A trial began on January 26 against four men charged with trying to supply missiles and assault weapons to the Liberation Tigers of Tamil Eelam (LTTE), according to Daily News. The Sri Lankan immigrants have been charged with terrorism because the LTTE is a designated terrorist organization in US. The Federal Bureau of Investigation engineered a sting in which three of the men drove from Canada to New York City in 2006 to meet with undercover agents posing as black-market arms dealers. Prosecutors said the men were caught on tape agreeing to buy 10 surface-to-air missiles and 500 rifles for $ 900,000. US authorities said the three men were on a secret mission to help the LTTE by buying hundreds of thousands of dollars worth of surface-to-air missiles and smuggling them into Sri Lanka. The three men, identified as Sathajhan Sarachandran, Sahilal Sabaratnam and Thiruthanikan Thanigasalam, who had been living in Canada, along with the fourth one, were jailed without bail after pleading not guilty. Each of them could face up to 30 years in prison if convicted.

The Government on January 26 informed the Appeal Courts that it has decided to cancel the radio license given to the Liberation Tigers of Tamil Eelam (LTTE), reported Colombo Page. The Attorney General informed this decision to the Appeal Courts when the petition challenging the LTTE radio license was heard. The petition was submitted a few months ago by Piyasena Dissanayake who argued that the radio license is illegal as the LTTE is a proscribed organization in the country. The case is to be taken for hearing again on February 2.

National Post reports that the trial of three Canadians accused of travelling to New York in 2006 to buy anti-aircraft missiles and assault rifles for the LTTE ended on January 27 following two more guilty pleas. Sahilal Sabaratnam and Thiruthanikan Thanigasalam pleaded guilty to conspiracy to support a foreign terrorist group and conspiracy to buy missiles. Their co-accused, Sathajhan Sarachandran, had already pleaded guilty on January 26. They each face a minimum sentence of 25 years with a maximum of life imprisonment after admitting they were part of a Canadian-based arms procurement cell of the LTTE. "With these convictions we have sent a clear message that the LTTE and its supporters cannot use the United States as a source of supply for deadly weapons and technology, and that all terrorists who attempt to do so will be met with the full resources of law enforcement," US Attorney Benton Campbell said.

The chief of the Liberation Tigers of Tamil Eelam (LTTE) unit in Britain helped supply military equipment to the outfit, a London court heard on January 28, according to Daily News. Prosecutors alleged that 52-year-old Arunachalam Chrishanthakumar alias A.C. Shanthan led the acquisition of funding and materials bound for the LTTE. Chrishanthakumar appeared at Kingston Crown Court in London charged with five offences, ranging from receiving electrical devices for terrorism, possessing terrorist documents, and belonging to a banned organisation. Three others - Jegatheswaran Muraleetharan alias Muralee Tharan, his brother Jeyatheswaran Vythyatharan alias Vithy Tharan and Murugesu Jegatheeswaran alias M. Jegan - are accused of receiving electronic items for use in terrorism.

The Colombo Chief Magistrate Court on March 24 ordered to prevent eight directors of the Liberation Tigers of Tamil Eelam (LTTE) front Tamil Rehabilitation Organization (TRO) from leaving the country, reports Colombo Page. While hearing the case charging TRO of raising funds for the LTTE, the Chief Magistrate, Nishantha Hapuarachchi, also issued arrest warrants against seven of the directors, who were absent in the Court. These directors are presently believed to be in the un-cleared areas (area not under Government control). According to sources, two of them are said to be a 'lieutenant' and a ‘colonel' of the LTTE. Meanwhile, the Chief Magistrate released Sinnaiah Ramalingam, the only director who appeared in the Court, on a SLR 500,000 surety bail.

A London court on April 17 convicted a man described as the head of the Liberation Tigers of Tamil Eelam (LTTE) in Britain on two terror-linked charges, including supplying bomb-making equipment to the outfit, reports Daily News. Arunachalam Chrishanthakumar (52) was found guilty of coordinating supplies of material to the LTTE and was also convicted of receiving documents for the purpose of terrorism after a trial at Kingston Crown Court. Jurors failed to reach verdicts on three other charges against Chrishanthakumar alias A.C. Shanthan, plus one charge against another accused Jegatheeswaran Muraleetharan. The Court is to take a decision next week on whether to hold a re-trial, adds Colombo Page.

