An anti-terrorism court in Lahore granted bail, on January 1, 2003, to Al Qaeda suspect and medical practitioner Ahmad Javed Khawaja, and his brother Ahmad Naveed Khawaja. However, the accused could not be released as they have been booked for 90 days in another case registered against them under section 3 of the Security of Pakistan Act, 1952. As reported earlier, Ahmad Khwaja and nine of his family members were arrested on December 19, 2002, from their Manawan residence for alleged links with Al Qaeda and Taliban.

An Anti-Terrorism Court (ATC) in Dera Ghazi Khan, on January 3, issued non-bailable arrest warrants against proscribed Sipah-e-Sahaba Pakistan (SSP) Sunni group chief and Member of the National Assembly (MNA) Maulana Muhammad Azam Tariq, for the sixth time for not appearing in the court. It directed police to present the accused on January 13. A case was registered against him and five others on July 31, 2000 at Jampur police station, under section 295A and 16 of the Maintenance of Public Order Ordinance.

Four front-ranking Al Qaeda terrorists were hidden at the Lahore residence of medical practitioner Ahmed Javed Khawaja, who was arrested along with four of his relatives on December 18, 2002, the government told the Lahore High Court, on January 15. "It was revealed through investigation that the al-Qaeda's most wanted terrorists were being harboured and facilitated at Manawan Compound owned by Dr Ahmed Javed Khawaja and his family," said an Interior Ministry statement presented to the court. The statement responded to a petition by Khawaja's wife challenging the legality of his detention, and that of his brother Naveed, sons Umar Karar and Khizar Ali and nephew Muhammad Usman. The Interior Ministry statement said terrorists allegedly harboured by the family were Abu Yasir Al Jazairi, identified as an Algerian or Moroccan, Assadullah and Sheikh Said Al-Misri, both listed as Egyptians and Abu Faraj, listed as North African. Al Jazairi was "responsible for the business of al-Qaeda," Al-Misri was a financial chief of the network, and Faraj was the head of Al Qaeda's North Africa network, according to the statement. Faraj was also a deputy of Khalid Sheikh Mohammad, a key Al Qaeda figure on the BI list, who escaped a raid on his hideout in Karachi in September 2002, the statement added.

An anti-terrorism court in Lahore, on January 21, ordered medical practitioner Ahmed Javed Khawaja and his brother Ahmed Naveed Khawaja, accused of sheltering front-ranking Al Qaeda terrorists, to stand trial next week on charges of attempt to murder, illegal weapons possession and anti-state activities. As reported earlier, they were arrested after a midnight raid on their residence in Lahore, on December 18, 2002. They have been accused of shooting at some 50 intelligence agents, including United States and Pakistani agents, during the raid.

Self-styled chief of the proscribed Lashkar-e-Jhangvi (LeJ) Sunni group Akram Lahori, and his two associates, denied on January 22 their involvement in the July 2001-murder of Shaukat Mirza, the Managing Director of a public sector organisation. The Lahore High Court’s Multan bench, on January 23, refused to prosecute proscribed Jaish-e-Mohammed (JeM) chief Maulana Masood Azhar on charges of making an anti-India speech. "It is not a crime to make speeches against India," ruled Judge Ijaz Ahmed Chaudhry, while dismissing the case. He said Indian Deputy Premier L K Advani "threatens Pakistan daily in India but the Indian government never institutes any case against him." Lahore Police registered a case against Azhar in August 2001 for delivering speeches against India. Altaf Shah, counsel for the Punjab government, told the Court that the Jaish chief made "provocative and sensational speeches which instigated students and youths to create a law and order situation." However, the Judge did not agree with this deposition and added, "Indian leaders always make anti-Pakistan and prejudicial speeches and they always attempt to create troubles for Pakistan."

Medical practitioner Ahmed Khawaja and his brother, a Canadian national, accused of having links with the Al Qaeda, were formally charged at a Lahore anti-terrorism court, on January 28, on charges of harbouring Al Qaeda operatives, attempted murder and illegal weapons possession. Both were arrested on December 18, 2002, on the suspicion of sheltering Al Qaeda cadres. As reported earlier, Khawaja reportedly confessed he provided medical treatment to a wife of Osama bin Laden and also to the wife of another key Al Qaeda leader, Abu Zubaida.

