A Delhi court on February 16 convicted two Harkat-ul-Jihad-al-Islami Bangladesh (HuJI-B) militants, including a Bangladeshi national, of possessing explosives, hawala (informal money laundering system) money and waging war against the country, charges which envisage death penalty as the maximum punishment, reports The Hindu. Additional Sessions Judge Nivedita Anil Sharma held Mohd Amin Wani, a Jammu and Kashmir resident, and Lutfur Rahman, the Bangladeshi national, who is reportedly to have received training at the instance of Pakistan-based Jama'at-ud-Da'awa (JuD) chief Hafiz Saeed, guilty in the case. Both the convicts were charged under the various provisions of the Indian Penal Code (IPC) including those relating to waging war against the country and other offences under the Unlawful Activities (Prevention) Act and the Explosive Substances Act.

A Delhi court on February 18 remanded a suspected Indian Mujahideen (IM) terrorist to seven days' Police custody in a fresh case relating to the serial explosions in Delhi on September 13, 2008, reports Times of India. The Delhi Police special cell sleuths produced the accused before the court after completion of his 12 days' police remand. Chief Metropolitan Magistrate Kaveri Baweja allowed the Special Cell to keep Shahzad, arrested from Uttar Pradesh on February 1, in their custody till February 25. He has to be interrogated in connection with the recovery of a laptop and two mobile phones from Azamgarh in Uttar Pradesh at his instance. He is also to be interrogated with regard to whereabouts of 14 absconding IM terrorists for their alleged role in the serial blasts in the Delhi. Shahzad absconded with Junaid following an encounter with Delhi Police at Batla House in south Delhi on September 19, 2008, six days after the serial blasts. Meanwhile, Police sources said accused Shahzad would be taken to Maharashtra to probe his connections with IM modules suspected to be involved in the Pune blast of February 13 which claimed 11 lives.

Additional Sessions Judge Nivedita Anil Sharma sentenced Mohammad Amin Wani, a resident of Jammu and Kashmir, and Lutfur Rahman, the Bangladeshi national who was reportedly to have received training at the instance of Pakistan-based Jama'at-ud-Da'awa (JuD) chief Hafiz Saeed, to life imprisonment. Awarding the sentence, the judge said they did not deserve capital punishment as the case was not the rarest of rare. Wani (29) was arrested on January 4, 2007, from Seeshganj Gurdwara in the old city area by Delhi Police's special cell for possessing INR 450000 hawala (informal money laundering system) money. Rahman (30) was arrested from Hazrat Nizamuddin Railway station with 1.5 kilograms explosives and a timer. According to the Police, the duo was in the capital to disrupt the January 26 Republic Day function.

A joint Police team of the Punjab and Delhi Police neutralised a module of the Babbar Khalsa International (BKI), an outfit backed by Pakistan's Inter-Services Intelligence (ISI), by arresting three militants from Punjab and Delhi, reports Times of India. Two suspected BKI militants, identified as Daljit Kumar alias Deepak of Baltana from Mohali District and Purshotam Singh alias Bunty from Rajoura in Patiala District, were arrested at the Zirakpur-Patiala road near Zirakpur in an operation conducted by the Mohali Police and the Special Cell of Delhi Police in the night of March 18. The third militant of the outfit, identified as Karwinder Singh, a native of Ropar, was arrested in Delhi on March 19. The arrests indicate that BKI is being pressured, just like Indian Mujahideen (IM) terrorists hosted by Pakistan, by its ISI handlers to revive terrorist activities. Senior Superintendent of Police, Mohali, Gurpreet Singh Bhullar said that two France-based terrorists identified as Purshotam Singh of Matheri and Goldy of Ghel, both from Ambala District, were funding the terrorists activities. INR 100000 recovered from the two militants was sent by them. Police also recovered a .455 bore revolver with three cartridges from the two militants. Purshottam Singh, a proclaimed offender, is reportedly one of the accused involved in the assassination of former Punjab Chief Minister Beant Singh, but could not be arrested. He had also tried to eliminate former Haryana Chief Minister Bhajan Lal before Benat Singh's assassination. Preliminary interrogation of the accused revealed that they were planning to carry out blasts in the region to create terror, the cops said, adding that more revelations are expected in the coming days. A case against them was registered at the Zirakpur Police Station and they were produced in the Derabassi court from where they were sent to Police remand till March 21.

