The Jharkhand government has once again urged the Union Home Ministry to provide additional paramilitary forces to tackle left-wing extremist—Naxalite activities in the State. The Union Home Ministry had earlier turned down the State police request for reinforcements and asked for a time-bound operation plan. Speaking to the media in Ranchi on February 1, a senior government official said, "We have sought 10 companies of paramilitary forces for three months, elaborating our plan of launching an anti extremist operation." The Jharkhand police have outlined operations with the help of paramilitary forces in Palamu, Lohardagga, Hazaribagh, Chaibasa and other districts in the plan.

The police are also reportedly trying to locate two public telephone booths allegedly set up by the outfit. Quoting highly placed sources the report further said that the apartment was purchased in a busy locality to avoid suspicion of the public and the police.

According to media reports of February 3, the United Arab Emirates (UAE) successfully resisted efforts of the Inter Services Intelligence (ISI), Pakistan’s external intelligence agency to provide safe passage to Imran Rehman Khan to Pakistan. Imran, a Dubai based alleged Lashkar-e-Toiba (LeT) terrorist and the main accused in the December 2-Ghatkopar bomb blast in Mumbai was deported to India, on January 9. Imran, during interrogations reportedly disclosed that the agents of Mafia don Dawood Ibrahim, tried to put pressure on authorities in Dubai for his safe passage to Pakistan, which was, however, turned down.

Separately, Intelligence sources reportedly informed that the ULFA hired four apartments on rent in the name of four local residents in Guwahati and also sponsored 10 rural unemployed youths to set up public telephone booths. This could also be a tactic to divert attention of the security forces in order to regroup the cadres in other areas, the report indicated. The report added that top ULFA cadres Prakash Gogoi and Rupa Baishya were reportedly looking for a 'suitable' hident in the Chandrapur area, situated on the outskirt Guwahati, to set up a base.

The United Liberation Front of Asom (ULFA), on February 2, called the differences over geographical boundaries in the Northeast an 'internal matter' and appealed for its resolution without the involvement of the Union government. The ULFA, in a statement in its mouthpiece Freedom, reportedly also asked the National Socialist Council of Nagaland-Isak Muivah (NSCN-IM) not to cherish hope of altering present boundaries with the help of the government. It said, " If anybody would like to change or rectify the all or any part of these existing territorial arrangement organized by both past British and present Indian occupations with the help of present occupation government of India there remain a little scope and hope". It also said, " Involvement of occupation India to solve our internal problem will only make those territorial problems more complex rather than any possible solution. We should consider that the problems belong to us and we must search proper way on our own to solve these problems. On the other hand, it will only be an exhibition of double standards to hire India to solve our own internal problems after having been declared India as a colonial occupation one". The statement added, "It would be the easiest and proper way to solve the enduring territorial problems within us in the peoples level, as we all know each other nation more accurately than alien Indian - It will be contradictory with respect to the objective reality to waste time for inter-regional territorial problems when we, the all have been engaging in a common battlefield." Meanwhile, the outfit has also owned up the responsibility for the blast at an underground oil pipeline in the Upper Mamoroni area of Tinsukia district, on January 21.

Media reports, on February 3, said the Chief Minister’s office in Hyderabad, Andhra Pradesh (AP) received a threatening letter allegedly sent by the Liberation Tigers of Tamil Ealam (LTTE) chief V Prabhakaran. The LTTE reportedly warned the AP government against human rights violation of the poor, especially the Tamils living in the areas, bordering Tamil Nadu. Citing official sources, media reports said that the seizure included two AK 56 rifles, an AK 47 rifle, three carbines, besides a huge quantity of ammunition. Meanwhile, the State police suspect that the arms and ammunition belonged to Dister Marbaniang, a Hynniewtrep National Liberation Council (HNLC) terrorist who was arrested recently. A suspected HNLC terrorist was also subsequently detained for interrogations, reports added.

