The Attorney-General for Pakistan Ashtar Ausaf Ali on November 1, presented ‘sensitive’ documents before a judge of the Lahore High Court in his chamber to defend detention of Jama’at-ud-Dawa (JuD) chief Hafiz Muhammad Saeed, reports The Dawn. Earlier, the AGP told the judge that the documentary material relied upon by the Federal Government to detain Hafiz Saeed was sensitive in nature and would not be appropriate to present in open court. He sought permission from the court to produce the relevant material in chamber and also requested it not to place the same on record of the case. After Justice Syed Mazahar Ali Akbar Naqvi allowed the request the AGP shared the documents with the judge in his chamber where Advocate Dogar was also present.

The White House retains a list of 20 terrorist groups that the Donald Trump administration claims are operating in Pakistan and Afghanistan and is believed to have shared this list with Pakistani officials, The Dawn reported on November 2 quoting diplomatic sources. The sources, however, rejected the suggestion as incorrect that US Secretary of State Rex Tillerson gave a list of 75 terrorists to Pakistani officials when he visited Islamabad last week. The White House list, released on The Washington Post’s demand, includes three types of militants groups: those who launch attacks into Afghanistan, those who attack targets inside Pakistan and those who are focused on Kashmir. Top on the list is the Haqqani network which, the United States claims, has safe havens in Federally Administered Tribal Areas (FATA) and uses them to launch attacks into Afghanistan. Other groups on the list are: Harkat-ul-Jihadi-i-Islami (HuJI), Jama’at-ul-Ahrar (JuA), Jama’at-ud-Dawa (JuD) al-Quran and Tariq Gidar Group, which is one of 13 Tehreek-e-Taliban Pakistan (TTP) affiliates. Islamic Revolutionary Guard Corps, Commander Nazir Group, Indian Mujahideen (IM), Islamic Jihad Union (IJU), Islamic Movement of Uzbekistan (IMU) ISIS-Khorasan, al Qaeda in the Indian Sub-Continent (AQIS) and the Turkistan Islamic Party Movement (TIPM) are also on the list.

Meanwhile, United States (US) Senators on November 8, decided not to tie financial aid for Pakistan to counter-terrorism measures against the Lashkar-e-Taiba (LeT), as was proposed by Senator Mark Warner, co-chair of the chamber’s India Caucus, in an omnibus legislation, National defense Authorisation Act (NDAA) 2018 it passed to fund the US military in 2018, because of resistance from the US Defense Department reports Hindustan Times. The provision was dropped from the legislation after the two chambers agreed through a process called Conference, meant to reconcile differing versions of a bill passed by the Senate and the House of Representatives. The reconciled version of the NDAA-2018 now makes $350 million of $700 million available to Pakistan under Coalition Support Fund (CSF) contingent upon certification from the Secretary of Defense, that Pakistan is taking demonstrable steps against the Haqqani Network. The legislation will now be put to a vote for passage, which is guaranteed to be passed. The reconciled legislation also proposes to direct the Executive to set up a formal structure to pursue relations with India under the new definition of “Major Defence Partner. The Defense Department had argued that the US must stay focussed on the Haqqani Network. A congressional Aide has told that progress in arresting and prosecuting senior leaders and mid-level operatives of LeT by Pakistan will be taken up another time. The Senators, in a joint report of the Senate and House Armed Services committees released on November 9, had asked the Pentagon to "demonstrate to Pakistan the consequences of continued support to terrorists".

National Counter Terrorism Authority (NACTA) responsible for countering internal terrorism has asked the Home Department of the Punjab Province to enhance security for the detained perpetrator of Mumbai terror attacks Hafiz Saeed leader of Jamaat-ud-Dawa (JuD) , claiming that a “foreign spy agency" was planning to kill him through members of a banned militant outfit, reports Times of India. Saeed is currently being kept at his residence+, 116-E, in Johar town, Lahore in Punjab. NACTA has sent a letter to Lahore-based Home Department of Punjab, claiming that a foreign spy agency had paid Rs 80 million to two activists of a proscribed militant group to kill Saeed, suggesting the Home Department to ensure strict security measures in the surroundings of Saeed's Lahore residence, which has been declared a prison for him by the Punjab's Government.