A Delhi court has convicted a former Jammu and Kashmir Police Constable for being a cadre of the Lashkar-e-Toiba (LeT), PTI reported on April 13. Mushtaq Ahmed Wani, who was posted as guard at the residence of Fazal Hussain Beigh, brother of ex-Finance Minister of Jammu and Kashmir Muzaffar Hussain Beigh, was arrested from a place near Red Fort in Delhi on November 25, 2006, by the Delhi police's Special Cell personnel. Wani, hailing from Baramulla District, was arrested along with INR 6 lakh alleged hawala money. It alleged the convict had come to the national capital to collect a consignment of arms, ammunition and hawala money which were to be used for terror activities in Jammu and Kashmir. The convict came into contact with his Pakistan-based handler Mohammad Ahmed, a ‘deputy commander’ of LeT, in September, 2006, and started working for the banned organisation at his instance. Additional Sessions Judge Dharmesh Sharma held Wani, 30, guilty of the various offences under the Unlawful Activities (Prevention) Act. The court is likely to pronounce the quantum of sentence on April 19.

A Delhi court on April 19 sentenced a former Jammu and Kashmir Police Constable to eight years rigorous imprisonment for being a cadre of the Lashkar-e-Toiba (LeT), reports PTI. Mushtaq Ahmed Wani, who was posted as guard as the residence of Fazal Hussain Beigh, brother of ex-Finance Minister of Jammu and Kashmir Muzaffar Hussain Beigh, was arrested from the Red Fort in New Delhi on November 25, 2006, by personnel of the Delhi Police's Special Cell. Besides the prison term, Additional Sessions Judge Dharmesh Sharma, who pronounced the quantum of punishment, also imposed a fine of INR 50,000 on Wani (30), holding him guilty of various offences under Unlawful Activities (Prevention) Act (UAPA). District and Sessions Judge S. P. Garg, who awarded the death sentence to Mohammad Naushad, Mohammad Ali Bhatt and Mirza Nissar Hussain, said: "The convicts do not deserve a lenient view. It was the most dastardly act ... the convicts indulged in the killing of innocent persons without any provocation." Their accomplice Javed Ahmed Khan was sentenced to life imprisonment. The four were convicted on April 8, 2010 of the murder, conspiracy and attempt to murder under the Indian Penal Code. The other two, Farooq Ahmed Khan and his woman accomplice Farida Dar, who had been held guilty of minor offences under the Explosive Substances Act and the Arms Act, were sentenced to imprisonment for seven years, and four years and two months respectively.

A 35-year-old man, wanted in connection with seizure of communication equipment meant for terrorists in Jammu and Kashmir five years ago, has been extradited from Dubai (United Arab Emirates) and arrested in New Delhi, Police said on May 11. Sheikh Sajjad, suspected to be linked to terror outfit Al Badr, was extradited on May 8 from Dubai where he was detained for his alleged involvement in sending hi-tech communication equipment, including satellite phones, meant for the militants. Upon his arrival here, Sajjad was arrested by Special Cell which produced him before duty magistrate on May 9. On May 10, he was again produced before the court which sent him to police custody till May 16. The consignment from Jeddah was seized at Indira Gandhi International Airport. Mohd Amin Khan, a resident of Srinagar who approached the customs officials to claim the consignment, was arrested a week later after the seizure of the consignment. At his instance, one Ubaid was also arrested, an unnamed senior Police official said, adding their interrogation led them to Sajjad. Ubaid was later acquitted by a court while Amin, who had a shoe shop in Chandni Chowk (New Delhi), was sentenced to 10 years’ imprisonment in this case.