A large number of TNSM activists had gone to Afghanistan during the US-led military campaign there and approximately 30 of them were arrested in Kurram Agency while returning. The Court, instead, indicted them on multiple charges of assault on police with illegal weapons, as the prosecution could not produce incriminating evidence of the Khwajas' alleged links with Al Qaeda activists, in accordance with the Court’s instructions issued at the last hearing. Two of the five terrorists accused in the US Consulate bomb attack case were held guilty and sentenced to death by an Anti-Terrorism Court in Karachi, on April 14. Muhammad Imran Siddiqui and Muhammad Hanif, alleged to be chief and deputy chief respectively of the Harkat-ul-Mujahideen Al-Aalmi (HuMA), were sentenced to death, while their accomplices––Sharib Arsalan Faruqi and Mufti Hafiz Zubair––were awarded life imprisonment. The fifth accused, Muhammad Ashraf, who, according to security agencies, is the ‘financial advisor’ of the group, was acquitted on the grounds that the prosecution has failed to substantiate its charges against him. In what was said to have been a suicide attack, a car fitted with explosives had crashed into the boundary wall of the US Consulate on June 14, 2002 killing 12 persons, including six women and two police personnel, and injuring 43 persons. The president of the outlawed Sipah-e-Sahaba Pakistan (SSP), Maulana Azam Tariq, on April 18 asked the Lahore High Court to suspend the Government’s orders freezing his party's bank accounts and imposing functional restrictions on it, till his petition against the ban on his party is decided. The Court issued notices to the Federal Government for a response to this plea and to the Maulana's previously filed petition against the state orders banning his group. The petitioner's counsel submitted that the state's decision to freeze the accounts of SSP had brought its social and humanitarian work to a halt. Besides, the closure of the party's regional offices at Lahore, Karachi, Rawalpindi, Jehlum, Multan, Bahawalpur, Faisalabad, DG Khan, Peshawar and Quetta had also affected the social functioning of the party, he argued. The counsel also claimed that the proscription had adversely affected its religious functions since hundreds of mosques, including the Farooq Azam Masjid and Jinnah Masjid in Karachi, drew funds for maintenance from the party's coffers. The petitioner claimed his party has incurred a loss of at least Rs 7.7 million due to the ban.

An Anti-Terrorism court in Karachi sentenced on June 30 three terrorists of the proscribed Harkat-ul-Mujahideen (HuM) to death on each of three counts for killing 11 French naval engineers and two others in a suicide car bomb attack near the Sheraton Hotel on May 8, 2002. While Asif Zaheer and Rizwanullah faced trial, Muhammad Sohail alias Akram, the third accused, was convicted and sentenced in absentia. Another absconding accused, Adnan Qamar alias Nooni, was acquitted of all charges for lack of evidence. The court further ordered that movable and immovable properties of the convicts be forfeited in favour of the state. The court also ordered the convicts to pay a total compensation of Rupees 0.6 million. Meanwhile, the convicts, while talking to the media, claimed that the court had convicted them under pressure from higher authorities. The court, in its 125-page judgment, held arrested accused Asif and Rizwanullah guilty of manufacturing and using the bomb. It also observed that absconding accused Sohail who had reportedly been using a fake name of Khalid Mehmood was the mastermind of the attack and hence deserved similar punishment.

The US police have arrested the accused under the Federal Neutrality Act (FNA), which bars citizens from engaging in hostile actions against nations with whom the US is at peace. The three other persons reportedly living in Saudi Arabia and charged along with the eight accused on the same counts, however, remain at large.

The court ordered unfreezing of the accounts and directed HBL to honour ART’s cheques and make payments according to their tenor. The court, however, reportedly observed that the Federal Government is free to initiate proceedings and exercise any power that might be available to it for dealing with the petitioner's accounts. The ART had filed the petition against freezing of its one rupee and two foreign currency accounts by HBL on September 25, 2001, on the directives of the SBP.

An anti-terrorism court in Karachi on October 18 awarded 10-year jail terms to three terrorists affiliated to the Harkat-ul-Mujahideen Al-alami (HuMA) for an attempt on the life of President Pervez Musharraf, while acquitting two co-accused in the case. The three, Imran, the HuMA chief, Muhammad Hanif, deputy chief and Muhammad Ashraf, the HuMA treasurer, were found guilty of attempting to blow up President Musharraf in Karachi on April 26, 2002. Another five HuMA cadres have been declared proclaimed offenders in this case and they would be tried separately after their arrests. According to The News, the three accused were initially arrested in a case pertaining to the bomb blast outside the US Consulate in Karachi and during interrogation, they allegedly confessed to planning to blow up the President. The plan, however, failed as the remote control that was to blast the explosive developed some fault.

A Pakistani national, who received training to join the outlawed Lashkar-e-Toiba (LeT) in the Indian State of Jammu and Kashmir, has reportedly been sentenced in the United States to 10 years and six months in prison. Mohammad Aatique was the first to be sentenced among a group of 11 persons indicted in Pennsylvania and Virginia in July 2003 for training with assault rifles. Aatique had entered into a plea bargain with the prosecution under which he pleaded guilty of going to Pakistan after the September 11, 2001, terrorist attacks to train with the LeT. A US Federal Court in Pennsylvania on December 17 sentenced him to the mandatory 10 years for firearms violations and six months for conspiring to violate the US Neutrality Act. Among the remaining suspects, three have pleaded guilty to weapons charges and the trial is expected to commence in February 2004.
