Justice Karamat Nazir Bhandari of the Lahore High Court allowed, on January 1, a petitioner-lawyer to amend his petition against the ban on the Lashkar-e-Toiba (LeT) and Jaish-e-Mohammed (JeM) to confine it to the detention of their chiefs. Advocate M D Tahir pointed the importance of Jehad in Islam in his arguments against the ban. The Judge observed that he had disjoined a number of aspects and had sought a variety of relief measures, which could only be considered separately. While demanding withdrawal of the ban imposed on the two Pakistan-based terrorist outfits, the petitioner had sought disbandment of India's Rashtriya Swayamsevak Sangh (RSS) and the Shiv Sena and the trial of their leaders.

Police in the Punjab arrested over 80 activists of the different jihadi outfits and militant groups, reports from Pakistan said, on January 4. A majority of them belonged to the Lashkar-e-Toiba LeT), Jaish-e-Mohammad (JeM), Tehrik-i-Jaferia Pakistan and Sipah-i-Sahaba Pakistan (SSP). Reports also said an anti-terrorism court (ATC) in Lahore, on January 4, sent 17 activists of militant groups on judicial remand. Of the over-80 arrested, 18 were taken into custody from Lahore and the suburbs. 20 more were held from Faisalabad and the remaining from other places in the province.

The tribal administration in Khar Bajaur sent to prison, on January 9, for a term of three years, 10 suspected Al Qaeda terrorists and 52 officials of the erstwhile Taliban regime who had illegally crossed over into Pakistan. The 62 persons, comprising Arabs and Afghans, had entered the tribal agency at different points of time through varied routes and were arrested. Media reports indicate that they have been sent to the Central Prison in Haripur and the district prison in Kohat. Official sources have indicated that the Afghan prisoners belonged to Kandahar, Qunduz, Kabul and Nangarhar provinces. The Arabs, belonging to the Al Qaeda, hailed from Syria, Egypt, Jordan, Iraq and Saudi Arabia. Official sources added, after their transfer to Haripur and Kohat, Pakistani intelligence agencies as well as the Unite States’ Federal Bureau of investigation (FBI) would interrogate them.

An additional district and sessions judge in Toba Tek Singh, on January 10, released on bail Sipah-e-Sahaba Pakistan (SSP) district President Maulana Muhammad Awais and Jamaat -Ulema-e-Islam (JuI –Fazlur Rahman faction) leader Maulana Abdul Ghafoor Rabbani. Maulana Masood Azhar, Chief of the Jaish-e-Mohammed (JeM) and Hafiz Muhammad Saeed, the former Chief of the Lashkar-e-Toiba (LeT) have been detained for three months under the provisions of the Maintenance of Public Order (MPO) Ordinance for making provocative speeches against government policies. Assistant Advocate General Amin Lone disclosed this while making a statement in Lahore before Justice Karamat Nazir Bhandari, on January 10. The order issued on December 25, 2001 seeking the arrest of Maulana Azhar was also presented to the Court. The order Maulana Azhar with instigating the general masses to rise against the government. The order declared that his speeches, presence, or other activities promote feelings of hatred and ill-will among various sects and thus constitutes a serious threat to national security and the solidarity of Pakistan.

The Lahore High Court (LHC), on January 11, upheld the three-month detention of Maulana Masood Azhar, Chief of the Jaish-e-Mohammed (JeM), and Hafiz Mohammad Saeed, ex-Chief of the Lashkar-e-Toiba (LeT). The LHC rejected a petition that contended that the detentions were illegal. Azhar has been detained since December 25, 2001 under the Maintenance of Public Order law, and since early January 2001 has been held in the Mianwali district jail, about 250 km south west of Lahore. Saeed was being detained in the Sihala rest house within a Punjab police training camp, about 40 km east of Rawalpindi.

According to media reports, the execution of a Lashkar-e-Toiba (LeT) cadre in Multan, who was convicted for killing two police personnel was postponed for a month on the direction of President Pervez Musharraf. As reported earlier, Shaukat Hayat was to be executed on January 22, today, after being sentenced to death by an anti-terrorism court in April 1996. Separately, the Multan jail superintendent was quoted as saying that the execution was postponed as the parents of one of the killed police personnel had forgiven the convict while talks were going on with the family of the other police personnel.