On a specific intelligence input, the Delhi Police arrested a woman identified as Anjum Zamrooda Habib after she came out from the Pakistan High Commission premises. An amount of Rupees 3.07 lakh besides some documents and propaganda material was recovered from her possession, Joint Commissioner of Delhi Police (Special Cell) Neeraj Kumar told reporters on February 6. He said Anjuam, leader of the Muslim Khawateen Markaz, a constituent of the APHC, revealed during interrogation that she had received the money from Pakistan’s Deputy High Commissioner Jaleel Abbas Gilani and was referred to him by the Hurriyat chairman Abdul Gani Bhat and Shabir Dar. She reportedly also revealed that Dar was frequenting the Pakistan High Commission for receiving money for an unnamed terrorist outfit. Both of them have been arrested under the Prevention of Terrorism Act (POTA) and are to be produced before a Magistrate on February 7, today, the Joint Commissioner said.

The meeting would be held in New Delhi on February 10 to sign an agreement on the formation of the Bodoland Territorial Council (BTC) to resolve the vexed Bodo issue. Government officials fear that the lower Assam districts, including Kokrajhar and Dhubri among others, may witness untoward incidents as the Sanmilita Janagosthiya Sangram Samiti (SJSS), an umbrella organization of approximately 18 non-Bodo groups in the region, is opposed to the formation of the BTC. Further, the proscribed United Liberation Front of Asom (ULFA) has allegedly supported the SJSS's position. However, the other proscribed outfit, the National Democratic Front of Bodoland (NDFB) has opposed to the SJSS. According to a media report, the Tehreek-ul-Mujahideen (TuM) has decided to suspend terrorist attacks on security forces (SFs) in Jammu and Kashmir (J&K) for six days in view of the forthcoming Eid-uz-Zuha festival as a gesture of goodwill and peace, a spokesperson of the outfit was quoted as saying in a statement. He said the decision was taken at the group’s ‘command council’s’ emergency meeting presided over by its Amir-e-Aala (chief), Sheikh Abdullah Mubarak. In view of Eid-uz-Zuha, the spokesperson said, the TuM decided to suspend "its precision attacks" on the SFs for six days from February 10 to 16. "The militants have been directed to suspend their attacks on army units, patrol parties or security personnel during the six days. The direction will also apply to Ikhwanis [counter-insurgents], Task Force and renegades", he said. He also said that the decision had been taken only as a temporary measure and should not be construed as a "cease-fire".

At a tripartite meeting in New Delhi, the formation of Bodoland Territorial Council (BTC) in the Bodo dominated areas of Assam was approved on February 10. This was announced after a meeting of the representatives of the Union and State governments along with a Bodo Liberation Tigers (BLT) delegation in Delhi. Among those present at the meeting were the Assam Chief Minister Tarun Gogoi and Deputy Prime Minister L.K. Advani. The BLT delegation included its 'chairman' Hagrama Basumatary who signed the agreement on behalf of the outfit, 'vice chairman' Kamal Mushahary, 'secretary general' Derhasat Basumatary and 'publicity secretary' Mainao Daimary. The BLT had declared a unilateral ceasefire in July 1999 in response to the Union government’s appeal for talks. The BTC would comprise 40 elected representatives and six more are to be nominated by the Assam government. Of the elected representatives, 30 seats would be reserved for tribals, five for non-tribals and five more would remain open for contest. Meanwhile, the Sanmilita Janagosthiya Sangram Samiti (SJSS) a platform of approximately 18 non-Bodo organisations termed the BTC accord as a 'suicidal move' for the State as well as the country. Separately, speaking in New Delhi, Chief Minister Tarun Gogoi said that the BTC accord would ensure peace and development in the Bodo dominated areas in the State. He also informed that the Union government has decided to sanction Rs 100 crores for infrastructure development in the BTC area. He added that signing of the Accord has once again proved that solution for such issues lies in a 'political settlement'.