The Colombo Additional Magistrate, G. Punarsha S. Ranasinghe, on June 3 detained a Liberation Tigers of Tamil Eelam (LTTE) intelligence unit head, Gunasundaram Jayasundaram, till June 9 in the Terrorist Investigation Division (TID) for allegedly supplying firearms and ammunition on a large scale to the LTTE, according to a Sri Lanka Army report. A TID officer said the suspect who owned business establishments in Sri Lanka, Singapore, Malaysia and Ukraine had funded the LTTE to purchase firearms and ammunition. The TID has alleged that Jayasundaram had also visited the LTTE leadership in Wanni. Four persons pleaded guilty in the federal court at Brooklyn in US on June 9 for conspiring to provide support to the Liberation Tigers of Tamil Eelam (LTTE) outfit, reports Daily News. The United States Attorney in Brooklyn, Benton J. Campbell, said the four defendants had raised millions of dollars and obtained weapons and technology for the LTTE. Prosecutors said one of the four defendants, identified as Karunakaran Kandasamy (51), was the director of the outfit’s American branch. Prosecutors also said that two others, Pratheepan Thavaraja and Murugesu Vinayagamoorthy, had been involved in an attempt to bribe an agent posing as a State Department official to remove the LTTE from the Government’s list of foreign terrorist organizations. The Government said that the LTTE, which dated to the 1970s, had relied on “sympathetic Tamil expatriates” to raise and launder money for the group. The Government said, for example, that Vinayagamoorthy had helped to launder LTTE money through a Swiss bank to cover a trip to Sri Lanka by a congressman.

The 52-year-old from Norbury was found guilty of charges relating to conspiracy to receive and receiving property that could be used for terrorism at Kingston Crown Court on April 17. A judge at the Old Bailey jailed him for two years for the conspiracy count and one year for receiving property; the sentences will run concurrently. Deputy Assistant Commissioner John McDowall, head of the Metropolitan Police’s counter terrorism command and senior national co-ordinator counter terrorism, said: “Shanthan bought component parts which have been used in the past by the LTTE to make improvised explosive devices. He purchased electrical equipment including circuit boards, GPS and antenna equipment and sent it to Sri Lanka for terrorists to use. He spent more than £13,000 in just 14 months on military publications, manuals and guides to be used as reference for military attack planning, yet denied he was involved in any terrorist activity”.

The Attorney General made a special request to the Magistrate to order the prison authorities to hand over the suspect Madusha Lakshan to the Colombo Crime Division (CCD) for questioning over the alleged plot. Making the application to get the suspect under CCD custody, Senior State Counsel Dileepa Peiris said the findings had revealed that the suspect had a personal animosity against the President and he had brokered with the Liberation Tigers of Tamil Eelam (LTTE) to get the support of a resident in Angunakolapelessa to carry out a suicide attack. Counsel Peiris said the plot was uncovered following a detailed statement given by Saman Chandana of Angunakolapelessa who was arrested during a cordon and search operation in the Wellawatte railway station area on April 15.

Under the order, the LTTE remains listed as a terrorist organisation by the US “The International Emergency Economic Powers Act was enacted by Congress in 1977 and was originally used by Presidents to impose economic sanctions on foreign nations considered a threat to national security. But in 2001, President George W. Bush issued executive orders under the law that enabled him, through the Treasury Department, to designate groups as terrorist organizations, freeze their assets and prohibit any aid or services to the groups,” said the website. The procedure was challenged in the court on the grounds that the law was unconstitutionally vague and that it violated the First Amendment right of free speech. A panel of the 9th US Circuit Court of Appeals ruled by a 2-1 vote that the law regulates conduct, not speech, and does not violate the Constitution. “There is no right to provide resources with which terrorists can buy weapons and explosives,” the court majority said.

The Daily Mirror reported on August 27 that the apex court made the observation when a petition filed on behalf of five Internally Displaced Persons (IDPs) was taken up recently. The court observed that if 13-year-old Sopika Surendranathan and her parents, who were confined in the IDP camps, had a place to go and if their next-of-kin were prepared to take them, there was no reason for them to be kept in the camps any longer. The senior state counsel stated that the family were not combatants. The court also granted leave to proceed with the rights petition for alleged infringement of their fundamental right to equality and equal protection of the law as well as their right to the freedom of movement and of choosing their residence within Sri Lanka. The matter was listed for hearing on November 12. The petition contended that the family owned three houses and had relatives in Jaffna and Colombo and, if allowed to leave, could obtain accommodation.

Chief Justice (CJ) Asoka de Silva ordered the Attorney General to take a policy decision on the matter after discussing with the secretary to the justice ministry and create a mechanism to implement it. The Supreme Court made the order after considering a fundamental rights petition filed by one J. A. Francis, who claimed he was under detention for over one and half years. The Government has admitted that nearly 10,000 cadres were arrested and detained during the last stages of the war against the LTTE. It is also estimated that nearly 2000 suspected LTTE militants were detained before the fighting intensified. The hearing has been postponed until September 8.