The State counsel said whatever Omar had stated before the court would be held against him despite the fact that he did not say anything on oath. As reported earlier, on his first production before the ATC, Omar had admitted having masterminded the abduction of Pearl. Sindh Advocate General (AG) Raja Qureshi made this statement after attending the pre-trial proceedings. The police submitted an interim charge sheet of the case and produced principal accused Omar Sheikh and his accomplice Adil Sheikh before the judge. On the AG’s request, the court allowed the police time till March 29 to file the final charge sheet and remanded both the accused to judicial custody till that date. Meanwhile, Raja Qureshi was quoted as saying that Omar cannot be extradited to the US in the near future as he has been charged with the abduction and murder of Daniel Pearl. A notification to this effect was submitted by Advocate-General of Sindh, Raja Qureshi, to the Anti-Terrorism Court before whom the police presented a final charge sheet of the case against Jaish-e-Mohammed (JeM) terrorist Omar Sheikh and three others on March 29. The police have admitted in the final charge sheet that thus far neither Pearl’s body nor the crime weapon have been recovered. The final charge sheet also shows recovery of two e-mails dated January 27 and January 30 - one in Urdu written by accused Sheikh Adil and one in English written by Omar Sheikh.

Ahmad Omar Saeed Sheikh, the prime suspect in the United States (US) journalist Daniel Pearl's abduction and murder case has pleaded innocence, according to media reports. While, defending himself on April 12, before Arshad Noor Khan, the Judge of the Anti-Terrorism Court in Karachi adjudicating the matter, he also reportedly said that he does not respect the British Laws. In which judge condemned Khalil to death and sentenced Mufti Shahid to life term for the murder of the doctor. In the third case, Talha, Khalil and Mufti Shahid were convicted for killing Syed Zafar Hussain, Director, Research & Technology Centre, ministry of defence, on July 7, 2001. The judge sentenced Talha and Khalil to death and Mufti Shahid to a life term in this case. In the fourth case, Khalil was condemned to death and Mufti was sentenced to suffer life term for killing Syed Ali Hasnain Naqvi on September 4, 2001. The fifth case against Talha, Mufti Shahid and Haider pertained to the killing of Dr. Ishrat Hussain near his clinic in North Nazimabad within the limits of Shahrah-i-Noor Jahan police. The judge awarded capital punishment to Mohammad Talha and life term to Mufti Shahid and Haider. After the judgement, the convicts reportedly raised slogans against the rival sect. However, later, they claimed before the reporters that they were innocent and judicial confessions were extracted of them under duress. They also expressed hope of 'getting justice' at appellate level.

According to the media reports, Ahmed Saeed Omar Sheikh, the prime accused in the Daniel Pearl abduction and murder case, and three other accused have pleaded not guilty before the Anti-Terrorism Court (ATC) II inside the Karachi Central Prison on April 22. The court earlier formally indicted them under the sections 356-A, 302, 109 and 120-B of the PPC (Pakistani Penal Code). They have also been charged under sections 7, 8 and 11 of the Anti-terrorism Act, which deal with creating harassment and terror in society. No one was allowed to attend the proceedings except for the three defence counsels and court staff. The court would hear a separate case relating to the other six accused who have been declared absconders.

According to media reports, the prosecution expressed lack of confidence in Abdul Ghafoor Memon, the trial judge in the Daniel Pearl murder case, on April 25 and has moved the Sindh High Court (SHC) for transferring the case to some other Anti-terrorism Court in Karachi. "The court proceedings are not being regulated in a manner that justice should not only be done but should be seen to have been done," said Advocate General (AG) of Sindh, Raja Qureshi, while advocating the cause of prosecution before an SHC division bench. The AG Sindh submitted that although the prosecution had succeeded in examining six prosecution witnesses between April 22 and 24, the prosecution side was not satisfied with the conduct of the judge during the hearing. The accused persons, according to him, had adopted threatening and intimidating behaviour.

The three terrorists, Mohammad Imran, Mohammad Hanif and Shaikh Mohammad Ahmed alias Danial were arrested on July 7. They are also accused in the June 14-US Consulate and May-8 Sheraton Hotel blasts. Imran and Hanif, according to official sources, were chief and deputy chief of the outfit, respectively. According to the remand papers, they had confessed to their involvement in the suicide bombings. They also reportedly confessed that five other accomplices had conspired to attack the consulate. They also allegedly confessed to having stuffed explosives in the same vehicle used for the US Consulate attack in an attempt to blow up President Musharraf's car near the Karachi airport on April 26.

Official sources said there was apprehension of untoward incidents on July 15, today, when the court is likely to announce its verdict. An Anti-Terrorism Court in Hyderabad, on July 15, awarded death sentence to Ahmed Omar Saeed Sheikh and life term to co-accused––Syed Salman Saqib, Fahad Naseem and Sheikh Adil––in the Daniel Pearl abduction-cum-murder case. Omar Sheikh, a front ranking terrorist of the proscribed Jaish-e-Mohammed (JeM) was prime the accused in the Pearl case. The court found Omar Sheikh guilty of committing offences under sections 7-A of the Anti-Terrorism Act, 365-A (kidnapping for ransom), 302 (murder) and section 120-A of the Pakistan Penal Code (conspiracy), after a trial inside the central prison. The judge sentenced the three co-accused to life imprisonment and a fine of Rs 500,000 each. The court also ordered that all the four accused to jointly pay an amount of Rs 2 million, which would be paid to Pearl's widow Mariane Pearl and their recently born son. The court held that Omar Sheikh was responsible for creating a sense of fear nationally and internationally and ruled that he had hatched a conspiracy and was the principal offender. He associated the co-accused with himself in order to accomplish his task of creating fear nationally and internationally. The verdict said, Daniel Pearl being a captive of the accused stood proved and the non-fulfillment of their demands has presumably resulted in the murder of Pearl at the hands of the accused.

