Nepal News reports that opposition parties NC and CPN-UML said they will continue with their protest programs including planned boycott of House session until the Government scraps its recent decision to legalize land and property transactions carried out by parallel governments (called “people’s government”) run by the UCPN-M party during the decade-long insurgency. A meeting of the second and third largest party in the Constituent Assembly (CA) concluded that the decision was against the interim constitution, Comprehensive Peace Accord (CPA) including the law of the land and urged the Government not to enforce it. A meeting of the Constitutional Committee (CC) failed to arrive at any agreement with UCPN-M faction remaining adamant on incorporating a provision for mandatory military training to citizens above 18 years in the new constitution, reports Himalayan Times. The meeting was supposed to endorse the sub-committee’s decisions that a Nepali citizen above 18 years of age would not require to undergo compulsory military training as the state can call upon its citizens to serve the nation as and when required; nothing needs to be mentioned about rehabilitation, management and integration of Maoist combatants in the new constitution; law with retrospective effect will be enacted in the new constitution; law will be enacted to fix ceiling on land holding and the country shall pursue a system of federal democratic republic. The United Kingdom has agreed to provide NPR 2.5 billion (20 million Pound Sterling) to Nepal Peace Trust Fund (NPTF) to support the ongoing peace process, reports Nepal News. Andrew Mitchell, the International Development Secretary of the UK pledged such assistance during the meeting with Prime Minister Baburam Bhattarai at Dhulikhel in Kavre Kistrict on January 18.

A farewell programme for former Unified Communist Party of Nepal-Maoist (UCPN- Maoist) combatants opting for voluntary retirement is all set to begin amid the protracted stalemate in the peace process and constitution-drafting processes, reports Kantipuronline. The departure of 7,365 combatants choosing voluntary retirement could start next week, according to Government and Maoist sources. “There is no dispute in our party in releasing the combatants opting for retirement,” UCPN-M Politburo member, Janardan Sharma said. The November-1 deal commits for integrating a maximum of 6,500 combatants by forming a new directorate in the NA. Commanders of the Maoist army have demanded that they be provided one major general, two brigadier general, eight colonel, 16 lieutenant colonel, 64 major, 120 captain, 96 lieutenant and 120 second lieutenant posts in the new directorate.

Kantipuronline reports that the Government on January 27 registered an appeal against the Supreme Court (SC) administration’s refusal to review its earlier decision of November 25 that put a final six-month cap on the extension of the Constituent Assembly (CA) tenure. The application filed by Prime Minister Baburam Bhattarai has cited three major precedents which show that the court can review even final decisions of its full bench. Bhattarai has also warned that the court’s refusal to review its ‘intrusive’ decision would jeopardise the balance of power among the judiciary, executive and the parliament and, thus, create disharmony. The apex court had on December 27 refused to register review applications filed separately by the Government and the Parliament, arguing that “the final verdict given by the full bench” cannot be reviewed. The Government has also argued that as per Article 107 (4) of the Interim Constitution, the apex court can review its own order or a final order, provided that it is heard by a different group of judges than those that issued the order. The constitution drafting process has run into serious crisis yet again as Constitutional Committee (CC) of the Constituent Assembly (CA) failed to resolve the major contentious issues even as the latest deadline given to the CC is expiring on January 29, reports Republica. Worse, the leaders closely involved in the constitution writing process say they see no solution in sight. As per the latest calendar of events of the CA, the CC was supposed to resolve all the remaining disputes by January 4 but the timeline was later extended to January 29 after leaders at the CC sought more time. But the last three weeks were wasted as not a single thorny issue was resolved. Signs of a major rift in the State Restructuring Commission (SRC) have surfaced, with two main opposition parties warning that they will not accept a report of the SRC due next week reports Kantipuronline. The parties have accused the ruling parties of ignoring their members in the commission in the decision-making process. Nepali Congress (NC) and Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) leaders issued the warning on January 27 after some of their representatives in the SRC complained that the members representing the Maoist and the Madheshi parties were taking decisions “unilaterally”, SRC Chairman Madan Pariyar, a CPN-UML nominee, was being “lenient” towards the Maoist-Madheshi faction and that the dissenting members were not being invited to regular meetings.

Members of the Public Accounts Committee (PAC) of Parliament have demanded details of the fund released by the Government for the Unified Communist party of Nepal-Maoist (UCPN- M) combatants who were not found in the cantonments during the regrouping process. In the PAC meeting held on March 4, they demanded details of the amount that the government released by creating fake names. The Government has already released the amount for 2,449 combatants who were found to have left the cantonments. A total of 16,996 combatants were categorised in the regrouping as per to their choices for three options-- integration, voluntary retirement and rehabilitation package. This number contradicts with the report of the then United Nations Mission in Nepal (UNMIN). The UNMIN had registered 19,600 combatants in the second verification.

