Speaking at a programme in Kathmnadu, Prachanda said, "The reports appearing in the media that our party has decided to take disciplinary action against Bhattarai are false. We have not taken any decision on this regard yet." There are some issues related to Bhattarai's dissatisfaction in the party, but such issues are always common in any left-wing and the UCPN-M is not an exception to this, he explained.

Chief of foreign department of Unified Communist Party of Nepal-Maoist (UCPN-M) Krishna Bahadur Mahara on January 3 talked about the possibility of country facing a "constitutional crisis" following the departure of the United Nations Mission in Nepal (UNMIN) before the completion of its mandate, reports Nepal News. He said this was so because the UN political mission has become an integral part of the interim constitution. Speaking at a programme organised by Maoist aligned Revolutionary Journalist Association in Dhorahi of Dang, he said "The exit of UNMIN without the completion of the army integration task and successful conclusion of the peace process will leave a void that can possibly create a constitutional crisis in the country."

The chairman of the Unified Communist Party of Nepal-Maoist (UCPN-M) Pushpa Kamal Dahal alias Prachanda said on January 10 that his party is prepared to hand over the command control of cantonments to the Prime Minister-led Special Committee overseeing the Maoist combatants before United Nations Mission in Nepal (UNMIN) scheduled departure on January 15, reports Kantipuronline. He outlined three steps that would ensure a smooth transition before UNMIN wraps up. The steps include organising a special ceremony to formally mark the transfer of the chain of command to the Special Committee, the regrouping of combatants into two different categories (those opting for integration and those opting for rehabilitation), and finalising the norms and modalities for integration. Prachanda said he wanted to send a message to the Nepalese and the international community that the Maoists are committed to the peace process.

A top parliamentary panel in Nepal on January 25 approved key changes in the rules for electing a Prime Minister (PM) that would make it mandatory to vote for a new leader in the House poll, amid a deadlock that has left the country without a Government for nearly seven months, Times of India reports. The five-member parliamentary committee headed by Ek Raj Bhandari recommended making it mandatory to vote in a multi-cornered Prime Ministerial poll in the House. Under the recommendations, lawmakers will not be allowed to abstain, attendance will be mandatory, and the Parliamentary speaker will be able to disqualify candidates after three failed rounds of voting. It has proposed termination of the election process if the House fails to elect a PM in the third round of polls. "We have proposed drastic changes to the laws in practice for electing a prime minister. The new provision suggests compulsory voting in favour of one candidate if there are more than one candidates," said Bhandari.

Party leaders said on May 12 they are ready to demonstrate ‘further flexibility’ on the integration and rehabilitation issue to justify the extension of the Constituent Assembly (CA) tenure. Different parties are likely to agree on integrating 8-10,000 combatants, according to an unnamed Maoist leader. Parties are close to deal on the mixed force. The Maoists have demanded that the PLA should be given the leadership of the mixed force. “We will settle the outstanding issues related to integration before the expiry of the current Constituent Assembly term,” said Maoist Standing Committee member Barsha Man Pun, adding, “We are ready to demonstrate flexibility to forge a new agreement.” Pun said they will settle the norms issue soon in consultation with other parties. Fixation of the norms of integration and rank harmonisation are the contentious issues in the integration process. The Special Committee for the Supervision, Integration and Rehabilitation of Maoist combatants is discussing four different integration modalities, including the formation of a separate force for the PLA and a mixed force comprising the PLA and personnel from the existing security forces.

The Secretary General's report on Children and Armed Conflict presented before the UN Security Council on April 23 has included Maoist in the list of 52 armed forces from Asian and African countries that recruit or use children, kill or maim children or commit sexual violence against children during the armed conflict. This is the sixth annual report that has put the Maoists on a watch list for using minors. The Maoists discharged of 2,973 minors from the cantonments in 2010. The discharge process was carried out as per the tripartite action plan that was signed between the Maoists, the Government of Nepal and the UN in December 2009. 2,394 individuals including 1,843 minors were released from the seven main cantonment sites during the formal ceremonies organised between January 7- February 8, 2010 and the "no-shows" were discharged through the sign off process involving the Maoist leadership a month later. The Maoists, however, insist that they have cut links with the "child soldiers" and that the UN has failed to adequately document the discharge of 4,008 disqualified combatants that included minors. "We handed over the disqualified combatants to the UN and suggested them to accept the rehabilitation packages after signing the action plan. They have cut off the links with the PLA," said Maoist Standing Committee member Barsha Man Pun, adding, "The UN's conclusion has deprived us of justice. We will raise our reservations regarding this issue during the upcoming visits of the senior UN officials."

According to the account of the local people, the Maoists had entered the village at around 11pm and launched the attack in seven houses. The Maoists also ‘captured’ five local youths -- Chabbi Subba, Gyanu Limbu, Birhang Limbu, Dipendra Tumbahamphe and Bishal Sunuwar -- and took them to the camp. They were freed 16 hours after they were captured in the afternoon of May 17. Two others, who had gone missing after the incident, came in contact in the morning. The PLA first division owned up the attack but refuted the local people's claim of abducting the five youths. “They were not kidnapped. They were brought to the camp for treatment, as they were injured in the incident,” said Sangram Thapa, ‘secretary’ of the PLA first division camp. Police also said five youths had sustained minor injuries. It is learned that the attack was instigated as an act of revenge, as six PLA combatants were injured in a clash with the local people of Kali Jhoda recently. Meanwhile, the Nepali Congress (NC) claimed that the people attacked and ‘captured’ by the PLA combatants were the cadres of the party.

