The Government is to expedite legal proceedings relating to the Liberation Tigers of Tamil Eelam (LTTE) suspects held under the Prevention of Terrorism Act (PTA) and Emergency Regulations. Justice Ministry spokesman Gamini Sarath Godakanda told The Island that Justice and Law Reforms Minister Milinda Moragoda on January 13 had received President Mahinda Rajapakse’s approval to fast track the process in keeping with a recently taken Government decision. He said that relevant authorities would be shortly informed of the new approach so that the grievances of many detainees and persons in remand custody could be addressed early.

A court in Sri Lanka has ordered the Police to immediately release 73 Liberation Tigers of Tamil Eelam (LTTE) suspects, reports BBC. The Colombo magistrate has rejected a request by the Police Terrorist Investigation Division (TID) for a conditional release. Police were ordered to send another 29 LTTE suspects to a rehabilitation centre for a period of one year. The TID which reportedly brought 102 former LTTE combatants from Boossa detention camp requested the court to release them with conditions. Nearly 11,000 LTTE suspects are still in the Government custody, the authorities said.

Colombo Page reports that a federal court in the United States on January 22 sentenced two persons, identified as Sathajhan Sarachandran (30), and Nadarasa Yogarasa (55), to 26 and 14 years of imprisonment respectively, in connection with their efforts to purchase USD one million worth of high-powered weaponry for the Liberation Tigers of Tamil Eelam (LTTE), a designated foreign terrorist organization in the US. The two convicts, both Canadian Tamils, were arrested by the Federal Bureau of Investigation (FBI) in an undercover sting operation when they attempted to purchase Surface-to-Air Missiles (SAMs), missile launchers, and hundreds of AK-47 automatic rifles at Long Island in New York on August 19, 2006.

They admitted to giving money to the LTTE between 2004 and 2007. Vinayagamoorthy had also pleaded guilty to providing radio transmitters which, the prosecution argued, were used for paramilitary activity in Sri Lanka, including denotating roadside bombs.

The General filed a 40-page complaint through his lawyer Wijeyadasa Rajapakshe to the Supreme Court complaining that the election is marred with bribery, corruption, the use of undue influence and vote rigging.

The British Supreme Court has ruled that being a cadre of the Liberation Tigers of Tamil Eelam (LTTE), which has been designated as a terrorist organisation by the British Government can seek asylum in UK, reports Daily Mirror quoting London Telegraph. This ruling was made in the case of “R” who joined the LTTE in 1992, at the age of 10. “R” occupied various positions until, at the age of 18. He was ‘appointed’ to lead a mobile unit transporting members of the intelligence division through the jungles to Colombo. He also acted as chief security guard to the leader of the intelligence division and second in command of the combat unit of the intelligence division. In October 2006, he was sent under cover to Colombo to await further instructions but two months later he discovered that the Sri Lankan Government was aware of his presence in the capital. Then he fled to Britain and claimed asylum on the basis that if he returned to Sri Lanka he would face mistreatment due to his race and LTTE membership. The application was refused, saying there were grounds for considering that he had committed war crimes.

An Australian court has released three persons, who were charged with sending funds to the Liberation Tigers of Tamil Eelam (LTTE) after pleading guilty to their charges, reports Colombo Page. Three Tamil persons, Aruran Vinayagamoorthy, Sivarajah Yathavan, and Arumugum Rajeevan, pleaded guilty to providing over USD 1 million to the LTTE outfit between 2002 and 2005. They were arrested in 2007 by the Australian Federal Police following a two-year investigation. The trio was earlier charged with the terrorism but the Australian prosecutors in 2009 withdrew all terrorism charges against the three LTTE supporters. The men pleaded guilty in December 2009 to a lesser charge of providing funds to a terrorist organization. Although LTTE is not banned in Australia, under the charter of the United Nations Act, Australian federal law makes it a criminal offence to funds to a terrorist organization banned either by the UN or by the Australian Government. However, Vinayagamoorthy also pleaded guilty to providing electronic equipment, including radio transmitters, used in bomb attacks in Sri Lanka. Justice Paul Coghlan of Victorian Supreme Court on March 31 accepted the guilty pleas and sentenced Vinayagamoorthy to two years in jail but released him on a good behaviour bond for four years. Justice Coghlan sentenced Yathavan and Rajeevan to one year in jail and released on a good behaviour bond for three years.

In the first case of its kind in Canada under its terrorism laws, a Sri Lankan Tamil has pleaded guilty to raising funds for the banned Liberation Tigers of Tamil Ealam (LTTE), reports Times of India. Appearing in the British Columbia Supreme Court in Vancouver on May 11, Toronto-based Prapaharan Thambithurai admitted raising money for the LTTE in 2008. Vancouver is the major city of British Columbia - the western-most province of Canada - with a huge concentration of the South Asian community. The 46-year-old Sri Lankan Tamil, who came to Canada as a refugee in 1988, was arrested in 2008 for illegally raising funds for the LTTE. The LTTE was banned along with many other terror outfits by Canada in 2006 after the new Conservative Government took over. He was arrested while seeking donations for the World Tamil Movement for relief work in Sri Lanka. But Canadian intelligence agencies found that the body was a front organization for the banned LTTE. Pleading guilty, the Sri Lankan Tamil admitted that half of the money raised for humanitarian aid went to the LTTE.

