On September 1, Sri Lanka's Tamil-controlled Northern Provincial Council (NPC) unanimously called for an international probe into the alleged war crimes committed towards the end of the war with the Liberation Tigers of Tamil Eelam (LTTE), reports Colombo Page. The Chief Minister of the NPC C.V. Wigneswaran passed a resolution rejecting the domestic process being proposed by the United States (US) and other members of the international community. While acknowledging the "long standing efforts" of the US and India along with the international community in securing justice, the NPC dismissed a domestic mechanism backed by the US as Sri Lanka has had a "long and blighted history of human rights violations' which according to the NPC amounts to genocide. The NPC, which is controlled by the main Tamil party, Tamil National Alliance (TNA), said in its resolution that the trial of the alleged perpetrators should not take place through any mechanism instituted by the Sri Lankan Government as a State also incurs responsibility for the acts of its agents. "Under these circumstances, the trial of the perpetrators of international crimes by a domestic mechanism would be a travesty of justice as it would amount to the potentially guilty Government trying its own agents, thereby violating the prohibition in the maxim nemo iudex in sua causa," the resolution said.

Former minister John Amarathunga said the government will be compelled to hand over former chief international arms procurer for the Liberation Tigers of Tamil Eelam (LTTE) leader Kumaran Pathmanathan alias KP, if India wanted him in connection with the killing of former Indian Prime Minister Rajiv Gandhi, reports Daily Mirror on September 3. Amarathunga said it had now been revealed that all evidence against KP, who provided the funds to the LTTE and nourished it had been completely destroyed during the Mahinda Rajapaksa regime. Under these circumstances it had become impossible for the Attorney General to file a case against him, he said. Although evidence against KP had been destroyed in Sri Lanka he was the only suspect living now in the case of Rajiv Gandhi murder, he said.

Sampanthan as the Opposition leader, the government had given undue recognition to the separatists, reports The Island. Muzammil, addressing a news conference at the party head office at Battaramulla, Colombo, said: "The national government has removed the check point at Omanthai and the High Security Zone as well as the Sampur army camp while releasing the LTTE suspects who were in remand." Those who pretend to be patriots and defenders of the country on political platforms and in TV talk shows in the run-up to the election like Anura Kumara Dissanayake and Patali Champika Ranwaka were today silent about threats to national security, he alleged. Sri Lanka will maintain the close relationship with China that provided strong support to help Sri Lanka end its 30-year civil war with the Liberation Tigers of Tamil Eelam (LTTE) rebels in May 2009, Field Marshall Sarath Fonseka said, reports Colombo Gazette on September 7. “Without China’s support we would have not been able to finish the war, basically,” Fonseka told Xinhua in an interview. China is one of Sri Lanka’s oldest and strongest friends and the nation provided assistance and support to end the civil conflict, said Fonseka, who took the post of army commander in 2005 and led the island nation’s forces to conduct victorious campaigns against the LTTE rebels ending the civil war. “With China we have had a historic relationship. So I think we must maintain that relationship and we will not forget what China has done for our country,” Fonseka said.

A report on alleged Human Rights violations in Sri Lanka during the Eelam War is likely to be presented on September 30 during the 30th session of the United Human Rights Council, reports The Hindu. As per the present time table, the subject on Sri Lanka will come up during the third and final week of the Council's session, which starts on September 14 and concludes on October 2. The sitting on Sri Lanka is expected to go on for three hours on September 30. Prepared by the Office of the United Nations High Commissioner for Human Rights Investigation on Sri Lanka (OISL), the report is a sequel to the adoption of a resolution adopted by the UNHRC in March 2014, requesting the Commissioner to “undertake a comprehensive investigation into alleged serious violations and abuses of human rights and related crimes by both parties in Sri Lanka during the period covered by the Lessons Learnt and Reconciliation Commission (LLRC) [which is February 21, 2002 to May 19, 2009]." The period signifies two events - the commencement of a ceasefire agreement between the Sri Lankan government and the Liberation Tigers of Tamil Eelam (LTTE), and the conclusion of the Eelam War.