Chief prosecutor Raja Qureshi said an appeal had been filed at the Sindh High Court on the instructions of the government "for the enhancement of punishment" of the three co-accused, Fahad Naseem, Salman Saqib and Sheikh Adil. Two terrorists belonging to the Harkat-ul-Mujahideen Al-Aalami (HuMA) confessed on July 17 before a judicial magistrate in Karachi that they were involved in a conspiracy to kill President General Pervez Musharraf on April 26. Muhammad Imran and Muhammad Hanif, chief and deputy chief of HuMA respectively, reportedly confessed that they had planned and had given clearance to their other accomplices to kill President Musharraf in a car bomb attack on April 26 when the President came to Karachi during the referendum campaign. As reported earlier, Waseem Akhter, an Inspector with the Rangers was also involved in this conspiracy. He had reportedly informed the terrorists about the programme of the passage of the President's cavalcade. According to media reports, the terrorists had packed 500-kilograms explosive with a remote control in a vehicle, which was parked on the roadside in front of Falak Naz Arcade at Sharea Faisal. Later, they came to know that their plan had failed, as the remote control device could not ignite the explosive-laden car.

Azhar had moved the bail application through his counsel stating that he had been arrested illegally. The judge reportedly said records revealed there was no law and order situation created as a result of the alleged speech delivered Azhar nor any segment of the public had been put on the alarm or fear. According to a media report, Hafiza Memona, wife of the proscribed Lashkar-e-Toiba’s (LeT) chief, Hafiz Muhammad Saeed, on November 8 filed a contempt petition against the Federal and Punjab governments in the Lahore High Court for lying to the court regarding Saeed’s custody. The petitioner has also reportedly demanded Rs 10,000 compensation for each day of his ‘illegal detention’ by the government. She also requested the court to declare his house arrest illegal. Hafiza Memona said the government’s orders to keep Saeed under house arrest were illegal and violated Articles 2-A, 4, 9, 10, 15, 25, 37 and 38 of the Constitution. According to a report in Dawn, a Pakistani daily, proscribed Jaish-e-Mohammed (JeM) chef Maulana Masood Azhar has not been released despite Lahore High Court (LHC) orders. The report quoted unnamed police officers as saying that they were yet to receive a directive from the Home department in this regard. They also said the detention period of Azhar would expire on December 17, today. As reported earlier, a review board of the LHC had, on December 14, refused to accept the government's version on extending the detention period and ordered his release. Azhar has been detained at his Kausar Colony house, which has been declared as a sub jail.

A Peshawar court on December 18 issued perpetual arrest warrants against Muttahida Quami Movement- Altaf Hussain (MQM-A) chief Altaf Hussain and six other accused in a case relating to arms smuggling. Altaf Hussain and the six had earlier been declared proclaimed offenders in the case, registered during the erstwhile government of Pakistan People's Party, on May 29, 1995, when arms and ammunition were recovered by the Crimes Investigation Department (CID) from a house in Peshawar. The government claimed then that the accused were smuggling arms to Karachi in order to use them for committing terrorist acts. The recoveries included four klashnakovs, a rocket launcher, 100 rockets, 100 hand-grenades and 800 cartridges.

The Lahore High Court (LHC), on December 24, barred the immediate extradition of three Al Qaeda suspects arrested during a raid involving US agents on December 19. LHC judge Mohammad Javed Buttar ruled that the three suspected terrorists, all possessing dual citizenship, could not be removed from the court's jurisdiction or sent abroad. The ruling added that the detainees "could not be sent abroad in any illegal manner." The three, identified as Omar Karar, Khizer Ali and Muhammad Usman, are sons and a nephew of Dr Ahmed Javed Khawaja, whose residence was raided by police and US Federal Bureau of Investigation (FBI) agents in their hunt for Al Qaeda and Taliban fugitives. Meanwhile, official sources said they believe Khawaja ran a vast "relief network" that provided treatment and financial support to terrorists around Pakistan. They added he was closely linked to the proscribed Lashkar-e-Toiba (LeT).

He was arrested earlier in December 2002 in Kathiawar Society, Karachi, along with his two accomplices. A bomb blast occurred outside the Sheraton Hotel in Karachi on May 8, 2002 killing several French nationals. During investigations, Zaheer admitted he had planted an explosive device in a vehicle that was used in the blast.
