The National Human Rights Commission (NHRC) unveiling a 11-point recommendation concerning transitional justice on February 5 asked the Government to come up with a law criminalizing conflict-era torture and enforced disappearance so as to prevent a situation of conflict-era victims seeking justice through international institutions, reports Republica. NHRC Chairman Anup Raj Sharma urged all the authorities concerned including the Government to amend the Enforced Disappearances Enquiry, Truth and Reconciliation Commission Act taking into consideration the Supreme Court's ruling to criminalize torture and disappearance and remove the statute of limitations for registering conflict-era cases and also international human rights law. “If the laws are not amended to ensure justice within the country, the conflict-era victims will be forced to seek justice from beyond the borders. It won't do any good to the country. So, we ask the government to heed our suggestions and move forward in an appropriate way for ensuring transitional justice,” he said.

CPN-Maoist Centre Chairman Pushpa Kamal Dahal on February 8 held talks with CPN-UML Chairman KP Sharma Oli and urged him to settle issues related to unification of the two parties before forming the new Government, reports The Himalayan Times. A left alliance source said the CPN-Maoist Centre was focusing on unification before the formation of a new Government mainly because it believed that unification would be easier if it happened before the formation of a new government. “Once a new government is formed, unification might get complicated,” the source added.

The EC on February 8 said it would submit the final election result to President Bidhya Devi Bhandari by February 14, reports The Himalayan Times. Election Commissioner Narendra Dahal told that the poll panel would announce parliamentary proportional representation election result on February 9 and write formal letters to political parties to recommend names of winners within three days from the closed list they had submitted prior to the election. As per the constitution, the EC has to submit result of the election of the parliamentary election within a week of announcing the final result.

The House of Representatives (HoR) finally took a complete shape after the Election Commission (EC) on February 14 announced winners of the elections under the proportional representation (PR) category, reports Kathmandu Post. The EC also submitted a report of the final Lower House elections results both under the first-past-the-post (FPTP) and PR categories to the President. While 110 members were elected under the PR category, 165 under the FPTP system, giving the final shape to the 275-member strong Lower House and paving the way for Government formation. As per the constitution, the HoR is responsible for electing the Prime Minister.

A meeting of Prime Minister KP Sharma Oli and CPN-Maoist Centre Chairman Pushpa Kamal Dahal at Baluwatar also finalised a list of Ministries and allocated them between the two parties. Maoist leaders said an extended meeting of the party headquarters decided to continue strengthening the party committees to operate them in a systematic way. Party committees of both the CPN-Maoist Center and Communist Party of Nepal-Unified Marxist-Leninist (CPN-UML) are not functioning well due to the ongoing preparations for the party unification. On April 24, the debate between the CPN-UML and CPN-Maoist Centre cadres over the banner at the unity parade to mark 69th establishment day of communist party in Nepal brought to the fore the deep differences between the two parties. Government on June 12 asked the United Nations Department of Political Affairs (UNDPA) for its drawdown plan, reports Kathmandu Post. The request was made in a meeting between Joint Secretary at the Ministry of Foreign Affairs (MoFA) Bharat Raj Poudyal, head of the Ministry’s UN Division, and Cathering Sung, head of the UNDPA-Kathmandu. In his meeting with Sung, Poudyal also made references to “smooth transition” of two previous UN Missions in Nepal- United Nations Mission in Nepal (UNMIN) and Office of the High Commissioner for Human Rights (OHCHR)-and hoped that the UNDPA will follow suit. For its part, the UNDPA-Kathmandu has communicated to the Government of Nepal that it is committed to a timely withdrawal and is currently waiting for instructions from its headquarters in New York to plan exit. The Government’s decision follows its stated position that Nepal’s political transition that started in 2006 has come to an end with the successful conclusion of elections to three tiers of Government-local, provincial and federal-as envisaged in the new federal constitution.

CVCP Chairperson Bhagi Ram Chaudhary said the punishment recommended is unacceptable since it is just ‘symbolic’. He said “Though the draft lacks word amnesty, the proposed provisions ultimately are guided towards providing the amnesty. We want full revision in the draft after meaningful consultations with the victims.” Similarly, ICTJ Reparative Justice Programme Director Ruben Carranza said the draft has many conflicting and ambiguous provisions that need corrections. Minister for Law, Justice and Parliamentary Affairs Sher Bahadur Tamang tabled the bill at the National Assembly after the Cabinet earlier in the day decided to replace the ordinance, which expires on July 7. An ordinance issued in the absence of Parliament, must be replaced by a bill within 60 days of the commencement of the Parliament session. The new bill to amend the transitional justice-related acts was formulated in the presence of the law minister, attorney general, former attorney generals and leaders of major parties, has stressed the need for reconciliation rather than prosecuting the perpetrators. It has proposed withdrawing cases now being investigated by the courts and bringing them under the transitional justice mechanisms.

Softening his previous stance against Constitution amendment, Prime Minister KP Oli speaking at the National Assembly on July 9 said that the Constitution can be amended if it has affected people in the country adversely, reports Republica. “If the constitution has affected the people adversely, for whose sake should we be taking a stance against its amendment? The constitution can be amended for the sake of the people and the development of the country,” he said. Oli changed his tune after the major political force in Madhes which was demanding constitutional amendment before joining the Government helped Oli’s Nepal Communist Party (NCP) garner a two-thirds majority in Parliament. A two-thirds majority would enable it to amend the charter.

Nepal Communist Party (NCP) at a secretariat meeting of the party held at the Prime Minister’s residence in Baluwatar, Kathmandu, on July 11 endorsed the regulations of the party, reports Republica. A task force comprising leaders Bamdev Gautam, Ram Bahadur Thapa and Bishnu Poudel who prepared the final draft of the regulations based on the feedback given by the Standing Committee meeting, had submitted its report to the party leadership. The NCP was formed following the unification between the then Communist Party of Nepal-Unified Marxist-Leninist (CPN-UML) and the Communist Party of Nepal-Maoist Centre (CPN-Maoist Center) on May 17. It may be noted here that the NCP had announced that it will complete the merger of the two parties' provincial committees, the district committees, Nepali migrants' organizations abroad and the people's class organizations within three months of the party unification.

Some of the UN specialized agencies that are there in the governance of international public goods and cross-border regulation of communications and air transportation has been partner in their respective fields ever since we became the member of these agencies.” Gyawali reiterated that Nepal’s commitment to the protection and promotion of human rights is total and unflinching. True to our commitment, we have regularly submitted our periodic reports to the treaty bodies and faithfully implemented the outcomes after the consideration of the reports.
