Over two dozen religious leaders and activists were arrested by the Faisalabad police during a crackdown on January 3. Police raided almost all the offices of terrorist and sectarian outfits in the city and took into custody office-bearers and activists of the Tehreek-e-Jaferia Pakistan (TJP), Sipah-e-Sahaba Pakistan (SSP) and Lashkar-e-Toiaba. Continuing with their crackdown on jihadi organizations, Karachi Police arrested several religious extremists, on January 4, reports said. Police raided several places in the city and picked up a number of suspects. Of those arrested were cadres of the Sunni Tehrik and the Sipah-i-Sahaba Pakistan (SSP). The police denied reports that they had raided mosques and madrassas (religious institutions). Elaborating, a police officer said, "We have acted upon secretly received information and raided the homes of suspects to pick them up." A senior police officer, Manzoor Mughal said the arrested persons were not picked up from religious institutions or mosques, and added that some of them were affiliated with jihadi groups and were wanted for sectarian killings. Some of those detained were later set free.

A majority of them belonged to the Lashkar-e-Toiba LeT), Jaish-e-Mohammad (JeM), Tehrik-i-Jaferia Pakistan and Sipah-i-Sahaba Pakistan (SSP). Reports also said an anti-terrorism court (ATC) in Lahore, on January 4, sent 17 activists of militant groups on judicial remand. Of the over-80 arrested, 18 were taken into custody from Lahore and the suburbs. 20 more were held from Faisalabad and the remaining from other places in the province.

Reports from Pakistan, on January 4, said police in Faisalabad, Punjab, had set free all the persons they had detained during the ongoing crackdown on activists of religious parties. Over two dozen activists of the Tehrik-i-Jaferia Pakistan, the Sipah-i-Sahaba Pakistan (SSP) and the Lashkar-e-Toiba (LeT) were arrested during surprise raids on January 3. They were set free after leaders reportedly called on Punjab Governor and senior Provincial Home Department officials and pleaded that the arrests were unjustified and that those detained were neither involved in any criminal cases nor had they violated any government instructions. They also assured the police that their cadres would not cause any law and order problem. Consequently, the Home Department ordered the release of those detained.

According to media reports, the military regime has been told that a ban on the Sipah-e-Sahaba Pakistan (SSP) and the Tehreek-e-Jaferia Pakistan (TJP) would be a violation of the fundamental rights protected in the 1973 Constitution. SSP and TJP, the two sectarian outfits, are reportedly facing threats of a possible ban by the government apparently to address the issue of sectarian terrorism. As reported earlier, two sectarian terrorist outfits – the Laskhar-e-Jhangvi (LeJ) and the Sipah-e-Mohammed Pakistan (SMP) of the SSP and TJP respectively -- have been banned since August 14, 2001 in order to curb sectarianism. Reports said, at a high-level meeting convened to discuss the issue of banning the SSP and the TJP, President Musharraf was apprised of the fact that proscription of any political party unilaterally by the government would be a violation of the fundamental rights enshrined in and protected by the Constitution. The government has been told that a political party, registered as such under Political Parties Act, can only be banned by the Supreme Court of Pakistan, only if the apex court is convinced of the reasons given by the government. Sources in the Law Ministry indicated that the government could not ban any political party on its own. Both the SSP and TJP are registered as political parties and have also been participating in electoral politics. The Law Ministry sources said Article 17 of the Constitution on "Freedom of Association" protects the political parties from any extreme action by the government.

President Pervez Musharraf, in an address to the nation on electronic media, on January 12, announced the proscription of five terrorist outfits, taking the number of banned groups to seven. President Musharraf banned two outfits active in Jammu and Kashmir, the Jaish-e-Mohammed (JeM) and Lashkar-e-Toiba (LeT). Sectarian outfits Sipah-e-Sahaba Pakistan (SSP), Tehreek-e-Jaferia Pakistan (TJP) and Tehreek-e-Nifaz-e-Shariat-e-Mohammadi (TNSM) were also proscribed. He also announced that the Sunni Tehrik has been placed under observation. As reported earlier, two sectarian outfits, Lashkar-e-Jhangvi (LeJ) and Sipah-e-Mohammed Pakistan (SMP), had been proscribed on August 14, 2001. Besides the proscription, he also banned any organisation in Pakistan if it calls itself as Lashkar, Sipah or Jaish. Those to be found involved in inciting people to commit violence, either in the external or internal context, would face punitive action, he added. He also stated that, in the year 2001, 400 persons had been killed in violent activities. He also announced future rules of behaviour for madrassas (seminaries) and mosques. He indicated that any mosque and new religious schools could be established only with the permission of the government. He also restricted the use of loudspeakers and all parties were disallowed the use of mosques or madrassas for political purpose, fanning sectarian hatred or anything that challenged the writ of the government. The President also said Pakistani religious leaders should not involve themselves in conflicts outside Pakistan. The President said Pakistan would not hand over any Pakistani national to India, though India has sent a list of 20 people it wants for terrorist and criminal activities committed in India. According to news reports, President Pervez Musharraf has directed the Inter Services Intelligence (ISI), Pakistan’s external intelligence agency, and other intelligence agencies in the country to assist police in all the four provinces in arresting sectarian terrorists. The President has reportedly directed the intelligence agencies to review and update information on the target groups so that the core groups of sectarian terrorists of both the Sipah-e-Sahaba Pakistan (SSP) and the Tehreek-e-Jaferia Pakistan (TJP) are arrested and not their second and third tier cadres. Reports said, the Interior Ministry would co-ordinate the reports of the various intelligence agencies and monitor their working with the provincial police.

News sources have indicated that, although the police had arrested most of the front line leaders of the banned religious groups, their cadres had managed to go underground. Police also raided the office of the Jamaat-e-Islam (JeI) in Karachi and sealed it on the basis of information that the HM was operating from its premises. Besides, the arrests of activists of the SSP and TJP, Islamabad police also sealed two offices of the Lashkar-e-Toiba (LeT) as well as offices of the Al Rasheed Trust (ART).

In Faisalabad, 19 more activists of the SSP and TJP were arrested and 17 offices of the banned groups were sealed across the district. Approximately 40 activists of the banned groups, including SSP and TJP, have so far been arrested in the Bahawalpur district. Forty activists of the banned outfits have been arrested from different parts of the Vehari district. Police also sealed 12 offices of SSP, TJP and JeM besides confiscating their literature. Police in Sheikhupura arrested 30 activists and sealed the offices of religious outfits in different areas.

An Interior Ministry spokesperson was quoted as saying that the government considered the banned outfits including the Sipah-e-Sahaba Pakistan (SSP) SSP and the Tehreek-e-Jaferia Pakistan (TJP) as terrorist organisations and, therefore, were banned under the Anti-Terrorism Act. He also disclosed that both the SSP and TJP, contrary to certain media reports, were also not registered as political parties.
