Four former cadres of Liberation Tigers of Tamil Eelam (LTTE) who pleaded guilty of conspiring to explode a bomb inside a private bus plying from Matale to Kandy near the Polgolla Open University in 2008 were on October 2 sentenced to five years rigorous imprisonment by the Colombo High Court, reports Daily News. The four accused were ordered to pay a fine of SLR 20,000 each by High Court Judge Sampath Abeykoon. Three were killed and 20 injured when a bomb exploded inside a bus in 2008. Defence counsel moved court that a lenient sentence is passed against the accused since they were kept in remand custody since 2008, for 10 years.

President Maithripala Sirisena on October 3 said the occupied lands in the North and East should inevitably be returned to the rightful owners and instructed the relevant authorities to sort out the problems and complete the process to release the lands before December 31, reports Colombo Page. The President instructed the officials when the Presidential Task Force on Development of the Northern and Eastern Provinces met for the third time at the Parliamentary Complex. The President gave further instructions to prepare a proper timeframe to launch the relevant program and present the progress of the program at the next Presidential Task Force meeting next month. Special attention was focused on releasing military occupied buildings and lands belong to schools in the North and East. The President, noting that people in certain areas of the Trincomalee district, are facing a severe water shortage inquired about the program being implemented to resolve the drinking water issue.

Former State Minister Vijayakala Maheswaran has been arrested by the Organized Crime Prevention Division (OCPD) of Police on October 8 (today) for calling reorganization of the outlawed terrorist group Liberation Tigers of Tamil Eelam (LTTE) in order to curb the rising crime in the North, reports Colombo Page. Speaking an event at the Veerasingham Hall in Jaffna on July 2, Maheswaran has called for the reorganization of LTTE in order to curb the rising crime in the North. The UNP Jaffna District parliamentarian resigned from her post of State Minister of Child Affairs on July 5 due to the criticism generated by her statement. The Attorney General advised the Inspector General of Police (IGP) Pujith Jayasundara to take legal action under the Penal Code against Maheswaran over her controversial statement on the LTTE.

Foreign Affairs Minister Tilak Marapana on October 9 said Sri Lanka has made considerable progress on complying with the United Nations Human Rights Council (UNHRC) resolution 30/1 co-sponsored by the US and Sri Lanka and adopted in October 2015, reports Daily Mirror. Minister Marapana said “The establishment of the Office of Missing Persons (OMP), passing of the International Convention for the Protection of All Persons from Enforced Disappearance Act, tabling of Reparations Bill and the Counter Terrorism Bill are the steps taken in the right direction by Sri Lanka to fulfil her obligations. We have had regular consultations with other co-sponsors, EU, UK and Canada and those who voted for the resolution at the UNHRC who have expressed their appreciation on the progress that has been made by Sri Lanka. Further, anyone could see himself how this government has restored democracy, rule of law, the independence of judiciary and media. Today, no one has the feeling of insecurity, abduction or disappearance. The government has also constituted the Constitution Council and through it established independent commissions. No suppression of media and harassment on media personnel, critical on the government. We have taken upon ourselves the reforms which are beneficial to our people. In this regard, the government is well aware of where we should draw the line. We are confident that the International Community will defend us to the hilt at the March 2019 sessions of the UNHRC and therefore no one must unnecessarily worry about it.”

Human Rights Watch (HRW) in a 80-page report, “‘Why Can’t We Go Home?’: Military Occupation of Land in Sri Lanka,” released on October 9 (today) said the Sri Lankan Government is slow to return civilian land and property nearly a decade since the end of the civil war in 2009, reports Daily Mirror. The report is based on over 100 interviews between August 2017 to May 2018 with members of affected communities, activists, local officials, and lawyers. It looks into cases of military occupation and land release in 20 areas in six districts, primarily in Sri Lanka’s North and East. The report details security force occupation of land both during and after the armed conflict. It identifies the lack of transparency and due process, failure to map occupied land, inadequate support to affected people and communities, and prolonged delays in providing appropriate reparations for decades of loss and suffering. The military has also used some confiscated lands for commercial profit rather than national security and returned damaged or destroyed property to owners without compensation. “All those displaced during Sri Lanka’s brutal civil war are entitled to return to their homes. Despite repeated pledges by the authorities, the military has been frustratingly slow to restore land to its rightful owners,” said Meenakshi Ganguly, South Asia Director.

