The Delhi High Court on January 30 dismissed a Public Interest Litigation (PIL) seeking the prosecution of Shashi Prakash, a former Joint Secretary (Internal Security) in the Union Home Ministry, in the Purulia arms-dropping case of 1995. Earlier, the Central Bureau of Investigation (CBI) on January 11, 2001 had admitted before the High Court that the Union Home Ministry had prior intelligence reports regarding the conspiracy to smuggle arms and ammunition into the country, but had exonerated the accused official.

On February 26, the Supreme Court of India expressed the fear that unchecked migration of the citizens of Bangladesh to India might pose a threat, both to the economy and the security of the country. Hearing a public interest litigation (PIL) seeking a direction to the government to stop the menace of illegal entry of foreign citizens into the country, the Apex Court observed, ``They are eating into the economy of the country and, to a large extent, are becoming a security threat.'' The court said the government needed to take exemplary steps like deporting some of the illegal migrants. Till such steps were taken, there would be no stop to this kind of migration, it added.

Delhi police, on June 4, announced a reward for eight Lashkar-e-Toiba (LeT) terrorists and money launders allegedly responsible for an attack on the Red Fort on December 22, 2000, in which three soldiers of the 7 Rajputana Rifles were killed. The decision was taken after a court proclaimed them offenders. The Delhi police chief told newsmen that any person providing Information leading to the arrest of the eight absconding terrorists would be paid the reward amount. At least seven people have so far been arrested for their involvement in the Red Fort incident. On January 4, Delhi police arrested three local contacts of the LeT in Delhi. Later, three money launders were arrested in Srinagar by the Jammu and Kashmir (J&K) police.

Delhi’s Additional Session Judge has fixed July 18 for commencement of trial in the Red Fort shootout case. A Lashkar-e-Toiba (LeT) suicide squad stormed the Red Fort on December 22, 2000, in which two army personnel and a civilian were killed. In two separate chargesheets, the police had named Pakistani national and a LeT terrorist Ashfaq, his Indian wife Rahmana, Babar Mohsin Bhagwala, Devender Singh, Shahanshah Alam and Rajiv Kumar Malhotra as accused under various sections of the IPC, Arms Act and Explosive Substances Act. Asfaq and his wife were arrested on December 26, 2000. The remaining four accused were arrested on January 4, 2001 for allegedly helping the LeT terrorists. The prosecution has cited 162 witnesses in support of its chagesheet against the accused.

On July 18, Delhi police filed a charge sheet against two more persons in the Red Fort shootout case in which two terrorists of the Lashkar-e-Toiba (LeT) stormed the historic monument and killed two Army personnel and a civilian on December 22, 2000. They have been charged under various sections of the Indian Penal Code (IPC0, the Arms Act and the Explosive Substances Act. So far, eight persons have been charge-sheeted in connection with the shootout. The prosecution has cited 162 witnesses in support of its charge- sheet. A city court in Delhi, on October 6, rejected the bail plea of three arrested activists of the Students Islamic Movement of India (SIMI). The court said, " There is sufficient evidence on record to show that SIMI and its activists have been promoting ill-will against other religions by publishing the magazine 'Islamic movement' and through the audio and video tapes which have now been seized by the police." The SIMI activists were arrested on charges of raising provocative slogans in protest against the ban on the organisation on September 27. The court had asked the prosecution to substantiate the allegations by producing the audio and video evidence about their unlawful activities.

A Delhi court, on October 16, rejected the bail application of the two terrorists facing trial in the Red Fort shootout case in which terrorists of the Lashkar-e-Toiba (LeT) had stormed the Red Fort and killed two army personnel and a civilian on December 22, 2000. The court observed that the accused did not qualify for being released, as the allegations against them were very serious in nature. Earlier, on August 29, 2001, the court had rejected the bail applications of two other accused on the same ground. The accused terrorists have been charge-sheeted under various sections of the Indian Penal Code (IPC), the Arms Act and the Explosive Substances Act.

The decision was reportedly taken soon after the tribunal headed by a Delhi High Court judge upheld the Union government’s decision to ban the outfit. A prominent leader of the banned organisation was quoted as saying, ‘‘Against our expectations, the tribunal’s decision came against us. We are left with no other option but to resume our religious activities under a different banner.’’ He reportedly added that a decision about the new name and its objectives would be taken soon.

The Delhi High Court, on November 6, issued a notice to the Union government seeking its replies about the measures being taken to ensure safety of people against the bio-terrorism threats. Taking cognizance of an application filed in a matter related to the problem of law and order situation in Delhi, the Court said that the respondents should file their replies by December 14. The Court also held that no awareness campaign had been launched by the government to educate the people about the measures initiated in case a person has contacted diseases spread through Anthrax spores or any other form of bio-terrorism.

Delhi police have chargesheeted another person, resident of Lucknow currently living in Saudi Arabia, in Red Fort shootout case in which two terrorists of the Lashkar-e-Toiba (LeT) stormed the Fort and killed two army personnel and a civilian on December 22, 2000. In a supplementary chargesheet filed before metropolitan magistrate, the special cell of Delhi police named Atharuddin alias Abdullah as the eleventh accused in the case. Police sources added that after the December 22 incident, Abdullah went to Jammu and Kashmir where he took part in an attack on a special operation group camp in January 2001. Thereafter, the accused reportedly went to Lucknow from where he fled to Jeddah, the chargesheet stated.
