Thurairajah and Gamini Amarasekera.

The Negombo District Court on December 16 ordered to lay by the cases filed against President Ranil Wickremesinghe by the next of kin of those who have died and those who were injured during the suicide bomb blast that took place at St. Sebastian’s Catholic Church in Katuwapitiya, Negombo in April 2019, reports Daily Mirror. The Court observed that the second defendant Ranil Wickremesinghe as the President of the country is entitled to immunity in terms of Article 35(1) of the constitution. The next of kin of those who have died and those who were injured during the suicide bomb blast had filed several lawsuits before Negombo District Court claiming compensation from former President Maithripala Sirisena, then Prime Minister Ranil Wickremesinghe, former Defence Ministry Secretary Hemasiri Fernando, former IGP Pujith Jayasundara and former Chief of State Intelligence Service Nilantha Jayawardena. However, the Court rejected the objections raised by former President Maithripala Sirisena and decided to proceed with the cases against him and other defendants.

The Liberation Tigers of Tamil Eelam (LTTE) cadres who turned themselves in to the Government's Forces at the end of the war in May 2009 must appear in court by 2023, according to a Vavuniya High Court judgement on December 17, reports Tamil Guardian. After hearing the habeas corpus petition pertaining to five incidents of enforced disappearances, including Elilan, the LTTE's political leader for the Trincomalee area, the court rendered its decision. Elilan was given to the Sri Lankan military by members of his family after the war ended in 2009. The Sri Lankan Army testified during the preliminary hearing at Mullaitivu Magistrate's Court that they had a list of survivors but did not provide the list to the court. The Vavuniya High Court consequently agreed with the petitioner's claim that individuals who had surrendered were in the Army's care. As a result, they must either be brought before the court by March 2023 or the circumstances surrounding their forced disappearances must be disclosed.
