Eyewitnesses told Daily Times, "Among the dead are 13 militants, most of them Uzbeks and Tajiks, while two brothers of Zalikhel chieftain Malik Saeedullah were also killed." Eyewitnesses further said, "Foreign militants and their local supporters attacked the brothers of the chieftain on Tuesday, killing both of them, and this led to a gunbattle." On February 7, the death toll rises to 19 in a reported clash between the Wazir Zalikhel sub-tribe and foreign militants near Azam Warsak in South Waziristan on February 6, according to AFP. "The death toll has risen to 19, from 15 yesterday. The dead include 12 Uzbek militants and three local supporters, three members of local peace committee and one Afghan shopkeeper," a security official said, adding, "The militants regrouped Tuesday night and torched two residential compounds belonging to Malik Saadullah(a pro-government tribal chief). Militants also abducted six of Saadullah's men but released three of them after a few hours."

The officials told Daily Times that two rockets were fired at the base inside the heavily fortified Tochi Fort in Miranshah: one hit the barrack that was damaged and the other landed in an open area near a preaching centre. "We are investigating who carried out the attack," they said. A spokesman for pro-Taliban militants denied involvement in the attack. "The enemies of the peace accord are behind the attack," Abdullah Farhad, a purported spokesman for militants in North Waziristan told.

Suspected pro-Taliban rebels in Pakistan’s tribal belt shot dead an Afghan refugee accused of spying for United States forces operating in neighbouring Afghanistan, officials said on March 9, according to Daily Times. Abdul Rahim was shot dead in Mohammad Khel village south of Miranshah, the main town of North Waziristan tribal district on March 8, a security official said. A note near his body said that he was an "American spy," the official said, adding, that Rahim had been abducted by militants a few weeks ago and his body had been taken to Afghanistan by relatives. It was the third such killing in a week near Miranshah and the eighth this year in the tribal areas.

In an interview with Khyber television channel, Crocker said the Waziristan agreement had all the points that the allies of Pakistan including the US wanted, but the question was implementation. "We asked Pakistan to ensure that the agreement would be respected. I personally appreciate the points written in the agreement but unfortunately the militants haven't respected the agreement because there are some tribal areas where the Pakistan government doesn't have full control," he added.

According to a Daily Times report, Pakistan Government agreed to launch no more land or air attacks in North Waziristan and also agreed to the withdrawal of the army from check posts into camps. The deal was signed between the North Waziristan political agent representing the NWFP Governor and "Tribal leaders of North Waziristan, local mujahideen and elders of the Utmanzai tribes". The party of the second part agreed to ensure that no attacks were carried against law-enforcement agencies or on government assets and there would be no "target killings". The tribal elders and others also agreed not to set up a parallel administration, and accept the writ of the Pakistan Government.

Joint Chiefs of Staff Chairman Gen Peter Pace told Chicago Tribune, "It is proper for us to point out to President Musharraf that people are continuing to come across the border." He also said that a controversial treaty that President Musharraf signed with tribal chiefs in North Waziristan had not produced the results that the Pakistani leader hoped it would in reducing cross-border attacks by Taliban and al Qaeda insurgents. The violence erupted in Shin Warsak, a village seven kilometres west of Wana in South Waziristan. Fighting broke out on March 19 in Shin Warsak village, 7-km west of Wana. "According to our reports 35 Uzbek militants and 12 tribal combatants have been killed," said a senior Government official, who declined to be identified. Among the dead were three children killed by a mortar bomb on their way home from school on March 19, a teacher said. "The children were getting off their school bus and some had started walking home when a mortar bomb hit," said the teacher, Noorzali, adding, some children were wounded. Military spokesman Major-General Waheed Arshad said the fighting was still going on and up to 35 people had been killed, at least half of them foreign militants and added that security forces were not involved. A battle between foreign militants, most of them Uzbeks, and ethnic Pashtun tribesmen erupted in the remote area near the Afghan border on March 6, when militants tried to kill a pro-Government tribal leader, in which seventeen people, most of them Uzbeks, were killed. It followed Government efforts to convince the tribesmen to help keep order and stop militant raids into Afghanistan. "It's a success of the government tribesmen strategy ... the tribesmen are fed up with them because they and their activities adversely affect their lives and business," Arshad said.

