Supreme Court on January 2 cleared the decks for the Government to endorse the second Constitution amendment bill as it decided that an interim order should not be issued staying the bid, reports The Himalayan Times. A division bench of Chief Justice Sushila Karki and Ishwor Prasad Khatiwada issued the order that the Judiciary could not bar the Legislative from using its wisdom in the formulation of legislation on the basis of the principle of separation of powers. The bench was responding to two writs filed separately by advocate Tikadhwaj Khadka and five others including Bishnu Bahadur Raut.

CPN-UML proposed withdrawing the proposal concerning provincial boundary revisions from the constitution amendment bill in order to find a consensus among the major political parties. “We have reservations over the other provisions also. But we are ready to allow the holding of discussions on the other provisions if the proposal concerning provincial boundary revisions is withdrawn,” CPN-UML Standing Committee Member Shanker Pokharel told.

Top leaders of Nepali Congress (NC), Communist Party of Nepal-Maoist Centre (CPN-Maoist Center) and United Democratic Madhesi Front (UDMF) at a tripartite meeting held at the Prime Minister’s residence in Kathmandu on January 5 have decided to table the constitution amendment bill at the parliament meeting scheduled for January 8, reports Republica. They decided to table the bill concluding that the Supreme Court’s ruling has cleared path to take the bill forward into the House. The parties also agreed that the Government would receive the Local Bodies Restructuring Commission (LBRC) s report at the earliest and move ahead for local, provincial and federal elections.

Local Bodies Restructuring Commission (LBRC) on January 6 submitted its report to the Government recommending creation of 719 local bodies across the country, reports The Himalayan Times. The LBRC submitted a 1,718-page report to Minister of Local Development Hitraj Pandey in the presence of Prime Minister Pushpa Kamal Dahal at Singha Durbar. Of the 719 local bodies, 256 (35 per cent) are in 20 Districts of Madhes. As per the report, there will be four metropolitan cities, 12 sub-metropolitan cities, 241 municipalities and 462 village councils. The local bodies will be divided into 6,553 wards.

The opposition parties were protesting the Constitution amendment bill that the Government registered at the House on November 29. However, Minister for Law Justice and Parliamentary Affairs Ajaya Shankar Nayak tabled the bill amid the protests on January 8. Ruling and the opposition Member of Parliaments (MPs) opposed Local Bodies Restructuring Commission (LBRC) report for restructuring the local bodies, reports The Himalayan Times on January 13. They also warned that mass protests would break out if the Government failed to correct the boundaries of the local bodies on time. Nepali Congress (NC) lawmaker Deepak Kuinkel said the LBRC report was not in sync with the ground reality. Tarai Madhes Sadbhawana Party-Nepal (TMSP-N) lawmaker Mahendra Ray Yadav said the LBRC office bearers had restructured local bodies sitting in the capital after they failed to do field work in Province 2. Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) lawmaker Panch Karna Rai said the LBRC recommended some places as local units even though local people had not resorted to such a demand.

Prime Minister Pushpa Kamal Dahal has expedited preparations to induct more Ministers in his cabinet in an apparent bid to garner support of more parties in favor of the Constitution amendment bill, reports Republica on January 14. Highly-placed sources said Prime Minister has already held talks with the top leaders of the Rastriya Prajatantra Party (RPP), Madhesi People's Rights Forum-Democratic (MPRF-D) and various fringe parties including the Janashakti Party Loktantrik, Nepal Family Party, Bahujan Shakti Party and Nepa Party to bring them on board the amendment bill. The Government is optimistic that it would be able to secure the required two-thirds majority votes in favor of the bill once the top leaders of these parties currently in the opposition rank are brought on board the Government.

The PM asked them what would be their reaction if the Government made preparations for election and announced election date after completing the process for constitution amendment. Likewise, Dahal asked the Madhesbased parties if they would participate in the elections even if the parliament rejected the amendment bill. The PM also asked them whether or not the agitating parties would be ready for local polls if some reasonable changes are made to the report of the local level restructuring commission in line with their demands. Similarly, the PM informed the Madhesbased leaders that the ruling coalition is ready to address their demand for making further changes to the amendment bill only on the issues of language of official business and removing village council chairperson, vice chairperson, municipality mayor and deputymayor from the Electoral College, which elects members of the National Assembly. PM Dahal also made it clear that the ruling coalition was not able to make any changes to the provincial delineation more than what has been proposed in the amendment bill but that he was ready to settle other delineation disputes through the Federal Delineation Commission. The Supreme Court scrapped the Truth and Reconciliation Commission (TRC) guidelines for putting insurgency-era rights violation cases on hold, reports The Himalayan Times. A division bench of justices Jagadish Sharma Poudel and Dipak Kumar Karki scrapped the TRC guidelines, stating they were against the provision of the TRC Act and Regulations. Nepali Congress leader and General Secretary of Conflict Victims National Society Binaya Dwaj Chand, along with other 15 conflict-victims organisations, had filed a petition against the guidelines on September 26, 2016. The apex court had earlier issued an interim order against the guidelines. The TRC had prepared the guidelines for putting on hold insurgency-era human rights violation cases on several grounds, including lack of evidence and inadequate details. Thousands of conflict-era cases were likely to be shelved without conducting any inquiry if the guidelines were followed.