The National Fisheries Solidarity (NAFSO) movement organised a roundtable in the Sri Lankan capital of Colombo on September 7, to discuss a report, titled “Let them come back to their places of origin in and with dignity”, the study centered on the situation in 38 refugee camps in 27 villages, reports Asia News. Completed in late August, the report indicated that about 35 camps have existed since the 1990s, but five of them were hitherto unknown. Some 1,536 families or 5,836 people live in the camps. However, about 30,000 people are still internally displaced on the Jaffna Peninsula. The island nation saw a brutal civil war between the government and Tamil Tigers [Liberation Tigers of Tamil Eelam, LTTE]. The latter sought to create an independent state in the predominantly Tamil provinces of northern and eastern Sri Lanka. These areas bore the brunt of 30 years of bloody civil war between the army and rebels, and the civil war ended with the rebels’ defeat. NAFSO coordinator Lavina Hasanthi told Asia News that the overall picture of the situation is still incomplete because many displaced people are not registered at refugee camps. Some in fact prefer to live in makeshift tents near their original home. NAFSO president Herman Kumara, a special guest from the World Forum for Fisher People (WFFP), told Asia News that 55 per cent of those living in the camps do not have electricity, and 70 per cent do not have access to clean water. He also noted that lavatories are almost non-existent, and where they do exist, they are off-limits at night. "As human rights activists, all we can hope for is for our fellow citizens to lead a life based on dignity,” he said. “We anticipate that displaced people will go back to a normal life, on their land, revive their culture so as to contribute to the country’s economy. Above all, we want to see them get out of their currently subhuman conditions and start to lead a decent living.”

Sri Lanka's Attorney General (AG) Y J W Wijayatilake clarified that the former Liberation Tigers of Tamil Eelam (LTTE) international wing leader, Kumaran Pathmanathan alias KP, has not been exonerated of charges of terrorism, though, investigations into 46 of the 193 cases against him had revealed that he had no role to play in those acts of terrorism, reports Colombo Page on September 11. In a statement published in the state-owned Daily News, Wijayatilake said in a Writ Application filed in the Court of Appeal, 193 cases of terrorism in which KP was allegedly involved were cited. Out of these 193 cases, 46 had been investigated and no evidence was found to implicate KP in them. This was told to the court. Since there were many cases to be investigated, the Attorney General's office did not say that KP had been "exonerated", Wijayatilake said.

The intensification of the anti-government conflict in Syria has had a deleterious effect on Sri Lanka's internal stability and security more than six years after the island nation successfully defeated the Liberation Tigers of Tamil Eelam (LTTE), IHS Jane's 360 weekly reports says, reports Colombo Page on September 11. According to the Open Source Intelligence (OSINT) Summary report, after the final defeat of LTTE in May 2009, Sri Lanka has remained largely free of the threat of violence by non-state armed groups. However, as with many other countries, the intensification of the anti-government conflict in Syria, is threatening Sri Lanka's internal stability and security, as indicated by the events over the past several months. It has indicated that Sri Lanka is not immune to the danger posed by the radicalization and recruitment techniques of the Islamic State (IS) and has necessitated an enhanced response by the Security Forces, the defense weekly noted. According to Jane's the first indications of this came in late July when unverified social media posts claimed that a Sri Lankan national, identified as Sharfaz Nilam Muhsin alias Abu Shuraih Saylani (37), had been killed in a United States-led coalition airstrike in an unspecified area of Syria on July 12, 2015, while fighting for the IS. Following the revelation of the death of the Islamic State of Iraq and Syria (ISIS) militant, Sri Lankan Prime Minister Ranil Wickremesinghe ordered the authorities to conduct a thorough investigation and question his family members to find out whether they also have any connections to the militants and whether he was a part of a Jihadi network in Sri Lanka.

A group of radical Tamils led by Northern Provincial Council (NPC) members MK Shivaji Lingam and Ananthi Sasitharan are at the tail end of their four-day march from Kilinochchi to Jaffna, demanding an international inquiry into the charges of war crimes against the Sri Lankan armed forces, and an international court to try the alleged perpetrators, reports New Indian Express on September 14. Speaking to New Indian Express from Kaithady in Jaffna, Shivaji Lingam said about 50 people are in the rally, which will wind up at Sangiliyan Thoppu in Jaffna, which had been the seat of the Tamil kings of yore. “I am in the march both as a Tamil and as a victim of war crimes,” said Ananthi Sasitharan. She had seen her husband Sasitharan alias Ezhilan, surrender to the Lankan army on May 16, 2009, at Mullaithivu. But till date, he is untraceable, with the army and every other agency saying that they have no information about him. Ananthi pointed out that her case is only one among hundreds of men and women of the Liberation Tigers of Tamil Eelam (LTTE) who had voluntarily surrendered to the Lankan forces in the hope that they would not be killed. On why she rejected a Lankan domestic mechanism to probe crimes charges and render justice, Ananthi said, “We have had many domestic mechanisms in the past and all have failed.”