Official sources said that the BSF personnel who were on routine patrol were attacked with sophisticated weapons at a spot some three kilometers away from the BSF’s Lokchao camp. The sources added that the KYKL also managed to snatch away three service SLRs (self loading rifles) from the injured personnel before escaping. Later, in a telephonic message the KYKL reportedly claimed responsibility for the killings and also claimed that the KYKL’s Lalhaba Tengol-1 had carried out the attack. They also claimed that three INSAS rifles, 12 magazines and 240 rounds of ammunition along with two grenades were taken away during the ambush. The intruder, identified as Rasool, is believed to be an Afghan national and speaks Afghani, the sources further said. He had sneaked into the Indian territory by crossing over the barbed wire. After preliminary interrogation by the BSF, Rasool was handed over to the Mamdot police and later sent to remand till February 16 by the local court. The sources indicated that interrogation of the intruder is likely to reveal how he crossed over to the Indian side despite fencing and vigil on the international border. The State's Education Minister Takam Sanjoy reportedly said that following a cease-fire agreement with the Union government, cadres of both the factions of the National Socialist Council of Nagaland, Isak Muivah (NSCN-IM) and the Khaplang (NSCN-K) have set up base-camps in these districts. He said, "We want a solution to the Naga problem and the Government of Arunachal Pradesh is ready to extend full cooperation to the ongoing peace talks". However, the State is against altering of present boundaries of the States in the Northeast. He also said that Arunachal’s areas bordering Assam have also allegedly become 'sanctuaries' for the Assam-based United Liberation Front of Asom (ULFA). The State government contends that it does not have adequate security forces (SFs) to tackle these terrorist outfits. The Minister alleged that the State's demand for additional SFs has not been met thus far by the Union government. Separately, welcoming the February 10-Bodo agreement on formation of the autonomous Bodoland Territorial Council (BTC), he added, "If this situation continues, the only island of peace in the North-Eastern region may be taken over by the terrorists and unwanted elements."

Speaking to media persons in Ranchi, he conceded there had been instances when the POTA had been misused. He said, "I have also come to know about the misuse of POTA. Police should differentiate between (innocents and) real culprits before booking any person under POTA." Jharkhand has been using the POTA to crack down on left-wing extremists—Naxalites—active in the State. Recently, a fact-finding team comprising lawyers, scholars and social activists visited the State and submitted a report to police chief RR Prasad saying POTA was being grossly misused. According to the team's report, 3,200 people have been accused and 202 arrested in a total 644 cases filed under POTA in Jharkhand. In contrast, it pointed out that only 100 people had been arrested and 400 accused under POTA in Jammu and Kashmir.

Committee chairman Richard Lugar and ranking member Joseph Biden reportedly raised the issue during a hearing on February 12 and cited reports indicating renewed ISI assistance to Taliban and Al Qaeda. Lugar pointed out that elements within the ISI that backed the Taliban earlier were attempting to regain influence in Afghanistan by facilitating the infiltration of terrorists across the border. Hailing the new Bodo Accord approving the creation of an autonomous Bodo Council signed on February 10 in New Delhi as a "success story" he said, "We are hopeful that the ULFA will come forward for negotiations without imposing any condition. We held unconditional talks with the Bodo rebels and achieved a major breakthrough." He further said, "The people are yearning for peace and I hope that the ULFA will honour the will of the people of Assam and work towards peace. We will not hesitate to talk with the ULFA. No doubt, it operates in a very important state but the outfit should come with an open mind." The ULFA has not responded to similar offers from the Union government in the past and has insisted on three preconditions for negotiations —talks should be held in the presence of United Nations (UN) observers, that it should be held in a "third" country and the issue of Assam's 'sovereignty' must be discussed during the talks. The figure during the corresponding period in 2001-2002 was 467. However, the percentage of foreign mercenaries among the infiltrators during the present period has increased to approximately 80 per cent as compared to 24.62 per cent during the same period in 2001-2002, the report said. The ISI is reported to have infiltrated 241 foreign mercenaries and 63 local terrorists during November 2002 and February 2003 as compared to 352 locals and 115 foreigners during the corresponding period in 2001-2002.