LBRC member Neeraj Sah said LBRC received over 50 phone calls and multiple delegations everyday from across the country seeking changes in the report.”The government cannot make selective revisions. If the report is revised it will set a bad precedent and will become a never ending process,” said another LBRC member Sunil Ranjan Singh. He said the report was prepared keeping in mind both the geography and the population. He added that neither the government nor any task force had the authority to revise the document and the report could be revised only after its implementation. “It will be unconstitutional to revise the report,” said Singh. Meanwhile, Minister for Federal Affairs and Local Development Hitraj Panday, who is also the head of the government’s task force to study the LBRC report, said the task force would study the report thoroughly and recommend its revision, if needed. Expressing dissatisfaction with its contents, the government has refused to endorse the report saying further consultations were needed on the report among the political parties. The constitutional body had submitted its report on number and boundaries of local bodies to the government on January 6. Apart from determining the number and boundaries of local bodies, the LBRC is mandated to prepare a report on the special, protected and autonomous regions, their economic feasibility and structure of the public administration in the federal model by March 13.

The opposition, which was against allowing deliberations on the amendment bill in parliament, said that the agitating Madhesi parties must commit to accepting the result of the parliamentary vote on the bill and participate in local elections. “We have become flexible in our previous stance following the government's request for creating an environment for local polls. But the UDMF (United Democratic Madhesi Front) must express its commitment to accepting the result of the voting on the bill in parliament and it must be ready to participate in local elections,” Bhanu Bhakta Dhakal, chief of the Communist Party of Nepal-Unified Marxist Leninist (CPN-UML), said. A meeting of the CPN-UML parliamentary party and a separate meeting of the nine-party alliance decided to demand that the Government and the UDMF express commitment to accepting the voting result in parliament and that the UDMF commit to participating in the local elections. “The government and UDMF must make it clear that they will accept the result of the vote in parliament. With this addition, the total number of conflict victims has now reached 139,711. They suffered in various ways at the hands of either the security forces or the Maoist rebels. Some of them lost family members and others incurred property losses. Likewise, some family members were abducted or involuntarily disappeared. According to the taskforce, which was formed on January 19, out of the total of 3,830 newly-verified conflict victims, 1,630 were mutilated or injured in other ways, 788 were abducted, 651 displaced, 485 suffered property losses, 125 were killed, 83 were disappeared and 68 children were orphaned.

A few incidents of disruption and violence in some Districts notwithstanding, Chief Election Commissioner Dr Ayodhee Prasad Yadav said in a press conference, voting concluded peacefully and in free and fair manner. Voting was carried out in Province No. 3, 4 and 6 in the first phase to elect leadership in 281 local levels, including four metropolitan cities, one submetropolitan city, 92 municipalities and 186 rural municipalities today. Two rural municipalities, one each in Manang and Dolpa districts, had unanimously elected their representatives without voting. Parliament on June 8 amended a provision of the Local Level Election Act through a fast-track process, smoothing the way for the agitating Rastriya Janata Party Nepal (RJPN) to participate in the second phase local polls scheduled for June 28, reports Republica. With the amendment, any political party that missed the deadline for submitting the signatures of its representatives for the purpose of candidacy nominations can now submit those signatures. As per the deadline originally set by the Election Commission (EC), all political parties participating in the second phase polls must have registered the names of their representatives by June 2. The hitherto existing provision had stated that political parties must submit the signatures of their representatives at least 15 days before the date for candidacy nominations. The amendment allows the parties to register names within a deadline given by the EC. As per the new provision, the EC will specify the number of days ahead of the nominations by which the political parties need to register their representatives.

