The United States (US) granted President Mahinda Rajapaksa immunity from a law suit filed in a US court against him by the pro-Liberation Tigers of Tamil Eelam (LTTE) Tamil Diaspora, according to Colombo Page. The US filed a "Suggestion of Immunity" at the United States District Court for the District of Columbia on January 13 for President Rajapaksa recognizing him as the "sitting head of state of a foreign state." "In this case, because the Executive Branch has determined that President Rajapaksa, as the sitting head of a foreign state, enjoys head of state immunity from the jurisdiction of U.S. courts in light of his current status, President Rajapaksa is entitled to immunity from the jurisdiction of this Court over this suit," the Assistant Attorney General wrote. The lawsuit filed by Kasippillai Manoharan, and two others seeks USD 30 million on behalf of three plaintiffs who said their relatives were killed in three incidents, including the Sri Lankan army's offensive in 2009 against the final holdout of the LTTE.

Colombo Chief Magistrate Rashmi Singappuli said that the court is expecting the advice of the Attorney General regarding legal action against two surrendered leaders of the Liberation Tigers of Tamil Eelam (LTTE), reports Colombo Page. The duo, former LTTE media spokesman Daya Master and translator George, surrendered to State Military in the last phase of the war against LTTE. They were held by the Criminal Investigations Department (CID) and later released on bail. The Magistrate also remanded LTTE's former leader of Women's Wing Thamalini further until January 30. She was arrested by CID on May 20, 2009. The court is also expecting the advice of the Attorney General regarding her.

Fonseka is currently serving a three-year prison sentence imposed by the Colombo High Court having found him guilty of inciting violence in the famous 'white flag' case. He is also serving a 30-month prison term imposed by a court martial in 2010 after finding him guilty of four charges related to alleged irregularities in military procurements during his tenure as Army Chief. Another court martial earlier delivered an order sentencing the former General for a dishonorable discharge from rank for engaging in politics while being in active service. The retired military chief was stripped of his ranks and medals.

The United States District Court for the Southern District of New York on February 9 has dismissed the lawsuit against a former General of Sri Lanka Army Shavendra Silva, filed by the relatives of two Sri Lankan Tamils alleging war crimes, reports Colombo Page. The court dismissed the lawsuit on the ground that Silva is currently serving, and is an accredited diplomat entitled to immunity from civil jurisdiction in the United States under federal statute and the Vienna Convention on Diplomatic Relations. Major General Silva was instrumental in the military capturing several former LTTE strongholds including the Mannar Rice Bowl, Nachchikudha, Devils Point, Pooneryn, Kilinochchi, Elephant Pass, Vishvamadu and Puthukudiyiruppuan.

United States Department of Justice is seeking a 15-year prison sentence for a Canadian Tamil man who pleaded guilty in a United States district court to charges of conspiring to provide material support to the Liberation Tigers of Tamil Eelam (LTTE), a proscribed organization in the US. Mylvaganam, a Canadian citizen who previously lived in the US, was arrested by Canada's Royal Canadian Mounted Police (RCMP) officers in Toronto and extradited to US in 2009, following his indictment in the Eastern District Court of New York. He pleaded guilty on February 8, 2012 to conspiring to procure sophisticated technology, including submarine design software and night vision equipment for the LTTE in 2006. Mylvaganam faces a maximum term of 15 years' imprisonment.

Colombo High Court on May 4 ordered the Prison Commissioner to transfer Sarath Fonseka to the Colombo National Hospital (NHC) from the private hospital where he is receiving treatment for security reasons, reports Daily News. The court observing the fact that there is a threat to Fonseka from the Liberation Tigers of Tamil Eelam (LTTE) and other organisations and the prison authorities are unable to provide maximum security for Fonseka while at the private hospital, ordered his transfer to NHC.

United States federal judge in New York on May 11 sentenced a top Tamil Tiger, who pleaded guilty to terrorism charges, to time served in jail and freed the man, reports Colombo Page. The defendant, Karunakaran Kandasamy (55), had pled guilty to among others, a charge of conspiring to provide material support to Liberation Tigers of Tamil Eelam (LTTE). A District Court document says Kandasamy was the director of the American branch of the LTTE, which operated through charitable front organizations, including the Tamil Rehabilitation Organization (TRO) and oversaw and directed the LTTE's various activities in the U.S, including raising millions of dollars for the LTTE and laundering it through the TRO. According to a court document, a single spreadsheet of priority items to purchase, totalled $20 million in arms and equipment, and included, among other things, 25mm Anti Aircraft Guns, 30 mm Twin Barrel Mounted Naval Guns, thousands of automatic rifles, grenade launchers, 50 tons of C4 explosive, and other weapons, were found from his colleague Vijayshanthar Patpanathan, another LTTE suspect, who pled guilty at the same time as Kandasamy, has assisted him and others in these fundraising and money laundering activities. They were pleaded guilty on June 9, 2009. The court, however, while announcing sentence expressed doubts that Kandasamy was involved in raising money for terrorism and believed the defendant's activities were humanitarian and not military.

