The Supreme Court (SC) on February 24 while hearing a case related to the implementation of Supreme Court’s earlier order (in 2013) over Karachi's law and order situation expressed its dissatisfaction over a report submitted by the Karachi Police and chided jail officials for installing jammers around the Central jail premises which has caused inconvenience to residents of the surrounding areas, reported Dawn. The bench also sought a report from revenue officials by February 26, 2014 pertaining to the recovery of encroached lands in the city. During the hearing held at the Supreme Court's Karachi Registry, Additional Inspector General of Police (AIGP) Karachi, Shahid Hayat, submitted before the bench a report over the performance of Police, according to which 13,000 suspects were arrested since September, 2013. The report further said that charge-sheets against 175 accused were filed in Anti-Terrorism Courts whereas charge-sheets against more than 7,000 arrested persons had been filed in Sessions Courts.

Anti-Terrorism Court (ATC) in Shikarpur District on March 1 convicted six suspects of murdering Geo News reporter Wali Khan Babar on January 13, 2011, and handed out death sentences to two and life imprisonment to four others, reports Dawn. Faisal Mehmood, Mohammed Ali Rizvi, Mohammad Shahrukh Khan, Syed Tahir Naveed Shah were sentenced to life imprisonment. Mohammed Shakeel was acquitted. The Supreme Court of Pakistan on March 20 ordered federal authorities to appoint permanent Inspector General of Police (IGP) Sindh within 24 hours, reports Daily Times. Three-judge bench headed by Chief Justice of Pakistan Tassaduq Hussain Jilani showed grave concern over non-appointment of permanent IGP Sindh and said that they were shocked that Province had no permanent IGP since February 20, 2014. A division bench of the Sindh High Court (SHC) headed by Justice Muhammad Ali Mazhar heard the arguments of the Attorney General of Pakistan (AGP) Salman Aslam Butt on May 20 regarding maintainability of the petition, filed by General (retired) Pervez Musharraf against the restriction on his travelling out of the country with regard to jurisdiction of the SHC, reports Dawn. The AGP contested that the High Court had not territorial jurisdiction to hear the matter as Musharraf’s name was placed on the Exit Control List (ECL) on the orders of the Supreme Court. It was stated that Musharraf should approach the Supreme Court to get his name withdrawn from the ECL. Meanwhile, Musharraf’s counsel Barrister Farogh Nasim while forwarding his arguments said that order regarding placing his client’s name on the ECL was against ‘principles of natural justice’ as no show-cause notice, as required by the law, was issued to his client. He said that earlier on April 8, 2013, the Supreme Court had issued directions to the Federal Government for placing the name of petitioner on ECL but later, final order of the apex court did not maintain the condition of ECL. Barrister Farogh was of the view that the trial court was competent to impose any restriction on movement of the petitioner if it considered necessary. Since the court had not barred the petitioner from traveling out of the country, any restriction by the Government on his movement was “sheer violation of the fundamental rights,” he added.

Former President General (retired) Pervez Musharraf on September 30 approached the Supreme Court to adjourn the appeal filed against the Sindh High Court’s (SHC) decision to remove his name from the Exit Control List (ECL), reports The Express Tribune. A five-judge bench of the apex court headed by Chief Justice Nasirul Mulk is taking up the Government’s appeal on October 1, 2014 (today). The legal team has submitted a single-page application to the court requesting adjournment of the case as Musharraf’s lawyer, Farogh Naseem, is busy appearing before a Special Court in the treason case. “The matter before the trial court requires detailed preparation and in order to effectually assist this Honourable Court in the instant matter, more time is required by respondent No.1’s [Musharraf’s] Advocate Supreme Court for preparation and research,” said Naseem. Further, the application said that there is no cavil with the proposition that the Court is to be given precedence, however, in view of the peculiar circumstances; the prayer for adjournment has been made in the interest of justice.

The six prisoners on death row in terrorism cases are militants belonging to Lashkar-e-Jhangvi (LeJ), Ataullah alias Qasim and Mohammad Azam alias Shareef; Bahram Khan, Shafqat Hussain, Jalal Morejo and Abdul Razzaq Chauhan who had been convicted of assault and murder, according to Inspector General (IG) for prisons Nusrat Mangan. In all, the IG prisons said, there were 457 inmates on death row across Sindh.

An Anti-Terrorism Court (ATC) on December 19 issued black warrants for two Lashkar-e-Jhangvi (LeJ) militants, identified as Attaullah alias Qasim and Mohammad Azam alias Sharif, who had been given death sentence by an ATC in July 2004 for killing Dr Ali Raza Peerani on sectarian grounds in June 2001 in the Soldier Bazaar area of Jamshed Town in Karachi, provincial capital of Sindh, reports Dawn. The court directed the jail authorities at the Sukkur central prison to carry out the hanging of Attaullah and Azam on December 23, 2014, at 6:30 in the morning till death. The jail authorities in Karachi requested another ATC-III to issue fresh black warrants for two condemned prisoners, Behram Khan and Shafqat Hussain, in separate cases. The court had issued black warrants for both the convicts but their hanging was deferred by the Presidency. Behram was sentenced to death for murder, while Sub-Inspector (SI) Pir Bux was awarded life imprisonment for abetting the killing in 2003. Behram along with SI Pir Bux killed lawyer Ashraf inside the courtroom of the courtroom of Justice Zawar Hussain Jaffery in the Sindh High Court in a case of mistaken identity, while Shafqat was found guilty of kidnapping-for-ransom case in which he killed a boy named Umair (7) in New Karachi Town area in 2004.

The Lahore High Court (LHC) and the Sindh High Court (SHC) on December 22 suspended implementation of death penalty of seven prisoners by a military court, reports Daily Times. As per media reports, Justice Arshid Tabassum of LHC’s Rawalpindi bench took up miscellaneous petitions for hearing in respect of death convicts. Laiq Khan Swati, counsel for Adiala jail prisoners on death row including Ahsan Azim, Asif Idrees, Omar Nadim, Kamran Aslam and Aamir Yusuf took up the plea during the course of hearing of petitions that military court cannot court-martial civilians, and despite this his clients were convicted and sentenced by military court against the law of land. He said neither they were given the right to hire services of any lawyer nor were they provided any judicial document during the currency of this case. The court heard the stance of the petitioner, sought the details of all the prisoners on death row and summoned reply from Federal and Provincial Governments till January 12, 2015. The court has suspended execution of these five death convicts till the next hearing of this case. The Sindh High Court suspended the black warrants of two inmates citing that the proper legal procedure was not followed. The suspension of the warrants came after the SHC heard appeals filed by the families of these inmates.

The petitioner, Muhammad Idrees submitted that his son Abdul Basit (34), was picked up from Babar Market in Landhi Town on June 26, 2014, by unknown persons and since then there was no information about his whereabouts. He requested the court to direct the authorities to recover his son. The Rangers' official filed its comments, stating that they had neither arrested Basit nor kept him in detention. Another petitioner Muhammad Yousuf stated that his son Muhammad Umair (29), was picked up from Landhi Town on June 25, 2014. Since then his whereabouts were still unknown. He added that he had approached the officers of the Law Enforcement Agencies to trace his son but they had failed to locate him.
