He said, "The CA has gone to the hands of pro-western and pro-status-quo parties. I urge the UCPN-M to stop wrangling for CA posts and join us." Similarly, speaking at a public program, CPN-M general secretary, Dev Gurung claimed that there is no possibility of enacting pro-people constitution through the CA. "There is still time to forge national consensus through a round table conference. For this, larger parties have to take the initiatives," he said.

Two senior leaders of the UCPN-M on January 1 lodged a written complaint against party Chairman Pushpa Kamal Dahal aka Prachanda, asking him to amend the list of PR candidates, reports The Himalayan Times. Former vice-chairmen duo Baburam Bhattarai and Narayankaji Shrestha have been objecting to the PR list that the party submitted to the Election Commission (EC) on December 30. Shrestha said they lodged ‘a disagreement and protest letter’, mentioning that party Chairman Dahal and his team finalised the PR list violating the criteria set by the recently held central committee meeting. The letter has outlined why they are objecting to the PR list approved by Dahal and his team. Bhattarai and Shrestha have also alleged that the party leadership ignored the dissident voices and that their suggestions were ignored when the PR list was being prepared.

The United Nations High Commissioner for Human Rights (UNHCHR) Navi Pillay issuing a statement from the UNHCHR headquarters in Geneva on January 3 welcomed the decision taken by the Supreme Court (SC) on January 2 against blanket amnesties for crimes committed during the 10-year conflict, reports Nepal News. Pillay said “This is a significant development for the thousands of victims of the conflict. The Supreme Court’s decision to block amnesties is the first step towards ensuring that the Truth and Reconciliation Commission (TRC) will not be used to avoid or delay criminal investigations and prosecutions of conflict-related cases. I now call on the Government of Nepal to urgently implement this important decision, in the spirit of working towards genuine and lasting peace, and to respect the demand of the Nepalese people for justice.”

He said the President would call the CA meeting after the recommendation of the HLPC. "The Government despite accomplishing major responsibility of holding CA election, it can't create dispute at the last moment," he said, reminding that the first meeting of the last CA was called by then Prime Minister Girija Prasad Koirala who was also the head of the State at that time. The SC on January 5 issued an order, in which it has instructed the concerned Government authorities to arrange people’s right to ‘no vote’ implying that people can cast ‘negative vote’ during election, reports Nepal News. A division bench of justices Kalyan Shrestha and Prakash Wasti delivered the order responding to a writ petition filed by Bikash Khadka on behalf of Campaign against Crime and Terrorism. As per the apex court order, citizens will have the choice to negatively mark any candidate during election and stamp him/her as ‘unwanted’. Negative voting will not allow the particular candidate to get elected. This provision is expected to reduce crime, corruption and terrorism in politics, as the voters can say ‘no’ to those whom they do not like to see as their representatives.

During the meeting, Home Minister Ghimire urged Koirala to form a new Government at the earliest and begin preparation for the same. Yadav said his party would give priorities to the constitution writing by staying in the opposition. The Comprehensive Peace Agreement had envisaged the commissions within six months of its signing in 2006. After two earlier attempts by the Unified Communist Party of Nepal-Maoist (UCPN-M)-led government, the present coalition of the Nepali Congress (NC) and the Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) finally drafted the bill that was passed by a majority in Parliament. The bill has now become an Act, but the provisions of amnesty and reconciliation remain controversial. While the government is adamant on reconciliation, victims’ groups object to amnesty for perpetrators of grave human rights violation. “If we look at the bill from the rights perspective, there might be room for reform, but it’s up to the government,” said President’s legal advisor Surya Dhungel.

Party chairman Pushpa Kamal Dahal aka Prachanda informed the party Central Committee (CC) meeting that party leaders decided to hold election after efforts to settle the leadership row at the CC meeting failed to make any headway. “We have decided to hold vote for the vital posts as several leaders are contending for the same posts. Party chairman informed the CC meeting that the election to these vital posts would be held on Saturday (May 24),” party leader Lokendra Bista said. The party has not yet finalized the number of office bearers. Party statute will be endorsed by the CC meeting prior to holding the election. Leaders are divided over the size of the office bearers´ body. Election will be held for a 17-member standing committee and 51-member politburo.