Two satellite camps under the People’s Liberation Army (PLA) sixth division in Dasarathpur, Surkhet District have been vacated on March 9. The combatants at Gumi-based satellite camp of the Pili Smriti Brigade were merged to the Lekhafarsa-based satellite camp of the Ghorahi Satbariya Smriti Brigade, while the Jit Smriti Brigade that was based at Kholtepani satellite camp has been incorporated into the main camp at Dashrathpur. Out of 3,134 combatants under the sixth division, 1,559 had opted for integration. Similarly, the satellite camp based in Sahajpur under the PLA seventh division in Kailali District has been vacated on March 10. The Himalayan Times reports that the Constituent Assembly is set to hold discussions on controversial reports of the Government-formed State Restructuring Commission (SRC) on federalism on March 26. The Madan Pariyar led nine-member SRC had submitted two separate reports to Prime Minister Baburam Bhattarai on January 31, and both the reports had run into controversy. According to CA Chairman, Subas Nembang, he would table the SRC reports before the CA full House and discussion would begin on March 26. He said he would also consult members of the CA thematic Committee on State Restructuring and Distribution of State Power, which had proposed carving out 14 federal units on March 23. The Constitutional Committee and its Problem Resolution Sub-Committee will also hold separate meetings on March 23 to discuss the constitutional issues, including the forms of governance, federalism, election system, judiciary and citizenship.

The Himalayan Times reports that seven teams of surveyors from the Army Integration Special Committee (AISC) fanned out to PLA cantonments to categories remaining Unified Communist Party of Nepal-Maoist (UCPN-M) combatants and send them home or the Nepal Army for integration. “Secretariat’s teams of surveyors today left for all seven main PLA cantonments. Some have already reached the camps while others are on their way,” said Deepak Prakash Bhatta, a member of the Secretariat who is leading the survey team to the PLA’s sixth division based in Surkhet. As per the Special Committee’s direction, all teams commence the re-categorisation work April 8. The teams are mandated to reduce the figure of the ex-fighters opting for integration down to 6,500 and send others home with perks and benefits on a par with what fellow combatants who opted for voluntary retirement received in January.

In what is being considered a major development in Nepal's peace process, the Nepal Army (NA) has taken control of the Maoist People's Liberation Army (PLA) cantonments, combatants and the weapons stored in containers inside the camps, reports The Hindu. This is in line with a decision taken by the Army Integration Special Committee (AISC) on April 10. NA will now be responsible for the Security of the 15 remaining Maoist cantonments, including its infrastructure. Around 9,700 combatants who have opted for integration remain in these cantonments, and there are over 3,000 weapons in the containers. A little more than 7,000 former fighters who voluntarily retired with cash packages left the camps in mid February, while 12 satellite camps were shut down in March.

Of the 9,705 combatants who opted for integration during regrouping in November 2011, 4,052 combatants from all the seven PLA division camps chose voluntary retirement as of April 15. Nepal News reports that the second round of regrouping work conducted by the Army Integration Special Committee (AISC) has concluded in all the People's Liberation Army (PLA) cantonments on April 19 with only 3,129 former Unified Communist Party of Nepal-Maoist (UCPN-M) combatants choosing integration into the Nepal Army (NA). However, there are 6,500 openings for former PLA fighters in NA. In the first phase of regrouping work, altogether 9,705 former combatants had chosen integration into the NA. However, as it appeared that the integration process will be complicated and lengthened, 6,576 combatants chose voluntary retirement scheme (VRS) during the second phase of regrouping work. According to Balananda Sharma, coordinator of the Special Committee secretariat, the 6,576 combatants who opted for voluntary retirement have been released from the cantonments. Combatants opting for voluntary retirement will be provided with cheques in the range of NPR 500,000 to NPR 800,000 depending on their rank.

Republica reports that the Central Committee meeting of the dissident faction of the Unified Communist Party of Nepal (UCPN-M) led by senior vice chairman Mohan Baidya has endorsed a political document that proposes revolt as its main political line and terms the acceptance of the Comprehensive Peace Agreement(CPA) one of the major mistakes. The 17-page document prepared by Baidya will be presented at the national gathering of leaders and supporters of the faction starting from June 16 in Kathmandu. “The objective circumstances are favourable for revolution but we should create the subjective circumstances for revolution,” the document reads. The faction has concluded in its document that national and international circumstances are also conducive for revolution. His argument is that the "capitalist" parties like Nepali Congress and the Communist party of Nepal-Unified Marxist Leninist (CPN-UML) are in crisis and there is no possibility of revival of "old forces" like the monarchy. Likewise, it has concluded that the "capitalist and imperialist" countries are also in crisis. In the document, Baidya has labelled Maoist Chairman Pushpa Kamal Dahal aka Prachanda and another vice chairman Baburam Bhattarai as the main obstacles to an immediate people’s revolt. “The [national and international] situation is favourable for revolution but there is no possibility of an immediate revolution because of Dahal and Bhattarai who deviated from the revolutionary line,” the document further states. “Now, we should struggle against the rightist revisionists and capitalists, bureaucrats and compradors.”