Colombo Court on September 11 released two Liberation tigers of Tamil Eelam (LTTE) leaders, former media spokesman Velayudan Dayanidhi alias Daya Master and interpreter Velayudan Kumaru Pancharatnam alias George Master, following several months of remand custody, according to Colombo Page. Releasing them on SLR 2.5 million bail each, the Colombo Chief magistrate Nishantha Hapuarachchi ordered the two former LTTE leaders not to leave the country. They were ordered to report to the Police every month and their passports were also impounded. Police did not object to the two men being released on bail. The former LTTE leaders had surrendered to Sri Lanka Army on of April 22 during the final stages of the war between Government forces and the LTTE. Following their surrender, they were brought to Colombo and held in custody under the Prevention of Terrorism Act. The former LTTE leaders have confessed to their past activities at the outfit to the Criminal Investigations Department.

Naidu was arrested on a warrant and produced in courts, said the Singapore Strait Times. The man was arrested at his home last week and brought to court on September 29 for a brief court appearance. The businessman is wanted by the United States (US) Government on two terrorism related charges. He is also wanted by the US for allegedly brokering arms deals with the LTTE. No formal charges have been laid against him so far. The Extradition hearing was adjourned until October 5. The Strait Times said the US Government made the request for the extradition during the middle of the year. According to the Sri Lankan intelligence sources, the LTTE made many of their purchases from arms dealers in Singapore.

The defendants include Nadaraja Matinthiran, the alleged leader in France of the LTTE, which is accused of extorting some five million euros (S$10 million) from the country's 75,000 Tamils. Also in the dock is a group called the Tamil Coordination Committee in France, believed to be a legal front for the LTTE, which has been listed as a terrorist organisation by the European Union since 2006. Most of the Paris suspects were arrested in April 2007 and charged with criminal conspiracy to commit acts of terrorism, financing of terrorism or racketeering to finance terrorism. It is believed that the LTTE exert a controlling influence over the political life of the 1.5-million-strong world Tamil Diaspora, in many cases levying a 'revolutionary tax' based on household size and income.

The Attorney General filed indictment against the Sri Lanka Customs Additional Director Indra Sarath Balasooriya and Wharf Executive Rajendran Yogarajah for aiding and abetting Roy Manoj Kumar Samadanam and his wife Ridma Roshani Selamban to provide a GPS unit to the LTTE. According to the statement made by Samadanam, a Sri Lankan expatriate in Canada when he came to Sri Lanka he was introduced to the LTTE by a friend. Then he was asked by the LTTE to help them to bring telecommunication equipment from Singapore and Malaysia. He further stated that later Muhundan and Sinawan in Singapore sent goods from Singapore. He got them released and sent them to the LTTE. The indictment includes productions of three boxes, four radar sets, four radar antennas, 150 VHF mobile phones.

A court in France on November 23 sentenced 20 out of 21 Liberation Tigers of Tamil Eelam (LTTE) militants who were accused of extorting millions of Euros from the Tamil community in France to prison terms, reports Colombo Page. An AFP report said the leader of the group Nadaraja Matinthiran has been sentenced to seven years in prison for extorting USD 7.4 million (5 million Euros) as taxes from the Tamil community living in Paris and other surrounding areas to finance the LTTE terrorist activities in Sri Lanka. The other 19 defendants were sentenced to six year or less while one was acquitted. The court also ordered that the Coordinating Committee of Tamils-France be dismantled after ruling that it was a front for the LTTE, AFP reported. According to the report most of the suspects were arrested in April 2007 and charged with criminal conspiracy to commit acts of terrorism, financing of terrorism or racketeering to finance terrorism. French prosecutors said the Tigers imposed a "revolutionary tax" on the Tamil immigrants to France most of whom were political refugees living in Paris and neighbouring areas. A Jane's Intelligence Review report in August 2007 said the LTTE's profit margin was some USD 200 to 300 million per year.

Aruran Vinayagamoorthy, 35, Sivarajah Yathavan, 38, and Arumugam Rajeevan, 43, of New South Walse, are to plead guilty to a single charge of providing money to the LTTE, their lawyers informed the Australian Supreme Court on December 21. In addition, Vinayagamoorthy would plead guilty to providing radio transmitters to the terrorists. The three men were arrested in a raid in May 2007 and charged of being members of a banned organization and providing financial support to the organization. The prosecutors have charged the men with several counts but later dropped most of the charges. They are pleading guilty to single count of providing money to a banned organization.
