Reinforcements were sent to Solukhumbu Districtof Province No.1 on June 3 after Netra Bikram Chand-led Communist Party of Nepal-Maoist (CPN-Maoist-Chand) party’s ‘suspicious activities’, reports Kathmandu Post. On June 3 afternoon, reports surfaced that the CPN-Maoist-Chand had planned an attack on a Police post at Chheskam village in Mahakulung of Solukhumbu District prompting concerns among high-level security officials in Kathmandu.The Solukhumbu local administration denied that there was an attack or any plan of attack on the Police post by the Chand outfit. The office, however, admitted that activities of the CPN-Maoist-Chand were on the rise in the District in recent days.

While expressing concern over the delay in addressing transitional justice issues, Australian Ambassador to Nepal Pete Budd on June 4 said that the leaders directly or indirectly involved in rights violations could face arrest in any country including in Australia, reports Republica.Ambassador Budd expressed concern at dilly-dallying by political actors in Nepal over addressing the issues of serious human rights violations during the decade-long Maoist insurrection. He suggested Nepali political leaders resolve the issues of transitional justice at the earliest to avoid the involvement of extra-territorial elements.

Thirteen years after the end of Maoist insurgency, victims of sexual violence have not yet been identified, reports The Himalayan Times on June 5. Women and girls who suffered sexual violence at the hands of members of security agencies and Maoist combatants during the conflict are yet to get any relief, let alone justice. Former member of Truth and Reconciliation Commission (TRC) Manchala Jha told that while the actual number of victims of sexual violence could be much higher, only 322 women and girls lodged complaints at the TRC, claiming to have been raped during the conflict.She said sexual violence was committed against women and girls in 62 Districts during the conflict but many victims were not willing to come forward due to fear of stigma.

Top leaders of major political parties on June 5 started consultations on how to settle Maoist conflict-era cases, as pressure mounts on them for delaying justice for conflict victims, reports Republica.Chairmen duo of the ruling Nepal Communist Party (NCP) KP Sharma Oli and Pushpa Kamal Dahal and main opposition Nepali Congress (NC) President Sher Bahadur Deuba assembled at the Prime Minister's official residence at Baluwatar, Kathmandu and discussed possible modalities for wrapping up the much prolonged transnational justice process. The consultations were initiated a day after Australian Ambassador Pete Budd warned that Nepali leaders directly or indirectly involved in rights violations could face arrest while traveling to any foreign country including Australia if the transnational justice issues are not resolved in time.

A hearing on a review petition filed by the Government against the 2015 Supreme Court ruling on transitional justice was postponed on June 6, again, making it the 22ndpostponement since it was registered the same year, reports Kathmandu Post. It was the sixth postponement this year alone.A full bench comprising five judges led by Ananda Mohan Bhattarai was to decide whether to proceed with the hearing.It was the first case to be dealt with by a five-member bench. However, it decided not to proceed with the case after Judge Hari Prasad Phuyal, who had defended the case on behalf of the victims as an advocate four years ago, couldn’t hear it. In February 2015, the apex court had issued a landmark ruling ordering the Government to revise the Enforced Disappearances Enquiry, Truth and Reconciliation Commission Act-2014. The court ruled that the law failed to adhere to the principles of transitional justice and international practices. But in April that year, then Government led by Sushil Koirala filed a review petition, challenging the ruling that was issued by a special bench led by then chief justice Kalyan Shrestha.Then chief secretary Leela Mani Paudyal had filed the petition through the Office of the Attorney General.Conflict victims, who have been awaiting justice for more than a decade, have been demanding that the government withdraw the petition and amend the Act as per the top court’s ruling and Nepal’s international obligations.The continuous deferral, victims say, could delay the entire transitional justice process.

Lenin Bista, a former Maoist child soldier, on June 6 petitioned the United Nations Office of the High Commissioner for Human Rights in Geneva demanding justice for the thousands of former child soldiers who have been largely left out of the transitional justice process, reports Kathmandu Post.The petition seeks UN support to asking the Nepal Government to prioritise justice for former child soldiers, recalling that a serious crime was committed against the thousands of minors forced to fight on behalf of the Communist Party of Nepal-Maoist during the 10-year armed insurgency.Thousands of Maoist fighters like Bista had been disqualified for being minors during the verification process conducted by United Nations Mission in Nepal (UNMIN) in 2007. Among the 4,008 disqualified combatants, 2,973 were minors while the remaining 1,035 had joined the Maoist People’s Liberation Army after the first ceasefire of May 26, 2006 — six months before the peace deal was signed. The Government had provided between Rs 500,000 and Rs 800,000 for the combatants who chose voluntary retirement. However, those who were disqualified didn’t receive any substantial support, except for a few thousand rupees from the United Nations.

The opposition party lawmakers prevented from running the House session seeking an answer from Home Minister Ram Bahadur Thapa over the police intervention during the demonstration held in Kathmandu on June 8 against the proposed Guthi Bill. CVCP stated that it would not accept appointment of the office bearers if TRC Act was not amended as per the decision of the Supreme Court. CVCP added that the two transitional justice mechanisms had remained ineffective due to the government’s failure to amend the TRC Act as per the spirit of the Supreme Court verdict. The National Human Rights Commission (NHRC) has urged the Government to initiate action against the perpetrators of torture, reports The Himalayan Times on June 26. In a press statement released by the rights body coinciding with the International Day in Support of Victims of Torture on June 26, the NHRC said besides compensating the victims, the Government had done very little to bring perpetrators to book. Though some of the victims have been compensated by the Government, perpetrators categorically pointed out by the NHRC have yet to be booked. According to the NHRC, it has registered nearly 1,910 complaints related to torture. The rights body completed its inquiry into 1,000 complaints. Of the complaints settled by the rights body, 179 cases are related to recommendations for compensation to the victims and legal action against the perpetrators.

The committee formed to recommend chairpersons and members for the Transitional Justice (TJ) bodies has formed yet another panel with former justice Prakash Wasti as head to develop new criteria to pick candidates other than those who have already applied for the posts, reports My Republica on July 1.Altogether 57 candidates have submitted applications to the recommendation committee seeking appointment at the Truth and Reconciliation Commission (TRC) and Commission of Investigation on Enforced Disappeared Persons (CIEDP). But the committee is not satisfied with the current applicants. “A panel headed by Prakash Wasti will prepare a new criteria to pave the way for recommending candidates other than those who have already applied,” said Prem Bahadur Khadka, a member of the existing recommendation committee. The committee is mandated to recommend officials for TJ bodies from outside the current list of applicants if it feels the applicants are not competent enough to lead the organizations and settle the conflict-era cases. “We will recommend ten persons once Wasti’s team comes up with the criteria,” said Khadka. The leaders of the ruling Nepal Communist Party, which was formed a year ago by merging the Communist Party of Nepal-Maoist Centre (CPN-Maoist Center)and Communist Party of Nepal-Unified Marxist Leninist (CPN-UML), are also divided over whom to appoint as the chief of TRC as they have their own interests in dealing with the conflict-era cases. Sources say former UML leaders want to appoint Govinda Bandi as chief of TRC whereas former Maoist leaders have been pushing to appoint former attorney general Raman Shrestha. Nepali Congress is said to be lobbying for Surya Dhungel as TRC head.Nepali Congress has been demanding that the chief of the TRC be appointed as per its recommendation. Most war-era cases are filed against the Maoist and NC leaders. More than 12 years have elapsed since the government promised to settle the conflict-era cases.