Two reports on state restructuring prepared by the Committee to Study and Determine Constitutional Records and the High-level State Restructuring Commission provide agenda for discussion among the CA members. The committee is entrusted to prepare reports on the basis of the progress made by the previous CA while the commission was an experts' panel formed in 2011 to suggest ways to federate the country. Submitting both the documents to the CA, Committee Chairperson Bishnu Poudel requested Assembly members to provide their suggestions and comments on federalism. There are several disputed issues related to federalism such as the number, name and demarcation of provinces which led to the dissolution of the first CA without delivering a constitution. Prachanda said that these contentious issues in constitution-making should be settled through consensus among the political forces and the new statute should be produced mainly on the basis of the historic 12-point agreement signed between the then Seven-Party Alliance and the erstwhile Communist Party Nepal-Maoist (CPN-Maoist), the Comprehensive Peace Agreement-2006 and the Interim Constitution-2007. "If the spirit of these historic political accords, including the 12-point agreement, the CPA and the Interim Constitution, is trampled upon and the contentious issues decided through voting on the ground that this is mandated by CA procedures, it will be a biggest blunder for the country," Prachanda said while addressing the CA meeting on May 29. Prachanda said that the NC and Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) leaders started insisting on deciding the major disputes through voting only after they emerged as the two largest parties through the second CA election. "I had proposed in the previous CA to decide such disputes through voting. But at the time it was rejected, arguing that there would be blood on the floor if this was done," said Prachanda. "But now the leaders of the same parties have been pushing for voting. Such an approach will push the country into crisis."

A source privy to the development said that all parties seem ready to make compromise, mainly on forms of governance and federalism. According to a leader, Unified Communist Party of Nepal-Maoist (UCPN-M) leaders have hinted that they could accept an eight-province model of federalism from their current position of 10 if the ruling parties agree to address the issue of ethnicity-based federalism. Chand also announced to organise first national convention of the new party from January 7-10, 2015. The new party includes former leaders of Communist Party of Nepal-Maoist (CPN-Maoist), including Khadga Bahadur Bishwokarma, Ishwari Dahal, Dharmendra Banstola, Tilak Pariyar and Santosh Budha. Further, Chand said the party has no plans to launch an armed revolt, adds Myrepublica. Chand, however, clarified that his party is ready to retaliate if the government tries to suppress their struggle. “We are ready to wage war, sit for talks or even shake hands to institutionalize the achievements of the decade long people´s war,” Chand said. Speaking at a debate organized by the Federation of the Nepalese Chamber of Commerce and Industry (FNCCI) in Kathmandu on December 22, the opposition parties even warned that failure to promulgate new statute through consensus will invite fresh conflict in Nepal. “We are ready to move ahead with consensus to bring new statute. But how long should we wait as our efforts in the Constitutional Political Dialogue and Consensus Committee (CPDCC) have so far failed to yield any result?” asked Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) Vice Chairman Bhim Rawal. Rawal argued it would be tantamount to undermining the mandate given to the CA by the Nepali people if this CA also failed to produce a new constitution under the pretext of consensus. Nepali Congress (NC) Vice President Ram Chandra Paudel alleged that opposition parties were interpreting consensus to suit their own interests. “Opposition parties have to either be flexible to reach consensus or they should agree on a process [to promulgate new statute]. It is not good to block both consensus and voting processes in the CA,” he said. Paudel said although the Unified Communist Party of Nepal-Maoist (UCPN-M) leaders walked out of the meeting on December 20, the ruling parties will continue negotiations with the opposition parties as last-ditch efforts to bring the new statute in consensus. “We are committed to addressing concerns of all groups. Let´s resolve the dispute related to constitutional issues in a practical manner,” Paudel said.

On December 26, Prime Minister (PM) Sushil Koirala said even seven Pradeshes will be more than necessary for a small country like Nepal, reports The Himalayan Times. Inaugurating the 41st general convention of Nepal Jaycees in Banepa of Kavre, Koirala said Nepal cannot afford as many as seven Pradeshes once it adopts the federal structure. "Top political leaders are holding a discussion to reduce the number of Pradeshes," Koirala said. The Prime Minister was of the view that more Pradeshes increase expenses of the state. While the national Parliament meeting hall has been rented, it will be ridiculous to federate the nation with more Pradeshes, Koirala argued. PM Koirala also reiterated that the new constitution will be issued by January 22, 2015. The nation will metamorphose within a decade after the constitution, Koirala added.