According to Colombo Page, Sri Lankan authorities filed a third case before a civil court against former Army Commander and Democratic National Alliance (DNA) parliamentarian General (retired) Sarath Fonseka on July 12. The latest case is to the allegation of conspiracy against the Government with 10 other military personnel. The other cases against General Fonseka before civil courts are the alleged controversial "white flag" story against the Defence Secretary and the HiCorp arms deals.

Sarath Fonseka dabbled in politics while in uniform, found him guilty and recommended him for a ‘dishonourable discharge from rank.’ A decision on the recommendation of the military court will have to be taken by President Mahinda Rajapaksa in his capacity as the supreme commander of the armed forces. A press statement by the Army said the court martial convicted General Fonseka of all ‘three charges' and recommended that he be ‘cashiered.’ A statement on the Presidential Secretariat Website said that when an officer was cashiered, he would lose the rank and all the awards and honours received as a military officer. Gen. Fonseka successfully led the war against the Liberation Tigers of Tamil Eelam (LTTE) and became the first military officer in the island nation to be elevated to the rank of a four-star General.

Colombo Page reports that a court martial in Sri Lanka on September 17 held the former Army Chief, Sarath Fonseka, guilty on all four counts in a case related to procurement of arms in violation of the tender procedures and recommended that he be jailed for three years. Director-General of the Media Centre for National Security Lakshman Hulugalle said at a news conference that the punishment would be subject to approval of President Mahinda Rajapaksa in his capacity as the supreme commander of the Armed Forces.

A federal jury in Baltimore has convicted a Singapore national of conspiring to provide weapons to the Liberation Tigers of Tamil Eelam (LTTE) operating in Sri Lanka, the US Justice Department said on October 18, reports Daily News. Balraj Naidu (48) was charged in a conspiracy to provide material support to the LTTE designated in 1997 by the US Department of State as a foreign terrorist organization. According to evidence presented at his trial, Naidu and four co-conspirators arranged to buy some 28 tons of US-made weapons and ammunition from an undercover business in Maryland. The LTTE representatives made a $250,000 down-payment on the $900,000 weapons deal with the bogus company in the summer of 2006, the Justice Department said. Naidu’s partners were arrested in September 2006, after inspecting the weapons that had been delivered to Guam and making another payment of $450,000 to the undercover business, the Justice Department said. Naidu was arrested after a further investigation, it said. US officials said the group also had tried to buy weapons from China, Thailand, North Korea, the Philippines and Indonesia for the LTTE to be used against Sri Lankan government forces. Naidu faces a maximum sentence of 15 years in prison. The co-conspirators, Thirunavukarasu Varatharasa, 40, of Sri Lanka; Haji Subandi, 73, and retired Indonesian Marine Corps General Erick Wotulo, 62, both Indonesians; and Haniffa Bin Osman, 59, of Singapore, all pleaded guilty and were sentenced to 57 months, 37 months, 30 months and 37 months in prison, respectively. The US designation as a foreign terrorist organization barred the group from legally raising money or buying operational equipment in the US.

The Colombo High Court on October 27 sentenced a cadre of the Liberation Tigers of Tamil Eelam (LTTE) to 30 years rigorous imprisonment for delivering a bomb to assassinate former President Chandrika Kumaranatunga on December 18, 1999, according to Colombo Page. Colombo High Court Judge W.T.M.P.D. Waraweva delivered the sentence against the accused Sathyavel Ilangeshwaram who was 19 years old at the time of the bombing. Ilangeshwaram and six others including a woman were accused on counts related to conspiring to assassinate the former President. Kumaranatunga lost an eye due to the bomb attack that targeted her at the final propaganda rally of the 1999 Presidential election. Twenty six persons were killed and 80 others were injured in the incident.

Sri Lanka's Supreme Court on October 29 dismissed a petition filed by the former Army Commander and defeated Presidential candidate Sarath Fonseka challenging President Mahinda Rajapaksa's re-election at the January 26 Presidential elections, reports Colombo Page. The five-member bench upheld a preliminary objection raised on behalf of President Rajapakse and rejected Fonseka's petition without being tried. The common opposition candidate and the Democratic National Alliance (DNA) leader alleged that election malpractices took place during the January 26th presidential election ( which President Rajapakse won with a wide margin of 18 percent equivalent to 1.8 million votes over Fonseka) and charged that the results were therefore unacceptable.