The United States (US) Congress on November 16 passed the bill that requires Pakistan to work with the Afghan and American Forces to destroy the Haqqani Network but leaves Lashkar-e-Taiba (LeT) out, reports Dawn. The National Defence Authorisation Act (NDAA) 2018 - approved by a voice vote by both the House and the Senate provides about $700 billion for US defence needs in 2018. The NDAA 2018 provides $700 million for reimbursing Pakistan for monitoring the Pakistan-Afghanistan border but withholds half of the amount unless the US Secretary of Defence certifies to the Congressional Defence Committees that, “Pakistan continues to conduct military operations that are contributing to significantly disrupting the safe havens, fundraising and recruiting efforts, and freedom of movement of the Haqqani Network in Pakistan. “Pakistan has taken steps to demonstrate its commitment to prevent the Haqqani Network from using any Pakistan territory as a safe haven and for fundraising and recruiting efforts. The Government of Pakistan is making an attempt to actively coordinate with the Government of Afghanistan to restrict the movement of militants, such as the Haqqani Network, along the Afghanistan-Pakistan border. Pakistan has shown progress in arresting and prosecuting senior leaders and mid-level operatives of the Haqqani Network.” Previous versions of the bill required the secretary to issue a similar certificate for LeT but its name was dropped from the later version.

Separately, the Lahore High Court on November 17, adjourned hearing of a petition of Jamaat-ud-Dawa (JuD) ‘chief’ Hafiz Saeed against his detention to wait for a decision on the matter by a Provincial Review Board (PRB), reports Dawn. As Justice Qazi Muhammad Amin Ahmad resumed hearing, a Deputy Attorney General stated that a Provincial Review Board comprising Judges of the High Court was scheduled to take up the detention matter of Mr Saeed on November 21. He said the court should adjourn hearing of the petition till a decision of the Review Board was out. The Judge accepted the request and deferred the hearing till November 22.

A Review Board comprising the Chair of Justice Abdul Sami Khan, Justice Sadaqat Ali Khan and Justice Aalia Neelum of the Lahore High Court (LHC), ordered the release of Jama’at-ud-Dawa (JuD) chief and Lashkar-e-Toiba leader Hafiz Saeed on November 22, on expiry of his 30-day detention if he was not required in any other case, reports Daily Times. The Officers from Finance Ministry (FM) and Punjab Home Department presented the documentary record in support of the detention of Hafiz Saeed. The FM Official said that Pakistan could face international sanctions if Hafiz Saeed was released while the Government’s Law Officer told the board that detention of Saeed was necessary, as he had threats to his life. The Review Board however passed the release orders after not being convinced that the release of Saeed would bring diplomatic and financial problems to the country. Talking to the reporters Hafeez Saeed said, “I’m thankful that the lawyers and the entire nation is with them. It is not just mine but the case of Pakistan, it is a slap on the face of India as we have established that Pakistan is a free state,” adds The Express Tribune.

The United States (US) has once again offered Pakistan to act jointly against the extremists outfits in Pakistan citing the rise in religious fringe, The Nation reported on November 27. “Pakistani government now has an opportunity to demonstrate its seriousness in confronting all forms of terrorism, without distinction, by arresting and charging Hafiz Saeed for his crimes” said a White House statement. Senior Officials at the Foreign Ministry (FM) said the US had shown concern over Pakistan’s failure to check the extremists’ advances as the Government struggled to contain a sit-in in Islamabad by religious outfits. “They [the US] were furious over [Jamaat-ud-Dawa chief (Jud)] Hafiz Mohammed Saeed’s release. The rise of religious groups like Tehreek-e-Labaik Ya Rasool Allah has infuriated them further. They want us to discourage them before they take over the country,” said one Official citing contacts in Washington.