Protesters vandalised at least three vehicles at Mujeliya and one hardware shop at Bramarpura. In Mahottari, RJP-N members vandalised a vehicle belonging to Deep Narayan Sah, a former state minister. Sah said he and his driver sustained injuries when protesters hurled stones at his vehicle. Protesters also obstructed a programme of an NGO being held at the Red Cross building in Jaleshwor. In Saptari, passengers were left in the lurch after buses were stopped at Rupani, Shambhunath, Kadmaha and Kalyanpur areas along the East-West Highway. A Cabinet meeting decided to defer the polls in Province 2 and change the election calendar in the three other provinces. “Elections in Province 2 will now take place on September 18 and the polling in the remaining provinces (1, 5 and 7) will be conducted as scheduled although the poll-related calendar has been revised without impacting the polling date,” said Minister for Labor and Employment Farmullah Mansoor after the meeting. This is the fourth poll deferral. Initially, the Government had fixed May 14 as the poll date across the country. Just ahead of nominations day, the Government decided to conduct the elections in two phases. Eighty percent of the eligible voters cast their ballots in Bajura, while the lowest turnout (61 percent) was recorded in Bhojpur. The second phase turnout is slightly less compared to 73 percent in the first round. Altogether 62,408 contestants contested 15,038 positions at 334 local units in the second phase local polls. The Government conducted the first phase elections in the 283 local units of Provinces 3, 4 and 6 on May 14. The election in Province 2 is set for September 18.

RPP was planning to vote against the bill. The party has 25 votes. The last effort to pass the bill had failed after around ten lawmakers of royalist RPP suddenly disappeared just before the voting process. The Government will need votes of two-thirds parliamentarians or 396 votes in the 593-strong parliament to pass the bill. The Government seems in control of 359 votes including NC’s 207 votes, Maoist Center’s 82 votes, RJPN’s 25 votes, Nepal Loktantrik Forum’s 17 and Federal Socialist Forum Nepal’s 15.

A Communist Party of Nepal-Maoist Centre (CPN-Maoist Centre) cadre who was pronounced guilty of murder by the District Court of Bara, lured by financial inducement and under pressure from Home Minister Janardan Sharma has been let free instead of being jailed, reports Republica on August 31. The District Court had slapped 20 years jail term on Ashok Kumar Sah Kalwar of Barainiya village, Bishrampur Rural Municipality-2. However, lured by financial inducement and under pressure from Home Minister Janardan Sharma, Bara Police let him walk free after detaining him for a night, various sources have claimed. Kalwar was arrested on August 21. However, the Police released him the next day, an officer of the Police post confirmed. Kalwar is close to Maoist leader Prabhu Sah, who is also currently the Minister for Urban Development.

Rashtriya Janata Party Nepal (RJPN) on September 1 submitted a memorandum to Prime Minister Sher Bahadur Deuba, opposing the report submitted by Constitution Delimitation Commission (CDC), reports The Himalayan Times. The party had drawn the attention of the Government to the discriminatory report of CDC which reduced five parliamentary electoral Districts in Madhes. The party also said that the CDC created electoral Districts to suit the interests of the major three parties and the report also broke clusters of ethnic groups and communities. The party said the CDC created only 78 first-past-the-posts (FPTP) electoral Districts in 20 Districts of Madhes which has 51 per cent population as per 2011 census report. It said 78 FPTP seats were only 47.27 per cent of the seats. The party said that 20 districts of Madhes had got 116 FPTP seats in the past when there were 240 FPTP seats in the country and that was 48.33 per cent of FPTP seats against 48.4 per cent population of the region.

India and Nepal on September 3 began their joint military exercise in the western part of the Himalayan country, focusing on counter-terrorism and forest fighting operations, reports Hindustan Times. The exercise - Surya Kiran - was being participated by around 300 troops each side in Rupandehi District in Nepal. Senior Nepal Army officer Rajendra Karki inaugurated the exercise, according to a statement by the army. The 12th edition of Nepal-India joint military exercise will conclude on September 16. According to the Indian Army officials, the Surya Kiran is the largest joint exercise in terms of troop participation. The battalion-level joint training between the two armies will focus on counter-terror operations in mountainous terrain by facilitating interoperability.

The report of the Constituency Delimitation Commission (CDC) was presented at the Legislature-Parliament meeting on September 4, reports The Himalayan Times. Minister for Law, Justice and Parliamentary Affairs Yagya Bahadur Thapa, on behalf of the Prime Minister, presented the report in the meeting. Meanwhile, the Supreme Court (SC) on September 4 directed the Government to hold all types of elections, including the election for the President and Vice-President of the country by January 21, reports The Himalayan Times. The order was passed by a division bench of justices Deepak Raj Joshee and Hari Krishna Karki. Senior Advocate Chandra Kant Gyawali and others had filed the petition seeking an order from the apex court to the government in this regard. The apex court also ordered the Government to bring laws to ensure that all the elections that the Government was supposed to hold were conducted by January 21. The petitioners had named the Office of the Prime Minister and Council of Ministers, among others, as defendant.