The Ministry of Home Affairs is working in full swing to withdraw registered criminal cases against Unified Communist Party of Nepal-Maoist (UCPN-M) cadres charged with various offences — including serious charges dating back to the period of insurgency, reports Kantipuronline. According to some senior Home Ministry officials, since taking charge of the Home Ministry, Krishna Bahadur Mahara has been asking them to expedite compilation of a list of cases registered against Maoist cadres from courts across the country. “The number of cases registered against the Maoists could surpass 300, according to our preliminary findings. Most of these cases were registered during the insurgency. We have been asked to find the status of the cases pending in various courts,” an official said. This is not the first time that the Maoist leadership has tried to get their party workers off the book. In October 2008, the Maoist-led Government withdrew 349 criminal cases against its cadres, according to official records. In February 2011, the Attorney General Yub Raj Sangraula went on record saying he would oppose any request from the Government for the withdrawal of court cases.

We are inclined to accept the modality suggested by Nepal Army with some changes,” said an unnamed Maoist leader, adding, that the upcoming standing committee of the party would finalise a proposal. Earlier, saying the issues of integration and rehabilitation of former Maoist combatants should be addressed politically, the UCPN-M, in its proposal sent to the government and the main opposition Nepali Congress (NC), has sought simultaneous development of national security policy, and restructuring plus esoteric “democratisation” of the security bodies along with the task of integration, adds Himalayan Times. In the eight-point proposal, the Maoists stressed on founding a separate structure for their People’s Liberation Army (PLA). “But taking into account the concerns of all sides a unified new force can also be formed,” it said, pointing out border security and natural disaster management as the dominion of the force-to-be-set-up with a PLA dominance. The proposal has envisioned the PLA leadership of the force that will be formed by incorporating 10,000 former fighters and the same number of personnel combinedly from the existing three forces— Nepal Army, Nepal Police and Armed Police Force. For rehabilitation, the proposal has talked about providing a fat purse to the combatants if they choose not to be the part of army integration but prefer joining politics or social sector-- NR 7 lakh up to the post of ‘platoon commander’ and NR10 lakh above it -- under the scheme of “golden handshake.” The handicapped and injured PLA men will also be entitled to the scheme. The 10-point 'proposal' prepared by a panel headed by Sher Bahadur Deuba include deployment of an all-party committee to monitor the cantonment sites of the Maoist combatants; integration of the combatants on individual basis as per the standard norms of the security agencies; integration of maximum of 4000 combatants; immediate return of the properties seized by the Maoists during the insurgency and scrapping of the dual security to Maoist leaders. The CWC concluded that the CA's term cannot be extended unless there is concrete progress in the peace process. Mahara said withdrawal of such cases will not breach the Comprehensive Peace Accord. "However, political consensus is a must for the withdrawal of such cases," Mahara conceded. There are more than 300 cases filed throughout the nation against the Maoists cadres. Asked whether the government would drop the case against Maoists lawmaker Balkrisha Dhungel, Mahara said Government will withdraw only politically motivated cases. Dhungel has been implicated in a murder of one Ujjwal Prasad Shrestha in Okhaldunga District seven years ago during the insurgency. The Supreme Court (SC) had slapped a life sentence on Dhungel, in addition to seizure of his property in September 2010. Minister Mahara said there are several cases, many of them politically prejudiced, against UCPN-M leaders and cadres filed during the conflict, adds Nepal News. “I am the Home Minister, but there are cases even against me,” he noted. Defence Minister Bishnu Poudel claimed on June 11 that integration of PLA fighters would take place strictly adhering to the Nepal Army’s (NA) integration criteria, Himalayan Times reports. Poudel said since Unified Communist party of Nepal-Maoist (UCPN-M) have in principle agreed to the NA integration proposal, Army integration would be carried out as per NA’s established criteria. “Maoists have lost moral grounds to dispute over criteria and ranks as they have already agreed to accept NA’s chain of command,” Poudel said. He however said a certain level of flexibility could be considered regarding combatants’ age, marital status, academic qualification and trainings while integrating them in the National Army. Ruling out any prospect of integration of Maoist combatants in bulk, Minister Poudel said, “Bulk integration and setting up a separate unit of the combatants is not possible.” Army integration will take place only by maintaining professionalism in the NA, he added. He also said there is no logic in the argument that the combatants would not hand over their weapons before the new constitution is drafted and called on Maoists to submit their arms to the state before August 31. Even before the expiry of the August 31 deadline for drafting of the new constitution, CPN-UML leader K.P Oli said that the term of the Constituent Assembly, which is mandated to promulgate the new constitution, will be extended once again. He said the CA's term will have to be extended as there was no possibility of the parties coming up with even a preliminary draft of the constitution by that time. Oli said that a majority Government will come into being if the efforts to form a consensus Government fails. Oli stressed on the need for the formation of a national consensus Government to ensure timely constitution and to make significant progress in the peace process.

Unified Communist Party of Nepal – Maoist (UCPN-M) Standing Committee member Barsha Man Pun on August 18 said that his party will lead the much anticipated national consensus Government as the political parties are close to reaching an agreement on important issues concerning the ongoing peace process including regrouping of the Maoist combatants – separating those to be integrated and rehabilitated, reports Nepal News. He further said that the next Government to be formed under the leadership of party vice chairman Baburam Bhattarai will ensure timely constitution and take the ongoing peace process to a successful conclusion. Pun, who is also the member of the Army Integration Special Committee, said that his party is ready to finish regrouping of PLA combatants without prior agreement on rank determination and norms. He said the party reversed the earlier stance that all issues be settled before going for regrouping to create an atmosphere of trust among political parties.