The Government of Sri Lanka has been provided with a copy of the United Nations (UN) report on the investigation into the alleged war crimes committed during the final phase of the war against the Liberation Tigers of Tamil Eelam (LTTE), reports Colombo Page. The report, scheduled for public release at the 30th session of the UN Human Rights Council (UNHRC) which begins on Monday (September 14) in Geneva, has been received Friday (September 11) night, according to a Foreign Ministry source. Foreign Minister Mangala Samaraweera is expected to use the speech to lay out his Government's plan for reconciliation and a domestic accountability mechanism that he hopes will be endorsed by the Council. According to the Foreign Ministry officials, Sri Lanka has five days to prepare the response to the report in writing. UNHRC High Commissioner, Zeid Ra'ad Al Hussein will present his report on Sri Lanka on September 30. The presentation will be followed by a discussion.

The much-awaited report of the Office of the United Nations High Commissioner for Human Rights Investigation on Sri Lanka (OISL) will be made public on September 16, reports The Hindu on September 14. The report, concerning alleged war crimes, is a result of a resolution adopted in March 2014, calling upon the Commissioner to “undertake a comprehensive investigation into alleged serious violations and abuses of human rights and related crimes by both parties in Sri Lanka during the period covered by the Lessons Learnt and Reconciliation Commission (LLRC)." The LLRC dealt with the period between February 21, 2002 and May 19, 2009, signifying two events — the commencement of a ceasefire agreement between the Sri Lankan government and the Liberation Tigers of Tamil Eelam (LTTE) and the end of the Eelam War. Announcing this during the inauguration of the 30th session of the United Nations Human Rights Council (UNHCR) in Geneva on Monday, UN High Commissioner for Human Rights Zeid Ra'ad Al Hussein said that along with the report, he would make his recommendations. According to a press release issued by the UN, a press conference would be held in Geneva on September 16, at 10. 30 am (local time). The UNHCR Commissioner, in his remarks, pointed out that the report’s findings were “of the most serious nature.” While welcoming the “vision” shown by President Maithripala Sirisena since his election in January 2015 and the commitments made by the new government under his leadership, Al Hussein said “this Council owes it to Sri Lankans — and to its own credibility — to ensure an accountability process that produces results, decisively moves beyond the failures of the past, and brings the deep institutional changes needed to guarantee non-recurrence.”

Releasing a statement on the Report of the United Nations (UN) Investigation on Sri Lanka on September 20, the ICG said it is important to pursue cases against LTTE leaders such as K. Pathmanathan ("KP") and V. Muralitharan ("Karuna"), and any other senior LTTE leaders who may be overseas to address the Sinhalese community's concerns on an investigation by the UN Human Rights Chief proposed "Hybrid Court". Former Commander of Sri Lanka Army Field Marshal Sarath Fonseka, who led the war against the Liberation Tigers of Tamil Eelam (LTTE), says the Army saved the Tamil civilians and it was LTTE which targeted the civilians and killed them, reports Colombo Page. "It was the LTTE which fired on civilians trying to flee to the army-controlled lines and killed them. The Lankan armed forces on the other hand had a policy of welcoming them and providing them safe shelter," Fonseka told Indian Express on September 21. "We were constantly telling the civilians to come out, assuring them that they will be well treated and looked after. With the result, people kept coming out," he said. According to Fonseka, civilians had begun heeding the army's call from 2008 onwards. "In the beginning, they came in trickles. Over time, 50,000 had crossed over. However, the mass exodus started in April 2009. On April 19, 150,000 had crossed over braving LTTE bullets. On May 14, 2009, 85,000 had quit the LTTE controlled zone. And on May 19, the war ended," Fonseka said.

The draft resolution, which is likely to pass unanimously next week, refers to the importance of having foreign experts involved in a potential investigation, but does not make the condition mandatory. The initiative was tabled at the UN Human Rights Council in Geneva on September 17, a week after the publication of a long-awaited UN report that laid bare the horrific barbarity committed by both the army and the Liberation Tigers of Tamil Eelam (LTTE) rebels in the bitter 37-year war. The report said Sri Lanka's criminal justice system was "not yet ready or equipped" to conduct an independent and credible investigation and called for a hybrid special court to include international judges, prosecutors, lawyers and investigators. But Sri Lanka has resisted a foreign inquiry, which many members of the island's Sinhalese majority consider an infringement of sovereignty. The main minority Tamil party the Tamil National Alliance (TNA) said the resolution, initiated by the United States and co-sponsored by Sri Lanka, was the "product of a difficult consensus". "We are acutely aware that some of the language used in the interests of a consensus will not satisfy all victims of the conflict whom we represent and who have reposed their trust in the TNA.”However, we are of the view that the draft provides a constructive starting point for what will inevitably be a long road to reconciliation," the TNA said in a statement.