According to police sources, the encounter took place when a police team checking vehicles on Namiligundupally road asked two persons going on a motorbike to stop. But, the duo opened fire at the police. The police retaliated in which the surrendered Naxalite was killed. Media reports said, on February 18 Mohammed Altaf, an accused in the December 2, 2002-bomb blast inside a bus in Ghatkopar, Mumbai, informed a special Prevention of Terrorism Act (POTA) Court that police had forcibly obtained his signature on a version of his confession. He said that confession was not what he made, on February 17. Subsequently, a Magistrate had, on February 18, recorded his confession. Altaf confirmed its contents before the POTA Court and said it was voluntary. He said in his confession before the Magistrate, "Myself, Abdul Mattin, Yunus Khwaja, Muzzamil Ahmed and Zahir Shaikh are innocent and not involved in Ghatkopar bomb blast or in the conspiracy to trigger the explosion… We do not believe in jihad. Jihad is not wanted in India. It may be relevant in Palestine, but not in India. We also do not believe in fundamentalist activities," he added. The POTA Court remanded Altaf and the other accused to further custody till February 28. Altaf was deported from Dubai on January 26, 2003 and arrested under POTA.

They had also reviewed the strategies being used by police against the PWG. After committing an offence in one district, PWG squads are slipping into another district by crossing the borders under the cover of forest or by crossing Krishna. Enhanced coordination and sharing of information between police in the five districts was reportedly empahised at the meeting. According to official sources, security forces (SFs) intercepted a group of nine LeT terrorists while clandestinely entering the Indian territory in the Hari Gala area, near Ghani village, and asked them to surrender. However, the terrorists opened unprovoked indiscriminate firing on the SFs. Seven terrorists were killed in the ensuing prolonged encounter. There were no casualties on the SFs side. Two more terrorists were hiding in a nearby forest area near Ghani village and a search was on for them when reports last came in. Bodies of all the seven terrorists killed in the encounter were recovered from incident-site, nevertheless, their identity could not be established immediately. The decision came after human rights groups said the POTA was being misused in the State. They were arrested for exchanging letters written by Naxalites. Kashmir Committee, on February 25, removed Ashok Bhan as its convener for declaring that the Committee had ceased its activities following N.N. Vohra’s appointment as the Union government’s interlocutor on J&K. Committee chairperson Ram Jethmalani, meanwhile, welcomed Vohra’’s appointment and said the Committee "does not believe that its role is exhausted by this appointment.'' He also said, the Committee was unhappy with the convenor’s announcement, which has been disowned immediately." He added Bhan is no longer associated with the Committee and the Committee is of the unanimous view that, in the interest of the country, "it should vigorously pursue its objective of finding and facilitating a peaceful, honourable and lasting solution [to] the chronic problem of Kashmir." He said the Committee would continue to promote dialogue with all "relevant elements within and outside the country." Bhan, claiming to be speaking for the entire Committee, had reportedly said, on February 22, the Committee was suspending talks with separatist groups in the State and that this suspension could be treated as a prelude to its winding up.

Both the accused were charged in October 2000 with conspiracy, murder and attempted murder in connection with the explosion off-the Irish coast inside Air India flight 182––Kanishka––which killed all 329 people on board, on June 23, 1985, after it left Vancouver in Canada to New Delhi. Earlier, a third accused in the case, Inderjit Singh Reyat, pleaded guilty for his role in making the bomb that blew up the plane and was sentenced to five years imprisonment under a plea agreement with prosecutors. Police sources said the Maoists were arrested following interrogation of four Maoists arrested from the same place on February 26. The Maoists were reportedly distributing leaflets in Nepali calling for mobilization of people for a ‘violent and subversive struggle’ to restore democracy and hold early elections to a new ‘Constituent Assembly’ in Nepal. Speaking to media persons, a senior police official said the Nepalese government would be informed of the arrests. The interrogation of the arrested insurgents led to the trail of a Maoist ring operating in Kolkata and its suburbs. Police have detained 10 Nepalese youth for questioning. Police sources said these Nepalese youth are believed to be on a ‘recruitment drive’ and had conducted ‘motivation and training classes’ for new recruits. There are about 100,000 Nepalese living in Kolkata. Raids on several houses in Tiljala, Barasat and Hooghly areas on February 27 provided evidence of the activities of the Maoist insurgents in the city. Police said raids would continue.

The accused––Mohammed Altaf, Imran Reheman Khan, Abdul Mattin Abdul Basit, Shaikh Mohammed Muzzamil Jamil Ahmed and Zahir Ahmed Bashir Ahmed Shaikh––were booked under POTA for triggering a blast inside a bus at Ghatkopar in Mumbai, on December 2, 2002.