He told the council during a debate on the situation in Afghanistan that Pakistan was pursuing a comprehensive strategy to promote peace and progress in its frontier regions, and this involved military, political, economic and administrative components. The objective of this strategy is to win the hearts and minds of the local population and isolate the militants from the moderates. Akram said, "Pakistan’s frontier regions have been deeply affected by three decades of war and conflict in Afghanistan. As part of our programme for modernisation and rapid socio-economic development, it is in Pakistan’s vital interest to eliminate Al Qaeda terrorists, Taliban militancy and Talibnisation in these frontier regions." Responding to an observation by Tom Koenigs, a special representative of the UN Secretary General, that suicide attacks, facilitators and Taliban commanders were crossing over from Pakistan, the Ambassador said crossing of the border was in both directions, and the Taliban must be controlled on both sides of the border. Clashes between foreign al Qaeda militants and pro-Government tribesmen in South Waziristan have left 110 people dead, Interior Minister Aftab Sherpao told Daily Times on March 21. Sherpao said that 84 Uzbek militants and 17 local tribesmen, including nine civilians, had been killed during three days of fighting. Another 83 Uzbeks have been captured by the tribal forces, he said, adding that the Government has not intervened in the clashes. However, witnesses in Wana told Daily Times that the Army had fired artillery rounds from the Zarinoor base at the Uzbek militants’ positions in Azam Warsak and Sheen Warsak and gunship helicopters were hovering over the area. However, Army spokesman Maj Gen Waheed Arshad said he had no information that artillery was being used against the foreign militants. The report further added that Maulvi Nazir is leading the battle against foreign militants for the first time since they crossed over from Afghanistan after the United States invasion. The clashes were spreading from Azam Warsak and Kaloosha to areas like Karikot. Critics say the peace accord has allowed militants to regroup in an area viewed as a possible hiding place for al Qaeda leader Osama Bin Laden. Rice said the frontier "is remote, it is cut-off, it is underdeveloped, and it is a hotbed for extremism", adding, local tribal groups had started to fight back against extremists in the area. "You have to separate the population from the foreign fighters. And you do that through fighting — the Pakistani army fighting them, through the tribals fighting them. "Around 130 foreigners were killed and 62 captured, and the clashes are now spreading to other areas," he told reporters at Governor’s House, adding, foreign militants battling tribesmen in South Waziristan could still avail an amnesty offer if they surrendered to the authorities. Orakzai said there could be around 500 foreign militants still hiding in the area. Asked if the ceasefire brokered on March 22 was holding, the Governor did not give a direct reply. Tribesmen in the Bajaur agency gave on March 26 an undertaking to the Government to deny shelter to "locals as well as foreigners, including Afghans" involved in terrorist or anti-state activities, according to Dawn. The five-point undertaking was signed by 800 tribal elders at a jirga held at the regional headquarters of the agency in Khaar. It was signed by tribal region’s administrator Shakeel Qadir Khan as a witness. The meeting was attended by elders from two major tribes, Utmankhel and Tarkhani, ulema, parliamentarians and officials of the political administration. "This is an undertaking and not an agreement. This is an undertaking by the tribesmen and the government is not a party to it. We have not pledged anything in return," the administrator said. "It has taken some time for things to deteriorate and it is going to take some time to put things back on the track," Shakeel Qadir told Dawn on phone from Khaar. "This is a long process. But I am confident that the tribes would abide by the undertaking. They know it and we know it that it is an undertaking that is binding on them," he added. The undertaking binds all tribes in the Bajaur region not to provide shelter to anyone, local or foreigner, including Afghan refugees, who are involved in terrorist or anti-state activities. The tribes also pledged neither to support nor keep contacts with such elements and on the basis of information or evidence they would cooperate with and provide all possible assistance to the government and jointly take action against any foreigner or Afghan. They also undertook to abide by all agreements signed with the federal government, with tribes or with the administration (in the tribal region) and would honour any agreement aimed at promoting peace and development in the area. The tribal elders undertook to fully cooperate with all government and non-governmental organisations permitted by the government to work for peace and development in the area. The tribes also pledged to be fully responsible for protecting all government and private property and staff. They pledged that they would "neither engage in any terrorist or militant activity detrimental to the honour and dignity of Pakistan, nor would they support any such action". "We pledge that the tribes of Bajaur will be accountable before the government of Pakistan and the political administration if there is any violation of the above-mentioned clauses, in which case the punishment will be carried out in accordance with the law and customs of the area and tribes," the last point in the undertaking said. The undertaking came after intense behind-the-scene negotiations between influential tribal elders, including Malik Shahabuddin, Malik Abdul Aziz and Malik Shah Mehmood, and wanted militant leader Maulana Faqir Mohammad, informed sources told Dawn. At a meeting held last week, the militant leader vowed his allegiance to his tribe and agreed to the terms and conditions of the undertaking given by the Mamond tribe.

Another official said three tribal fighters were also killed and six wounded in the fighting. Residents said the militants also shot dead a local man who was travelling in the area on his bike. The latest clashes were concentrated in Azam Warsak, Shen Warsak and Kalusha areas of South Waziristan. Residents say between 300 and 500 Uzbeks and Chechens are holed up in the area. They said the Uzbeks were effectively under siege in the mountainous terrain as all roads leading to the troubled towns were being controlled by tribal commander Mullah Nazir. A tribal leader, Haji Sharif, ruled on March 29 out any negotiations with the foreigners.