Sri Lanka: Former LTTE militant involved in Canadian murder case, says the Police The murderers of Andrew Mahendrarajah Anthonipillai, a Canadian of Sri Lankan origin, who was killed at Kaagncheepuram lane, near Paranthan junction, on May 3, have been arrested, reports The Island. Police have arrested five persons, including a former Liberation Tigers of Tamil Eelam (LTTE) militant, identified as A. Akilan (member of military wing) for their alleged involvement in the killing. All five were produced before the Kilinochchi Magistrate’s Court on May 24 and remanded pending further inquiries. A. Akilan had undergone rehabilitation in Vavuniya town (Vavuniya District) in Northern Province at the conclusion of conflict in May, 2009. Having interrogated the suspects, the Police recovered a laptop, iron bars, an axe and a hand phone.

A Sri Lankan court on June 22 ordered the authorities to rehabilitate former female political wing leader, Subramaniam Sivathai alias Thamalini of Liberation Tigers of Tamil Eelam (LTTE), reports Colombo Page. The Criminal Investigation Department (CID) has met Thamalini on the orders of the Attorney General and during the meeting she has expressed desire to be rehabilitated. Thamalini has been in remand custody since her arrest by a special Police team on May 27, 2009 at the Internally Displaced Persons (IDPs) camp in Vavuniya District of Northern Province. She was charged with training LTTE cadres and establishing connections with LTTE members overseas.

The Criminal Investigation Department (CID) informed the Colombo Magistrate Court that the Attorney General's advice has not yet been received regarding the two former leaders of the LTTE. The two former leaders are Velayuthan Dayanidhi alias Daya Master, who was the media spokesman of the LTTE, and Velupillai Kumaru Pancharathnam alias George Master, who was the translator for slain LTTE leader V. Prabhakaran. The two former LTTE leaders have surrendered to Sri Lanka Army on April 22, 2009, during the final stages of the war between government forces and the LTTE. Following their surrender, they were brought to Colombo and held in custody under the Prevention of Terrorism Act. The former LTTE leaders have confessed to their past activities at the rebel outfit to the CID. The Magistrate ordered to obtain the consultations of the Attorney General urgently and postponed the case till November 26. They were later released from remand custody on bail while the court proceedings continued.

The Tamil Eelam Supporters Organisation (TESO) Conference, sponsored by the opposition Dravida Munnetra Kazhagam (DMK), is scheduled to be held at YMCA grounds in Royapettah in Chennai, India on August 12. State advocate-general A. Navaneethakrishnan told judges Elipe Dharma Rao and M. Venugopal on August 10 that the venue will give rise to several problems as it is located in the centre of the city. He also pointed out that 100,000 people will attend the event, but the venue cannot hold more than 8,000 people.

Justifying the continuation of the ban on the Liberation Tigers of Tamil Eelam (LTTE), the Union government of India on September 28 asserted that the banned organisation continued to be a threat to the country’s sovereignty and integrity, reports Daily Mirror. Immediately after the assassination of the former Prime Minister, Rajiv Gandhi in May 1991, the Union government, which had imposed the ban on the LTTE for the first time in May 1992, had been extending it every two years under the provisions of the Unlawful Activities (Prevention) Act. As per the law, the Centre had issued a notification banning the organisation on May 14 for another period of two years. On September 28, Justice V.K. Jain, who constitutes the one-man Tribunal set up under the Act to go into the ban, conducted a hearing here to decide its validity. R.K. Suman, Director of Internal Security, Union Home Ministry said, “Though the LTTE has been decimated, there are reports to indicate that remnant LTTE cadres or leaders are trying to regroup and revive the organisation in Tamil Nadu and elsewhere in India.” He also said there were reports that the banned organisation was likely to revive with the assistance of Maoist organisations in the country.

The Sri Lankan Government on October 21 has commenced hearing cases of former Liberation Tigers of Tamil Eelam (LTTE) members in two of the four special courts set up for that purpose, reports Colombo Page. Justice Ministry Secretary Kamalini de Silva said that two courts have been established in Mannar and Vavuniya Districts to expedite the hearing of cases against LTTE suspects. She noted that two more courts are to be established in Anuradhapura and Colombo Districts for the purpose. The Government in May had informed parliament that there were some 359 LTTE suspects in local prisons and 309 cases have to be heard.

The two suspects, both born in Sri Lanka in 1979, were arrested November 11 and are being held in custody in Paris.