The Delhi Police on July 14 claimed before a court that the Indian Mujahideen (IM) had allegedly carried out September 13, 2008 serial blasts in Delhi at the instance of its founder, now Pakistan-based Amir Raza Khan, according to PTI. "Amir wanted to avenge the death of his brother Asif Raza Khan in a Police encounter in 2001. This fact was revealed in a letter written by Aftab Ansari, facing death penalty in 2002 Kolkata's American Centre attack case, to the widow of Asif," public prosecutor Rajeev Mohan said. A Delhi court on July 21 issued non-bailable warrants (NBW) against five Pakistanis in a case filed by the National Investigation Agency (NIA), charging them with facilitating terrorist attacks in India, but rejected its application for NBWs against Lashkar-e-Toiba (LeT) chief Hafiz Mohammed Saeed and Zaki-ur-Rehman Lakhvi, the first and second accused, reports The Hindu. While agreeing with the prosecution’s charges against the seven, Special Judge (NIA) S. P. Garg said no purpose would be served by issuing NBWs against Saeed and Lakhvi. For, a Mumbai trial court had issued NBWs against them and subsequently Interpol also issued Red Corner Notices. The NIA counsel had on July 20 said that Saeed and Lakhvi could be issued the “Special Notice” as the Security Council had imposed sanctions on them for their ties to the al-Qaeda and the Taliban. The five persons against whom NBWs have been issued are Karachi residents Sajid Mir alias Wasi and Abdur Rehman Hashim, Pakistani army officers Major Iqbal and Major Sameer Ali, and Pakistan-occupied Kashmir (PoK) resident Illyas Kashmiri. All the accused have been charged under various sections of the Indian Penal Code, the Unlawful Activities (Prevention) Act and the South Asian Association For Regional Cooperation (SAARC) Convention (Suppression of Terrorism) Act for “facilitating terrorist acts and acts preparatory to terror attacks between 2005 and October 2009 in India including Delhi”.

The Supreme Court (SC) recorded Pakistan’s hand in the killing of Mirwaiz Moulvi Farooq by militants from Jamaat-e-Islami and Hizb-ul-Mujahideen (HM) in 1990 in Srinagar, Times of India reports. While upholding the conviction and life sentence to Mohammad Ayub Dar for the murder, the SC said Dar's confession was clear about the training in use of firearms he and his accomplices received in Pakistan during his visit there in 1989. "Dar has given details of the whole outfit including the names of the leader and other companions and the confession also refers to the firearms brought by the group of terrorists from Pakistan and the training which was for bringing into effect the terrorist activity in the Kashmir valley," the SC said. "It has also come in the confession that Dar had visited Pakistan, Lahore and Muzaffarabad to meet other members of the group namely Hyder, Hanif Hyder, Nasir Khan and Yusuf Bangroo on fake passport. The said confession also gives details that the said passport was issued in Sikar, Rajasthan, with visa of Pakistan," the Bench noted. It said: "We are thoroughly convinced that this confession is not only a good, voluntary and truthful confession but a reliable one also and the trial court has committed no mistake whatsoever in relying upon the said confession."

Additional Sessions Judge Dharmesh Sharma also imposed a fine of INR 7,000 on the convict, identified as Asim Waseem aliasSumaar Ali after holding him guilty under the Official Secrets Act, the Indian Penal Code and the Foreigners Act. The Police found that the accused was passing classified and secret details about the deployment and movement of army through courier. They also recovered two driving licenses from Ali issued in Agra (Uttar Pradesh) and Hissar (Haryana). Ali was arrested by Delhi Police's Special Cell sleuths on September 15, 2005, following a tip off that a man from Pakistan's Rahimyar Khan District had entered the country and was spying on the directions of the Pakistan’s External Intelligence agency Inter-Service Intelligence (ISI).

A Delhi Court has acquitted an alleged Jammu and Kashmir-based militant of the Lashkar-e-Toiba (LeT) of the charge of waging war against the country, saying recoveries of huge cache of arms and hawala money from him were not proved, reports Daily Excelsior. "Recovery of the arms and ammunitions have not been proved, by no stretch of imagination, the charge of sedition can be said to be proved against the accused (Irshad Ahmed Malik)," Additional Sessions Judge J R Aryan said. Malik, hailing from Doda District of the State who was staying at Rajdhani hotel in South Delhi, was arrested on the evening of March 27, 2004, by the special cell of the Delhi police on a tip off. The police had recovered INR 2.75 lakh cash, alleged hawala money and a pistol along with eight live cartridges, the charge sheet said. During the probe, the militant also helped recover an AK-56 assault rifle and 60 cartridges from a place near the Humayun's tomb in the national capital, it added.