Prime Minister Ranil Wickremesinghe said, "The disappearances not only in the North but also in the South have been reported. Reparations have to be made, Steps should be taken to provide relief to the victimized parties ". The Bill provides for the provision of individual and collective reparations for aggrieved persons who have suffered violations of human rights or humanitarian law.

Northern Province Chief Minister C. V. Vigneswaran speaking to the media after holding a meeting at his Jaffna office with Provincial Council political representatives and civil society organisations on October 12 has called upon the Tamil National Alliance (TNA) to demand the release of all Tamil political prisoners, as a condition to lend its support to the Government during the forthcoming Budget. The Office on Missing Persons (OMP) met families from the Western Province in Colombo on October 16 and briefed them on the ongoing process to address the issue on people reported missing, reports Colombo Gazette. The meeting took place at the Lakshman Kadirgamar Institute. The OMP heard from the families of the missing and took their suggestions. The OMP also briefed the families on the interim report of the OMP, which was released in September. The OMP has recommended in the report that state officials including members of the armed forces and police who are named as suspects or accused in criminal actions relating to abductions and enforced disappearances, be suspended pending the final determination of such cases.

After being isolated for long periods during the war, the Northern and Eastern provinces of Sri Lanka are in the midst of recovering from a traumatic past and a World Bank funded project supports the local authorities in the provinces to deliver services and local infrastructure in a responsive and accountable manner,reports Colombo Pageon October 17.With contributions from the North East Local Services Improvement Project (NELSIP) residents now enjoy swift services, such as rural roads and easy access to drinking water. The local authorities are empowered for their service deliveries.The Project is designed to improve the delivery of infrastructure services, such as rural roads and drinking water supply by local authorities in the Northern and Eastern Provinces, to strengthen their service delivery systems, and to build capacity to deliver their mandated services.The unique design of this project is that each community contributes three percent of the cost by providing labor or utilities like water or electricity. In addition, community members can identify their own needs and prioritize how the money is spent by voting in public town hall meetings.Based on successful results of NELSIP, the Government of Sri Lanka has stepped up its grant support to local authorities since 2014.

Plans are in progress to release a 23-acre block of land in Mullikulam, Mannar, a block of 53 acres of land in Mullivaikal, Mullaitivu held in the custody of the Sri Lanka Navy and a 3-acre block of land in Thoppur, Trincomalee where the 224 Brigade Headquarters of the Sri Lanka Army has been established, to the original owners of the lands, a statement on Cabinet decisions said. Also, in order to enable the people to be resettled in those areas to maintain sustainable livelihood activities, three small tanks so identified will be renovated while developing the infrastructure facilities in such areas and handing them over to the original owners. Accordingly, a proposal made by Minister of Resettlement, Rehabilitation, Northern Development & Hindu Religious Affairs D.M. Swaminathan to re‑establish such facilities enabling to release the lands being occupied by the Tri‑Forces and to secure the funds required for the development of infrastructure facilities in the areas, was approved by the Cabinet.

Prime Minister Ranil Wickremesinghe has said that the appointment of former President Mahinda Rajapaksa as Prime Minister by President Maithripala Sirisena is unconstitutional, reports Colombo Page on October 26. Mr. Wickremesinghe has said that he would continue to function as the Prime Minster. "I am still the Prime Minister of this country," he has said in a statement. According to the Article 42 (4) of Sri Lanka Constitution the President "shall appoint as Prime Minister the Member of Parliament, who, in the President's opinion, is most likely to command the confidence of Parliament." Article 46 (2) says The Prime Minister shall continue to hold office throughout the period during which the Cabinet of Ministers continues to function under the provisions of the Constitution unless he - (a) resigns his office by a writing under his hand addressed to the President; or- (b) ceases to be a Member of Parliament.
